Thanks again for sending the lab results for the outfalls at the landfill. The report looks good overall.
One test that needs to be performed for each outfall and added to the report is PH. This test was added to the Landfill
Permit in 2018. Please call the lab and ask them to add this to the next report.

the Division of Water Quality (DWQ) is forwarding herewith the reissued General Permit. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October
15, 2007 (or as subsequently amended).
The following information is included with your permit package:
• A new Certificate of Coverage (COC)
• A copy of General Permit NCG120000
• A copy of the Technical Bulletin for the General Permit
• Two copies of the Discharge Monitoring Report (DMR) Form
• Two copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of Stormwater, and it specifies your obligations for discharge
controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself
with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the
permit to update your current SPPP to reflect all new permit requirements.
The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable
storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable,
report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part II of your
permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this
permit and do not count prior exceedances.
The more significant changes in the General Permit since your last COC was issued are noted either in the
Draft Permit Fact Sheet that accompanied the public notice (http://p2rtal.ncdenr.org/web/wq/ws/su/current-
notices), or in the Response to Comments / Summary of Changes and Technical Bulletin documents that are

Some of the changes include:
• Part ll:
• Section A: The Stormwater Pollution Prevention Plan (SPPP) section, if applicable, has been updated
to the most current language of our permits. Additional conditions for specific industry sectors have
been added to the SPPP requirements in some cases.
• Sections B, C: Failure to perform analytical Stormwater monitoring may result in the Division requiring
that the permittee begin a monthly sampling scheme.
• Sections B, C: A lower TSS benchmark of 50 mg/I for HQW, ORW, PNA and Tr Waters applies to these
more sensitive waters.
• Sections B, C: The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter
Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other
analytical monitoring requirements.
• Sections B, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in
separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined
in the "Definitions" section of the permit.
• Sections 8, C: The term "Representative Storm Event" has been replaced by "Measurable Storm
Event." A measurable storm event is defined in the permit.
• Section D: If the permittee fails to respond effectively to problems identified by qualitative
monitoring, DWQ may require the permittee to perform corrective action.
Please review Parts III and IV to understand the Standard Conditions of your new NPDES General Permit,
including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and
Maintenance obligations; and Definitions. Please note that all samples analyzed in accordance with the terms
of this permit must be submitted to the Division on Discharge Monitoring Report (DMR) forms available on
the Stormwater Permitting Unit's website above. DMR forms must be delivered to the Division no later than
30 days from the date the facility receives the sampling results from the laboratory. Also note that existing

Thanks Linda — I thought that's what you were talking about. The coir fiber material pores are too large to be effective
and I looked for a tighter weave and found some, but I did not feel the weave was tight enough to be effective. We have
silt fence material on order right now to "face" the coir fiber material with and create a more resistant barrier and then
we planned to have approx. 10 —15' of rip -rap and surge stone for the water to flow thru at the end of each run so that

The landfill stormwater permit has recently been reissued, so if you have any questions about that we can discuss.
As we have discussed in the past your basins are not very effective in helping you meet the permit benchmark numbers.
The installation forebays can be useful in avoiding short circuiting and for maintenance. Also allowing wetland plants
to live in the basin (or the forebay) can assist with pollutant assimilation.
I doubt adding forebays or allowing wetland plants to grow in the basins will be an issue with DLR given the size of your
basins we just need to make sure the holding capacity is not jeopardized. But they are the permitting folks for your
basins, so 1 would prefer they have a look and comment before you make too many changes. It is not uncommon for the
generic basins not to be as effective as needed to meet the water quality numbers. Other landfills, (Foothills, Trans)
have installed forebays with success and DLR was ok with it. When I say installed... they basically just created a berm
across the basin, so it took up some of the capacity but not enough that DLR was concerned.

This letter is in response to your request for clarification on the application of the Environmental
Management Commission's Water Supply Watershed Protection (WS WP) rules to the proposed expansion
of the John's River Waste Management Facility in Burke County, NC. Specifically, you requested: 1)
confirmation of the classifications of streams located on the subject property site, and 2) clarification of
whether the C&D landfill expansion will be allowable per the WSWP rules.
The Division of Water Quality has reviewed the materials submitted with your request which include site
characterization drawings and a brief permitting history of the facility. The four unnamed tributaries of the
Catawba River that run through the landfill property are classified WS-lV&B CA (Critical Area), as is the
segment of the Catawba River to which they are tributary. This particular segment of the Catawba River (at
Lake Rhodhiss) and its tributaries were classified WS-IV-CA in 1992. The John's River Waste
Management Facility (formerly known as Burke County Landfill) began operations in 1988. As such, it is
considered existing development per the Water Supply Watershed Protection rules (15A NCAC 2B .0202).
Because it is existing development, the proposed C&D expansion will not be subject to the prohibition on
new landfills in the WS-IV Critical Area.
This determination does not release Burke County from complying with water quality standards, effluent
limitations, analytical monitoring requirements, and other conditions set forth in NPDES Stormwater Permit
NCG 120067. Because of the. site's proximity to public water supply intakes and due to ongoing
compliance issues with stormwater benchmark values, the county will likely be required by DWQ to employ
more stringent best management practices. In addition, the site will be subject to the Catawba Riparian
Buffer Rule (I 5A NCAC 213.0243).

This letter is in follow-up to the NPDES Stormwater Permit Compliance Inspection conducted on
March 27, 2012, The facility is working towards compliance with permit NCG120067. The
facility has complied with the conditions of Notice of Violation (NOV) issued March 22, 2011.
Sampling as required by the NOV at the outfalls was sporadic due to flows. The facility is no
longer under the NOV, but is still required to perform increased monitoring until further notice.
Below is a discussion of the continued requirements for the landfill.
Regarding submittal of the Monitoring Reports to the Regional Office, the analytical results shall
still be submitted; however the Qualitative Reports no longer need to be submitted. The
Qualitative Monitoring Requirements (table 4) still stand but submittal -is no longer required.
In order to obtain sufficient analytical data, to gauge management strategies, the facility was
instructed that sampling can be performed if a discharge is taking place regardless of the 30 minute
timeline requirement. Footnote #2 in Table 1 is waived, which basically states that samples from
ponds shall be taken within the first 30 minutes of discharge from the pond. If a discharge from
any of the outfalls is occurring samples may be obtained even if it is outside of the first 30 minutes
of discharge. It is also not necessary for the facility to wait 72 hours between storm events.
Landfills tend to have elevated numbers due to lack:of housekeeping, ground cover or
maintenance, if these are the issues sampling outside these restraints is not going to change the
numbers significantly. It is more important to get data in order to gauge if improvements are
working or not.

SDO #I: Stormwater Discharge Outfall (SDO) or Stormwater Monitoring Point (SWMP) #1 is the
discharge from the shop area. Because the facility has disconnected the roof drains and no longer
uses the illicit discharge from the building, obtainingsamples from this discharge is unlikely. This
discharge is associated with the NCG080678 permit. `'See NCGO80679 inspection report for
comments.
SDO #2: Stormwater Discharge Outfall (SDO) or Stormwater Monitoring Point (SWMP) #2 is the
discharge from the transfer station area. To date one sample set has been obtained from the
outfall, it was collected on 9/6/201 l and only included COD and TSS parameters. There have not
been any Fecal Coliform numbers reported for this outfall. The outfall discharges to a large
headcut. If possible large stone can be placed at the base of this headcut in attempt to stabilize.
However, do not attempt to bring heave equipment into the valley to access the headcut as this will
only further destabilize the area. This outfall needs to continue being sampled monthly until more
data is obtained to establish compliance.
SDO#3: Stormwater Discharge Outfall (SDO) or Stormwater Monitoring Point (SWMP) #3 is the
basin #SB-2A discharge. The facility has been able to get sample results from this SDO. Fecal
Coliform is elevated. It is unclear what the facility can do to lower these numbers. The elevated
numbers could be from wildlife or from subsurface flows from the old unlined landfill reaching the
basin. The TSS numbers are also elevated. LandMi personnel have ideas of how to reduce these
numbers. Two suggestions from the inspector are to fix erosion at the inlet pipes as, noted in photo
41 and to install a device (baffles,etc) to alleviate short circuiting of flows to the outfall from the
inlet pipe on side of basin as noted in photo #2. Sampling at this outfall should continue on a
monthly basis until the TSS number decline.
SDO#4: Stormwater Discharge Outfall (SDO) or Stormwater Monitoring Point (SWMP) #4 is the
basin #SB-1 A discharge. The facility has also been able to sample from this SDO. As noted
above, it is unclear what the facility can do to reduce -the fecal coliform numbers: they are likely
from the old landfill cell or wildlife. Improvements from last inspection to this drainage area,
specifically the drainage ditch, appear to have been successful. Sampling at this outfall can resume
under the semi-annual monitoring schedule in Table 2 of the permit.
SDO#5: Stormwater Discharge Outfall (SDO) or Stormwater Monitoring Point (SWMP) #5 is the
drainage area at the north end of the site housing the compost piles, etc. Two traps converge flows
via a ditch to the outfall. Personnel need to continue sampling this outfall monthly to establish
compliance,
SDO46: Stormwater Discharge Outfall (SDO) or Stormwater Monitoring Point (SWMP) #6 is the
trap #S'r-3 located near SB-2A. Sampling at this outfall needs to continue monthly as well.
SDO #7: Stormwater Discharge Outfall (SDO) or Stormwater Monitoring Point (SWMP) #7 is the
new outfall at the north end of the property. If TSS is elevated at next sampling event then
monthly monitoring at this outfall will be required.

SDO #2: Stormwater Discharge Outtall (SDO) or Stormwater Monitoring Point (SWMP) #2 is the discharge from the
transfer station area. To date one sample set has been obtained from the outfall, it was collected on 9/6/2011 and
only included COD and TSS parameters. There have not been any fecal coliform numbers reported for this outfall. The
outfall discharges to a large headcut. If possible large stone can be placed at the base of this headcut in attempt to
stabilize. However, do not attempt to bring heave equipment into the valley to access the headcut as this will only
further destabilize the area. This outfall needs to continue being sampled monthly until more data is obtained to
determine compliance.
SDO#3: Stormwater Discharge Outfall (SDO) or Stormwater Monitoring Point (SWMP) 43 is the basin 4SB-2A discharge.
The facility has been able to get sample results from this SOO. Fecal Coliform is elevated. It is unclear what the facility
can do to lower these numbers. The elevated numbers could be from wildlife or from subsurface flows from the old
unlined landfill reaching the basin. The TSS numbers are also elevated. Landfill personnel have ideas of how to reduce
these numbers. Two suggestions from inspector are to fix erosion at the inlet pipes as noted in photo #1 and to install a
device (baffles,etc) to alleviate short circuiting of flows to the outfall from inlet pipe on side of basin as noted in photo
#2. Sampling at this outfall should continue on a monthly basis until the TSS number decline.
SDO#4: Stormwater Discharge Outfall (SOO) or Stormwater Monitoring Point (SWMP) #4 is the basin #SB-1A discharge.
The facility has also been able to sample from this SDO. As noted above, it is unclear what the facility can do to reduce
these numbers; they are likely from the old landfill cell or wildlife. Improvements from last inspection to this drainage
area, specifically the drainage ditch, appear to have been successful. Sampling at this outfall can resume under the
semi-annual monitoring schedule in Table 2 of the permit.
5D0#5: Stormwater Discharge outfall (SDO) or Stormwater Monitoring Point (SWMP) #5 is the drainage area at the
north end of the site housing the compost piles, etc. Two traps converge flows via a ditch to the outfall. Personnel need
to continue sampling this outfall monthly.
SDO#6: Stormwater Discharge Outfall (SDO) or Stormwater Monitoring Point (SWMP) #6 is the trap #ST-3 located near
513-2A. Sampling at this outfall needs to continue monthly as well

I had a chance to go through the Stormwater Pollution Prevention Plans (SPPP) you sent me.
First of all, I have to say Joyce Engineering did a nice job on that document for you. There are some corrections that
need to be made to the SPPP with regard to the frequency of the Qualitative monitoring, which I pointed out to you
during our phone conversation July 6th. Regardless they have basically included everything you need in the SPPP. There
is one form in particular that should be very useful. It is in Appendix XIV; the Maintenance Inspection Form.
Next, I would like to say Greg is doing a good job with the Qualitative Monitoring Forms. I would suggest he include the
Certificate of Coverage Number for identification;,the Larfdfillsl#=is:NCG120067 and the Maintenance:shop°is
NCGO80678. I forgot to mention to you today on the phone that you are using an old version of the Qualitative
Monitoring Form so I have attached the latest version for you and Greg to use. It is a better version than the one Greg is
using now. Section C of the permit explains Qualitative Monitoring. It does require a paper trail but its purpose is to
ke pup with maintenance of the protective measures.
Finally, during our last conversation we discussed the requirement that you begin the monthly Analytical Monitoring in
July either with the County lab or hire a commercial lab. You needed clarification on how many Stormwater Discharge
Outfalls (SDO) you are expected to sample. I needed to see the SPPP, specifically the Site Map, for proper clarification.
On the Site Map Joyce created, what DWQ refers to as a SDO Joyce calls this a Storm Water Monitoring Point (SWMP).
This is ok, I just want to make sure we are on the same page here with descriptions. The Landfill Site Map indicates
three SWMP (SWMP-2, SWMP-3, SWMP-4). There are actually four SDOs or SWMP at the Landfill. The forth one is the
drainage from portions, or all of, DA-1, DA-2 and DA-3. These Drainage Areas stormwater is treated by Sediment Traps
(ST-1 and ST-2), then conveyed over rock lined ditches through a culvert (C1) and down a slope to a wetland/stream
feature. Please add this location for Qualitative and Quantitative monitoring.
I have attached the No Exposure application form. Have a look and see if you think the Maintenance shop may conform.

Thank you Linda for calling this morning — It gave me a chance to get some things cleared up, particularly with the
Maintenance Garage discharge. As we discussed, this discharge is dependent on wash down of the interior of the garage
and has nothing to do with storm water discharge. I will develop a plan to eliminate this discharge and utilize a pump
and haul since we do not have access to municipal sewer at the landfill site. I will not plan on doing quantitative
monitoring at this location as discussed and will keep you informed as to the status of our efforts to eliminate the
discharge.
In addition, I will mail copies of our Storm Water Pollution Prevention Plan for both the maintenance garage and the
landfill. As we discussed, the discharge points for these approved plans are what Greg Watts has been sampling from. If
we need to do additional sampling, please advise in writing so that we have a record of that request.

Phone conversation with Carson Fisher June 17, 2011.
Told him he was supposed to be monitoring monthly. He has been trying to get analytical set up with
WWTP as I suggested. I told him if that was only a suggestion I made to save the county money and if
it was going to be an issue he needed to have a commercial lab perform the analysis. He believes
after fiscal year (July 1) it will be worked out and they can begin sampling. I told him that was ok, but if
VWVFP is too busy, he needs to use a commercial lab.
We also discussed who would be gathering samples. He said he would be gathering the samples. I told
him to make sure the month did not get away from him. It is sometimes difficult for someone not onsite
to gauge the weather and travel to be onsite for sampling. He felt confident this would not be an issue.
We also discussed where he should take the samples, I told him at the end of the pipe not at the end of
the rip rap channel. Sampling at the end of the pipe should be easiest for him and the rip rap channel
or other conveyance to the river should be evaluated during qualitative under ergsj n occurring at
discharge, numberl0qn form. I also told him since Gregg Watts was doing the qualitative form weekly
if he wanted to use the qualitative form to record erosion control maintenance at the bottom that was ok
with me.
We discussed the sampling locations. He thought there were three (3) for the landfill and one (1) for
the maintenance garage. He included 1 of the 3 for the landfill at the transfer station; the other 2 were
at the basins. I told him that was correct, but there was also another stormwater discharge outfall
(SDO) location in the vicinity of ST-1 which conveys under the road and discharges to tributary/wetland
area. Since I was trying to explain this SDO from a partial site map which was a cc I did not know
which map I was looking at, no title or date was shown on cc, He is going to send me a cc of the SP3
with actual site map so we can look at the same map to discuss this outfall he was not aware of.
He also questioned the sampling for the garage from the observed discharge point from the garage
.floor drain. He wasn't sure how that was associated with stormwater. I explained that it was not a
stormwater discharge bu_ t_an-illegal dime. I told him he did not need to sample it, but to remove
the discharge. He reeds to find a way to tie that discharge into a proper treatment system. He
mentioned an oil water separator with a pump and haul. He already has a pump and haul contract set
up at the transfer station to adding-thls_to-the ontract should not be an issue. He will have the engineer
draft up plans for oil water separator.

Burke County is in receipt of the above -referenced NOV and Recommendation of
Enforcement. I offer the following in response to the concerns raised in the NOV.
Part II Section B — Analytical Monitoring has not been conducted and recorded in
accordance with permit requirements. This is correct. Analytical monitoring will begin
this month (April 2011) as instructed in the NOV and results will be forwarded to Ms.
Linda Wiggs.
Part II Section C -- Qualitative monitoring has not been conducted and recorded in
accordance with permit requirements. I have inspected the outfalls on the
stormwater features almost weekly over the past year, but I admit I have not recorded
those inspections. Those will begin this month also and copies of those inspections will
be forwarded weekly to Ms. Linda Wiggs. The ditch line in the southwest area of the site
has been dipped out and is functioning correctly. A section of silt fence was also
installed along the top edge of that section of ditch to minimize overflow and discharge
off site.

NCG080678 Follow-up (NOV-2008-PC-0534) — On July 25, 2008 a NOV was issued
for the Burke County Garage ......................... A response to NOV-2008-PC-0534
has not been received by DWQ. Enclosed please find a copy of my response sent to
Chuck Cranford. Unfortunately, I did not date my response. However, I am fairly sure it
was sent within 15 days of receipt of the NOV, but I can't prove it. We have developed
and partially implemented the SPPP. We did investigate the floor drain and could not
determine from plans whether that drain emptied into the basin. We have not definitely
answered that question at this time but will make every effort over the next two weeks to
make that determination and report our findings to DWQ.
As far as the analytical monitoring is concerned, I did talk to Mr. Mason Greene, City of
Morganton WFP Superintendent to see if they could assist. He cannot but suggested I
call the WWTP Superintendent. I have left a message for him to return my call.
Burke County staff want to be in compliance with Stormwater Monitoring and will
concentrate on this program over the next few months to get us back on track. Thank

After review of the above -referenced NOV and our Stormwater permit, I offer the
following for your consideration:
1). Failure to develop and implement a Stormwater Pollution Prevention Plan — Based on
the maps and information required, I believe that we can develop a Stormwater Pollution
Prevention Plan within the next 60 days and have the plan implemented within an
additional 60 days (or sooner) after development of the plan.
2) Failure to conduct the required analytical and qualitative stormwater monitoring —
Once we can determine the amount of motor oil used per month and know what
monitoring has to be done, we can implement the required storrnwater monitoring during
this second half of 2008.
As we discussed, these plans and monitoring would apply to both the above -referenced
Garage Stormwater permit and the John's River Waste Management Facility Permit No.
NCG120067 issued November 1, 2007.

This letter is in follow-up to the National Pollution Discharge Elimination System (NPDES) General Permit
NCG120000 (NCG120067) compliance inspection conducted on March 16, 2011. Present during the inspection
were Don Price with Division of Water Quality, as well as Greg Watts with the Burke County Landfill. The
facility was found to be in violation of permit NCG 120067.
NCG120000 Permit Violations
Part II Section B - Analytical Monitoring Requirements.
Analytical monitoring has not been conducted and recorded in accordance with permit requirements.
Part II Section C - Qualitative Monitoring Requirements.
Qualitative monitoring has not been conducted and recorded in accordance with permit requirements.
Maintenance on a low spot of the southwest ditchline Is required. This ditchline was laden with sediment and
allowing a bypass of the basin (SB-1 A). Evidence of•an overflow of an adjacent silt fence was noted. The
small amount of sediment that reached the old basin (SB-1) is not currently a concern, however if this continues
sediment removal and restoration could be required as this old basin is online and considered waters of the
State. The Qualitative Monitoring should have indicated this problem area under #10. Active landfills remain
under an erosion control plan; therefore inspection of all stormwaterlerosion control measures is required
weekly and after every one-half inch of rain event. A NCG010000 inspection form was left with Mr. Watts to
assist with these requirements.

On July 25, 2008 a Notice of Violation (NOV) was issued for the Burke County Garage onsite at the landfill.
The NOV issued (NOV-2008-PC-0534) noted the failure -to develop and implement a Stormwater Pollution
Prevention Plan (SPPP) and failure to conduct analytical and qualitative monitoring. Observed during the July
7, 2008 inspection by Chuck Cranford was the garage Moor drain with a discharge point to the adjacent woods
with the potential to reach the stream. A response to NOV-2008-PC-0534 has not been received by DWQ.
Please also include in your Required Response the SPPP implemented for NCG080678, analytical and
qualitative monitoring results for NCGO80678 along with documentation that the floor drain from the
garage is not a wastewater discharge.
Thank you for your attention to this matter. This office requires that the violations, detailed above, be abated
immediately. These violations and any future violations are subject to a civil penalty assessment of up to

Inspection Summary:
Facility Mgr stated he had previously performed this monitoring but stopped after new erosion control installed in 2010
thinking it was ok.
All new Erosion control measures were added at facility in 2010. Most measures (rip rap ditchline and basins/traps) are in
very good working order and maintained. However, one dichtline (SCC-3, S.W. dicthline to S13-1A) has a low spot which is
laden with sediment allowing heavy flows to bypass basin to a silt fence by old basin (SIB-1). This low spot will be a
constant maintenance issue for landfill. A small amount of sediment had overflowed silt fence to old basin which is
currently more like a wetland area. At time of inspection the small amount of sediment was not a concern requiring clean
up, but could become an issue if not addressed at source.
All vehicle maintenance is performed undercover.

In response to your renewal application for continued coverage under stormwater General Permit NCG120000 the Division of
Water Quality (DWQ) is forwarding herewith the reissued stormwater General Permit. This permit is reissued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North
Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.
The following information is included with your permit package:
• A new Certificate of Coverage
+ A copy of General Stormwaler Permit 120000
• A copy of the Technical Bulletin for the General Permit
Five copies of the Discharge Monitoring Report (Di Form
• Five copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwaler only, and it specifies your obligations with respect to stormwater
discharge controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself with all
the changes in the reissued permit.
The more significant changes to the General Permit include the following:
• Part I Section A — A new provision that facilities draining to 303(d) listed waters, or in watersheds with an approved TMDL,
may not be eligible for renewed coverage under the General Permit.
• Part 11 Section B Table 1 — An increased sampling frequency from once per year to twice per year.
• Part Il Section B Table 3 — Benchmark concentrations now replace cutoff concentrations; the elimination of the option to
avoid sampling based on cutoff concentrations.
• Part 11 Section B — New provisions requiring the permittee to execute Tier One and Tier Two response actions, based on
the first benchmark exceedence (Tier One) and the second consecutive benchmark exceedence (Tier Two). Tier Two
requires that the permittee institute monthly monitoring instead of twice -per -year monitoring, until three consecutive
monitoring events show no benchmark exceedences.
• Part 11 Section B — A new provision that four exceedences of any particular benchmark will trigger increased DWQ
involvement in the permittee's stormwater management and control actions. DWQ may direct the permittee to apply for
an individual permit, or may direct the implementation or installation of specific stormwater control measures.
DWQ received a number of comments on a series of general permits similar to this one. A full response to comments can be
found at http://ncwatergoality.org/su/industrialgpinfo.htm. Some comments resulted in permit modifications, others are
addressed in the response document or Fact Sheet. A specific request for clarification is addressed below.
Must analytical results be by a certified lab? What about pH measurements? All analytical results obtained to satisfy
NPDES permit requirements must be certified, as directed in North Carolina regulations at 15A NCAC 2H .0800, and as
administered by DWQ's Laboratory Section Certification Branch. This includes field pH measurements.
General Permit Text Error Note: Part 111 Section D 6. Records Retention contains an erroneous reference to the
Stormwater Pollution Prevention Plan (SPPP). An SPPP is not a required element of General Permit NCG120000.

It recently came to the Division's attention that the compliance schedule in the NCG120000 permit is
incorrect. The compliance refers to requiring a Stormwater Pollution Prevention Plan which is not a
requirement of this permit. The corrected compliance language that should go under Part III, Section A: 1. is
shown below. We have also attached a new page reflecting this change for your permit file (Part III page 1 of
11). This new page should replace the current page in your permit.

Yes, those numbers are as high as raw wastewater. I checked with Raleigh to see if they have any recollection of landfills
with number so high; they did not. However, they are primarily issuing permits and they might not be in the loop on
other regional landfills. You may recall when we started down this path I spoke with other regional staff, which is what
led us to the wetland scenario.
Where are you in getting SB-1A (SDO 4) altered to include a wetland cell? In November 2012 Kristin Hicklin with DLR and
I met with you at the landfill to go over altering that basin into a forebay/wetland treatment unit. It was my
understanding that this alteration would take place in 2013. Once this takes place and plants are established we can see
if your numbers improve.

Linda — attached are stormwater sample results from last month. As you are aware, we have had a tremendous amount
rain and TSS was elevated. The fecal counts are extreme and we are at a loss except for the wildlife in the area. We know
we have a large wild turkey population at and adjacent to the landfill as well as deer. Fecal counts have been high on
previous testing, but not this high. Are other landfills in rural areas experiencing these high fecal counts? HCF

I hope you are having a good week.
I have attached the report for the storm water samples you submitted on June 6, 2013. The SWMP
#5 fecal coliform sample was unreadable. A slime layer had grown over each plate we set up
preventing the normal fecal colonies from growing. Whatever bacteria were present overran the fecal
bacteria even though the media and temperature at which we run the test are supposed to retard
growth of nonfecal bacteria. If you have any questions, please call me.
