I have attached a PDF of the inspection letter from the previous time that Frontier Spinning Mills was inspected as we discussed. Keep in mind that this letter also includes the inspection of the plant at 109 Turner Road as well as an evaluation of two No Exposure Certification Applications that were submitted by Frontier in 2008. The list we discussed for the plant at 170 Shakey Road is on pages 1-2. Let me know if you have any questions! I will be sending out your inspection letter for today's inspection with tomorrow's mail. Skvarla, III Governor Director Secretary 11 April 2013 Jay Flanary, Director of Manufacturing Services Frontier Spinning Mills, Inc. 1823 Boone Trail Road Sanford, NC 27330 Subject: Compliance Evaluation Inspection NPDES General Stormwater Permit NCG170000 Certificate of Coverage NCG170357 Frontier Spinning Mills, Inc. Rockingham County Dear Mr. Flanary: Aana Taylor -Smith of the Winston-Salem Regional Office of the NC Division of Water Quality (DWQ or the Division) conducted a compliance evaluation inspection at the subject facility on 11 April 2013. The assistance and cooperation provided by Mr. Jody Jarrell and Mr. John Booth during the inspection were greatly appreciated. An inspection checklist is attached for your records and the inspection findings are summarized below. This facility is located at 170 Shakey Road in Mayodan, Rockingham County, North Carolina. Stormwater related to industrial activity is discharged from the site to an unnamed tributary of the Dan River, which is currently classified as WS-V (Water Supply) waters, in the Roanoke River Basin. Documentation & Monitoring Review The Stormwater Pollution Prevention Plan (SPPP) is complete and current. It is updated on a yearly basis and all required records were available for inspection. Problems with the SPPP were described in the previous inspection, conducted 24 November 2008, with the resulting recommendation that the plan be updated to include several missing sections. During the inspection, it was noted that all recommendations had been addressed. The facility had one spill in the past three years that was well -documented, but records of the spill were not included in the SPPP. Please be sure to update the SPPP with a list of significant spills as required by Part II, Section A, Paragraph d of the permit. Additionally, although the SPPP has been reviewed and updated on a yearly basis, please rememberto include a statement that the plan has been updated with the plan itself. Qualitative monitoring has been conducted and documented as required. The facility has 14 Stormwater Discharge Outfalls (SDOs) at which qualitative monitoring is performed on a semi-annual basis. The facility has one "switcher" vehicle that receives yearly preventative maintenance on -site, but as less than 55 gallons of new motor oil are used per month, the facility is exempt from analytical monitoring requirements. All necessary secondary containment is implemented as required. Each of the 14 outfalls was examined during the inspection. With one exception, the SDOs were clean and well - maintained. Please note that Outfall 2 should have the grass removed from the mouth of the pipe. As discussed, keep an eye on Outfall 14, as it may be prone to erosion. Additionally, you may want to consider updating the description of Outfall 13 in the SPPP, as it did not appear as described, but was found at the location given in the SPPP. The receiving waters at each outfall looked clear with no visible foam or floating solids. Outfall and access maintenance is performed regularly and well -documented. We appreciate your efforts to comply with the stormwater general permit, as well as the improvements made to the facility's SPPP and practices since the last inspection. No additional response to this letter is required. Please do not hesitate to contact Aana Taylor -Smith or me at (336) 771-5000 if you have any questions regarding the inspection or this fetter. This permit is reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as subsequently amended.) The following information is included with your permit package: • A new Certificate of Coverage • A copy of stormwater General Permit NCG170000 • A copy of a Technical Bulletin for the General Permit • Five copies of the Discharge Monitoring Report (DMR) Form • Five copies of the Qualitative Monitoring Report Form The General Permit authorizes discharges of stormwater only, and it specifies your obligations with respect to stormwater discharge controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself with all the changes in the reissued permit. The more significant changes in the General Permit since the your -last Certificate of Coverage include the following: • Permit cover page — Coverage is expanded to include industrial activities similar to the categorically identified industries. • Part I Section A — This part explains that the No Exposure Exclusion from permitting option may be available to the permittee. • Part II Section A — Several minor expansions and clarifications of the required content of the Stormwater Pollution Prevention Plan have been added. Please be sure that your plan is updated to comply with the new requirements. • Part II Section B — Qualitative monitoring must now be conducted during a representative storm event. • Part II Section B — The permittee is required to keep a written record of his response to problems identified by his qualitative monitoring observations. • Part II Section C - For facilities with vehicle maintenance activities using more than 55 gallons of new motor oil per month, new provisions require that discharges from the vehicle maintenance areas be sampled twice per year, and that the sampling results be compared to new numerical benchmark values. (The previous cutoff concentrations have been eliminated.) • Part 11 Section C — For facilities with vehicle maintenance activities using more than 55 gallons of new motor oil per month, new provisions require the permittee to execute Tier One and Tier Two response actions, based on the first benchmark exceedence (Tier One) and the second consecutive benchmark exceedence (Tier Two). Tier Two requires that the permittee institute monthly monitoring instead of twice -per -year monitoring, until three consecutive monitoring events show no benchmark exceedences. • Part 11 Section C —This part contains a new provision that four exceedences of any particular benchmark will trigger increased DWQ involvement in the permittee's stormwater management and control actions. DWQ may direct the permittee to apply for an individual permit, or may direct the implementation or installation of specific stormwater control measures. NCG170357 —170 Shakey Road Facility 4a- 4g 4. The facility has a Stormwater Pollution Prevention Plan (SP3). The following SP3 discrepancies were noted during the inspection: a. The general location map does not reflect the locations of the stormwater discharge outfalls (SDO) with latitudesliongitudes, as required in Part 11, Section A, Paragraph 1a of the permit. Corrective Action: The map will be updated with the required information. Completion Deadline: 311109 b. Corrective Action: The map will be updated with the required information. Completion Deadline: 311109 c. There was no certification that the SDOs had been evaluated for the presence of non-stormwater discharges as required by Part II, Section A, Paragraph 1 e of the permit. Corrective Action: Once the SDO's have been identified, samples will be taken and evaluated. Completion Deadline: 3115/09 • Page 2 December 18, 2008 d. The Spill Prevention and Response Plan (SPRP) required by Part II, Section A, Paragraph 3 should be reevaluated and/or better implemented. A stain and absorbent material, indicating a relatively small spill, was observed near the large recyclables dumpster located at the northeast comer of the facility. This appeared to be the result of loading/unloading activities by the contractor that picks up the recyclables. The best management practices (BMP) employed at the facility under the SPRP must be better developed and/or implemented in order to manage and ensure proper cleanup of such spills. Corrective Action: The SPRP plan will be reviewed, updated, and implemented to reflect clearly defined BMP. Completion Date: 03/31/09 e. There is no employee -training program as required by Part II, Section A, Paragraph 5. Corrective Action: The program will be reviewed and updated as listed in item d above. Once the review is complete, employee training will be conducted. Completion Date: 03/31/09 f. The SP3 is not being reviewed and/or updated annually as required by Part II, Section A, Paragraph 7. Please note that documentation of annual reviews/updates is required to demonstrate compliance. Corrective Action: The program will be reviewed on an annual basis once the review and update has been conducted. Completion Date: 03/31/09 g. The SDOs currently being monitored as defined on the site map and general location map must be reevaluated. Monitoring is not being conducted at the ends of the discharge pipes for all SDOs, but rather some distance upstream of the ends of the pipes, usually at stormwater catch basins. The ends of the pipes need to be found and properly maintained so they can be accessed for qualitative monitoring. These locations must then be corrected on the site map and general location map. Additionally, some of the SDOs currently identified on the site/general location maps are not being monitored as required and there are additional SDOs on the site which are not identified on the site/general location maps and are not being monitored as required. It is possible that limited site work may be accomplished to combine some of these discharge points and reduce the overall number of SDOs. All SDOs must be properly identified, annotated on the site and general location maps and monitored as required. • Page 3 December 18, 2008 Corrective Action: The SOO's will be located, re-evaluated, identified and maintained as prescribed in the discrepancy 4g above. Both of these receiving streams are located in the Roanoke river basin. Documentation & Monitoring Review - NCG170357 (170 Shakey Road) 3. Frontier Spinning Mills, Inc. is being issued a Notice of Violation (NOV-2008-PC-0807) for failure to meet multiple permit conditions as noted during this inspection and specified below. 4. The facility has a Stormwater Pollution Prevention Plan (SP3). The following SP3 discrepancies were noted during the inspection: a. The general location map does not reflect the locations of the stormwater discharge outfalls (SDO) with latitudes/longitudes, as required in Part If, Section A, Paragraph 1a of the permit. b. The site map does not show the separate drainage areas with their corresponding SDOs, directions of flow, percentages of impervious surfaces and the activities that occur in each drainage area, as required in Part 11, Section A, Paragraph 1 c of the permit. There was no certification that the SDOs had been evaluated for the presence of non-stormwater discharges as required by Part iI, Section A, Paragraph le of the permit. d. The Spill Prevention and Response Plan (SPRP) required by Part II, Section A, Paragraph 3 should be reevaluated and/or better implemented. A stain and absorbent material, indicating a relatively small spill, was observed near the large recyclables dumpster located at the northeast corner of the facility. This appeared to be the result of loading/unloading activities by the contractor that picks up the recyclables. The best management practices (BMP) employed at the facility under the SPRP must be better developed and/or implemented in order to manage and ensure proper cleanup of such spills. e. There is no employee -training program as required by Part 11, Section A, Paragraph 5. f. The SP3 is not being reviewed and/or updated annually as required by Part 11, Section A, Paragraph 7. Please note that documentation of annual reviews/updates is required to demonstrate compliance. g. Additionally, some of the SDOs currently identified on the .site/general location maps are not being monitored as required and there are additional SDOs on site which are not identified on the site/general location maps and are not being monitored as required, It is possible that limited site work may be accomplished to combine some of these discharge points and reduce the overall number of SDOs.. An SDOs must be properly identified, annotated on the site and general location maps and monitored as required. Stormwater facility inspections, secondary containment inspections and housekeeping/maintenance inspections are currently being conducted in accordance with permit requirements. Site Review - NCG170357 (170 Shakey Road) 5. The site was fairly clean and well maintained. The only issues noted were the small spill and the SDOs, as mentioned above. No Exposure Certification - NCG170357 (170 Shakey Road) 6. Frontier Spinning Mills, Inc. recently submitted to the Division a No Exposure Certification (NEC) for this facility. The NEC is hereby denied for the following reasons: a. The facility is non -compliant with the current NCG170000 stormwater permit. The facility will have to attain complete permit compliance and correct all discrepancies listed above in paragraphs 3a — 3g, prior to an NEC being granted. b. There is a material storage area located near the southeast corner of the facility where unused parts are being stored outside, exposed to the -elements. These materials must be removed, permanently moved inside the facility, or placed under permanent cover to qualify for the NEC. The waste oil tank and its secondary containment (SC) structure are located outside, exposed to precipitation. In order to qualify for an NEC, this tank and its SC structure will have to be placed under permanent cover or removed. Mr. Jay Flanary 24 November 2008 Page 3 of 4 d. There are two large recyclables dumpsters on site that are currently open top. These dumpsters will have to be permanently covered or removed to qualify for the NEC. e. There are two large trash compactors on site. The compaction compartments of these units are sealed, however the ends of the units, where trash is loaded into the compactors, is open and exposed to precipitation. These units will have to be permanently covered or removed in order to qualify for the N EC. Documentation & Monitoring Review - NCG170136 (109 Turner Road) 7. The facility has a Stormwater Pollution Prevention Plan (SP3). The following SP3 discrepancies were noted during the inspection: a. The general location map does not reflect the locations of the SDOs with latitudes/longitudes, as required in Part II, Section A, Paragraph 1a of the permit. b. The site map does not show the separate drainage areas with their corresponding SDOs, directions of flow, percentages of impervious surfaces and the activities that occur in each drainage area, as required in Part 11, Section A, Paragraph 1c of the permit. c. There was no certification that the SDOs had been evaluated for the presence of non-stormwater discharges as required by Part 11, Section A, Paragraph 1e of the permit. d. The Spill Prevention and Response Plan (SPRP) required by Part 11, Section A, Paragraph 3 should be reevaluated and/or better implemented. Although there were no spills observed at the site and none had been recorded, the SPRP component of the SP3 is minimal and its effectiveness is questionable. e. There is no employee -training program as required by Part 11, Section A, Paragraph 5. f. The SP3 is not being reviewed and/or updated annually as required by Part 11, Section A, Paragraph 7. Please note that documentation of annual reviews/updates is required to demonstrate compliance. g. The SDOs are currently being monitored upstream of the actual discharge point, within the perimeter fence of the facility. The SDOs must be monitored at the ends of the pipes. The ends of the pipes must be identified and accessibility to them maintained to permit proper qualitative monitoring. Stormwater facility inspections, secondary containment inspections and housekeeping/maintenance inspections are currently being conducted in accordance with permit requirements. Site Review - NCG170136 (109 Turner Road) 8. The site was clean and well maintained. This unit will have to be permanently covered or removed in order to qualify for the NEC. 10. You are reminded that the Director of the Division of Water Quality may assess civil penalties not to exceed $25,000 per day for violations of the NCG170000 general stormwater permit. Please reply to this letter/Notice of Violation within 30 days of receiving it. Your response should include corrective actions with implementation schedules for each of the discrepancies noted above in paragraphs 4a — 4g for NCG170357 and 7a 7g for NCG170136. As stated above, before either facility will be granted NEC status, complete permit compliance will have to be attained and demonstrated and all conditions listed above in paragraphs 6a — 6e and 9a — 9d, will have to be met. 11. Thank you for your cooperation in this matter. Should you have any questions regarding the inspection, this letter, or the NEC, please feel free to contact Mr. Boone or me at (336) 771-5000.
