On May 29, 2019, Brian Lambe from the Wilmington Regional Office of the Division of Energy,
Mineral, and Land Resources (DEMLR), conducted a compliance evaluation inspection for Creekside
Yacht Club located in Oleander Drive, New Hanover County, North Carolina. The site drains to
Bradley Creek, which is currently classified as Class SC Waters in the White Oak rover Basin.
The following observations were noted during the DEMLR inspection (please see the attached
addendum for additional information about your permit):

The sampling results on 5/5/2019 for Capper were 0.012mg/L. The sample on 12/1/2018 reported
a 0.32 mg/L for Copper. Prior results have also exceeded the benchmark of 0.005mg/L for Copper
resulting a Tier It and Tier III response from the permittee.
This inspection was conducted to review the data and site for evaluation for relief of Tier II and III
requirements for.Copper at Outfall 1. The site is very well maintained and great attention is given to
reducing impacts of the facility on Bradley Creek. The sample point is taken adjacent to the boat lift.
According to a letter from lames Frei of SwSG February 28, 2005, the catch basin below the sampling
point leads to an undocumented infiitration field. The sample point was compromised as an
alternative due to the infiltration field not directly discharging to Bradley Creek. The infiltration
should be treating the stormwater. Please be aware of other impacts of the infiltration field. This
office recommends utilizing NC Department of Agriculture and Consumer Services soil testing for
heavy metals (contact New Hanover Cooperative Extension).

Therefore, you may resume sampling under normal sampling protocols per permit requirements. You
are relieved of Tier II and III requirements. Please contact this office if you have an unusual spike in
sampling results for the duration of the permit period. This office reserves the right to reinstitute the
tiered response requirements as needed.

Thank you for visiting with us on Wednesday, May 29, 2019 to discuss stormwater best practices,
We sincerely appreciate your input and guidance as we strive for continuous improvement. As you
know, Creekside's current stormwater sampling conducted on May 5, 2019 exceeded the copper
benchmark value. Our report indicated a value of .012 mg/L versus the benchmark of .005 mg/L.
We have attempted to identify the source of the copper but unfortunately have not been able to
pinpoint the exact cause_ Our employees continue with BMPs using tarps to collect containments
when we power wash boats. The lessee of the service department, Sea Coast Marine, will use tarps
when power washing or bottom painting boats to reduce the possibility of copper contamination.
We will also consider using a mesh filtering system around our catch basins/drains to enhance the
collection process depending upon the overall cost of this approach.
We ask for a waiver of the Tier Two monthly sampling requirements based on our proactive
approach to reduce copper and the potential cost to Creekside. We would greatly appreciate your
help and assistance with this matter.

A compliance evaluation inspection of the Creekside Yacht Club marina was conducted on February 11,
2009. This inspection was to verify that the facility is operating in compliance with the requirements
specified in the NPDES General Permit (certificate of coverage NCG190009). The findings and
comments noted during this inspection are provided in the enclosed copy of the inspection report
entitled "Compliance Inspection Report".
A review of the Stormvvater Pollution Prevention Plans for this site was reviewed. The Stonnwater
Pollution Prevention Plan appears to be complete and the stormwater monitoring from the site appears to
be compliant with the requirements of the NDPES permit. Should you have any questions concerning

Inspection Summary:
The Regional Inspector recommends the following:
1. Replace the drain valve from the secondary containment structure around the petroleum storage area with a drain
valve that can be locked. This drain should only be accessible by a responsible party who is designated in the stormwater
pollution prevention plan. The contents should be released only after the contents are inspected and the quality of the
contents documented. This item has been identified several times by the consultant who provides facility inspections.
The next inspection by the Regional DWQ personnel should ensure this item has been remedied.
2. Place absorbent material in the outfall basin SDO-001 since several visual inspections have identified a sheen in the
basin and on the standing water in the basin. This should be implemented in the SWP3 as an amendment and
improvement to the SMPs already practiced.
3. Please note that the permit is up for renewal (August 2009). The Raleigh Central Office (DWQ) should be sending a
renewal application to the permittee. Please be advised that stormwater samples need to be taken the last year of the
permit (this year) and submitted with the renewal application.
4. The permittee should place a copy of the Certificate of Coverage in the SWP3 plan (where provided).
The site was clean and appears to practice good housekeeping. The paperwork and SWP3 plan were complete and fairly
well organized.

Comment: The facility has one area where discharges may occur during a large rain
event. The discharge point has been identified as having an oil sheen in the standing
water in the basin. The Regional Inpsector recommended that the permittee place
absorbent materials that have an affinity for petroleum products in the basin to ensure
the sheen is absorbed by the material. The absorbent material can be disposed of
when it becomes saturated with petroleum products and no longer absorbs the oil
sheen. This BMP should be added to the permitttee's SWP3 as an improvement to the
BMPs.

In regards to your NOV letter dated December 16, 2004, this letter is to let you know that we
have delivered the final SWPPP to the Permittee.
Regarding the outfall monitoring task: This facility is unique in that it does not have a point
source discharge of stormwater under typical conditions. A portion of the site discharges to a
dry retention basin that was probably designed under the original coastal stormwater
management rules (captures runoff from the one inch rainfall event). This retention basin has no
outlet device other than overflow over the embankment.
The remainder of the site drains to several catch basins that are connected to an underground
infiltration system — of which no design or construction drawings can be found. The lowest
catch basin (see Figure 1) may overflow during large storms (maybe greater than the 25-yr
event). However, facility staff have never seen this catch basin overflow.
Facility staff state that on rare occasions, such as after a large storm during low tide, water
exfiltrates through the bulkhead boards near the Ship's Store (see Figure 2).
Of the more than 400 industrial facilities 1 have visited for Permit compliance, this is the first one
where I could not locate an outfall. Even the boat haul -out dock slopes away from the water's
edge and toward the Figure 1 catch basin.
I would like to propose that NCDWQ waive the monitoring requirements if I cannot observe and
collect a stormwater sample from a point source discharge along Creekside's bulkhead this year.
I will respond to one storm event that is forecast to exceed the 10-year storm this year. I will
measure and record the rainfall data and report to you my findings. If the rainfall event exceeds

the 10-year event and no discharge occurs, then this site will be designated as a non -discharging
facility.
This site is not conducive to installing an automatic sampler — since we don't really know where
discharge may occur first, and it is unreasonable to expect Creekside to pay me for more than
one monitoring attempt. We will not respond to an event predicted to exceed a Category 1
hurricane.
As an alternative, we could sample the runoff that enters Catch Basin #1, but this sample location
would be before the infiltration treatment provided by this Permittee and may not represent the
true characteristics of this facility's stormwater discharge.
Let us know what you think of granting a sampling waiver. In the meantime, please do not
hesitate to call me if you have any questions.

The North Carolina Division of Water Quality conducted a recent inspection of Creekside Yacht Club
on December 13, 2004. This inspection was conducted to determine if the facility is operating in compliance
with the conditions and requirements specified in NPDES General Permit Number NCG 190000.
Please find attached a copy of the Industrial Stormwater Inspection Report, which indicates the findings
of the inspection and a summary of compliance issues. The facility was found to be noncompliant with the
conditions and requirements of the general permit. A Stormwater Pollution Prevention Plan has not been
developed for the facility and monitoring is not being done. Within ten (10) days of receipt of this notice please
submit a letter that describes the actions to be taken to achieve compliance and presents a schedule for
achieving these actions.

ADEQUACY OF SWPPP:
A Stormwater Pollution Prevention Plan has not been developed for the facility.
VEHICLE/EQUIPMENT MAINTENANCE AREA:
Repair and maintenance activities are done within an enclosed shop building. Boats are placed
outside the shop on pavement to allow connection to a water source while running the engine.
All stormwater and cooling water is collected in stormwater inlets and directed to a stormwater
treatment pond. No hull preparation or painting are done on the site.
VEHICLEIEQUIPMENT WASH AREA:
No washing is done in the vicinity of the maintenance shop. Some washing is done in the area
where boats are removed by forklift. It is understood that runoff from this area is directed to a
stormwater infiltration system.
TEMPORARY STORAGE OF WASTE MATERIALS:
Waste oil and fuel is stored in an above ground tank next to the maintenance shop. While the
tank is installed on a concrete surface and enclosed by a concrete wall, there is a drain outlet in
the containment wall with no valve to control drainage.
OUTDOOR STORAGE OF MATERIALS:
No material was observed stored outside except for boats. Fuel is dispensed on the dock and
stored in underground storage tanks.
SPILL RESPONSE AND CLEANUP PROGRAM:
It is unclear if containment and absorbent materials are kept on site to respond to a spill, or if the
facility has a relationship with a contractor.
EROSION CONTROL ON SITE:
The site is largely paved and no erosion is evident.
ILLICIT DISCHARGE ELIMINATION:
While there is no formal program for illicit discharge detection, it does not appear to be a
problem on the site.
WASTEWATER TREATMENT FACILITIES:
The site stormwater collection and treatment system appears to be well maintained.
STREAM IMPACTS/RESULTS OF SAMPLING:
No adverse stream impacts were observed. No sampling program has been instituted.
SUMMARY:
A Stormwater Pollution Prevention Plan has not been developed for the site and a monitoring
program has not been instituted. A copy of the permit is not maintained at the site. The facility,
however, has instituted numerous practices that reduce potential impacts to surface waters from
stormwater discharges. Stormwater runoff from the site is collected and directed to an
infiltration system that appears to greatly reduce or eliminate the direct discharge to surface
waters. Stormwater from the shop area is treated in a pond with the overflow being directed to
the infiltration system. The large forklift utilizes LP gas and care is used to watch for, and clean
up, oil spills. No sanding or painting of boats is done on the site and only a limited amount of
boat washing is done. The site is quite clean.
A Stormwater Pollution Prevention Plan must be developed in compliance with the permit
requirements. A monitoring program must also be instituted. A locking valve must be installed
in the secondary containment structure around the waste oil tank to control the outlet from the
structure. A permit file needs to be set up to include all related documents and monitoring
reports.

The North Carolina Division of Water Quality conducted a recent inspection of Johnson Marine
Services, Inc. on December 13, 2004. This inspection was conducted to determine if the facility is operating in
compliance with the conditions and requirements specified. in NPDES General Permit Number NCG190000.
Please find attached a copy of the Industrial Stormwater Inspection Report, which indicates the findings
of the inspection and a summary of compliance issues. The facility has been found to be noncompliant with the
conditions of the general permit. The permit coverage has been allowed to expire and a Notice of Intent has not
been submitted for renewal of coverage. A Stormwater Pollution Prevention Plan has not been developed and
monitoring has not been done as required by the permit. Within ten days of receipt of this notice, please submit
a letter that describes the actions to be taken to achieve compliance and presents a schedule for achieving these
actions.

ADEQUACY OF SWPPP:
A Stormwater Pollution Prevention Plan has not been developed.
VEHICLE/EQUIPNIENT MAINTENANCE AREA:
An enclosed shop area is available for performance of maintenance and repair. Boats are
removed from the water by forklift and staged on the pavement outside the shop. It appears that
some repair activities are performed on the paved area outside the shop.
VEHICLE/EQUIPMENT WASH AREA:
Pressure washing is done on the paved area outside the shop.
TEMPORARY STORAGE OF WASTE MATERIALS:
Waste oil is held in a drum within the shop for pickup by a licensed hauler. Some other
materials are stored outside under a shed to reduce exposure to rainfall.
OUTDOOR STORAGE OF MATERIALS:
Many engines and engine parts are staged outside on a paved surface that drains directly to the
adjacent waters of the marina. These need to be placed under cover to eliminate exposure to
rainfall. Boats are staged on trailers in the parking area associated with the facility.
SPILL RESPONSE AND CLEANUP PROGRAM:
No containment boom is kept on site and the facility does not have contact information readily
available for notifying appropriate agencies or employing a contractor in the event of a
petroleum product spill.
ERROSION CONTROL ON SITE:
The area around the shop and sales buildings is mostly paved and stable. There is a large gully
within the graveled parkin; area where boats are staged. It appears that some erosion may be
taking, place in this area.
ILLICIT DISCHARGE ELIMINATION:
There is no program for identifying and eliminating illicit discharges but it appears that it may

not be a problem at the facility.
WASTEWATER TREATMENT FACILITIES:
There are no treatment facilities at the site.

STREAM IMPACTS/RESULTS OF S AVIPLING:
No monitoring has been done as required by the permit. No stream impacts were observed.
SUMINIARY:
The permit coverage has been allowed to expire, a SWPPP has not been developed, and no
monitoring has been done. Pressure washing of boat hulls is being done on pavement, allowing
the constituents from antifouling paint to enter surface waters. Actions must be taken
immediately to achieve compliance.

Dear Permittee:
Your facility is currently covered for stormwater discharge under General Permit NCG190000. This permit expires on
August 31, 2004. The Division staff is currently in the process of renewing this permit and is scheduled to have the
permit reissued by summer of 2004. Once the permit is reissued, your facility would be eligible for continued
coverage under the reissued permit.
In order to assure your continued coverage under the general permit, you must apply to the Division of Water Quality
(DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in advance
that your permit coverage will be expiring. Enclosed you will find a Permit Coverage Renewal Application Form. The
application must be completed and returned by March 4, 2004 in order to assure continued coverage under the
general permit. Due to staff and budget constraints, letters confirming our receipt of the completed application will
not be sent.
Failure to request renewal within the time period specified may result in a civil assessment of at least $250.00. Larger
penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your facility
without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and could
result in assessments of civil penalties of up to $10,000 per day.
Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the 11 categories of "storm water discharges associated with industrial activity," (except
construction activities). If you feel your facility can certify a condition of "no exposure", i.e. the facility industrial
materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion. For additional
information contact the Central Office Stormwater Staff member listed below or check the Stormwater & General
Permits Unit Web Site at http://h2o.enr.state.nc.us/su/stormwater.html
If the subject stormwater discharge to waters of the state has been terminated, please complete the enclosed
Rescission Request Form. Mailing instructions can be found on the bottom of the form. You will be notified when the
rescission process has been completed.
