On January 28, 2014, Sue White of this office responded to a phone call received on January 27, 2014 from David Shoaf of Smith Reynolds Airport, reporting a spill through a storm drain located at Piedmont Aviation. Ms. White met with you, Ken Willard and Michael James of Piedmont Aviation, and John Spainhour, David Moore and Ladonta Clark from the City of Winston Salem. On January 24, 2014 an employee of Piedmont Aviation disposed of 20 gallons each of two chemicals, Zyglo Emulsifier ZR-10B and Zyglo Penetrant ZL-10B improperly by pouring it onto the ground and then pouring the remainder into the storm drain located on the back side of the property. This constitutes an illegal discharge to receiving waters designated as an unnamed tributary to Brushy Fork Creek, a Class "C waterbody in the Yadkin River Basin. The resulting violations are detailed below: Item 1. Removal of use 15A NCAC 02B .0211 (2):The waters shall be suitable for aquatic life propagation and maintenance of biological integrity, wildlife, secondary recreation, and agriculture; sources of water pollution which preclude any of these uses on either a short-term or long-term basis shall be considered to be violating a water quality standard. Item II. Oils-, deleterious substances; color or other wastes: 15A NCAC 02B .0211 (3)f: Oils; deleterious substances; colored or other wastes: only such amounts as shall not render the waters injurious to public health, secondary recreation or to aquatic life and wildlife or adversely affect the palatability of fish, aesthetic quality or impair the waters for any designated uses; It is understood by this office that the following occurred after the spill: 1. On January 27, 2014, Mr. Shoaf was notified of a substance in the storm conveyance by his crew and took the proper steps to contain the product, employing a clean-up kit with booms and swabs. A&D Environmental was hired by Piedmont Aviation to handle the clean-up on January 27, 2014. 3, On January 28, a safety meeting was held at Piedmont Aviation to discuss proper handling and disposal of chemicals. We appreciate the immediate attention to this matter. Because of the handling of this issue, this Office will not be sending a recommendation for enforcement action to the Director of the Division of Energy, Minerals and Land Resources regarding these issues. Please be aware, these violations, and any future violations, are subject to a civil penalty assessment of up to $25,000 per day for each violation. Ron Boone of the Winston-Salem Regional Office of the NC Division of Water Quality (DWQ) conducted a compliance evaluation inspection (CEI) at the subject facility on March 23, 2011. The assistance and cooperation of David Shoaf during the inspection, was greatly appreciated. An inspection checklist is attached for your records and the inspection findings are summarized below. 2. The facility is located at 3801 North Liberty Street, in Winston-Salem, Forsyth County, North Carolina. Stormwater related to industrial activity is discharged from the site to an unnamed tributary to Brushy Fork Creek, which is currently classified as Class C waters in the Yadkin River basin. Documentation & Monitoring Review 3. The permittee has a very good Stormwater Pollution Prevention Plan (SP3), However, the following discrepancies were noted: a. The plan has not yet been fully implemented; b. Qualitative Monitoring has not yet been accomplished; c. The SP3 does not list on site wetlands as required; d. Not all chemicals used on site, which have potential exposure to stormwater, have been addressed in the SP3, i.e. specifically Purple K (a fire retardant) and firefighting foam. e. The SP3 has not yet been certified as required. Please make sure to add these to your NCG SW inspection lists if they aren't already listed. Below is the email from Mike Randall with some info relative to the NCG15 permit. Re: SWPPP The airports only had 12 months from the effective date of their permit to develop their SWPPP. They were advised that if they needed additional time they needed to request an extension, provide a root cause and submit a Plan of Action (POA) for when the SWPPP would be completed. DWQ has not received any request. Most of the permits were issued prior to February 2010 (see attached) and should now have their SWPPP. Re: Monitoring The NCG15 monitoring requirement for airports was not discussed prior to issuing the permits in late 20091early 2010, nor does the permit specify when monitoring shall begin, only that it be done semi-annually during a representative storm event. Several airports/consultants took that to mean that they would begin monitoring after the SWPPP was developed and they began implement the SWPPP. Even though the permit is silent regarding when monitoring is to begin, unless a specific compliance schedule is described in the permit then all conditions are in effect upon issuance of coverage. Although, the monitoring is required from the time of permit issuance, DWQ understands that these are new permits, for the most part first time permittees, and there may be some confusion/miscommunication between airports and consultants. There also appears to be some confusion between monitoring all drainage outfalls for the airports versus only the outfalls associated with industrial activities as described in the General Permit and DWQ guidance. Although the NOI request the applicant to identify "How many discharge points (ditches, pipes, channels, etc.) convey stormwater from the property' ... and "What is the name of the body or bodies of water (creek, stream, river, lake, etc.) that the facility stormwater discharges end up in," the SWPPPs, in accordance with the General Permit and DWQ guidance, only require monitoring outfalls associated with industrial activities, for example, fueling, aircraft maintenance areas, aircraft washing, and designated deicing areas that could be exposed to stormwater runoff. Re: Aircraft Washing Pursuant to the General Permit, "Any other point source discharge to surface waters of the state is prohibited unless it is an allowable non-stormwater discharge or is covered by another permit, authorization, or approval. The stormwater discharges allowed by this General Permit shall not cause or contribute to violations of Water Quality Standards. This General Permit does not allow discharges determined by the Division of Water Quality to be wastewaters." Pursuant to the General Permit, "Wash water and rinse water must be directed to a sanitary sewer system or permitted by a separate wastewater permit issued by the Division." DWQ guidance, consistent with other individual and general permits, allows Best Management Practices (BMPs) alternatives including, "...cleaning operations shall take place where the runoff can be directed to and infiltrated in grassed or graveled areas to prevent a point source discharge of the wash water into drainage ways, storm drains, or surface waters. All outdoor aircraft cleaning activities must use bio-degradable soaps and detergents. Where aircraft cleaning cannot be performed as described above and when aircraft cleaning is performed in the vicinity of a storm drainage collection system, the drain is to be covered with a portable drain cover during cleaning activities. Any excess ponded water shall be collected, removed and properly handled prior to removing the drain cover." In keeping with DWQ guidance if an airport has a collection pad for wash water and rinse water; 1. Wash water and rinse water will need to be directed to and infiltrated in grassed or graveled areas to prevent a point source discharge. This could be through a curb cut or drain in the containment structure to allow the wash water and rinse water to be directed to and infiltrated in grassed or praveled area. 2. Excess ponded water that cannot be directed to and infiltrated in grassed or graveled area, discharged to sanitary sewer, or permitted as a point sources, shall be collected, removed and properly handled. 1 Point source discharges that contain wastewater (i.e., wash water and rinse water) with/without an OWS may need a Separate wastewater permit. Stormwater runoff that does not contain wastewater, (i.e., wash water and rinse water) may continue to be discharged through an OWS without a separate wastewater permit. Where the airport has a pad for aircraft cleaning the Regional Offices may need to visit the site to provide alternative BMPs that satisfy the permit conditions and DWQ guidance. Re: Inspections I recommend the regional office conduct inspections as resources allow; rather than wait another 12 months for the monitoring results. The airport managers are generally eager to comply with the new permit and would benefit from any recommendations the regional office staff provide. With respect to enforcement, DWO staff understand airports are first time permittees and recognize that there may have been some confusion as to when the airports should begin monitoring.
