The Stormwater Permitting Program received a National Pollutant Discharge
Elimination System (NPDES) application for the subject facility in our office on August 5,
2014. After a review of the application package, we are requesting additional information
on the following items;
1. The proposed site plan has been permitted as a Law Density project through
our Wilmington Regional Office under State Stormwater Management Permit
No-,SW817.402.107The wastewater discharges were not clearly indicated during
your Low Density Permit application, and are not allowed under this permit.
2. Surface flows from wetting of aggregate in the Aggregate Storage area on the
site plan will flow into a grassed swale untreated. Please indicate the source of
water proposed for this purpose. If the water is from a municipal or drinking
water supply source it is of less concern; however, if the source is from the
proposed recycle system it may be a more significant concern due to the
potential for high pH.
3. Please indicate the truck washout area proposed on the site plan. This area is a
concern because it may contribute to untreated wastewater flows, and may also
cause an increase in your impervious area and will affect the limitations noted
on your State Stormwater Management Permit SW8140210.
4. Your application indicates you are proposing a closed loop recycle system that
meets 15A NCAC 02T .1000. This type of system is permitted through the
Aquifer Protection Section of the Division of Water Resources and must contain

the 25 year 24 hour storm event as required by NC rule in both 15A NCAC 02T
.1003 (a)(2) , and 15A NCAC 02T.1005 (b)(6). The Closed Loop Recycle System
(CLRS) proposed is noted to contain only the seven year storm event. For this
reason, it is not considered a CLRS, but rather a wastewater discharge for the
purpose of our permit. If you are proposing a closed loop recycle system, you
will be required to apply for this permit through the Division of Water
Resources and meet the conditions.
Please be aware that you are responsible for meeting all requirements set forth in
North Carolina rules and regulations. Any oversights that occurred in the review of
the subject application package are still the responsibility of the applicant. In
addition, any omissions made in responding to the above items shall result in
future requests for additional information.

I looked at the site plan that you forwarded. It tells me what I already knew, that the operation drains towards the state
stormwater swale. I did see the notes about the co -mingled stormwater and wastewater on the plans you sent. These
notes were not on the state stormwater plans. I agree with you that it appears they are going to have a unpermitted
wastewater discharge.

After a review and discussion with Ken Pickle, we decided you may be interested in looking at the site plan that was
submitted as part of the NPDES stormwater permit.
I am sending a copy to you through inter -office mail. You should get it by Tuesday.
We think you were absolutely justified in your concern. Specifically, look at the hand written notes identifying the outfall
locations. Were they on the plan when you issued SW8140210?
It appears to us there will be an untreated wastewater discharge.
Also on the NOI the closed loop system he notes, does not meet the 2T requirements, and no permit has been applied
for.

Larry,
Yes we did issue a state stormwater permit for this site. The one concern I have is that we approved this as a low
density. The swales direct stormwater to the wetlands and this is located near SA waters. How are they proposing to
keep the process wastewater out of our swales?
These Ready Mix sites are notorious for allowing wastewater to drain into our swales or ponds and overflowing into the
wetlands and streams. I would like to know what their pollution prevention plan says for the prevention of this.

This is in response to the letter received on February 1, 2010 concerning the storm water
inspection of the Morehead Facility:
1) Stormwater Pollution Prevention Plan SPPP
The SPPP has been reviewed and a plan has been developed to address deficiencies that
were discovered. The site map has been modified to show additional Stormwater outfalls
identified during the inspection. The annual certification for addressing any potential
illicit discharges will be completed after the identified deficiencies have been corredted.
2) Ounlitative Monitories
Qualitative monitoring will be conducted at all identified outfalls.
3) Analytical Monitoring
Analytical monitoring will be conducted at all identified outfalls.
4) Other Observations:
Settling basins will be constructed to ensure adequate treatment prior to discharge for the
two outfalls identified during the inspection, located on the South side of the property.
The heavy sediment that was observed in the receiving ditch from the two outfalls located
on the south side of the property will be removed. Weather permitting; corrections will be
completed by March 1, 2010.

Dear Mr. Wells:
On January 20, 2010, Linda Willis with the Wilmington Regional Office of the Division of
Water Quality, conducted a site inspection at the Morehead Plant #14 located off Highway 70 in
Morehead City, Carteret County, North Carolina. Ms. Willis met with Mr. Millis, who was very
cooperative and helpful during the site inspection. She also spoke with Hank Gay to discuss her
concerns. Ms. Willis has indicated that many of the S&W Ready Mix Concrete Company, Inc. facilities
in the Wilmington Region are maintaining their sites in significant compliance with the NPDES Permits.
This site is an old facility that had not been adequately designed to handle all of the issues related to the
site's stormwater runoff. This facility drains to Hull Swamp, a Class C Water of the State, located in the
White Oak River Basin.
Accordingly, the following observations and/or permit conditions violations were noted during
the Division of Water Quality inspection:
1) Stormwater Pollution Prevention Plan (SPPP)
A Stormwater Pollution Prevention Plan (SPPP) has been developed, recorded, and properly
implemented, however, there are some deficiencies that need to be addressed. The SPPP requires an
annual review of the plan to determine whether improvements can be made to address the quality of the
discharges from the site. The site map does not have all storm water/wastewat er outfalls identified. An
annual certification is required addressing any potential illicit discharges from the facility.

Qualitative monitoring has been conducted and recorded for one of the three outfalls on the site. In
accordance with permit requirements, all three outfalls must be monitored.
3) Analytical Monitoring
Analytical monitoring has been conducted and recorded for one of the three outfalls on the site. in
accordance with permit requirements, all three outfalls must be monitored.
Other Observations:
The two discharges from the south side of the property convey wastewater from the drum mixer washout
as well as stormwater runoff. There is no treatment provided for these discharges and there is evidence
in the receiving ditch that a significant amount of sediment including cement fines were present. The
discharges from this site must be of sufficient quality to meet the NPDES Permit limitations. Be
advised; the turbidity standard for receiving waters classified as "Class C" waters of the State is 50
Nephelometric Turbidity Units (NTU)_
Requested Response
Please provide in writing to this office, within 30 business days, the actions that will be taken to ensure
the discharges from this site have adequate treatment prior to discharge. Also indicate how you will
resolve the deficiencies in the Stormwater Pollution Prevention Plan and stormwater/wastewater
monitoring.
Thank you for your attention to this platter. This office requires that the violations, as detailed above,
be properly resolved. These violations and any future violations are subject to a civil penalty
assessment of up to $25,000.00 per day for each violation. Should you have any questions regarding

settling basins exist to provide settling prior to discharge. Heavy sediment is seen in the
discharge outfalls and receiving ditch from two outfalls located on the south side of the
property. Settling basins should be provided to ensure adequate treatment prior to
discharge. A settling pond is located on the soutwest side of the property. Ditches
along the north side,of the property discharge to the pond.

property. Settling basins should be provided to ensure adequate treatment prior to
discharge. A settling pond is located on the soutwest side of the property. Ditches
along the north side of the property discharge to the pond.
