On April 30, 2018, the Wilmington Regional Office of the Division of Energy, Mineral, and Land
Resources (DEMLR), received the 2017 Annual summary Data Monitoring Report (DMR) for Bock Marine
Builders, Inc. located in Carteret County, North Carolina. The site drains to Core Creek (ICW, Adams
Creek Canal), which is currently classified as Class SA, HQW Waters in the White Oak River Basin.
The following observations were noted on the DMR:
1) The DMR states that Outfall 1 was on Tier 2 during the past year.
2) The DMR states that monthly monitoring was discontinued because "no BMP can reduce Copper
to below BMV @ reasonable cost."'
Please be advised that the submitted sampling results equate to a Tier Two and Three response by you.
Tier Three requires that you notify this office in writing within 30 days of receipt of the fourth analytical
results. This office will determine if you qualify for relief of the monthly montitoring requirements of
Tier Two.
The exceedance of the benchmarks are not permit violations, however, failure to respond to the
exceedances as outline in the NCG190000 permit is a violation of permit conditions.
Please be advised that violations of the NPDES Stormwater General Permit may be subject to a civil
penalty assessment of up to $25,000.00 per day for each violation.
A written plan of action is required to remedy site conditions. If you have any questions, comments, or

On January 19, 2018, Brian Lambe from the Wilmington Regional Office of the Division of Energy,
Mineral, and Land Resources (DEMLR), conducted a compliance evaluation inspection for Bock Marine
located in Core Creek Road, Carteret County, North Carolina. The site drains to Core Creek (Intracoastal
Waterway Adams Creek), which is currently classified as Class SA, HQW Waters in the White Oak River
Basin.
The following observations were noted during the DEMLR inspection (please see the attached
addendum for additional information about your permit):
1) Stormwater Pollution Prevention Plan (SPPP)

You recently inquired about releasing your facility from Tier Two monitoring requirements under the
NCG190000 permit. Personnel from this office conducted an inspection regarding this request on
February 4, 2014. During this inspection several deficiencies were noted. The goal of monthly testing is
to implement BMPs and compare the sampling data to see what is effective and what is not effective.
• Certify wastewater system with DWQ , Please contact Jim Gregson (910)796-7215 regarding
wastewater permitting and water quality standards.
• Additional rernediation of contaminated soils may be warranted. Suggest soil testing. Soil
testing should provide evidence whether there are concentrations of Copper that are
contributing to the high samples. Multiple soil samples may show any hot spots that need to be
remediated.
• BMP implementation schedule should be filled out and documented. There were several
suggestions by the preparer of the SPPP that should be implemented such as drip pans for
boats waiting for service.
• Complete all certifications in SPPP. SPPP is a working document and should be used as a
workbook, not just for reference.
• Test for contribution for adjoining land owners.
• Prepare document for "self repair" customers informing of procedures to minimize
contamination. Document procedures taken by customers.

Please continue with the monthly sampling and implementation of best management practices. In
following the SPPP you should be able to document efforts made in regards to the BMPs. Sampling at
points that may contribute to the sampling that are beyond your control (adjacent property and or road
runoff) mayjustify high samples. Without documentation of actions taken, this office cannot relieve
monthly monitoring requirements.

familiarize myself with it again.
The review of the SPPP revealed some notions of problems:
• Certify wastewater system with DWQ {»not sure I know what you mean by this one?)
• Additional remediation of contaminated soils may be warranted. Suggest soil testing.
• BMP implementation schedule should be filled out and documented. I don't have any documentation of efforts
he has taken.
• Complete all certifications in SPPP, SPPP is a working document and should be used as a workbook, not just for
reference.
• Drip pans for boats waiting for service.
• Test for contribution for adjoining land owner.
• Prepare document for "self repair" customers informing of procedures to minimize contamination.
• Consult with Clean Marina Program and or professional.
>> If I understand you correctly here, the facility is falling short on several obligations under the permit. improvements
and corrective actions should be recommended through the Region's response and reference to requirements under
NCG190000. Some of these bullets sound like recommendations — for example, preparing guidance for self -repair
customers — rather than something spelled out in the SPPP. That's fine.
>> The recommendation for contaminated soil remediation highlights the high metals issue. From the table, the copper
values dropped significantly in June and July of last year, but otherwise they've been way over the current benchmark in
the permit of 7 ug/I total copper. It's not just a little over; values are pretty high here, and they aren't necessarily
improving.

Cu Benchmark in the permit*

*INFO ABOUT THIS BENCHMARK: This is the Cu benchmark in the permit today, put in before our revision of the Cu
benchmark to 0.010 mg/I that will go in permits starting this year. HOWEVER, marinas typically discharge to saltwater,
and we don't have a different saltwater benchmark for Total Copper. Some calculations suggest that the saltwater total
coppervalue would be lower than 10 ug/I, so right now, sticking with the 7 ug/I may not be terribly inappropriate for
this general permit.
So my question is basically what to do? Go individual permit? Require additional stormwater measures (does this mean
stormwater pond?)
Please advise.
>> I don't think moving them to an individual permit will change much. We have the tools and direction we need under
the General Permit, and an individual Permit will look very similar. It's not worth the effort at this stage (permit
development, public notice, etc.) — especially since there are probably numerous other marinas out there in a similar
situation. The advantage would only be if there were something very specific we needed to outline in the permit
language that this marina must do.
>> To go back to your original question for a minute: do we relieve the permittee from Tier 2 -> now Tier 3 monthly
monitoring? I don't think that's justified yet — they obviously have a lot to do to come into compliance with their SPPP
obligations under the permit. Also, if the permittee follows through with some of those response actions you listed, he
should be monitoring how it's affecting the concentrations in his discharge. It's tough to do that if he drops back to
monitoring once every six months. So I don't advise letting them out of monthly monitoring yet.
>> I would advise actions like the soil testing, testing for adjoining property contribution (if there's run-on?), explaining
how they treat the washing wastewater (is there a question about this, or do they have a wastewater treatment
system? I'm not clear about that from your bullets.).
>> Give him a timeline to do these things and come back to you with a good argument about (1) whether nothing's
improving and/or (2) there's contributions he can't control, and (3) to demonstrate he is diligently working on the
problem jas well as being attentive to his obligations under the permit and SPPP requirements]. After that period,
review his actions and the data, and determine whether monthly monitoring continues to help the permittee solve his
problem or tell him/us what's going on at the site, and where the problem is concentrated.
>> For example, did soil testing reveal some real hot spots for Cu, and that that's where it's coming from? Are his
customers not following proper procedures? Did he do something about it? If monthly monitoring does not serve a
purpose [whether it's to track a trend in Cu concentrations, or to identify what the problem might be], and there are
other actions he really can still be focusing his energies on to rectify it, the Region can relieve monthly monitoring with a
letter. Please be sure to document the rationale for any reduction in monitoring in that letter, or in some other form
for our permit file.
>> If there's no improvement in levels, and the permittee is cooperating with response actions, the region should also
consider potential water quality problems in the receiving waters (are WQ standards being violated?). An investment in
more expensive actions, such as structural BMPs and/or more sophisticated treatment of stormwater runoff from this
facility, could be warranted sooner rather than later if contributions from this marina are causing WQ
problems. However, at this particular stage, the permittee should be investigating other options. The biggest priority
right not is to make sure the permittee is capturing and treating all wastewater, and not discharging that water
untreated or without a proper (wastewater) permit.

I would like to address the points you made in your Inspection Report dated Oct. 22, 2013 and
ask for consideration in returning us to the semi-annual sampling of stormwater outflow instead of
the monthly sampling.
We are using tarps and side curtains under and around boats where heavy bottom work is being
performed. Ground cloths are used under boats where routine bottom work is being done including
not only the boats we are working on but also those being worked on by others. Boat owners are
instructed to utilize vacuum sanders or other means to alleviate paint residue from contaminating the
ground while our own employees are using vacuum sanders.
We are also promoting the use of ablative bottom paints as opposed to conventional bottom paints
with high copper content, which not only reduces the amount of copper in the paint, but reduces the
amount of sanding necessary for repainting, thus less ground contamination. And, we are trying
some new paints with a zero copper content on aluminum boats as well as my own personal boat.
Additionally, I have moved the fuel tank and used oil tanks away from the river bank. The rest of
the contaminated soil is scheduled to be removed as soon as possible. And I believe the powerwash
containment system is 90% efficient in alleviating discharge into the water.
I'm not sure what else we can reasonably do. Therefore, your consideration of our efforts would
be appreciated.

On October 21, 2013, staff from the Wilmington Regional Office conducted an inspection of the Bock
Marine facility on Core Creek Road, Carteret County, North Carolina.
Enclosed is the Compliance Inspection Report. Deficiencies in the implementation of the Stormwater
Pollution Prevention Plan are in regard to the individual boat owners doing their own work on site must follow the
best management practices for your site. This will aid in reducing your analytical monitoring results. Further
measures should be taken to ensure that all contaminants are confined to the site. Please continue to work
towards reducing the copper sample results. Additionally, all outfalls should be identified.

Inspection Summary:
Tarps and side coverings are used when sanding and painting boat bottoms, but individual boat woners are allowed to
conduct thier own maintenance and are not required to use tarps or any other protections when sanding and painting.
Some contaminated soils have been removed, while others need to be removed as soon as possible. Reccomend owner
requiring boat owners doing thier own work follow procedure set forth in stormwater pollution prevention plan.
Ensure the power wash containment system captures all wastewater and does not allow contaminated water into surface
waters.
Identify all outfalls.
Bock requests for monthly sampling to be reduced from tier 2 monthly to semiannual sampling. Please provide additional
measures to reduce the copper sample results. Submit written plan to this office.

The Division of Water Quality (DWQ) has reviewed your request for an exemption from monitoring requirements in your
NPDES Industrial Stormwater monitoring, and conducted a site visit on April 10, 2013. DWQ is unable to concur with
your request for exemption from monitoring at this time.
Based on observations made at your facility, Wilmington Regional Office staff found that additional BMPs can be
implemented to reduce pollutants from industrial activities taking place at your facility. Evidence of ground tarps and
plastic curtains around boats being maintained by your staff were observed but the same protection is not being
implemented for boat work being conducted by individual boat owners on the site. Staff also found evidence of
wastewater discharges from the boat washwater system where a hose allowed the concentrated wastewater to
discharge onto the ground and into surface waters. DWQ believes that more actions can be feasibly implemented to
reduce exposure to the pollutants from industrial activities at you site. Additional information can be found in the BMP
Manual for North Carolina Marinas or on the Clean Marina website: http://portal.ncdenr.org/web/cm/clean-marinas.
DWQ cannot grant your requested exemption from monitoring based on the aforementioned observations. Additionally,
you are hereby notified that the discontinuation of the required Tier Two monthly monitoring constitutes a violation of
the permit condition SECTION B: ANALYTICAL MONITORING REQUIREMENTS and SECTION A. 2: Duty to
Comply and is subject to a civil penalty not to exceed $25,000 per day for each violation. Please continue to
operate under the full conditions of General Permit NCG190000.

Inspection Summary:
-Bock Marine employees use tarps and side coverings when sanding and painting boat bottoms, although individual boat
owners are allowed to conduct their own maintenance and are not required to use tarps or any other protections when
sanding and painting. It appears that contaminated soils have been removed in some areas and new gravel has been
placed under most areas where boat work is being conducted. Evidence of fresh paint spills were observed on the new
gravel where boat owners were painting boats without using tarps.
-There is a filter system set up to power wash boats when hauled while on the travel lift that is designed to be a closed
loop system but the system has a holding basin that hangs over the water that does not appear to be able to capture all
the powerwash discharge and the a hose from the filter system allows the concentrated filter water to discharge onto the
ground and along the bulkhead and eventually into the waterway.
-A roll of filter fabric has been purchased to be used under boats when work is to be conducted but has not yet been
installed.
The recycle oil, antifreeze and zinc are stored in covered containers.
-The recycle oil/diesel fuel tank area has oil on the ground and it is located adjacent to a second discharge point that is
not being monitored.
-Owner has stopped conducting the required monthly monitoring. Last one was 1/25/2013.
-The one outfall that is being monitored takes in flow from the high rise bridge that extended over a large section of the
outfall ditch and also has a ditch that flows from the old Monroe Johnson Construction company and Mr. Bock believes
that there are also boat repairs being conducted on that neighboring property. The outfall monitoring is conducted
downstream from the ditch and highway runoff.

We are in receipt of your letter dated April 23, 2013.
We will commence with the monthly monitoring in May 2013 for Copper, the only parameter that has exceeded its
Benchmark value in two or more consecutive samples. One monthly sample between now and September 30 will
include all the parameters listed in the Permit as this will satisfy the Year 4 Period 2 sample. A copy of the DMRs will be
sent to your office as well as to Central Files.
We will also address the other issues raised in your inspection and letter.
The inspector, Jean Conway, mentioned a second outfall near the POl- tanks that is not being monitored. We do not see
a point source conveyance at this location; there may be natural undulations in the topography that tend to direct
surface flow, but in our opinion there is no outfall subject to monitoring, only sheet flow near these tanks.

We are submitting this request to reduce the frequency of analytical monitoring at the s0ct
facility.-----.-_
During the fourth quarter 2012, this facility conducted three monthly monitoring -events per Tier
Two requirements. This facility has not been able to consistently reduce Copper below the
Benchmark Values (see Table 1). While the metal concentrations have trended lower over the
past three years, there are no additional feasible BMPs that can be implemented to reduce these
metals below their respective Benchmark Values.
We believe this Permittee's funds would be better spent maintaining the BMPs implemented to
date instead of on expensive analytical monitoring costs. Monthly monitoring will not improve
water quality.
BMPs currently installed include placing ground tarps under boats undergoing minor hull repair
work. Boats that require extensive hull scraping, prep work, and painting are enclosed with
plastic curtains and placed over a ground tarp.
Boat washwater is captured, filtered, and reused in a closed -loop system; there is no discharge of
boat washwater into this facility's SDO or the adjacent waters of the State.
Deteriorated anodes are accumulated into a covered drum for off -site recyclin .

Another recently implemented BMP is the removal of several inches of soil from the area where
more than three decades of hull cleaning and repair work has occurred.
Other methods of sweeping and surface cleaning is not feasible as the entire site has either a
gravel or sand/ grass cover.
The Permittee is requesting a cessation of the monthly Tier Two monitoring effective
immediately. The Permittee will continue with the semi-annual analytical and qualitative
monitoring through the end of the current Permit term.
If you need to discuss this petition, you may contact me or Kenny Bock at the Bock Marine
facility (phone 252-72-6855). If we do not receive a response from NCDENR/ DWQ within 45
days from the date of this letter, we will assume our request has been approved.

Drive -by Recon of facility while in the area.
Observed approx. 20-30 boats throughout the site in various degrees of having bottom hull work. No tarps beneath any of
them - most active ones (i.e. someone present) appeared to be individual owners rather than Bock employees. Visible
greenish -blue and reddish -brown fines on ground underneath most of them. Observed greenish -blue staining on boat
ramp where boats are probably powerwashed as removed from water.
No further action taken by inspector.

In response to your renewal application for continued coverage under stormwater General Permit NCG190000 the Division of
Water Quality (DWQ) is forwarding herewith the reissued stormwater General Permit. This permit is reissued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North
Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as subsequently amended.)
The following information is included with your permit package:
• A new Certificate of Coverage
• A copy of Stormwater General Permit NCG190000
• A copy of a Technical Bulletin for the General Permit
• Five copies of the Discharge Monitoring Report (DMR) Form
• Five copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater only, and it specifies your obligations with respect to Stormwater
discharge controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself with all the
changes in the reissued permit.
The more significant changes in the General Permit since your last Certificate of Coverage include the following:
• Permit cover page — Coverage is expanded to include industrial activities similar to the categorically identified industries.
• Part I Section A — This part explains that the No Exposure Exclusion from permitting option may be available to the permittee.
• Part II Section A — Several minor expansions and clarifications of the required content of the Stormwater Pollution Prevention
Plan have been added. Also, there is an added requirement for a Solvent Management Plan. Please be sure that your plan is
updated to comply with the new requirements.
• Part II Section B - Revised provisions require that stormwater discharges be sampled twice per year, and that the sampling
results be compared to new numerical benchmark values. (The previous cutoff concentrations have been eliminated.)
• Part II Section B — Monitoring for some metals has been added to the analytical monitoring requirements.
• Part 11 Section B — Beginning with monitoring in Year 3-Period 1, revised provisions require the permittee to execute Tier One
and Tier Two response actions, based on the first benchmark exceedence (Tier One) and the second consecutive benchmark
exceedence (Tier Two). Tier Two requires that the permittee institute monthly monitoring instead of twice -per -year monitoring,
until three consecutive monitoring events show no benchmark exceedences.
• Part II Section B — Beginning with monitoring in Year 3-Period 1, this part contains a new provision that four exceedences of
any particular benchmark will trigger increased DWQ involvement in the permittee's stormwater management and control
actions. DWQ may direct the permittee to apply for an individual permit, or may direct the implementation or installation of
specific stormwater control measures.
• Part 11 Section C — Qualitative monitoring must now be conducted during a representative storm event.

monitoring observations.
• Part III Section E — Items 1. and 2. require submittal of a new reporting form, the Annual Summary DMR. This annual
summary of only the analytical monitoring results should be submitted to the local DWQ Regional Office, The Annual
Summary DMR reporting form will be posted on the Stormwater Permitting Unit's website in the near future.
Your coverage under the General Permit is transferable only through the specific action of DWQ.
This permit does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it relieve the
permittee from responsibility for compliance with any other applicable federal, state, or local law, rule, standard, ordinance, order,
judgment, or decree.

In accordance with your application for discharge permit received on March 21, 1995, we are
forwarding herewith the subject certificate of coverage to discharge under the subject state - NPDES general
permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and
the Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated
December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual permit
application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division
of Environmental Management. The Division of Environmental Management may require modification or
revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Environmental Management or permits required by the Division of Land Resources, Coastal
Area Management Act or any other Federal or Local governmental permit that may be required.
