I have attached an NOI and Map for this permit application. This one is a little strange because the used to be covered
under NCG120075, but did not come in for renewal. They kept paying the fees for a while, but then the permit was
inactivated because they didn't respond. Ken had some email correspondence with their consultant on this back in
2013. 1 can forward that to you if you want to see it. They are reapplying for coverage now. Not sure why it took two
years for them to get the NOI in?

Please take look and let me know if we can go ahead with issuance of the permit.

Thanks for your call today.
OK, here's the deal with Kersey Valley Landfill.
• Permittee/DWQfailed to renew NCG120075 way back in the 2007 renewal cycle.
• Consequently our renewal activities in 2012 did not pick up this expired/inactive permit. No renewal letter was issued
to them in 2012, and of course there was no response from them, and consequently we did not re -issue the COC in
2012. (just like we didn't reissue the COC in 2007.)
• We are constrained by EPA Region IV requirements on the reissuance of permits that have expired in this way. We must
now issue a new COC to these folks.
• The best way for us to do that with minimum administrative time investment is for Hiph Point to submit a new NOI,
which will result in a new COC number. So, unfortunately, they need to submit a new NOL Fortunately, given our
understanding that this is essentially just a continuation of previously existing permit coverage for this site, we will be
able to process that new NOI quickly.

Thanks for your call today.
OK, here's the deal with Kersey Valley Landfill.
+ Permittee/DWQ failed to renew NCG120075 way back in the 2007 renewal cycle.
Consequently our renewal activities in 2012 did not pick up this expired/inactive permit. No renewal letter was
issued to them in 2012, and of course there was no response from them, and consequently we did not re -issue
the COC in 2012. (Just like we didn't reissue the COC in 2007.)
• We are constrained by EPA Region IV requirements on the reissuance of permits that have expired in this way.
We must now issue a new COC to these folks.
• The best way for us to do that with minimum administrative time investment is for Huh Point to submit a new
NOI, which will result in a new COC number. So, unfortunately, they need to submit a new NOI. Fortunately,
given our understanding that this is essentially just a continuation of previously existing permit coverage for this
site, we will be able to process that new NOI quickly.

No letter produced because the permit expired in 2007. They didn't renew last time. The permit is inactive and with our
connection now to a new EPA database they don't like for us to reactivate inactive permits. So, they will end up getting
a new permit number instead of having this one reinstated. I think the best approach would just be to have them send
in a new NOI with a cover letter that explains their situation.

It recently came to the Division's attention that the compliance schedule in the NCG120000 permit is
incorrect. The compliance refers to requiring a Stormwater Pollution Prevention Plan which is not a
requirement of this permit. The corrected compliance language that should go under Part Ill, Section A: 1. is
shown below. We have also attached a new page reflecting this change for your permit file (Part III page 1 of
11). This new page should replace the current page in your permit.
SECTION A: COMPLIANCE AND LIABILITY
Compliance Schedule
The permittee shall comply with the permit in accordance with the following schedule:
Existing Facilities: Upon the effective date of the Certificate of Coverage the permittee shall comply
with all of the conditions detailed in Part II, Section A: Final Limitations and Controls for Stormwater
Discharges.
New Facilities: Upon the beginning of discharges from the operation of the industrial activity the
permittee shall compty with all conditions detailed in Part II, Section A: Final Limitations and Controls
for Stormwater Discharges.
