There hasn't been a discharge in his tenure (even 2013). We discussed the situation and come to the conclusion that they should keep the permit. In the future they are going to report "no discharge" rather than creating a controlled release to collect the sample. As always I appreciate your guidance. The entire site is surrounded by a berm and ' stormwater flows into a retention pond that does not discharge. Interesting. A fairly unusual circumstance in our experience, I think. Currently the facility collects stormwater samples by opening a valve to produce flow. So I would guess that they don't necessarily collect the sample during a rain event. One of my reactions is that it does seem like a waste of effort and money if they would not otherwise have a stormwater discharge from the site. I mean, if the only reason they would ever have a discharge is if they open the valve. The outlet of the valve flows into another area that ponds water on site. So, about this other area on site: does it discharge? Would it have a discharge if the valve were never opened on the basin? Does it also receive runoff from the industrial activity area? What happens when this facility gets a 6" rain — is there a discharge then from the property arising from any portion of the industrial activity area? They do not wash trucks at this facility so there isn't any wastewater. I am going to advise them to have their permit rescinded. I think it's important that they understand that any subsequent action on their part that produces a site discharge means they have to have a permit. We don't want them filling in the pond and breaching low side of the berm because they need the operating area, and don't like working in standing water. This is a large company and they may want to keep the permit. If they do decide to keep the permit I am going to advise them to record "No Flow" on their DMR's unless for some reason the do end up having flow in the future (I don't foresee this happening). OK then, I concur. If they can operate without a stormwater discharge, that's the best scenario for water quality, as far as we are concerned. Any thoughts you have on this scenario are appreciated. • Just two points, first would this second area of ponding actually be a discharge point in and of itself, without flow from the basin? • They should understand that if we rescind the permit, any subsequent action that produces a discharge would be "discharging without a permit." Especially worrisome if they had a permit, and then asked us to rescind it (the current case.) We're ok with this rescission, presuming that you are. Please advise them to submit the paperwork. We will take this email from you as the ARO ok to rescind, and skip a second round through ARO, if that's ok with you.
