On September 23, 2008, Corey Basinger of the Winston-Salem Regional Office conducted a
compliance inspection at the New Generation Yarn Corporation facility (1248 Springwood Avenue,
Gibsonville, North Carolina). The inspection consisted of two parts: a review of the facility files
and records and an on -site facility inspection.
The review of the facility files and records resulted in the following violations-
1) New Generation Yarn_ Corporation did not have 'a copy of the Certificate of Coverage
(NCG170370) on file;
2) A Storrnwater Pollution Prevention Plan (SPPP) and a Spill Prevention Control and
Countermeasures Plan (SPCC) had not been developed by the subject facility;
3) No qualitative (visual) monitoring had been conducted as required by NCG170370.
The on -site facility inspection resulted in the following observations:
a) hack systems and empty aluminum cylinders are stored outside;
b) 55 gallon drums stored outside are kept tender roof but without secondary containment;
c) a small amount of plastic pellets were observed around the dunipster;
d) there are two (2) outfalls at the facility.

In sumrrtary, the subject facility must develop and implement a Stormwater Pollution
Prevention Plan (SPPP) and a Spill Prevention Control and Countermeasures Plan (SPCC) no
later than December 31, 2008. The facility must also conduct the qualitative (visual)
monitoring for the period September -November 2008 by November 30, 2008. Please submit a
copy of the SPPP, SPCC and qualitative monitoring data to this office for review upon completion.
Because the facility has been determined to be non -compliant with the terms and conditions
contained in NPDES Permit No. NCG170370, you are required to respond in writing to the
Winston-Salem Regional Office, stating your intentions and methods to resolve the issues of
non-compliance. The response must be received in this Office fifteen (15) business days after
receipt of this correspondence. Until full compliance is achieved, the facility remains subject to
appropriate enforcement actions contained in North Carolina General Statute 143-215, including
possible imposition of civil penalties in an amount up to $25,000 per day per violation.

On January 8, 2009, Corey Basinger of the Winston-Salem Regional Office conducted a follow-
up compliance inspection at the New Generation Yarn Corporation facility (1248 Springwood
Avenue, Gibsonville). The inspection was conducted to determine if the subject facility had
achieved compliance with permit conditions subsequent to the Notice of Violation issued on
September 24, 2008.
During the January 8th follow-up inspection, it was determined that all requirements and
conditions of NPDES Permit No. NCG 170370 have now been met. A Stormwater Pollution
Prevention Plan (SPPP) has been developed and is deemed satisfactory.. - A secondary
containment design has been completed and should be constructed in the immediate future. The
number of barrels/containers stored outside has been reduced since the last inspection.
Enclosed please find the most recent version of the Qualitative Monitoring Report Form. You
may use this form or create your own form that contains the same information. Once completed,
these forms should be kept with your Stormwater Pollution Prevention Plan. Also enclosed is a
copy of the USGS Topographic map for the facility.

Your facility is currently covered for stormwater discharge under General Permit NCG 170000. This permit will
expire on July 31, 2004. North Carolina General Statute 143.215.1(c) requires that an application for permit
coverage renewal be filed in a timely manner. A prior notice of renewal was sent for this site on December 1,
2003. To date, no response has been received by the Division of Water Quality (DWQ). In order to assure your
continued coverage under the general permit, you must apply to DWQ for renewal of your permit coverage.
Enclosed you will find a general permit renewal application form. The application must be completed and returned
by April 19, 2004 in order to assure continued coverage under the general permit.
Failure to request renewal by April 9, 2004 can result in a civil assessment of at least $250.00. Larger penalties
may be assessed depending on the delinquency of the request. Discharge of stormwater from your facility without
coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and could
result in assessments of civil penalties of up to $10,000 per day.
