On August 22, 2017, Ryan Swaim, Environmental Specialist with the North Carolina
Department of Environmental Quality — Division of Energy, Minerals and Land Resources
(NCDEQ — DEMLR) conducted a multimedia inspection at the facility located at 3970 Liberty
Road in Greensboro, NC. Compliance deficiencies regarding the facilities industrial stormwater
permit were discovered during inspection.
This facility holds General Stormwater Permit NCG160188 to discharge stormwater from
industrial activity associated with Asphalt Paving Mixtures and Blacks {SIC 29511 under the
National Pollutant Discharge Elimination System (NPDES). The permit became effective
October 1, 2014 and expires on September 30, 2019. A copy of the current permit is required to
be maintained with the Stormwater Pollution Prevention Plan (SPPP) documents. The current
permit was available for review and was included in the SPPP at the time Mr. Swaim conducted
inspection.
This facility was required to develop and maintain a Stormwater Pollution Prevention Plan
(SPPP). At the time inspection, the facility SPPP and each of its components appear to have
been current and compliant with exception to permit monitoring requirements.

The following observations and deficiencies were noted during the NCDEQ multimedia
inspection and subsequent follow-up inspection:
Analytical Monitoring (Bi-Annual)
• NCG160000, Part II, Section B requires analytical monitoring to be conducted twice
annually for TSS and total rainfall at each outfall. The facility was deficient in that it has
no record of every complying with the bi-annual monitoring requirement. Failure to
monitor and report in accordance with the permit terms may result in monthly
monitoring and renortin r: for a specified time period.
Qualitative Monitoring (Bi-Annual)
• N_CG 160000, Part II Section C requires the qualitative monitoring to be conducted twice
annually at each outfall. The facility was deficient in that it did not monitor twice
annually as required. Monitoring requires the person conducting monitoring to go to
each outfall twice each year and document on the qualitative monitoring form what was
observed. It is a visual inspection. Fill out a separate form for each outfall. Please begin
monitoring twice (2) annually as permit requires.
Your Required Response:
Accordingly, you are directed to respond to this letter in writing within 30 calendar days of
receipt of this Notice. Your response should outline how the violations will be addressed and
should be sent to this office at the letterhead address and include the following:
• Analytical Monitoring Begin bi-annual analytical monitoring. Let us know when to
expect results from your monitoring samples, who will be collecting samples, and what
facility you choose to providing testing services.
• Qualitative Monitoring: Begin qualitative monitoring for each outfall. Monitoring
should identify color, odor, clarity, floating solids, suspended solids, foam, oil sheen,
erosion or deposition and any other obvious indication of pollution. A photo taken at of
the water at the time of inspection provides excellent documentation. Your response
should include your expected compliance with bi-annual monitoring requirement.
Thank you for your attention to this matter. Failure to correct the violations may result in this
offices recommendation for enforcement by the Director of the DEMLR (Division of Energy,
Minerals, & Land Resources) if the issues and any future violations continue. This office
requires that the violations, as detailed above, be abated immediately and properly
resolved. Environmental damage and/or failure to secure proper authorizations have been
documented on the subject tract as stated above. Your efforts to undertake activities to bring the
subject site back into compliance is not an admission, rather it is an action that must be taken to
begin to resolve ongoing environmental issues.

Comment: The one outfall the site had was observed and appeared to be function by capturing all the sites
stormwater. The outfall was very accesible and the standing water in the outfall was notably

We have received an application for coverage of a new facility under NCG 16 from Sharpe Bros. for
their asphalt facility. The facility drains to a UT of Little Alamance Creek (class WS-IV; NSW) in
Greensboro (Guilford County). They have no vehicle maint. or haz waste. they do have a
stormwater pond and secondary containment for fuel storage. Does the WSRO have any concerns
about issuing this facility a COC for this general permit?
