Dear Ms. King;
Please accept this letter and attachments in response to the above referenced Compliance Inspection conducted at
the Macon County MSW Landfill on October 6, 2016. The Solid Waste Department has thoroughly reviewed the
comments made during this inspection, as well as the Department's stormwater management facilities and
records/record keeping requirements. We have addressed many of the Items listed in your correspondence of
October 28, 2016, and in the enclosed Compliance Inspection Report (Attachment 1). Details on these Items are
listed below.
Regarding Items that have not been addressed at this time; these Items generally fall in one of two categories:
First, while researching Permit Conditions for guidance on compliance, we discovered that a Storm Water
Pollution Prevention Plan (SWPPP) is not a condition of the general permit NCG 120000. To wit. -many of the
deficiencies noted are difficult to address as they relate to the SWPPP. This certainly does not mean that these
deficiencies were/are ignored; as will be detailed below. Second, a large portion of the MSW Landfill facility is
under construction related to the development of Phase III of the Landfill. In consultation with our Consultants,
we believe ultimate resolution of these Items will be more properly addressed in the coming months as a Permit
Amendment will be submitted in the next few months, as construction is completed.
Items to be addressed on or before March 31. 2017:
1. A Certificate of Coverage must be available at the site. As discussed during the inspection, a request has been
made to NCDEQ Stormwater Permitting for a copy to be sent to you;
Certificate of Coverage forwarded to the Macon County Solid it"aste Department from NC DEQ —Stormwater
Permitting. The Cerfijicate of Coverage has been added to the Stormwater files and will be maintained at the
site at all tunes.
2. An approvable Storm Water Pollution Prevention Plan, specific to the site, must be developed. Recall the EPA
has a template on its website that might be of use;
A StormWater Pollution Prevention Plan (SWPPP) has not been developed. In development of this response
and compliance with Permit Conditions, it was discovered that an S1,VPPP is not required for this permit.
However, many components of a Plan were individually noted in the Compliance Inspection Form.
Deficiencies noted on that Form are addressed in more detail in Attachment 2.
3. Significant spills occurring during the past three years must be documented and available for review;

An accidental Spills Log has been developed for the site and incorporated into the Storinwater files. A copy of
this Log is provided in Attachment 3. To date, there has only been one such Spill at the site that was not
recorded. This spill was reported to the Division of Water Resources immediately. DTVR responded that, due
to the small amount of material spilled, reporting was not required. Immediate actions were taken to clean up
the spill, including removal and disposal of the contaminated soils in the landfill; applying absorbent "booms "
to on area between the spill and an adjacent creek; and using absorbent mats to remove as much of the
contaminant as possible from taller vegetation. Future spills, if and when they occur, will be logged and
reported if necessary.
Employee training must be conducted and documented for review;
Employees have been trained on operation issues regarding proper stormwater management. This training
includes operational practices to minimize erosion and impact on stormwater quality; inspection ofslormwater
management controls; and, spill response. Historically, a record of these trainings has not been maintained.
As mentioned above, the MSW Landfill is currently under construction of a new Phase. Once completed, an
amended Operations Plan, which incorporates new stormwater controls and management areas will he
submitted to the Solid Waste Section in the request fora Permit to Operate. Tlie new Plciii ii�ill be a trigger for
additional training of operators at the site. This training will be verified and recorded in the Stormwater files.
Additionally, Macon County Solid Waste has added a position of Environmental Field Specialist to the staff
(me). Trainings andlor Certifications in Stortnwater Management will be a focus of this position.
5. Qualitative and analytical monitoring. requirements must be followed and documented; and,
The Solid Waste Department takes all measures possible to be in compliance with the Qualitative and
Analytical Monitoring Requirements. A more detailed description of these efforts is offered in Attachment 2. It
is noted however, that semi-annual sampling of stormwater discharge fr'onr a representative rain event was not
conducted during the July -December period. This is due to the site experiencing no rain events during the
months of July-Seplember, 2016 Three rain events (whether qualifying or trot) occurred during the final
quarter of 2016. Inspections revealed, however, that no flow was witnessed from Outfalls 1, 2, or 3 during any
of these rain events. Outfall 5 is in the La ndfril Construction area, and has been removed and diverted to a
new location that will appear in the amended Plan referenced above. Outfall 4 is also in the construction zone
and could not be accessed to determine flow. Weekly monitoring of outfall locations continue at the site, and
sampling will be performed cat Clue first opportunity.
6. All outfalls should be reviewed to determine which ones accurately reflect stormwater discharges at the site.
The above mentioned amended Plan will incorporate a review of existing outfalls at the site.
In conclusion, the Solid Waste Department believes that. the deficiencies noted in the Compliance Inspection Form
and subsequent report, have been; are being: or will be addressed, per the explanations above. We would request
that the DLQ review this submittal for responsiveness regarding actions to this point, and grant an extension for
compliance with remaining deficiencies described, that will be addressed in the forthcoming amended Operations

Detailed Response to Routine Compliance Inspection
Section A: Storm Water Pollution Prevention Plan
Item 2 below, details the justification for the MSW Landfill to not create an SWPPP
for this site. However, as you will find in additional Items listed below, an effort to
address the provisions of an SWPPP have been addressed individually.
1. Is a copy of the permit and the Certificate of Coverage available at the site?
Inspection Response: Have a copy of the permit, but do not have a copy of Certificate of Coverage.
The permit was available on site at the time of the inspection and a copy of the Cerlificote of Coverage is now on file
at this facility.
2. Is a cope of the signed and certified SWPPP at the facility?
Inspection Response: No
An SJJ'PPP is not on site. According to our findings, an SIYPPP is not a condition of permit NCG120000. Additional
support for this position seas found in a document: Response to Comments on AICG120000 dated October 30, 2012
by the DIYQ. lVithin Itenr 14 of this document, one commenter requested that the permit scope be expanded to
include requirements for good housekeeping, training, spill response, and the other elements common to the
Stor»nvaler Polhtlion Prevention Plan (SPPP) required under other stormtivater discharge General Permits.
The D[i'Q Response: "Since 1992, DWQ has relied on the similar elements in the 011;1Iregidrentents as to the site
engineering plan and operational procedures for their landfill permittees. J6e continue to Wew an additional
requirement far a SPPP as largely redundant. Until and unless ive become cnvare of significant problems in this

A copy of the Permit to Operate (957-03) issued by DIVAI, and accompanying Operations Plan and Site Engineering
Plan for this facility are located on site and available for review.
3. Does the Plan include a "Narrative Description of Practices"?

A description of the facility's practices is located in the Operations Plan of the Permit issued by O)VAl.
4. Does the plan include a general location (USCS) map?
Inspection Response: No

Any needed repairs with regard to leaking f]ttids.f oir equipment crre addressed quickly. However, generally till
equipment is operated in the lanc f Il or inside of on site structures. As such, leaks or spills occurring in these
facilities would not escape to outfalls or surface waters.
8. Does the plan include a Stormwater Facility Inspection Program?
Inspection Response: No
An inspection of each oulfall and its drainage area is conducted weekly and documented in a Qualitative Monitoring
Fornr. These Fornis are maintained on site at all bites, and are available for review. An amended copy of this
Form, cis requested, is included at Attachment 2C.
Does the Plan include a BMP Summary?
Inspection Response. No
We do not maintain this document in our program. h formation regarding B,IIP's would be incorporated in the
facility Operations Plan.
10. Does the Plan include a list of Responsible Parties?
Inspection Response: No
Responsible parties will be the Environmental Field Specialist, and the Facility Director.
11. Has the SWPPP been implemented?
Inspection Response: No
As in Item 2, ive do not find any evidence that a SFPPPP is required to be in compliance with this permit. The
Seditrew and Erosion Control Plan mentioned in the permit is located on site and has been implemented
Section B: Monitoring and -Records
1. Does the plan include a list of significant spills occurring during the past 3 years?
Inspection Response: No, 1 spill- hydraulic fluid in pond
A Spill Log has been created and the use of the Log implemented at the site. As noted above, only one spill occurred
at the site, which was not logged at the titre of the spill.
2. Does the facility provide and document employee training?
Inspection Response: No
An Environmental Field .Specialist has been hired and will be the lead on this program. Both internal and external
training is and will retrain an importantAnction of this position. Should any issues arise in the interim, DEQ and
the local Erosion Planning and Development Department will be contacted for guidance.
Has the facility conducted its Qualitative Monitoring? (semi-annual)
Inspection Response: Yes, form needs to be updated
The Qualitative Alonitoringform has been updated: See Section A: Rein 8, above.
4. Has the facility conducted its Analytical Monitoring? (s-a)
Inspection Response. Yes, no rainfall event this year
The site did not have a qualifying rainfall event in 2016. Limitations on scinipling of oiitfalls due to hold -time
requirements on some samples (5 hours for Decal), and lack of f oiv from various outfalls during qual firng rain
events have been noted repeatedly, and made it impossible to collect samples a1 the site during 2016 Sampling will
be performed during the next rain event possible, even if the event is a non-qualifj,ing rain event.
5. Is the facility meeting all permit specified benchmark goals?
Inspection Response: No, not with Fecal
It'e have been in compliance ►with COD and TSS and have taken measures, ivhen we have had an exceedance, to
make improvements per the Tiered Response outlined in the permit. Records of these responses are on file at the
facility.
In regards to Decal Coliform, ive are unable to imeel this parameter. The exceedance in this parameter seems to be
an industry ivide issue. In fact, it is dcult to reason hoiv any solid ivaste landfill is able to meet compliance. The
exceedances are reasoned to result from birds and other wildlife residing at or near the facility. Il is not believed
that they are clue to operational processes or direct influence fr-oni the landfill. This is evidenced by similar bacterial
levels reported in samples for which the out/all charging area is not under the influence of the landfill as those that
inav be influenced by the landfill. The Solid Waste Deparintent has researched and observed vciirious products and
processes aimed at bird control and have concluded none of these provide effective mitigation over time.
Specifically, the use of predatoij, decoys ivas attempted several years ago. In a short period of dine, the other birds
became used to their presence, and ignored them (or roosted on them). Also considered ivere, the use of loud noises
such as a boom canon. This deterrent was not explored f u Cher at this facility chie to potential complaints fi•onr
residential neighbors; and, a firing range is adjacent to the facility and does not seem to deter their presence. Also
considered ivas the use offalcons and wire or spiked barriers. Anecdotal evickmce, however, indicates that neither
of these is more than temporarily effective as deterrents.
6. Is the facility following the tiered response?
Inspection Response: No, not with fecal
As detailed above, )ve have attempted researched and/or observed different deterrents for the bird issue at this
facility and have concluded these processes and products are either not suitable at this .site or are ineffective In the
long term.
As such, it is believed that there is no 13,1/P or other process available to the Department that 7vould assist in
mitigation of these exceedances, and no additional actions toward addressing the same are contemplated
Additional guidance or lechnical assistance from Land Ouality is certainly welcomed. At this time, however, we
ivould request that a variance eliminating the benchmark and response requirements with regards to mccrinnim
containment levels for fecal analysis.
Section C: Waste Management
1. Does the facility provide all necessary secondary containment?
Inspection Response: N/A, all tanks are covered
All bulk liquid storage tanks, with one exception, are covered and provide secondary containment as a preventative
and housekeeping measure. A small diesel fitel tank (100-gallons) located at the Recycling Processing Center has
been relocated outside of the building cis a safety precaution. This tank aloes include secondary containment, and a
shed roof over the area will he constructed as soon as possible.
Section D: outfalls
1. Were all outfalls observed during the inspection?
Inspection Response: left blank
A portion of the ou falls ivere visually inspected at the site. As referenced repeatedly throughout this report, a new
site sampling plain and oulfall evaluation is anticipated shady due to expansion and development of Phase 111.

This letter is sent as notification that the MSW Landfill, COC NCG 120083, was not able to
collect stormwater samples for Period 1, 2015. Period 2, 2014, samples were collected in late
December, eliminating January and February from qualifying events. In March, it rained almost
daily, making; it impossible to collect samples because of the 72 hour storm event requirement.
April; May and June were unusually dry months, and all rain events that did occur were
unsuitable for a sampling event due to day of week; time of day (5 hour hold time for bacteria
saniples); or no flow at the outfalls. We did attempt to take samples on July 2, 2015, as we did
have a rain event of 0.9 inches. However. we had no flow at four of our sampling points during
that event. We experienced 1.4 inches of rain on July 3`d, but again, we did not have the 72 hour
period since the last rain event.
Therefore, it is my intention to take stormwater samples as soon as possible for Period 1, 2015;
and take a second set of samples later in the year for Period 2, 2015. 1 regret that we were unable
to obtain samples during the required time period and would reiterate that lack of sampling was
not due to lack of effort or intention, but was simply a product of not experiencing a qualifying
rain event within the short window of time each weekday that would allow us to forward them to
our lab within the permitted hold times. Weekly inspection of our stormwater control systems
have continued as required during this time period.

In response to your renewal application for continued coverage under stormwater General Permit NCG120000
the Division of Water Quality (DWQ) is forwarding herewith the reissued General Permit. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October
15, 2007 (or as subsequently amended).
The following information is included with your permit package:
• A new Certificate of Coverage (COC)
• A copy of General Permit NCG120000
• A copy of the Technical Bulletin for the General Permit
• Two copies of the Discharge Monitoring Report (DMR) Form
• Two copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge
controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself
with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the
permit to update your current SPPP to reflect all new permit requirements.
The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable
storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable,
report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part it of your
permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this
permit and do not count prior exceedances.
The more significant changes in the General Permit since your last CDC was issued are noted either in the
Draft Permit Fact Sheet that accompanied the public notice (http://portal.ncdenr.org/web/wq/ws/su/current-
notices), or in the Response to Comments / Summary of Changes and Technical Bulletin documents that are
posted on the Stormwater Permitting Unit's website with the new General Permit. Please visit

Some of the changes include:
Part II:
• Section A: The Stormwater Pollution Prevention Plan (SPPP) section, if applicable, has been updated
to the most current language of our permits. Additional conditions for specific industry sectors have
been added to the SPPP requirements in some cases.
• Sections B, C: Failure to perform analytical stormwater monitoring may result in the Division requiring
that the permittee begin a monthly sampling scheme.
• Sections B, C: A lower TSS benchmark of 50 mg/I for HQW, ORW, PNA and Tr Waters applies to these
more sensitive waters.
• Sections B, C. The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter
Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other
analytical monitoring requirements.
• Sections B, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in
separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined
in the "Definitions" section of the permit.
• Sections B, C. The term "Representative Storm Event" has been replaced by "Measurable Storm
Event." A measurable storm event is defined in the permit.
• Section D: If the permittee fails to respond effectively to problems identified by qualitative
monitoring, DWQ may require the permittee to perform corrective action.
Please review Parts III and IV to understand the Standard Conditions of your new NPDES General Permit,
including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and
Maintenance obligations; and Definitions. Please note that all samples analyzed in accordance with the terms
of this permit must be submitted to the Division on Discharge Monitoring Report (DMR) forms available on
the Stormwater Permitting Unit's website above. DMR forms must be delivered to the Division no later than
30 days from the date the facility receives the sampling results from the laboratory. Also note that existing
permittees do not need to submit a renewal request prior to expiration unless directed by the Division.
Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit
does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it
relieve the permittee from responsibility for compliance with any other applicable federal, state, or local law,
rule, standard, ordinance, order, judgment, or decree. If you have any questions regarding this permit

Inspection Summary:
DWQ staff was met on site by Chris Stahl and other staff. A tour was conducted of the facility, observing the stormwater
conveyances and outfalls and site conditions_ During the visit, the SPPP manual was reviewed, operational activities and
existing stormwater exposures were discussed. Permit requirements were also reviewed as pertaining to the most recent
permit version, dated November 1, 2007. At the time of the inspection the site was found to be in compliance with the
permit. The inspector noted that the facility appeared to maintain good housekeeping practices and records were found
to be in good order.
Two noteworthy items were indicated during the visit:
- The site plan with stormwater discharge outfalls identified needs to be updated. Several outfalls were eliminated from
monitoring requirements after close inspection.
- Soil erosion has impacted a stream adjacent to one of the main entrance roads and also along the stream just above
the pond. Efforts should be taken to prevent further lass of soil to the streams.

We have received an application for coverage of an existing facility under NCG 12 from Macon
County Dept. of Solid Waste Management. The facility drains to the Little Tennessee River
(Lake Emory) (class C) in Franklin (Macon County). No haz waste, but they do have vehicle
maintenance. Also on the landfill property are the county's maintenance facility, animal

o Rule. 02 73, Options for Offsetting Nutrient Loads
Provides parties subject to the various rules - new development, existing development, State and Federal
stormwater entities, agriculture, and point sources — the option to obtain more cost-effective reductions by
purchasing reduction credit from other, offsite reduction sources or private sellers. This open, market -
based framework provides options in addition to the NC EEP option currently used in the Neuse and Tar -
Pamlico strategies. It requires that minimum ofsite standards be met before seeking credit elsewhere. It
sets criteria for those seeking to sell excess reductions, and would require Division approval.
