DWQ has reviewed the information provided and conducted a follow-up site visit on March 12, 2009. The written response, corrective measures and the sample analysis results observed at the site have satisfactorily resolved the violations noted in the subject Notice of Violation and Recommendation for Enforcement. This letter in no way precludes this Office for taking action on this or any other violation. Violations are subject to civil penalty assessment of up to $25,000.00 per day for each violation. Cherokee County Asphalt Plant NPDES Stormwater General Permit- NCG160152 Cherokee County, North Carolina Dear Mrs. Wiggs: p ECE�VE MAR 16 2009 WATER QUALITY SECTION ASHEVILLE (REGIONAL OFFICE Please consider this letter response to your Notice of Violation letter dated Feb. 2, 2009. 1) Stormwater Pollution Prevention Plan (SPPP) a) Secondary Containment has been pumped and disposed of by Enterprise Oil Co. 5201 N. Middle Brook Knoxville, TN 37921 (see attached Manifest No. 304684). The Secondary Containment has been cleaned, sand blasted, sealed and repainted. Secondary Containment drain valves have been removed; piping capped and sealed in concrete. The "OILEY WATER" brand named filter has been cleaned and new filters installed. 2) Qualitative Monitorinq a) In the past all Qualitative Monitoring has been done by quarry personnel as the Asphalt Plant Area Stormwater drains to the quarry monitored outfall No. 001. Any additional Qualitative Monitoring recommended by DWQ will be conducted. 3) Analytical Monitoring a) Monitoring would have been performed in 2008 if a storm event that resulted in a discharge would have occurred. Any additional Analytical Monitoring required for 2009 will be conducted. Linda Wiggs Page 2 Required Response: A) Economic conditions resulted in temporary layoffs, responsibilities of the employees where not reassigned. As a result Harrison Constructions Cherokee County Asphalt Plant was not compliant with NPDES NCG160152 permit conditions for this period of time. B) All Maintenance and corrections at the site have been completed. C) Harrison Construction will provide a copy of all monthly inspections, 2009 qualitative and analytical monitoring reports as requested to DWQ Ashville Regional Office until further notice. D) Chain of Responsibility has been implemented; Refresher Training has been performed with all Superintendents, Site Supervisors, and foremen. Further training for the hourly employee will be scheduled when they return from layoff. Harrison Construction has developed a Chain of Responsibility, to include monthly monitoring by me or a trained, competent designee to assure that the Stormwater Pollution Prevention Plan and Spill Prevention Control and Countermeasure Plan (SPCA are being adhered to. APAC Atlantic Inc.) located along Marrestop Road, Cherokee County, North Carolina. Present during this inspection was Don Mason. The site drains to two Unnamed Tributaries to Persimmon Creek, Class C waters.and one Unnamed Tributary to North Fork Rapier Mill Creek, Class, C, waters, located in the I-Iiwassec River Basin. The site visit and file review revealed that the subject project is covered by NPDES Stormwater General Permit — NCG160152. The following violations were noted during the Division of Water Quality inspection: 1) Storniwater Pollution Prevention Plan (SPPP) A Stormwater Pollution Prevention Plan (SPPP) has been developed, recorded, and properly implemented. es No The SPPP was not reviewed due to the onsite representative not having a key to access the building where the Plan was located. Regardless, the Permit requires Stormwater Management, ' including Feasibility Study, and Secondary Containment retluirements as well as Preventative r' I Maintanence and Good I-lousekeeping. Poor conditions at and near the inlet structures were. documented. Leaking or, overflowing drums and buckets with. unknown substances were at ' several locations at the asphalt plant. Stains from these canisters were evident. The containment wall structure is compromised .ind,s.igns of leaking were apparent. The amount of liquid held within the containment structure appeared excessive, greater than a foot was present. The means by which to filter petroleum product from liquid in containment area is a 50 gal barrel with Filter, which also had signs of residue at outfall. A feasibility study should be prepared for this operation to rectify these violations. 2) Qualitative Monitorin Qualitative monitoring has been conducted and recorded in accordance with permit requirements, Not Evaluated For the same reason as mentioned above Qualitative Monitoring was not evaluated. See Required Response for actions requested. 3) Analytical Monitoring Analytical monitoring has been conducted and recorded in accordance with permit requirements. cs No Monitoring on January 8, 2007 for Total Suspended Solids exceeded cutoff concentration. No other monitoring results were submitted to determine arithmetic mean. Monitoring should have been performed in 2008. Regardless, additional monitoring will be required in 2009.. REQUIRED RESPONSE A) Please detail the events that resulted in non-compliance with the above -mentioned NPDES NCG160152 permit conditions. B) Explain when you anticipate being in full compliance with the NCG160152 Permit Conditions. C) It is requested that DWQ Asheville Regional Office be provided a copy of all the weekly inspections, 2009 qualitative, and analytical monitoring reports from this point forward until further notice. Continue to send the required submittals to the Central Files address as well. D) Finally, you should include in your response an explanation of how you propose to prevent these problems from reoccurring at this facility. Thank you for your assistance and cooperation during this inspection. Please be advised that violations of the NPDES General Permit are subject to a civil penalty assessment of up to $25,000.00 per day for each violation.
