This inspection was to verify that the facility is operating in compliance with the conditions and limitations specified in NPDES Permit No. NCG110108. MINCEY MITCHELL WARD TRENT BURROUGHS The Town Of Tabor City is in receipt of your correspondence dated June 1, 2009 (Certified Mail No. 7007 0220 0000 8216 7077) in which you directed a Notice of Violation with Intent to Enforce on the Town of Tabor City. In that Notice you required a written response within ten days of receiving that certified correspondence. Please consider this letter as that written response. The Town of Tabor City did receive an April 28 letter stating that an inspection had been conducted on April 7 concerning Tabor City's compliance with its stormwater permit. When we received your letter, we immediately contacted our engineers (Hobbs, Upchurch & Associates) for advice. Tabor City had never been inspected or cited for matters related to stormwater before. As you can imagine, we needed assistance before responding back to your office. Shortly thereafter, the Town :deceived a separate Notice of Violation with a Re -commendation for Enforcement from your desk. That letter, Case No NOV-2009-PC-0434, appeared to suggest rather severe concerns and had a very short time for a response (15 days). Again, we. contacted our engineers to help with a response for you. But, we also had to gather data from our contract operators (Meritech) and the company that has been contracted to renovate the treatment plant (T.A. Loving Co.). I trust that your office has received our written response to that matter. JUN I 0 2009 BY: After forwarding a response to your office on that May 12th case, the Town of Tabor City received a third correspondence concerning the wastewater treatment plant. That letter was from Coleen Ei_ Sullivan (Case No_ LV-2008-0384) which imlQued a Civil Penalty Assessment of $9,70 _ 15 on the Town of Tabor City and demanded payment. Tabor City did make that payment on .June 8th. This was very difficult in Light of the fact that during this: tremendous economic recession, the Tr wn ` z annual wastewater bond payment to U.S. Rural Development of some $134,000 had just been made in the month of May ;as well_ Our latest finance statement shrews only $18,908.47 remaining in cash on deposit in the: wastewater fund. When the Town received your June letter, the fourth in less than five weeks, it became obvious to us that Tabor City had indeed overlooked the April 28th matter_ That was not our intention. Between dealing with the severe issues of your May 1 th Notice, making the bond payment, working with the contractor on punch list items to complete the renovation project, and getting the Civil Penalty Assessment paid, we simply did not get back to the original matter. So, the Town of Tabor City does want to state for the record that since receiving the April 28 Notice, our engineers have been working on a written Stormwater Pollution Prevention Plan. We have had at least five (5) telephone conferences about the particulars of the Plan, and how Tabor City will implement it_ I have also spoken by phone with the contract operators of the plant about this Stormwater Pollution Prevention Flan. It appears now that this document will be ready toward the end of July after the engineers complete their analysis and review. We will forward a copy to you once it is finished_ Tabor City notes with interest that your June 1 Notice indicated a $25,000 civil penalty assessment may be forthcoming as a result of Tabor City not having a Stormwater Pollution Prevention Plan. [Obviously, yttiur office can impose this fine, but I can state for the record that Tabor City is financially.unable to pay it. You are aware of how financially strained the state government is at this time_ It is much worse in the small towns with no revenue: base Instead, 1 would ask your office to consider the progress that we are trying to make at the WWTP_ A three million dollar renovation is nearing completion. The equalization basin, UV lighting, grit removal and ability to have dual basin treatment are all components that your office has urged us to install over the past several years_ We are doing what you asked. And we will get a stormwater policy in place and implement it. Tabor City is not a case where nothing is being done or responsibility is not being taken seriously. There have got to be other wastewater plants in this region that are performing worse, or are not taking legitimate steps toward corrective action. Thank ,you for your consideration of this response. The inspection was conducted to determine compliance with the permit requirements specified in the NPDES Stormwater General Permit NCGI 10108, which allows stormwater discharges from the site to surface waters of the State. The site drains to Grissett Swamp, Class C-Sw waters located in the Lumber River Basin. The site visit and file review revealed that the subject facility is not in compliance with the North Carolina General Statute 143-215.1(a)(6) or the specified conditions in the NPDES General Permit NCGI 10108, issued on June 1, 2008. The following violations are being considered for enforcement actions: t) Stormwater Pollution Prevention Plan (SPPP) Failure to develop and record a Stormwater Pollution Prevention Plan (SPPP). No response has been received by this office. Please be advised that violations of the NPDES General Permit are subject to a civil penalty assessment of up to $25,000.00 per day for each violation.
