VAN DER VAART Secretary TRACY DAVIS Subject: Compliance Inspection Evaluation Permit No. NCG 120057 (New Landfill) & NCG 120073 (Old Landfill) Ashe County Environmental Services Ashe County Dear Mr. Hurley: On April 21, 2016 Glen White, Tian Latham and George Smith of the North Carolina Department of Environmental Quality — Minerals & Land Resources met you and Kathy Weaver, Scale House Operator, at the subject facility located at 739 Fred Pugh Rd, Crumpler in Ashe County to conduct a compliance inspection for the facilities Industrial Stormwater Permits. Permit: This facility holds General Stormwater Permits NCG120057 (New Landfill) & NCG120073 (Old Landfill) to discharge stormwater from industrial activity for Landfills under the National Pollutant Discharge Elimination System (NPDES). The permit became effective November 1, 2012 and expires on October 31, 201.7. A copy of the current permit is required to be maintained with the Stormwater Pollution Prevention Plan (SPPP) documents. The current permit was available for review at the time of inspection. Records/Reports: This facility was required to develop and maintain a Stormwater Pollution Prevention Plan (SPPP) in accordance with Part II, Section A of the permit. The SPPP appeared to be up to date and contained all of the required components. Qualitative and Analytical Monitoring records were complete and conducted in accordance with permit requirements. Chemical Oxygen Demand, Fecal Coliform and Total Suspended Solids results were all within required parameters. Facility Site Review: This facility is a municipal solid waste landfill serving Ashe County. The site has six (6) riser basins and five (5) sediment traps. Most of the devices had been recently cleaned out, some with repairs. All were in good working order with no evidence of sediment leaving the site from the basins. Only the -largest riser basin had an issue with bank failure in one area and causing sediment to build up at the riser. This basin will require repairs and clean -out. There is one Lined Leachate Lagoon located adjacent to the current landfill cell. It appeared to be structurally sound and functioning as designed. Overall, all measures have been well maintained and are in good working order. This permit is reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as subsequently amended). The following information is included with your permit package: • A new Certificate of Coverage (COC) • A copy of General Permit NCG120000 • A copy of the Technical Bulletin for the General Permit • Two copies of the Discharge Monitoring Report (DMR) Form • Two copies of the Qualitative Monitoring Report Form The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the permit to update your current 5PPP to reflect all new permit requirements. The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable, report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part 11 of your permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this permit and do not count prior exceedances. Additional conditions for specific industry sectors have been added to the SPPP requirements in some cases. • Sections B, C: Failure to perform analytical stormwater monitoring may result in the Division requiring that the permittee begin a monthly sampling scheme. • Sections B, C: A lower TSS benchmark of 50 mg/I for HQW, ORW, PNA and Tr Waters applies to these more sensitive waters. • Sections B, C: The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other analytical monitoring requirements. • Sections B, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined in the "Definitions" section of the permit. • Sections B, C: The term "Representative Storm Event" has been replaced by "Measurable Storm Event." A measurable storm event is defined in the permit. + Section D: If the permittee fails to respond effectively to problems identified by qualitative monitoring, DWQ may require the permittee to perform corrective action. Please review Parts III and IV to understand the Standard Conditions of your new NPDES General Permit, including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and Maintenance obligations; and Definitions. Please note that all samples analyzed in accordance with the terms of this permit must be submitted to the Division on Discharge Monitoring Report (DMR) forms available on the Stormwater Permitting Unit's website above. DMR forms must be delivered to the Division no later than 30 days from the date the facility receives the sampling results from the laboratory. Also note that existing permittees do not need to submit a renewal request prior to expiration unless directed by the Division. Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it relieve the permittee from responsibility for compliance with any other applicable federal, state, or local law, rule, standard, ordinance, order, judgment, or decree. Ms. Judy Watson, Scale House Operator was present for the inspection. Permit This NPDES permit became effective on November 1, 2007 and expires on October 31, 2012. Analytical Monitoring is required. (Part II, Section B, Table 1) Qualitative Monitoring is required. (Part II, Section C, Table 4) Records & Reports Chemical Oxygen Demand, Fecal Coliform, and Total Suspended Solids (TSS) were performed, and the chain of custody forms along with the lab reports were kept on file for SDO-1 and SDO-3. Facility Site Review The leachate lagoon was structurally sound. There was no evidence of leaks. The landfill did clear additional areas, and there are four new sediment and erosion control devices. The big sediment trap with the skimmer was repaired. The stream clean -out will be performed during the week of April 2, 2012. The DWQ and Land Quality Section are scheduled to inspect the stream and measures on April 10, 2012. Self -Monitoring Program Qualitative monitoring every seven days, and/or after every 0.5 inch rainfall event is performed and documented for the following Outfalls: SDO-1 (old landfill) and SDO-3 (new landfill). Analytical monitoring is performed and documented twice a year for the following Outfalls: SDO-1 (old) and SDO-3 (new). Chemical Oxygen Demand, Fecal Coliform, and Total Suspended Solids (TSS) are performed at each outfall. The benchmark value was not exceeded two times in a row for any parameter. A rain gauge is kept on the site adjacent to the animal shelter, and rainfall records are recorded. The compliance evaluation inspection is satisfactory. Ms. Judy Watson is performing and documenting the monitoring in an excellent manner. These sediment traps, otherwise know as stormwater discharge outfalls (SDO) are operating and properly maintained. Self -Monitoring Program Qualitative monitoring every seven days, and/or after every 0.5 inch rainfall event is performed and documented for the following Outfalls: SDO-1 (old landfill) and SDO-3 (riew landfill). Analytical monitoring is performed and documented twice a year for the following Outfalls: SDO-1 (old) and SDO-3 (new). Chemical Oxygen Demand, Fecal Coliform, and Total Suspended Solids (TSS) are performed at each outfall. The benchmark value was not exceeded two times in a row for any parameter. A rain gauge is kept on the site adjacent to the animal shelter, and rainfall records are recorded. The four SDOs that are part of the erosion control plan must be qualitatively monitored every seven days, and/or after every 0.5 inch rainfall event. PIease perform this monitoring until the Land Quality Section closes the erosion control project. Failure to perform this monitoring is a permit violation. The compliance evaluation inspection is satisfactory. The qualitative monitoring for the newly installed SDOs must be performed.
