Dear Mr. Gantt,
The purpose of this letter is to respond to the above referenced Notice of Violation (NOV). Per
the response requirement of the NOV, DARRAN Furniture Industries, Inc. (DARRAN) has
prepared this communication to address the compliance issues noted in the NOV with anticipated
corrective action timeframes.
In the referenced NOV, Ms. Aana Taylor -Smith with the Winston-Salem Regional Office of the
Division of Energy, Mineral and Land Resources identified ten (10) compliance issues related to
the DARRAN Stormwater General Permit. DARRAN is working with Phoenix Environmental,
Inc. to address the noted deficiencies and the anticipated corrective action timeframe is
approximately 45 working days. It is anticipated the noted violations and deficiencies will be
corrected by the week of October 13, 2014.
In closing, DARRAN takes environmental compliance seriously. The violations of the NC
Stormwater General Permit requirements were unexpected. The compliance responsibilities for
this permit were passed to Mr. Ron Schott approximately seven years ago and he was not made
aware of detailed compliance requirements contained in the General Permit. Mr. Schott
maintained monitoring in -place when he assumed responsibility, but the documentation efforts
fell short of permit requirements. While not infallible, we strive to maintain environmental
compliance and act in a proactive manner to protect human health and the environment.

Aana Taylor -Smith of the Winston-Salem Regional Office of the NC Division of Energy, Mineral, and Land Resources (DEMLR)
conducted a compliance evaluation inspection at the subject facility on 22 July 2014. Your assistance and cooperation were
greatly appreciated. An inspection checklist is attached for your records and the inspection findings are summarized below.
This facility is located at 2402 Shore Street in Archdale, Randolph County, North Carolina. Stormwater related to industrial
activity is discharged from the site to the Uwharrie River, which is currently classified as Class WS-III waters, in the Yadkin -
Pee Dee River Basin.
Documentation Review
The Stormwater Pollution Prevention Plan (SPPP) that was provided on site is missing several elements and does not meet
permit requirements. The following problems were noted with the SPPP:
1. No general location map was included. Part Il, Section A-1(a) of the permit requires a USGS drafted quadrangle
map or equivalent showing the facility's location.
2. There was no narrative description of practices included with the SPPP. See Part ll, Section A-1(b) of the permit for
requirements for the narrative description.
3. Stormwater Discharge Outfalls (SDOs) have not been evaluated for illicit discharges, nor was there a signed
certification statement of such an evaluation included with the SPPP. Part Il, Section A-1(e) of the permit requires
that SDOs be evaluated annually and that a signed certification statement be kept with the plan.
4. TFie plan lacked an evaluation of feasible alternatives to current practices as required by Part Il, Section A-2(a) of
the permit.
S. A Best Management Practice (BMP) summary was not included. Part II, Section A-2(c) of the permit requires that a
BMP summary be included with the plan and reviewed and updated annually.
6. The Spill Prevention and Response Plan (SPRP) was not kept with the SPPP. Please keep a copy of the SPRP with the
SPPP and revise or update it as needed according to Part II, Section A-3 of the permit.
7. A Preventative Maintenance and Good Housekeeping Program required by Part ll, Section A-4 of the permit was
not included with the SPPP.

8. Employee training has not been documented as required by Part II, Section A-5 of the permit. Stormwater training
is required at least annually and training must be documented with the date and signature of each employee in
attendance. These records must be kept with the SPPP.
9. Responsible parties have not been identified as required by Part 11, Section A-6 of the permit.
10. The SPPP has not been updated or amended. Part ll, Section A-7 of the permit requires the SPPP to be reviewed
and updated annually, along with a re -certification that outfalls have been evaluated for the presence of non-
stormwater discharges and a re-evaluation of BMP effectiveness.
Facility inspections have been conducted and recorded on a monthly basis. Thorough, detailed records of facility inspection
were available for review.
Monitoring Review
Qualitative monitoring (QM) has not been conducted or documented as required. No records of QM exist. Part II, Section B
of the permit requires semi-annual QM at each SDO during a representative storm event. Dar Ran Furniture Inc. must
immediately correct QM violations by beginning monitoring as required by the permit.
Analytical monitoring (AM) is not required for this facility because no vehicle maintenance occurs on site.
Site Review
The facility is clean and well -maintained. Secondary containment is implemented as required. The site's four outfalls were
inspected and found to be in good order. No evidence of erosion or instability at the SDOs was observed. The receiving
stream was free of pollution indicators.
The incomplete and inaccurate SPPP and the insufficient QM are considered violations of the NCG180000 general permit.
You are reminded that pursuant to NC General Statute 143-215.6A, the Division may assess civil penalties of up to $25,000
per day, per violation of NCG180000. Please reply in writing to this NOV within 30 days of receiving it. Your reply should
detail corrective actions with implementation schedules for each of the violations identified above.

pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between the state of North Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.
