Sullins Dee Freeman Governor Director Secretary July 27, 2010 Ms. Lori, Carter, Division Environmental Representative APAC-Atlantic, Inc. —Thompson-Arthur Division Post Office Box 21088 Greensboro, North Carolina 27420 Subject: NOTICE OF DEFICIENCY — ACTION REQUIRED General Stormwater Permit Inspection — NPOES Permit No. NCG160121 APAC-Atlantic, Inc. — Alamance County Dear Ms, Carter: On July 21, 2010, Jenny Graznak of this office performed a Stormwater Permit Inspection at the APAC-Atlantic, Inc. Asphalt Plant located at 1858 Huffman Mill Road in Burlington, North Carolina. This facility holds General Stormwater Permit No. NCG160121 under the National Pollutant Discharge Elimination System (NPDES) to discharge stormwater from activities associated with Asphalt Pacing Mixtures and Blocks. You and Bill Sorrell, Plant Foreman, were present for the inspection, This type of inspection consists of two basic parts: a review of facility files and self -monitoring data and an inspection of the facility's storage areas and discharge points. This particular inspection evaluated five (5) areas, and observations from each area are addressed below: 1. Permit The permit became effective October 1, 2009 and expires September 30, 2014. 2. Records/Reports As required by the Permit, the facility has a Stormwater Pollution Prevention Plan (SPPP) that was available for review during the inspection. Engineering Consulting Services, Ltd. (Greensboro) created the SPPP. Josh Dunbar with Falcon Engineering is working to prepare a new updated SPPP for the site, in order to comply with the new permit requirements and correctly address the current outfalls at the site. The SPPP should be available for review by October 1, 2010. Employee Training, which includes sampling methods and meter use, occurs on an annual basis, with the last event occurring on February 16, 2010. A sign -in sheet for the training is maintained in the SPPP. 3. Effluent/Receiving Waters Stormwater from the property discharges to Back Creek (Class C, NSW) in the Cape Fear River Basin. 4. Facility Site Review The site has several aboveground storage tanks (with secondary containment) for diesel fuel, hot oil, industrial fuel, and hydraulic oil. The site has three outfalls, all of which were observed to be in poor condition during the inspection. The ditch along Huffman Mill Road needs to be cleaned out as it is full of silt and sediment. Outfall 002 is the pipe behind the rap pile and has no erosion or sedimentation control measures to prevent silt from entering the stream through storm water. The outfail could be improved with some.rip rap or a check dam. Outfall 003 is the pipe behind the milling pile. However, the pipe is broken due to the encroaching pile of millings, waiting to be crushed. A sediment basin or catch basin needs to be rebuilt in this corner of the property to handle storm water. 5. Self -Monitoring Program Pace Analytical performs the analytical monitoring for the facility. Monitoring was performed on May 6, 2009 and February 22, 2010, with all results falling under permit benchmarks. A rain gauge is maintained at the facility outside the control room. Qualitative monitoring was also performed on May 6, 2009. However no other qualitative monitoring records were available for review during the inspection. It seems that monitoring might have been performed as required by the permit, but the records have not been maintained appropriately. REQUIRED ACTION This inspection letter is being sent to you as a Notice of Deficiency and action is required for the site to be in compliance with the storm water permit requirements. Ms. Graznak observed the following issues during her inspection: 1. As mentioned above, all three outfalls are in need of work to prevent silt and sediment from the site from entering waters of the State. You have until December 31,,2010 to improve the state of all three outfalls. 2. Paperwork should be better organized so that sampling and/or monitoring records are available upon request from Division of Water Quality. When Mr. Dunbar provides the new SPPP for the facility, you should take this opportunity to review the documentation requirements of the permit. You have until October 1, 2010 to improve the recordkeeping at this facility and to comply with the new permit's SPPP requirements.
