Post Office Box 731 Forest City, North Carolina 28043 Dear Mr. Tomblin: June 10, 2002 Subject: NOTICE OF VIOLATION Latco Concrete Products, Inc. COC NCG 140299 Rutherford County On May 28, 2002, staff of the Asheville Regional Office inspected Latco Concrete Products, Inc, for compliance with your general permit. During the inspection the following permit violations were noted: 1) The facility does not have a stormwater pollution prevention plan (SWPPP). This is a permit requirement. Latco Concrete Products, Inc. must have all permit required documentation, plans, and reports on file. 2) Latco Concrete Products representative stated that all vehicle maintenance is preformed off -site. However, areas of soil contaminated petroleum/oil were observed. In the truck fueling area the soil was discolored around the pump. This indicates that petroleum is/was spilled. Measures should be take to prevent petroleum from soaking into the soil. These should be cleaned up as soon as possible and materials used disposed of in as required by the Division of solid Wastes regulations. 3) There were no containers for the disposal of oily/petroleum waste on site. All sampling and analysis must be preformed in accordance with requirements contained in the permit. COC NCG 140299 Rutherford County Dear Mr. Tomblin: In accordance with your application for discharge permit received on August 11, 2000, we are forwarding herewith the subject certificate of coverage to discharge under the subject state - NPDES general permit. This permit is issued 'pursuant to the requirements of North Carolina General Statute 143-215 A and the Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated December 6, 1983. The stormwater permit you are receiving, NCG140000, does not permit wasting concrete, dumping excess concrete, directly into storm sewer outfalls or into waters of the state. Any facility which either dumps excess concrete or washes excess concrete into storm sewers or waters of the state will be operating in direct violation to both the terms of this permit and the North Carolina General Statutes. Such a discharge shall be considered an illegal discharge and may subject the owner to enforcement actions in accordance with North Carolina General Statutes 143-215.6A If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to request an individual permit by submitting an individual permit application. Latco Concrete Company is.required to -have an individual NPDES Permit or a General Permit for Ready Mix Concrete. Enclosed is a Notice of Intent for coverage under the General Permit. Latco Concrete Company, during certain periods of rainfall, has been discharging without a permit wastewaters from truck washing activities to a conveyance to an unnamed tributary to Bracketts Creek. This discharge existed in violation of Section 143-215.1 of the General Statutes of North Carolina. The cited section of the General Statutes prohibits anyone from making any outlets into the waters of the State or operating any disposal system without first having obtained a permit. The existence of the above described, unpermitted discharge subjects the responsible party to enforcement procedures. Section 143-215.6 of the General Statutes of North Carolina details enforcement procedures, which may be implemented. Each day on which a violation occurs constitutes a separate offense for which penalties could be assessed.
