and emailed to you, the spills were listed on form and emailed, the SDO's were certified and form emailed to you, BMP summary was filled out and emailed, employee training was completed and documented, SP# annual review was completed for 2013 and will be completed annually, researched and found more of the qualitative forms and they were emailed to you I discussed these items with plant employees and managers and items will be kept on file going forward Items have been corrected on the site review, valves have been locked and I had training and discussion with manger and employees on Winston-Salem Regional Office (WSRO) and Shelton Sullivan, of the Cental Office (CO), of the NC Division of Water Quality (DWQ or the Division), conducted a compliance evaluation inspection (CEI) of APAC's Kernersville plant on April 9, 2013 Your assistance and cooperation during the inspection was greatly appreciated An inspection checklist is attached for your records and the inspection findings are summarized below The facility is located at 2863 Hwy 66, in Kernersville, Forsyth County, North Carolina, at approximate coordinates 36 0242560N, -80 056814OW According to the current Stormwater Pollution Prevention Plan (SP3), which was last written in September, 2011, stormwater related to industrial activity is discharged from stormwater discharge outfalls (SDO) 001, 002, and 003, to an unnamed tributary to Rich Fork, which is currently classified as a Class C water and is located in the Yadkin Pee -Dee River Basin Documentation & Monitoring Review APAC has a very good SP3, however not all requirements have been met The following deficiencies were noted • The General Location Map (GLM) does not meet all the requirements specified in Part II, Section A, Paragraph 1(a) of the NCG160000 general permit • The list of significant spills has not been updated annually as required in Part II, Section A, Paragraphs 1(d) and 7 of the NCG160000 general permit • The SDOs N0D-2013 PC 0148 4/16/2013 Page 2 of 3 • The BMP summary, as required by Part II, Section A, Paragraph 2(c), is Incomplete • Employee training is not documented as required by Part II, Section A, Paragraph 5 According to Mr Boone, you stated that you train the foreman at this plant annually and then he trains the other plant employees However, the only training that has been documented, is your training of the foreman Please begin documenting training of all employees • SP3 Annual Reviews have not been accomplished and/or documented as required by Part II, Section A, Paragraph 7 of the NCG160000 general permit • Not all Qualitative Monitoring (QM) has been conducted, or the documentation is simply not available, as required by Part II, Section C of the NCG160000 general permit It is noted that Analytical Monitoring (AM) as required in Part iI, Section B of the NCG160000 general permit has been accomplished and no benchmark exceedences have been experienced It is also noted that during a review of the plan in mid 2012, two additional SDOs (002 and 003) were discovered and had developed since the previous review due to changes in the site layout Site Review In general, the site was clean and well maintained The following issues were noted • The valve had been removed from the secondary containment drain, • There is a group of secondary containment pallets that contain miscellaneous potential pollutant materials located on the north side of the facility, immediately adjacent to the wetland The containment pallets were full of liquid, which appeared to be mostly rainfall The pallets' contents need to be examined properly emptied/disposed of APAC may want to consider moving the pallets further away from the wetland, and maybe covering them, to better mitigate the threat posed by the pollutants The pallets should be better maintained, i e kept empty of precipitation and other fluids so they can fulfill their intended purpose in the event of a container developing a leak APAC may also wish to consider managing the pallets just as they do their other secondary containments, i e inspect them regularly and drain and document accordingly • Movement of rap material at the site from underneath a shelter to the southern edge of the stormwater pond, drastically changed the drainage of the site All site drainage formerly went to the pond, but movement of the material has caused diversions that resulted in SDOs 002 and 003 This rap material should be removed to allow the majority of drainage to flow into the pond and out SDO 001 If done properly, APAC could eliminate SDOs 002 and 003, resulting in significant savings • SDO 003, located on the southeast corner of the facility, is experiencing heavy erosion, which could result in samples with high suspended solids concentrations APAC should take action to better stabilize the SDO and the drainage features leading to it Strategic placement of check dams, waddles, etc, may also aid in retaining suspended solids on site, until SDO 003 can be eliminated, if that's what APAC decides to do with 003 The Division requires that APAC corrects the deficiencies outlined above as soon as practical Please reply in writing to this letter within 30 business days of receiving it Your written reply should detail corrective action plans with implementation schedules for each of the deficiencies noted above APAC is reminded that violations of the NCG160000 General Stormwater Permit are subject to civil penalty assessments not to exceed $25,000 per day, per violation APAC's
