As a matter of fasct, it is in our batch of letters going out later today/ I51 thing tomorrow. This batch will catch us up on all permits that are expired without renewal, but whose permittees are still paying. (The notification part, at least. We'll have to follow this mail -out with either inactivation of their permits in BIMS for those that don't respond, or processing renewals if they wish to remain active.) In the future, I think we've proposed that a process be put in place that will include a batch update of BIMS permit status to expired/ inactive so that billing cannot continue for expired permits. Up until now we've been bad about holding permittees accountable forjust "not renewing" their permit for years and years. Present at the inspection were Marc Stokes (NCDENR), Melanie Bruton (Interim MRF Superintendent), Roger Trent (MRF Supervisor) and Richard McMillan, P.E. (Assistant Director). During this inspection, a review of the City's documentation took place along with a field inspection in and around the facility and the two (2) stormwater outlets. Copies of the Stormwater Pollution Prevention Plan (SWPPP) (October 2004) were readily available and reviewed. After reviewing the requirements of the permit, discussions took place about the lack of visual inspection documentation of the stormwater outfall as required. Further discussions took place concerning the SWPPP, lack of training, housekeeping inspections, and compliance. On February 24, 2009, the City received a Notice of Violation (NOV) dated February 20, 2000, from NCDENR-DWQ. The three (3) items cited in the NOV that were found to be out of compliance were: • Stormwater Pollution Prevention Plan (SWPPP) developed in 2003 contains requirements that were not being fully implemented or amended. • Employee training on an annual basis had not been performed or documented. • Regular bi-annual Qualitative Monitoring of the two stormwater outfalls had not been completed or documented. To remedy these NOV issues, the City of High Point has and/or in the process of performing the following actions: Full Implementation of the SWPPP: City staff is reviewing the entire SWPPP to determine what activities are still relevant and will make the appropriate amendments. Certain activities are no longer being performed at the MRF (i.e.: MRF no longer stores drums of oil at the facility). Activities such as annual housekeeping and equipment inspections were not being performed and documented. The City will begin performing the appropriate inspections and documenting the results. Employee Training: Training had not been performed since the implementation of the SWPPP in 2003. The City will train required employees on an annual basis for housekeeping, spill response/cleanup procedures, and preventative maintenance activities. A record will be kept as documentation of the training and what individuals were trained. Positions to be included in the training will likely comprise of equipment operators, baler operators, mechanic, and supervisors. Qualitative Monitoring: Bi-annual qualitative monitoring has not been performed as required by our permit. The only record of an outfall inspection was 30 MAR 06. The City will perform qualitative monitoring as required by the permit on a bi-annual basis. One inspection will be performed between Jan -June and another between July -Dec, with a minimum of 60 days between inspections as required by the permit. The appropriate form (FORM 5) will be filled out and kept as part of our records. We appreciate your staff spending time with High Point's staff to discuss the requirements of this general permit. There is one building on site that has varying levels depending on operations. The facility operates on a four day, 10 hours per day schedule with 24 personnel. The facility has two storm water discharge locations. Outside of the building there exists a covered, diked diesel tank and several areas of open storage. 3. Storm water Pollution Prevention Plan A plan was developed in 2003 that contains the required items but has not been fully implemented. This is a violation of, o�OC. The certification requirement concerning evaluation of outfalls for non-stormwater discharges was missing. This is a violation of your COC. This permit expires on April 30, 2008. The Division staff is currently in the process of renewing this permit. When a draft is available for notice and public comment, it will be posted on our website at http://h2o.enr.state.nc.us/su/publicnotice.htm. Once the permit is reissued, your facility would be eligible for continued coverage under the reissued permit. To assure consideration for continued coverage under the general permit, you must apply to the Division of Water Quality (DWQ) for renewal of your permit. Letters confirming our receipt of the completed application will not be sent. Failure to request renewal within the time period specified may result in a civil assessment of at least $250.00. Larger penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your facility without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and could result in assessments of civil penalties of up to $25,000 per day. "No exposure exclusion" is now available to industrial facilities in any of the categories of "storm water discharges associated with industrial activity," (except construction activities). If you feel your facility can certify a condition of "no exposure", i.e. the facility industrial materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion.
