The purpose of this correspondence is to notify you of the recent acquisition of the stock of
Rockwell Collins, Inc., headquartered in Cedar Rapids, Iowa ("Rockwell Collins"), by United
Technologies Corporation, headquartered in Farmington, Connecticut ("UTC"), and the related
merger of Rockwell Collins into UTC's aerospace business (currently operating as UTC
Aerospace Systems) .
Rockwell Collins is now a wholly -owned subsidiary of UTC. Following the transaction, Rockwell
Collins will continue to exist as a corporate entity and all current Rockwell Collins operating
businesses will continue to exist in the name of Rockwell Collins or a Rockwell Collins
subsidiary. Similarly, the legal entities operating at any of the UTC Aerospace Systems
company sites will remain the same. To the extent there are any name changes in the future,
we will provide you with any necessary notifications or other filings.
We note that this stock acquisition and merger involved no sale or transfer of facilities, business
operations, or other assets owned and operated by the Rockwell Collins or UTC entities.
Accordingly, there will be no immediate changes to the ownership or operation of any Rockwell
Collins or UTC Aerospace Systems site.

Ron Boone, of the Winston-Salem Regional Office (WSRO) of the NC Division of Water Quality '(DWQ or the
Division), conducted a compliance evaluation inspection (CEi) of B/E Aerospace's (B/E) Winston-Salem plant on January
15, 2013. Your assistance and cooperation during the inspection was greatly appreciated. An inspection checklist is
attached for your records and the inspection findings are summarized below.
The facility'is located at 1455 Fairchild Road, in Winston-Salem, Forsyth County, North Carolina, at approximate
coordinates 36.1311170N,-80.2248740W. Stormwater related to industrial activity is discharged from stormwater
discharge oytfalis (SDO) 001 through 005 to Brushy Fork, which is currently classified as a Class C water located in the
Yadkin Pee -Dee River Basin.
Documentation & Monitoring Review
BIE's Stormwater Pollution Prevention Plan (SP3), documentation, and monitoring activities were reviewed during
the inspection. The following violations/deficiencies were noted:
• The General Location Map (GLM) does not meet all the requirements specified in Part II, Section A, Paragraph
1(a) of the NCG180000 General Stormwater Permit.
• The Site Map (SM) does not meet all the requirements specified in Part 11, Section A, Paragraph 1(c) of the
NCG180000 General Stormwater Permit.
• The list of significant spills needs to be updated in accordance with Part II, Section A, Paragraphs 1(d) and 7 of
the NCG180000 General Stormwater Permit. It is noted that no spills have been recorded or reported.
• The SDOs have not been certified annually as required by Part II, Section A, Paragraphs 1(e) and 7 of the
NCGI80000 General Stormwater Permit.
• The SP3 does not contain a feasibility study as required by Part II, Section A, Paragraph 2(a) of the NCG180000
General Stormwater Permit.
• The facility does not provide all required secondary containment as required by Part 11, Section A, Paragraph 2(b),
of the NCG180000 General Stormwater Permit. This is discussed in further detail below under "Site Review'.
• Position assignments for SP3 responsibilities have not been made as required by Part II, Section D, Paragraph 6
of the NCG180000 General Stormwater Permit. `
• The SP3 has not been reviewed and updated annually as required by Part II, Section A, Paragraph 7 of the
NCG180000 General Stormwater Permit. This includes the annual update of the spills list and recertification of the
SDOs.

Site Review
The site was relatively clean and well maintained. Mr. Boone noted the following violations/deficiencies:
• There are two large used coolant tanks located on a concrete pad under an overhang at the northeast corner of
the site. This pad incorporates a trough type drainage system that catches all fluids draining onto the pad and
redirects them into a catchment and recycling system of some kind. One tank is approximately 2,500 gallons and
is made of plastic. The other tank is made of metal and holds approximately 1,800 gallons. Both tanks require
secondary containment (SC) in accordance with Part II, Section A, Paragraph 2(b), but neither tank has SC. It is
further noted that the volume of the catchmentlrecycling system is not large enough to contain the contents of
either of the large used coolant tanks.
• The concrete pad (mentioned above) is also used for storage of. scrap metal and several 55-gallon drums of both
new and used oil. Housekeeping of the. pad itself should be improved — oil, soil, metal shavings, etc., were
plentiful on the pad and could be washed off the pad into stormwater drainage systems during severe weather.
The northwest corner of the facility is used for storage of pallets and other wooden articles such as crates used to
ship equipment. There are also miscellaneous equipment parts in the area. This area could stand a bit better
housekeeping as well.
The SDOs were also inspected and Mr. Boone noted no concerns.
The Division requires. that B/E corrects the violations/deficiencies outlined above as soon as practical. Please
reply in writing .to this letter within 30 business days of receiving it. Your written reply should detail corrective action. plans
with implementation schedules for each of the violations/deficiencies noted above. B/E is, reminded that violations of the
NCG180000 General Stormwater Permit are subject to civil penalty assessments not to exceed $25,000 per day, per
violation. B/E's written reply, as well as the actual actions it takes to correct these violation sldeficiencies, will be taken
into consideration when the Division assesses whether further action is necessary to compel B/E to comply with all permit
requirements.

Dear Mr. Barger:
On September 16, 2009, Jenny Graznak of this office performed a Stormwater Permit
Inspection at B/E Aerospace, Inc. located at 1455 Fairchild Road in Winston-Salem, North
Carolina. This facility holds General Stormwater Permit No. NCG180231 under the National
Pollutant Discharge Elimination System (NPDES) to discharge stormwater associated with the
manufacture of furniture and fixtures. Specifically, B/E Aerospace manufactures airplane seats.
You were present for the inspection. This type of inspection consists of two basic parts: a
review of facility files and self -monitoring data and an inspection of the facility's storage areas
and discharge points. This particular inspection evaluated five (5) areas, and observations from
each area are addressed below:
1. Permit
The permit became effective September 1, 2009 and expires August 31, 2014. A copy of the
permit was available during the inspection.
2. Records/Reports
As required by the Permit, the facility has a complete Stormwater Pollution Prevention Plan
(SPPP), dated November 2003, which was available for review during the inspection. The
SPPP appeared to be thorough and complete, including a location map of the outfalls and a site
plan listing potential Stormwater pollutants (with MSDS sheets) and best management practices
used at the site. Employee Training is conducted on an annual basis.
3. Facility Site Review
A covered shed houses new oil stored 55 gallon drums as well as waste oil. Used coolant is
stored in a large tank, and metal scraps are stored in garbage bins under the same shed. There
is also an on -site generator with diesel fuel. New pallets are also stored outside.
4. Effluent/Receiving. Waters
The site has five Stormwater outfalls. No problems were noted with the outfalls during the
inspection. Stormwater from the property discharges to an unnamed tributary to Brushy Creek
in the Yadkin Pee Dee River Basin.

5. Self -Monitoring Pro -gram
The stormwater permit requires semi-annual qualitative monitoring of stormwater discharge
outfalls. An on -site review of the monitoring reports during the inspection showed that all
parameters were evaluated per the specifications of the permit. The last monitoring event
