Dear Mr. Shiver;
I greatly appreciate the inspection conducted by Mr. Beck and Mr. Hare earlier this
month. I feel that their guidance and suggestions to improve our facility were very
informative and will also aid in our preparation and training. Below is an outline of the
actions that will take place to correct the inadequacies listed in the Notice Of Violation
letter.
Our SWPPP will be more comprehensive and will include a more detailed definition of
activities conducted on -site. These activities will include boat maintenance, boat
washing and the regular disposal of waste oil and fuel which are stored on -site. This area
will be more appropriately maintained and will continue to be checked daily. We have
already contacted a contractor to give a proposal for a secondary containment installation
around the gas and diesel tank. As I discussed with Mr. Beck and Mr. Hare, our tenants
are the individuals who are responsible for the fuel tanks. Their lease will end in July of
2005 and will not be renewed at this time. An assessment will then be made of what
activities will continue at our facility. Our Best Management Practices will be altered to
meet the needs of our facility at this time and at the end of our tenant's lease.
Our Spill Prevention and Response Plan will incorporate what we have learned from our
working relationship with the Coast Guard and the MSO of Wilmington. This plan will
be included with our SWPPP. We will cover what steps must be taken to avoid accidents
and ensure safety. In the event an accident takes place we will be knowledgeable of the
appropriate steps to take to minimize impact.

Materials that were stored outside have now been moved safely inside the marina shop.
These include the old engine parts and batteries.
Finally, sampling and monitoring will be initiated as soon as possible per my discussion
with Mr. Beck and Mr. Hare. I have already contacted a lab for assistance with this

The North Carolina Division of Water Quality conducted a recent inspection of Inlet Watch Yacht Club
on December 8, 2004. This inspection was conducted to determine if the facility is operating in compliance
with the conditions and requirements specified in NPDES General Permit Number NCG 190000.
Please find attached a copy of the Industrial Stormwater Inspection Report, which indicates the findings
of the inspection and a summary of compliance issues. The facility was determined to be noncompliant with
conditions of the permit. The Stormwater Pollution Prevention.Plan has been developed but does not contain
some of the necessary elements. Also, monitoring has not been done at the facility as required by the permit.
Please submit a letter within ten (10) days of receipt of this notice which specifies what actions are to be taken
to achieve compliance and provides a schedule for accomplishing these actions.

ADEQUACY OF SWPPP:
A SWPPP has been developed and contains some of the necessary elements including
identification of the outfalls, and identification of the general activity areas. More specific
identification of activities such as boat washing, boat maintenance activities, and fuel and waste
oil storage and handling needs to be included. A stormwater management plan needs to be
included that presents a review of the feasibility of eliminating or reducing exposure, provides a
schedule for installing secondary containment, and includes a description of Best Management
Practices (BMPs) to be utilized. The other elements presented in the permit must also be
addressed including a Spill Prevention and Response PIan and a Preventative Maintenance and
Good Housekeeping Program.
VEHICLE/EQUIPMENT MAINTENANCE AREA:
It appears that most maintenance is done within the shop building. Some maintenance and repair
activities are done by boat owners in an area that is graveled and bordered by a curb.
VEHICLEIEQUIPMENT WASH AREA:
Pressure washing of boats is generally done on pavement behind the shop building. There is no
means for collecting the wash water. Some washing is done in a graveled area that is bordered
by a curb.
TEMPORARY STORAGE OF WASTE MATERIALS:
Waste oil is held in drums within an enclosure on a concrete pad with a low berm around it. This
meets the need for eliminating exposure and provides some secondary containment. Some
spilled oil has been captured by absorbent material within the containment area. This should be
removed on a regular basis.
OUTDOOR STORAGE OF NATERIALS:
Batteries are stored outside behind the shop building. Some materials including oily engine parts
were seen outside behind the shop building. This all needs to be placed under cover to eliminate
exposure. The gasoline and diesel fuel tanks are Iocated adjacent to the bulkheaded shoreline
and have no secondary containment structures as required by federal regulations and the permit
conditions.
SPILL RESPONSE AND CLEANUP PROGRAM:
The marina keeps containment boom on site and has a good working relationship with the USCG
MSO Wilmington.
ERROSION CONTROL ON SITE:
The site is mostly paved so there is little opportunity for erosion.
ILLICIT DISCHARGE ELIMINATION:
While the SWPPP does not address illicit discharge detection and elimination, it does not appear
that it is an issue at the site.
WASTEWATER TREATMENT FACILITIES:
There are no wastewater treatment facilities. The graveled, curbed area for boat maintenance by
owners might be considered a BMP.
STREAM IMPACTS/RESULTS OF SAMPLING:
No sampling, either analytical or qualitative, has been done. No impacts were observed.
SUMMARY:
A Stormwater Pollution Prevention Plan has recently been developed. It contains some of the
elements for a site plan but does not contain other elements including a stormwater management
plan that provides a feasibility study for eliminating exposure, a secondary containment schedule
and a BMP summary. Other elements contained in the permit including a spill prevention and
response plan, a preventative maintenance and good housekeeping program, and employee
training need to be addressed.
Monitoring has never been done at the facility. This must be initiated, as required in the permit,
as soon as possible.

pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between the state of North Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.

* A Stormwater Pollution Prevention Plan (SPPP) Certification Form. Completion of this form is required to
certify that you have developed and implemented the SPPP as per the conditions of the permit. This form
must be completed and returned to the Division within 30 days of receipt of this letter.

* Five copies of the Analytical Monitoring form and five copies of the Qualitative Monitoring form
* A copy of a Technical Bulletin on the Stormwater program which outlines program components and
addresses frequently asked questions

Your coverage under this general permit is not transferable except after notice to DWQ. The Division may require
modification or revocation and reissuance of the Certificate of Coverage. This permit does not affect the legal
requirements to obtain other permits which may be required by DENR or relieve the permittee from responsibility
for compliance with any other applicable federal, state, or local law rule, standard, ordinance, order, judgment, or
decree.
