Inspection Summary:
On November 20, 2018 this facility was inspected concerning a newly assembled SWPPP. I met with Ben Lail on site.
During the inspection, the following items were noted;
1) The SWPPP could use some elaboration in some areas, but the essential elements are there.
2) The site map was Inaccurate with respect to the stormwater basins at the rear of the facility. The map will be revised to
accurately reflect the conditions on site.
3) Secondary containment has been constructed around the add/mix tanks.
4) Some off -site deposition was noted next to the larger basin. The permittee Is directed to evaluate and correct the indutrial
process in that area to eliminate the potential for waste concrete buildup outside of the constructed stormwater control
measures.

I checked our files, but I couldn't find am a p of the facility showing the outfall. I did talk to someone in our Asheville
Regional Office. In 2012, she issued a Notice of Violation to Hamby Brothers for failing to do the required analytical
monitoring as well as failing to comply with other aspects of the facility's stormwater permit. At that time, she was
working with Betty Smith and Randall Hamby. Mr. Hamby should understand what needs to be done with your permit
and where to find a copy of it in your files.
As far as the renewal letter you received from us recently, you'll need someone to determine the GPS coordinates for
your stormwater outfall and enter it into our online database. From our file, it appears you have just one outfall.
Something you could consider is hiring an environmental consulting company to assist you with complying with your
permit. Many industrial facilities use a company to map their outfalls, do their sampling, write their stormwater
pollution prevention plan, and make sure you're keeping up with data reporting requirements. Failing to comply with
your permit can result in enforcement action and civil penalties.
Someone from our Regional Office (Jean Conway or Stan Aiken) may be in touch with you regarding your permit. In the
meantime, you can take a look at the attached General Permit which does apply to this facility. It describes the
analytical monitoring requirements as well as other requirements. One very important thing is that the facility must be
doing quarterly sampling at its outfall after a rain event. The samples must be sent to a laboratory to analyze, then the
results get reported to us.

1) No SWPPP was available on site. Daniel Tester has said that the facility will be having a SWPPP put together and
implemented soon.
2) Secondary containment is required for the add/mix storage area. Daniel Tester says that they will be lookng into the best
way to meet compliance in that area.
3) The area of the site that stormwater is leaving in a concentrated flow is allowing untreated water to leave. The facility is
directed to design and implement stormwater detention and treatment BMPs.
This site will be re -inspected on or after October 16, 2018. If the above items are not addressed, further action will be taken

Inspection Summary:
On August 7, 2018 this facility was visited to perform an inspected for compliance. I met with Randall Hamby on site. Durin
gthe inspection, the following was noted.
1) A SWPPP could not be produced on site, and Mr. Hamby indicated that none existed to his knowledge, nor had any
monitoring been done.
A follow up inspection will be performed on August 21, 201S. Please have. all documentation required to be in your SWPPP
available, and try to take and send at least one set of samples off for analysis.

On August 7, 2018 this facility was visited to perform an inspected for compliance. I met with Randall Hamby on site. burin
gthe inspection, the following was noted.
1) A SWPPP could not be produced on site, and Mr. Hamby indicated that none existed to his knowledge, nor had any
monitoring been done.
A follow up inspection will be performed on August 21, 2018. Please have all documentation required to be in your SWPPP
available, and try to take and send at least one set of samples off for analysis.

Hi Melissa,
Linda forwarded me this email string from 2015 regarding NCG140097. I got a call yesterday from this facility (not the
owner -- I think an administrative person). They were asking questions about the renewal letter we sent out to all the
NCG14 facilities. Basically, the person I spoke to didn't know anything about their permit and didn't even know where
to find their permit. It also appears they haven't done any monitoring since 2011, not even after they were issued an
NOV in 2012 by Linda.
Is this facility in your area? If so, is it one you could put on your list of facilities to visit soon? I don't think we need to
spend much more time trying to hold their hands to comply -the owner is aware of what he needs to do. Linda spent a
iot of time going back and forth helping them with their SPPP and other things. Some of those documents are on your
shared drive (which I can't access).
The 2012 NOV would still be in force, I think. Not sure if we would rather issue a new NOV or pick up where we left off
in 2012? Either way, I think this site needs some attention. They had high pH levels based on Linda's readings, and
they're located very close to a receiving water.

It did take some brain fog clearing, but I now have some recollection. I did an inspection in 2010 as noted in the file and
BIMs which I played nice with them on even trough they were not compliant. So when I went back in 2012 and they still
were not compliant I issued them a NOV. In the electronic file the "hamby.pfd" is the only sampling document they ever
could produce for me, so again the NOV.
Here is the problem with the follow up, I sent the 2012 NOV in August and took the wastewater position I am currently
in the following month. Therefore, I did not follow up on this facility and if there is nothing in any of the files then
apparently no one did. If Raleigh has not received any data from this site, regardless of whether or not we followed up,
this site remains in violation. I had to do a lot of hand holding with Mr. Hamby and his folks, so once I left if no one
carried that "coddle" then I doubt they have come into compliance on several fronts.
Ask Raleigh if they have received any data from this site (we use to access to a database, but I am not sure if that still
exists), let them know what I said and that ARO will do a follow up inspection soon. I can go with whomever wants to go
to this site since I have a history. Who in Raleigh is asking?

Per your request I've been down to DWR Central Files. Diane Rodman went through what they have. I can report as
follows:
• 2012: inconclusive about whether the permittee turned in DMRs, since the 2012 stuff has been archived off site.
• 2013: other 2013 materials are still on site: No DMRs for NCG140097.
2014: other 2014 materials are still on site: No DMRs for NCG140097.
• 2015: other 2015 materials are still on site: No DMRS for NCG140097 yet in 2015.
My check of BIMS provides no other clues about DMR submittals (not that it necessarily would.)
SPP skeleton working file for NCG140097 does not have any DMRs (not that it necessarily would.)
SPP stacks of incoming and in -process DMRs in Laura's office and Bradley's office do not contain any from
NCG140097. Note: our processing of incoming DMRs is being handled by Bradley and Laura, and neither one is in the
office today. However, l think it's pretty safe to conclude that we have nothing from these folks that might be in process
at the moment.
You reported earlier that despite the 2012 NOV direction to send DMR's into ARO, there are none. We don't have any
either. Whether any were submitted in 2012 is unknown.
Summary: looks like they have sent us nothing in 2013, 2014, and nothing vet in 2015.

Inspection Summary:
Met with Randall Hamby, James Triplett and Mel Skinner. Mel walked the site with me and Crystal took notes to relay to
Jenny Anders in office. Appoximately 1" of rain had fallen that morning.
Sampling data has not been produced for inspector. It could not be found during inspection and a request via email on
8l2112 has not received a response.
The site has comingled stormwater (SW) and wastewater (WW) and should have been performing quarterly sampling. Th
facility will have to institute monthly monitoring for paratmeters listed in Table 7.
pH readings were obtained during the inspection are as follows:
Truck washflow area pH=11.2 s.u,
Bermed Pit pH=11.4 s.u.
Grass pitlswale pH=10.6
pH will likely have to be reduced prior to discharge to meet benchmark. The facility needs to purchase a pH meter. pH
reading are to be obtained immediately; in -situ.
The bermed containment area is along side of the grass swalelpond area. On the day of the inspection the bermed
containment area appeared to be receiving most of the water from the site. Water was flowing through the berm towards'
grass area. It would be better if the berm was properly constructed with a rock weir to allow for a controlled release as
oppose to a funneling through the berm.
Because the area between the facilities treatment area and the receiving stream is overgrown, it was not determined if th,
berm is also directly discharging to the stream. The facility will have to determine this. The berm should not be discharge
into the receiving stream.

In accordance with your application for a stormwater discharge permit received on , we are forwarding
herewith the subject certificate of coverage to discharge under the subject state - NPDES general permit. This
permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the Memorandum
of Agreement between North Carolina and the US Environmental Protection agency dated December 6, 1983.
The stormwater permit you are receiving, NCG 140000, does not permit wasting concrete, dumping excess
concrete, directly into storm sewer outfalls or into waters of the state. Any facility which either dumps excess
concrete or washes excess concrete into storm sewers or waters of the state will be operating in direct violation to
both the terms of this permit and the North Carolina General Statutes. Such a discharge shall be considered an
illegal discharge and may subject the owner to enforcement actions in accordance with North Carolina General
Statutes 143-215.6A
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to
you, you have the right to request an individual permit by submitting an individual permit application. Unless
such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division of
Environmental Management. The Division of Environmental Management may require modification or revocation
and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Environmental Management or permits required by the Division of Land Resources, Coastal Area
Management Act or any other Federal or Local governmental permit that may be required.

and IV of General Permit No. NCGI40000 as attached.
This Certificate of Coverage shall become effective March 31, 1995.
This Certificate of Coverage shall remain in effect for the duration of the General Permit.
