On July 31, 2018, Isaiah Reed from the Asheville Regional Office of the Division of Energy, Mineral and Land
Resources, conducted a site inspection for the American Concrete facility located at 2698 Mount Home Church Road,
Burke County, North Carolina. Your time and assistance during the inspection were greatly appreciated. A copy of the
Compliance Inspection Report is enclosed for your review. The inspection and file review revealed that the subject
facility is covered by NPD>; S Stormwater General Permit-NCG 140000, Certificate of Coverage-NCG 140435.
Permit coverage authorizes the discharge of stormwater fi•om the facility to receiving waters designated as the East
Prong Hunting Creek, a Class WS-IV rvaterbody in the Catawba River Basin.
As a result of the site inspection, the following permit violation(s) are noted:
1) Stormwater Pollution Prevention Plan (SPPP)
Failure to provide and properly implement a Stormwater Pollution Prevention Plan (SWPPP) as outlined in
North Carolina General Permit NCG 140000 (Part III, sections 1-9)
-At the time of the inspection, no Stormwater Pollution Prevention Plan (SWPPP) was available on site.
2) Qualitative Monitoring
Failure to conduct Qualitative monitoring as outlined in the NCG 140000 permit (Part IV, Sections A, B, C,
and D).
-At kite time of the inspection, no qualitative data was available on site,
3) Analytical Monitoring
Failure to conduct Analytical monitoring as outlined in the NCG 140000 permit (Part IV, Sections A, B, C,
and D).
-At the time of the inspection, no analytical monitoring data was available on site.
4) Site Maintenance
Failure to conduct all necessary site maintenance as outlined in the NCG 140000 permit (Part V, Section C).
-At the time of the inspection, there was visible off site deposition of sediment and concrete waste in the
roadside drainage ditch adjacent to the south side of the facility.
-At the time of the inspection, the basins observed were not appropriately maintained.

Failure to practice good housekeeping on site as outlined in NCG140000 (Part 1I1, Section 4).
-At the time of the inspection,' an oily sheen was observed in the runoff and on the ground around waste oil
containers, and in the vehicle maintenance area.
Requested Response:
You are asked to respond to this office, in writing, within 30 calendar days from receipt of this notice. Your written
response should include a reasonable explanation as to why the aforementioned violations have occurred as well as a
Plan of Action to prevent these violations from recurring.
Thank you for your attention to this matter. This office is considering sending a recommendation for enforcement to the
Director of the Division of Energy, Mineral & Land Resources regarding these issues. Your above -mentioned response
to this correspondence will he considered in this process. This office requires that the violations, as detailed above,
be properly resolved. These violations and any future violations are subject to a civil penalty assessment of up to
S25,000 per day for each violation. Your efforts to undertake activities to bring the subject site back into compliance: is
not an admission, rather it is an action that must be taken in order to begin to resolve ongoing environmental issues.
Your above -mentioned response to this correspondence, the degree and extent of harm to the environment and the
duration and gravity of the violations will be considered in any civil penalty assessment process that may occur. Should

Inspection Summary:
On July 30, 2018 this facility was inspected for compliance. I met with Gary Siroupe on site. During the inspection, the
following items were noted:
1) No SWPPP was available on site. The facility is directed to create a Stormwater Pollution prevention plan as outlined in
North Carolina General Permit NCG140000 (Part III, sections 1-9) and make it available for the next inspection,
2) At the time of the inspection, no Qualitative monitoring reports could be produced. The permitee is directed t4
immediately implement a stormwater monitoring program as outlined in the NCG1400DO permit (Part W, Sections A, B. C,
and D).
3) At the time of the inspection, no Analytical monitoring reports could be produced. The permitee is directed to immediately
implement a stormwater monitoring program as outlined in the NCG140000 permit (Part IV, Sections A, B. C, and D).
4) At the time of the inspection, there was visible off site deposition of sediment and concrete waste in the roadside drainage
ditch adjacent to the south side of the facility. The permitee is directed to remove all sediment and concrete waste deposited
in the drainage ditch and all sediment deposited at the outlet end of the drainage pipe existing under the driveway next to the
drainage ditch.
5) At the time of the inspection, the basins were observed to be poorly maintained and fun of wastewater. The permitee is
directed to maintain all treatment basin in accordance with NCG149000 (Part V, Section C)
G) At the time of the inspection, the vehicle maintenance area, including waste oil containers, was found to be in poor
condition. The permiee is directed to outline and implement a Good Housekeeping and preventative maintenance plan on
site in accordance with NCG140000 (Part Ip, Section 4).

Inspection Summary:
On July 30, 2018 this facility was inspected for compliance. I met with Gary Stroupe on site. During the inspection, the
following items were noted:
i) No SWPPP was available on site. The facility is directed to create a Stormwater Pollution prevention plan as outlined in
North Carolina General Permit NCG140000 (Part III, sections 1-9) and make it available for the next inspection.
2) At the time of the inspection, no Qualitative monitoring reports could be produced. The permitee is directed to
immediately implement a stormwater monitoring program as outlined in the NCG140000 permit (Part IV, Sections A, B, C,
and D).
3) At the time of the inspection, no Analytical monitoring reports could be produced. The permitee is directed to immediately
implement a stormwater monitoring program as outlined in the NCG140000 permit (Part IV, Sections A, B, C, and D).
4) At the time of the inspection, there was visible off site deposition of sediment and concrete waste in the roadside drainage
ditch adjacent to the south side of the facility. The permitee is directed to remove all sediment and concrete waste deposited
in the drainage ditch and all sediment deposited at the outlet end of the drainage pipe existing under the driveway next to the
drainage ditch.
5) At the time of the inspection, the basins were observed to be poorly maintained and full of wastewater. The permitee is
directed to maintain all treatment basin in accordance with NCG140000 (Part V, Section C)
6) At the time of the inspection, the vehicle maintenance area, including waste oil containers, was found to be in poor
condition. The permitte is directed to outline and implement a Good Housekeeping and preventative maintenance plan on
site in accordance with NCG140000 (Part ill, Section 4).

permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and
the Memorandum of Agreement between North Carolina and the US Environmental Protection
Agency dated October 15, 2007 (or as subsequently amended).
Please note that NCG140000 contains effluent limitations for process wastewater
discharges;(see Part IV, Section D). Wastewater discharges must comply with these effluent
limitations. An exceedenee of any of the wastewater limitations is a violation of permit
conditions.
Please take notice that this COC is not transferable except upon approval of the Division
of Energy, Mineral, and Land Resources. The Division of Energy, Mineral, and Land Resources
may require modification or revocation and reissuance of the COC. This permit does not affect
the legal requirements to obtain other permits which may be required by the Division of Energy,
Mineral, and band Resources or permits required by the Coastal Area Management Act or any
other federal or local governmental permit that may be required.

Inspection Summary:
On ,tune 9, 2016, Bev Price, Steve Ensley, Jeff Menzel and I met with Jimmy Mull and Gary Stroupe to conduct a
compliance inspection at the facility. A stormwater permit was Originally issued on January 6, 2016 however this is the first
time the facility has been inspected for stormwater. They do not have an SPPP in place but are performing the monitoring
requirements. We discussed the permit requirements with Mr. Stroupe and explained what actions were needed to
become compliant with the permit. Specifically we addressed the 3 basin areas and the need for a weir to be installed in
the collection basin so proper sampling can be performed. The ditch line below the basin area needs to be stabilized to
Prevent sediment from leaving the site. Additionally the slopes of the basins need to be stabilized with ground cover.
Finally, the secondary containment is not sufficient and needs to be addressed.

In accordance with your application for a discharge permit received on July 12, 2013, and
again with revised information on February 28, 2014, we are forwarding herewith the subject
certificate of coverage (COC) to discharge under the subject state NPDES general permit. This
permit is issued pursuant to the requirements of North Carolina General Statute'143-215.1 and
the Memorandum of Agreement between North Carolina and the US Environmental Protection
Agency dated October 15, 2007 (or as subsequently amended).
Please note that NCG140000 contains effluent limitations for process wastewater
discharges (see Part IV, Section D). Wastewater discharges must comply with these effluent
limitations. An exceedence of any of the wastewater limitations is a violation of permit
conditions.
Please take notice that this COC is not transferable except upon approval of the Division
of Energy, Mineral, and Land Resources. The Division of Energy, Mineral, and Land Resources
may require modification or revocation and reissuance of the COC. This permit does not affect
the legal requirements to obtain other permits which may be required by the Division of Energy,
Mineral, and Land Resources or permits required by the Coastal Area Management Act or any
other federal or local governmental permit that may be required.
Please note that permit requirements in Part II, Section A, numbers 1-5, and Part II,
Section B, number 1 are no longer valid per NC Session Law 2011-394. However, note that Part
11, Section A, number 6, and Part 1I, Section B, numbers 2-10 are unaffected by this Session
Law. Those sections will remain in effect for the duration of this permit term.

That NOI is still on my desk awaiting my attention. I can make it a priority to issue nit June 30, but that's the best I can
do at the moment.
The delay here is on my desk, not at the ARO. My review of the NOI indicates we won't have any problems issuing it, but
just can't get to it in a quicker time frame.
These folks are already in operation, and we are going to issue them a permit. They need help, however. I think ARO
should skip the site visit as a part of the permit issuance process, but should follow up right away after issuance to get
these folks moving in the right direction. They don't really have a clue right now, and need some hand holding.
Sorry for my delay, but it's just a delay. I haven't forgotten them.

* NO1 carries date stamps of July 12, 2013 and February 28, 2014. Permit application return log by BAG (7/23/13)
notes that no site plan was submitted and applicant did not answer questions for our abbreviated engineering
alternatives assessment.
Site plan included this time, with topo. Not a complete site plan as per our NO1 requirements, but substantial
conformity. (Outfalls not identified as such.)
Alternatives assessment questions skipped again, except for the final one which concludes that surface water
discharge is the most environmentally feasible option. KBP Personal opinion: 1 concur with the conclusion, and
would forgive the omission with the expectation that this applicant, and the surveyor he hired to put together the
site plan probably are not sufficiently familiar with water quality work to make it through these questions
without us spending the time to do it for them over the phone.
Surveyor appears to have accurately identified four drainage areas
o DA1— sheet flow onto a neighbor's lawn. Very flat terrain in that direction, and probably no probtem
considering that we do not have a regulated discharge based on no point source for the stormwater-
only flows. No nearby waterway or conveyance apparent in photos and Google aerials.
o DA2 -- leaves property in a gravel drive, crosses the undeveloped roadway ROW, becomes a shallow
natural swale (point source), but quickly enters a neighbor's hay field and might be considered to be no
point source discharge to surface waters. KBP opinion - Suggest RO confirmation of the physical facts of
drainage during first site visit.
o DA3 -- Surveyor suggests this is sheet flow or small rill flow. KBP opinion - Probably right, but suggest RO
confirmation at their first inspection. Surveyor reports a tree line and berm to the east. KBP suspicion
that there might also be a drainage feature in the tree line. We can process the NO1 without resolution
on this point, imb.

s o DA4 — Piped flow, from the hot area of mixing and wash down. Pathetic sediment ponds unlikely to be
controlling to permit limits or benchmarks. No pH control apparent. Receiving water is WS-IV, but
several hundred feet away, with some portions apparently overland flow on the neighbors property.
Not certain from the aerial photo whether there is a ditch/erosion feature or not. Per the surveyor's
photos, TSS is certainly making it off site, onto the neighbor's property. KBP opinion — Need RO to
establish that the flow makes it to the East Prong Hunting Creek, or is dispersed on the neighbor's
property, resulting in no discharge to surface waters.
l see these alternatives:
• Return again. My second choice.
• Accept the NOi, and ask ARO to investigate during the processing of the NOI. My third choice.
• Process the NO1, issue the COC, and ask ARO to immediately schedule a site visit. I think this is my first choice.
ARO will need to work with these folks, as they appear to have been in operation for quite a while, and have no
idea that TSS or pH control are necessary. No effective provisions for control of either pollutant. The only
possible saving aspect here is that maybe the flow from DA4 never reaches surface waters. Definitely need ARO

and have the RO follow up. This facility is going to need personal attention from the RO to get it right. Probably

the runoff onto D/A #1. Mount Home Ch. Road is located on the northern side of D/A #1.
A 12" RCP is located along the south side of the road and serves to carry water from the
eastside of the Greene property westward down Mt. Home Ch. Rd. A drop inlet is located
in the northwest corner of D/A #1 along the road which collects some surface water from
the and pipes it to the west also. The natural flow of runoff from D/A #1 would be from
northeast to southwest. The average grade across this area is 433%, with a grade of 5%
from the southwest comer of the material bin to the property line below the concrete pad.
The rate of flow was calculated in a Iine just north of the tree line crossing north of the
office and material bin and below the concrete pad. There was no significant washing in
this area though. The large portion of water moving thru this area appeared to be sheet
flow or small reel flow. Water exited D/A #1 into a natural valley to the west this
property is owned by Shirley Pearson. The out flow area is a grassed lawn.

Drainage Area #2
Drainage Area #2 (D/A #2) is located in the center of the American Concrete Inc. (ACI)
property. This area serves as employee and customer parking, concrete truck, and
equipment parking and maintenance. This area also has office and a frame maintenance
building, and product form areas, product storage, and material bins, and sand and gravel
stockpiles. This is the area of most heavy traffic on the site. It is almost entirely a well
graveled surface with areas of spilled concrete. The Lail property located to the northeast
serves as a watershed area of 0.5 acres which slopes 7% to the southwest corner of the of
the Edward Lail lot. This watershed area is entirely a lawn. This runoff as well as runoff
from the sand/gravel stockpiles and materials bins crosses the center of D/A #2 flowing to
the southwest. Additional runoff comes from the northern portion of D/A #2 (area north
of the frame building, and east and west of the office building) and converges in the truck
parking area just south of the frame building and the office building. The grades along
these areas varies a lot, but is near 5% thru the truck parking area. Runoff rxits the
property at _a Rravel driveway_ entrance at a 10% grade dear the end of asphalt of Hill
Street (and is the point of interest of calculations of flow).Runoff crosses Hill Street and
runs down a vegetated road bank into a hayfield owned by Delores Stroune to the South.
The runoffs reads out well and no Mllies are in the field.

Drainage Area #3
Drainage Area #3 (DIA #3) is located along the eastern side of the ACI property. This
area serves as product storage area, concrete form area, and a portion of the sand and
gravel stockpile. DIA #3 has practically no watershed to the north and the east, as the
runoff from the fail yard travels west, and a berm along the eastern property line blocks
water from entering from the east. A ditch along the west side of this berm serves to carry
much runoff from the east side of A #3 to the south, as well as the whole area drains to
the south into a natural woode where it crosses the Stroupe property to the south. A
small portion of D1A 3 western most point is a concrete pad used for drum storage of
chemicals and contains a metal outbuilding. Runoff from this area flows south toward
Hill Street. The runoff from DIA #3 is mainly sheet flow or small reel flow.

Drainage Area #4
Drainage Area #4 (D/A #4) contains the mixing and wash down operation of the ACI site,
as well as storage of necessary chemicals and cleaners. runoff anUwater from wash
down operations runs into three sedimentation ponds, where the water exits
sedimentation pond three by flowing over a bank in a level spreader like fashion. This
water is carried to the west by a ditch along the northern side of Hill Street to a 15"
Ca_rruAgated Metal_P pe (CMP) (Point of ]merest), which carries the water to the south side
of Hill Street. This CMP is 40' in length and at a grade of 15%. This CMP also collects s
water from the roadside ditch to the west. Once the runoff is on the Strou
(property to the south it runs to via a ditch to a 12" Corrugated Plastic (Point of
Interest), This pipe is 253.5' in Iength and is on. a grade. o_ f 2.3%. crossing a wetland area_ G „'r
and ending as a 12" CMP at the East Prong of Hunting Creek.
