Dear Mr. Godwin:
On December 22, 2008, the Division of Water Quality, Stormwater Permitting Unit received your
Notice of Intent (NOI) to be covered under North Carolina's general permit NCG140000 for your
existing location in Shallotte. Your submittal contained a check for $100, three copies of the NOI
form, three copies of the site location map, and three copies of 8.5"x11" as -built survey by Thomas
& Jones Surveying Company (2 pages). The submittal is significantly deficient, and we are
returning it unprocessed.
The submittal is deficient in the following particulars.
Inadequate design basis. You have applied for a permit to discharge stormwater and
wastewater under our general permit NCG140000, and for an Authorization to Construct
treatment facilities. North Carolina rules require DWQ to conduct an engineering review of
your application. Our key design basis criteria for review for your existing construction are:
Does the application include engineering calculations that predict compliance with the
permit limits (i.e., TSS removal talcs, Settleable Solids removal talcs, pH correction
narrative) for wastewater discharges; or else, does the application include water balance
calculations that show that there will be no discharge of wastewaters from the recycle
system in response to the 25-year, 24-hour storm event? The two criteria are stated in
items 14 and 15 of the NOI that you submitted with the package. The submittal is not
approvable in that it does not identify an approvable design basis, and lacks calculations
showing the proposed treatment system is consistent with either of the two approvable
design bases. Note also that there is no design narrative that tells us specifically how the
stormwater and wastewater flows are generated, collected, conveyed, treated, and
discharged.
2. Inadequate site plan. Please consider that as reviewers, we can't tell from the site plan
whether the measures you are proposing are sufficient, or not, because the drawing does
not present a complete picture of the site for us. The 8.5" x 11" plans provided are illegible,
in part. Specifically: we must know where the wastewater and stormwater discharge
points are - - they're not labeled on the site plan. We must know where the wastewater
flows originate - - the areas' of the site are not labeled so that we can identify where
wastewater originates (for most ready mix sites we need to see the -aggregate piles, the
rinse off stations, the drum wash out stations, the recycle system, the recycle system

you submitted, note that the site plan (check box 6) must provide all of the elements listed
as a through g.
Three (3) sets of full-size plans, details, and calculations are required per the final checklist at
the end of the NOI. AllL plans, calculations, and details must be sealed by a Professional
Engineer or other qualified professional per G.S. 89C-25 (7). If needed, please have your
engineer contact Ken Pickle or myself to discuss any of these items further, 919-807-6300.

In accordance with your application for a discharge permit received on May 29, 2009, we
are forwarding herewith the subject certificate of coverage (COC) to discharge under the subject
state —NPDES general permit. This permit is issued pursuant to the requirements of North
Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina
and the US Environmental Protection Agency dated October 15, 2007 (or as subsequently
amended).
Please be aware that this facility discharges to a stream classified as a High Quality
Water (I-IQW). There are more stringent effluent limits that must be met for process wastewaters
(see Supplemental Effluent Limitations attached). Process wastewaters include drum washout,
wetting of raw material stockpiles, vehicle and equipment cleaning, and recycle system
discharges. If these effluent limits cannot be met by the existing recycle system, then
modifications to the existing recycle system will be required to meet the limits.
Please note that any future construction, installation, or modification of wastewater
treatment facilities (including process wastewater recycle systems) will require an Authorization
to Construct (ATC) prior to construction per 15A NCAC 2H .0138 & .0139. You must submit,
in triplicate, plans/specifications and design calculations, stamped and'sealed by a professional
engineer, with a letter requesting an ATC to the Stormwater Permitting Unit, 1617 Mail Service
Center, Raleigh, NC 27699-1617.
Please take notice that this certificate of coverage is not transferable except after notice to
the Division of Water Quality. The Division of Water Quality may require modification or
revocation and reissuance of the certificate of coverage. This permit does not affect the legal

stormwater): This NOI is also an APPLICATION FOR Authorization to Construct (ATC) wastewater
