Wooten Corporation �, High Density Commercial Wet Detention Pond Project st gnslow County �, Dear Mr. Butts: y On May 30, 2013, the Wilmington Regional Office issued a Stormwater Management Permit for the Burton Industrial Park — Concrete Plant for S.T. Wooten Corporation. A Certificate of Coverage NCG140428 was issued on August 8, 2013, approving the discharge of truck wash water into the permitted BMP #1 covered in the subject State Stormwater Permit No. SW8130501. This permit is being modified to provide additional terms and conditions regarding the use of the permitted wet detention pond as an NPDES regulated wastewater discharge for the truck wash water. Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H,1000 and Session Law 2008-211. We are forwarding modified Permit No. SW8130501 dated November 1, 2013, for the construction, operation and maintenance of the BMP's and built -upon areas associated with the subject project. This permit shall be effective from the date of issuance until May 30, 2021, and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the conditions listed in this permit regarding the Operation and Maintenance of the BMP(s), recordation of deed restrictions, procedures for changing ownership, transferring the permit, and renewing the permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system, to record deed restrictions, to transfer the permit, or to renew the permit, will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings (OAH). The written petition must conform to Chapter 150E of the North Carolina General Statutes, and must be filed with the OAH within thirty (30) days of receipt of this permit. T. Wooten Corporation Burton Industrial Park -- Concrete Plant. for S. T. Wooten Corporation Burton Park BoulevardJacksonville, Onslow County FOR THE construction, operation and maintenance of two (2) wet detention ponds in compliance with the provisions of 15A NCAC 2H .1000 and Session Law 2008-211 (hereafter collectively referred to as the "stormwater rules') the -approved stormwater management plans and specifications and other supporting data as attached and on file with and approved by the Division and considered a part of this permit. This permit shall be effective from the date of issuance until May 30, 2021, and shall be subject to the following specified conditions and limitations: 1. DESIGN STANDARDS 1. This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. This stormwater system has been approved for the management of stormwater runoff as described in Section 1.9 of this permit. The stormwater controls labeled BMP #1 and BMP #2 have been designed to handle the runoff from 197,065 and 65,340 square feet of built -upon area, respectively. 3. A 50' wide vegetative buffer must be provided and maintained adjacent surface waters, measured horizontally from and perpendicular to the normal pool of impounded structures, the top of bank of both sides of streams and rivers and the mean high water line of tidal waters. 4. A vegetated filter strip is not required for this pond as it has been designed to provide an average annual total suspended solids removal efficiency of 90%. 5. The level spreaders shown on the plans are not required under the stormwater rules and therefore are not considered a part of the approved state stormwater treatment system. These additional measures are incorporated only by reference and are not enforceable parts of the permit. 6. The tract will be limited to the amount of built -upon area indicated in this permit, and per approved plans. The built -upon area for the future development within the drainage areas of BMP's #1 and #2 is limited to 7,877 and 3,414 square feet, respectively. The final plats for the project will be recorded showing all such required easements, in accordance with the approved plans. 8. The runoff from all built -upon area within the permitted drainage area(s) of this project must be directed into the permitted stormwater control system. 9. Classification of Water body C NSW 10. BMP #1 will act in a temporary capacity to receive the truck wash water discharge as per NCG140428. The total additional volume associated with the truck wash operation is based on a maximum water usage of 55 gallons per truck, 15 trucks per day, each making 3 trips per day for a total of 2,475 gallons or 331 cubic feet of additional volume. For purposes of determining the additional wastewater volume over and above the state stormwater design storm of 1.5", a factor of safety of 5 was applied, resulting in a total additional volume of 1,655 cubic feet. The total minimum required storage volume in BMP #1 is below the provided volume of 25,657 cubic feet. ll. SCHEDULE OF COMPLIANCE No truck washing activities shall be allowed during a heavy rainstorm, or immediately after a heavy rainstorm, or during the time that BMP #1 is discharging via the weir set at the temporary pool elevation of 38.0, or during the time that the water level in BMP #1 is rising and is within one inch of going over the temporary pool weir at elevation 38.0. 2. All truck wash water discharges into BMP #1 shall enter the BMP via the forebay. 3. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 4. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. Page 3 of 8 State Stormwater Management Systems Permit No. SW8 130501 5. The permittee shall, at all times, provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The signed and approved Operation and Maintenance Agreement must be followed in its entirety and maintenance must occur at the scheduled intervals. 6. Records of maintenance activities must be kept and made available upon request to authorized personnel of DENR. The records will indicate the date, activity, name of person performing the work and what actions were taken. 7. Decorative spray fountains will be allowed in the stormwater treatment system, subject to the following criteria: a. The fountain must draw its water from less than 2' below the permanent pool surface. b. Separated units, where the nozzle, pump and intake are connected by tubing, may be used only if they draw water from the surface in the deepest part of the pond. c. The falling water from the fountain must be centered in the pond, away from the shoreline. d. The maximum horsepower for a fountain in BMP 1 is 1/6 horsepower. A fountain is not permitted in BMP 2 as the permanent pool volume is less than 30,000 ft3. 8. The facilities shall be constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data on file with and approved by the Division. 9. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 10. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 11. Access to the stormwater facilities for inspection and maintenance shall be maintained via appropriate recorded easements at all times. 12. The permittee shall submit to the Director and" shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Redesign or addition to the approved amount of built -upon area or to the drainage area. C. Further development, subdivision, acquisition, lease or sale of any, all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a LAMA Major permit was sought. d. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 13. Prior to the construction of any permitted future areas shown on the approved plans, the permittee shall submit final site layout and grading plans to the Division for approval. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 15. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. A copy of the approved plans and specifications shall be maintained on file by the Permittee at all times. 16. At the time the permittee ceases operations at this site, the permittee shall restore the permitted BMP's to the permitted design condition. The permittee shall provide written certification to the Division that the BMP's have been restored to design condition and shall request that the Division inspect the restored BMP's. Failure to restore the BMP's to design condition, or failure to request an inspection of the BMP's prior to ceasing operations are considered violations of the permit. III. GENERAL CONDITIONS This permit is not transferable to any person or entity except after notice to and approval by the Director. At least 30 days prior to a change of ownership, or a name change of the permittee or of the project, or a mailing address change, the permittee must submit a completed and signed Name/Ownership Change Form to the Director accompanied by the supporting documentation as listed on the form. The approval of this request will be considered on its merits and may or may not be approved. 2. The permittee is responsible for compliance with all permit conditions until such time as the Director approves the transfer request. Neither the sale of the project in whole or in part, nor the conveyance of common area to a third party constitutes an approved transfer of the stormwater permit. 3. Any individual or entity found to be in noncompliance with the provisions of this storrmwater management permit or the requirements of the Stormwater rules is subject to enforcement procedures as set forth in G.S. 143 Article 21. 4. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. 5. In the event that the facilities fail to perform satisfactorily, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 6. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 7, The permit remains in force and effect until modified, revoked, terminated or renewed. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and re -issuance or termination does not stay any permit condition. 8. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 9. The permittee shall submit a permit renewal request at least 180 days prior to the expiration date of this permit. The renewal request must include the appropriate documentation and the processing fee. All slopes are grassed with permanent vegetation. 9. Vegetated slopes are no steeper than 3:1. 10. The inlets are located per the approved plans and do not cause short-circuiting of the system. 11. The permitted amounts of surface area and/or volume have been provided. 12. Required drawdown devices are correctly sized and located per the approved plans. 13. All required design depths are provided. 14. All required parts of the system are provided, such as a vegetated shelf, and a forebay. 15. The required system dimensions are provided per the approved plans. 16. I recommend that we assume 5 days without rain, so that the 331 cubic feet per day becomes 1,655 cubic feet in 5 days. Adding 1655 to 23550 is 25,205 cubic feet, again, well within the provided volume of 25,657. The methodology to arrive at the additional volume associated with the truck washing operation is correct, however the minimum required volume for BMP #1 reported in the unsealed, undated, recently received Truck Wash Usage Summary, 14,487 cubic feet, is incorrect. The May 1, 2013 design calculations indicate that the minimum required volume for BMP #1 is 23,550 cubic feet. Additionally, the temporary volume provided, 16,988 cubic feet, is incorrect. The May 1, 2013 calculations (and the permit) indicate that the provided volume in BMP #1 is 25,657 cubic feet. If I add 331 cubic feet to 23,550 cubic feet, the new required minimum volume is 23,881 cubic feet. This is still within the pond design parameters, but you should correct the Truck Wash Water Usage Summary calculations you recently provided to reflect accurate numbers. It looks ok. However we will be making a correction to the state stormwater permit to include the info below written by Linda; referring to the NPDES General permit for pond one and adding an 0 & M condition to prohibit truck washing during a heavy rain storm when the pond level is one inch or less from the top of the pond. We will come up with more specific language and/or provide a marked up detail of the outlet structure from the drawings they sent. I think we should account for that daily amount for a total of 5 days. If it doesn't rain for 5 days, during that 5 days, 1,655 cf of volume will have been added to the pond from truck washing. Using that volume, there's still a cushion of 846 cf in the pond, 14487+1655=16142. A total of 16,988 cf has been provided in the pond. If we assume that the minimum volume required and the volume provided in the pond were calculated correctly in the original permit, then everything looks good. I would like to see a condition added to our permit that prohibits truck washing during heavy rain, or when the pond is full and discharging. . Georgette did ask about this when I spoke with her a few weeks ago. I've attached my justification for the design. Essentially, the grading plan resulted in an "extra" 2500 cf of temporary storage in the water quality pool. Based on Wooten's data, and the expected activity in the plant, an average of 330 cf of wash water will be produced. So the wash water will not result in any significant change in the normal water level of the pond, thereby ensuring that there is always sufficient storage for the stromwater. This will, however, result in more frequent small discharges, which will need to be monitored by STW. As you are aware, we no longer perform and engineering review in the NPDES program for industrial wastewater facilities. However, Georgette's request goes to the sufficiency of the BMP under SW8130501 in the state stormwater management program, the 2H .1000 program. Please forward to me the talcs establishing the sufficiency of that engineered BMP. I mean, please send me the calcs showing that BMP 1 has been designed in accordance with the estimated hydraulic loading including the additional flows from ready -mix concrete operations, as per standard state stormwater design requirements in her program. IT make a copy for our files, and forward them to her for her files. If there is something I obviously don't understand, please contact me today. Conversation with Jim Gregson at WiRO [yesterday, July 2" d], my paraphrase: 'If there's wastewater going to their stormwater BMPs, then they're in violation of their State Stormwater permit. They should just get an NPDES wastewater permit for all of it. There was not any mention of commingling in their State SW application, and their calculations don't mention anything about an extra 15,000 gal capacity for wastewater.' Bradley and I agree that the truck wash -down (exterior of vehicles) and aggregate pile spray/runoff—even though wastewater —is unlikely to compromise the ability of the detention ponds to adequately function or treat the runoff. We could make that case to WiRO (Ken, I think you have previous experience on another coastal county concrete site where this was an issue for the RO...), but we are asking more questions of the consultant/applicant because details seemed vague on what was happening with the drum washout water. Conversation with Ryan Fisher today, July 3'd: Me: Thanks for adding the area of the drum washout on the plans and some more detail about the pit. I see the side slopes, but I don't see information on what the depth is exactly? If this stuff is being rinsed out and just sitting there, what kind of storm event would cause an overflow and possibly send this wastewater to the detention pond? [He wasn't sure of exact depth and asked how much detail we were looking for on the plans, but he went on to explain the normal operating procedure ST Wooten uses...] Ryan explained that while other companies routinely use, 200-300 gallons of water for each truck rinse out, ST Wooten doesn't do that. They primarily do their rinses on the job site. Back at the plant, the excess concrete is dumped into the washout pit, some water is sprayed into the drum, and delvo or a similar chemical is added to keep the concrete from setting up over night. Then they just start with that the next day. Meanwhile, the waste concrete (about %Z yard or so) is left to dry in the bermed area; the aggregate is reclaimed; and when it's dried, the waste concrete is moved out to the yard. The company claims little to none of this wastewater will leave the area and go to the pond. But the actual depth of the pit and the amount of trucks doing this per day is not noted anywhere... 1 explained that the WiRO might have some concerns about the stormwater ponds treating some of that wastewater, and while we should be able to work through concerns about the other wastewater areas on site,we are anticipating the need to assure the region that wastewater from drum washout would rarely flow to the BMP(s) on site. [I also pointed out Question 25 for future reference on other state stormwater permitted sites ... where the approval to include WW should be included with our NO1 application; it was overlooked). My intent here was to help him to understand why we are asking for more details on the wash pit when we really don't do ATC reviews anymore. Ryan also said (as he did the first time) that he was sure they mentioned that stormwater and wastewater would be commingled at the site when they met with their Express coordinator (Christine Nelson). He admitted he wasn't sure if the State SW.application indicated it was commingled, though. He says it "didn't seem to be an issue when they met." That's all I can report on that. Jim's review of the application obviously didn't turn up much about it. What else I did to help (hopefully): Maybe not much. To prevent any stormwater from being conveyed to the roadway, we had to design the site to slope from the roadway to the rear of the property. The property also has a state stormwater permit recently issued in May for two stormwater detention ponds (SW8130501). The client is close to beginning operation, and we haven't been able to get to it before now with our workload, so I began the review while Ken Pickle is away. I've requested additional information from the consultant (Ryan Fisher with W&R), and that should be coming in today or tomorrow. I'll be out on Friday, but Ken will be back then, so he may be resuming review at that time. We just wanted to go ahead and get it out to the WiRO for review / request approval for the NOI. Commingled stormwater and wastewater will discharge from the stormwater pond (see application). Ryan explained that they oversized the stormwater BMPs. to handle an additional 15,000 gal of water than needed for the drainage area, as a "safety margin" capacity to handle any extra discharge volumes considered wastewater at this site. The biggest piece of my additional information request is that they show on the plans where the mixing drum washout will take place; right now that's missing. Ryan described that trucks would wash out their drums inside a bermed area near the aggregate bins at the back of the property, and all water would be captured, but I've asked him to provide detail about that on the plans. The "Truck Washdown" noted on the plans is the area where trucks are sprayed down to remove dust from the exterior (not the drum interiors). There isn't any information about how the truck washout and vehicle/equipment cleaning wastewater is being treated, or exactly where that wastewater flows. I see summaries of the stormwater BMP calculations, but I do not see any information about how the volumes of washout waters were taken into account in the design of those detention ponds. Are any of those wastewaters allowed settling time prior to entry into the detention pond? There is not much detail presented on the Truck wash down area in the set of plans. I presume the majority of these wastewaters eventually flow to Stormwater BMP 1, given the drainage area delineation and production area location. The truck washdown rack is for the rinsing of the exterior of the trucks prior to leaving the site and is separate from drum washout area (which is not shown on the plans you received). I will be adding the location of the drum washout area and sending you an updated plan. The drum washout area will utilize berms that will prevent the drum washout material from being conveyed directly to the stormwater BMP and will allow for settling time. The remnants from the drum washout will be removed and disposed of to prevent any material from being conveyed to the BMP. To handle the volume of washout waters at the plant, the design of the stormwater facilities back -calculated and were oversized and are capable of handling much more additional volume (--15,000 gallons) than the stormwater requirements shown on the plans. Question 18 (the wastewater treatment alternatives analysis) notes that there is a sewer connection close by. The 4" sanitary sewer line is shown on the plans near the truck washout area, as well. However, even though Q 18 indicates the WWTP would accept wastewater, this was not being considered because "The site will commingle stormwater and wastewater and will not require connection to the nearby sewer collection system." I'm not sure I understand that response The proposed topography of the site prevented ST Wooten from feasibly sending any wastewater to the sanitary ti sewer network that is located on Burton Park Boulevard. The existing stormwater plan for the industrial park would not allow additional impervious to be conveyed to the roadway drainage network. To prevent any stormwater from being conveyed to the roadway, we had to design the site to slope from the roadway to the rear of the property. This prevented us from conveying any wastewater to the sanitary sewer network as the processing areas are located the farthest from the roadway. Also, what are the provisions the site plans for controlling any pH excursions, or where do they plan to make adjustments if necessary to meet the NCG14 discharge limits? The pH will be monitored closely by onsite staff and will be corrected with CO2. Please give me a call to discuss at your earliest convenience. Georgette did ask about this when I spoke with her a few weeks ago. I've attached my justification for the design. Essentially, the grading plan resulted in an "extra" 2500 cf of temporary storage in the water quality pool. Based on Wooten's data, and the expected activity in the plant, an average of 330 cf of wash water will be produced. So the wash water will not result in any significant change in the normal water level of the pond, thereby ensuring that there is always sufficient storage for the stromwater. This will, however, result in more frequent small discharges, which will need to be monitored by STW. As you are aware, we no longer perform and engineering review in the NPDES program for industrial wastewater facilities. However, Georgette's.request goes to the sufficiency of the BMP under SW8130501 in the state stormwater management program, the 2H.1000 program. Please forward to me the calcs establishing the sufficiency of that engineered BMP. I mean, please send me the calcs showing that BMP 1 has been designed in accordance with the estimated hydraulic loading including the additional flows from ready -mix concrete operations, as per standard state stormwater design requirements in her program. I'll make a copy for our files, and forward them to her for her files. if there is something I obviously don't understand, please contact me today.
