Both site locations (auto storage location and auto stripping/office location) were inspected. Both site locations were clean and -in good -condition. -All fluids are stored inside -and -either recycled on -site or hauled -by -a-contractor: There - are no inlets at the auto stripping location. Outfall #1 drains Lot 1 and flows across approximately 500 feet of undisturbed grass before the downstream tributary is reached. Lot 1 contains autos that are drained and ready to crush. There is little to no potential for offsite transport. Outfall #2 flows directly from Lot 2 (mostly drained vehicles and a few autos ready for set up)to Lot 3 (all autos are drained and ready to strip) and Outfall #3. Per this inspection, it was assessed that only Outfall #3 (draining Lots #2 and #3) would require analytical monitoring. If two subsequent years show no exceedances of any parameters, then a request to rescind the permit may be submitted by the facility. Outfall #1 should be documented in the SPPP as "no flow" and Outfall #2 as flowing to the monitoring point of Outfall #3. From: Kucken, Darlene Sent: Friday, June 06, 2014 2:42 PM To: Georgoulias, Bethany Subject: Jim West & Sons Auto Recycling NCG100234 Okay — here's your quiz for the day and let's see what you can do with this one! We received a complaint call and Jonathon and Tim Fox went out to investigate. They found no problems, and in fact found a well run operation. But the West's filed a general permit and obtained the permit on May 8, 2014. Dale West then called me to ask what to do next. I went to the site yesterday and here's what I found: 1. The complaint apparently came from a "crazy" guy they employed for 3 weeks before they fired him. He was mad and called us. 2. The site is well run and clean. All the liquid materials are kept indoors and all liquids are recycled on site, except for the used oil and transmission fluid which is pumped by a recycler for offsite use. 3. Per the permit, they have 3 outfalls. 4. Outfall #1 only gets flow from lot #1; all vehicles in Lot #1 are drained and ready to crush and go into a container to be hauled off. The pipe has a lot of built-up sediment and it will not be feasible to get a clean sample. It also flows across his grassed lawn for about 600+ feet before the unnamed tributary to Dix Creek. I cannot see that this pipe could be sampled or has an impact, There is no evidence of flow across the grass. I think this might not be a potential point source discharge to surface waters. Check out our'Stormwater Point Source Guidance' on the intranet (http://portal.ncdenr,org/group/ir/stormwater-guidance). A grassed lawn A� with that much length to travel —unless it's in the flood plain or a ditch conveyance --provides a lot of space for infiltration. You could argue that this is not subject to the NPDES stormwater program. 5. Outfall #2 drains Lot #2 directly to Lot #3. Most of the vehicles on Lot #2 are also drained; they have one or two cars here that get pulled into the shop as quickly as possible to drain them (usually within a couple days). Outfall #2 is a_dirt channel and pretty impossible to sample due to the topography. 6. Outfall,#.3rdra'ins.Lot #.3tand �Lot .#2._Lot #3_is_all drained vehicles -ready to pull apart. The Outfall is also a dirt channel and little evidence of any flows across Lot #3. It will also be very hard to sample and I doubt will provide a clean sample. Outfall #3 goes through their own property and through a mature woods at least 600 ft to -a - small unnamed trib to Dix Creek. If I interpreted 5-6 correctly, Outfall #2 actually flows -> to -> Outfall #3. Is that correct? Then maybe only Outfall 43 is the potential point source here. But then, it also flows through woods for at least 600' before reaching a tributary? Flow through a wooded area is all but certain to channelize in more than one place; however, that's a very long distance. If flow from the outfall is outside the flood plain for most of that distance, again you might argue this is not a point source discharge of stormwater, either... and therefore not subject to the NPDES stormwater program. The entire site is bermed on the perimeter. and between the Lots. There are no inlets anywhere on the site, nor actual outlet structures such as concrete aprons, pipes, etc. Buncombe County does not favor auto recycling and they have been denied a permit to add onto this facility. So they have no way of growing this site. In truth, I find this site poses no risk to anything and there are much bigger fish to fry up here. It is a well run, clean site and no expansion potential. But they already have the permit, so I helped him figure out how to put together his SPPP and he's ready to go on that. Now for the question: do they have to do the analytical monitoring given the above conditions? If so, can I guide them to sample outfall #3 only as a representative outfall? He would collect the sample himself given his parents live on site (one reason it's so clean), and then send it to Pace. Your thoughts? A couple ways to handle this I think. You've done a great job of considering other factors on which to base BPJ (because this kind of scenario is a tough call -- particularly if you're dealing with a really dirty operation). You've established low risk to surface water impacts, and that's important. So, now that they are under a permit, do they have to do analytical monitoring? Technically, yes, the permit binds them to do analytical monitoring requirements. If there's a discharge. If not, they must report "No Flow" semi-annually. Option #1: Keep them under the permit, have them report "No Discharge" unless for some strange reason their site circumstances change. It sounds like Outfall #3 is really the only one that _might_ count anyway, so I'm not sure bothering with ROS is even worth it. The benefit to maintaining permitted status in a gray area like this? This facility will (hopefully) remain attentive to stormwater pollution prevention. Option #2: ARO is comfortable in their determination that none of the outfalls qualifies as a potential point source discharge to surface waters, and the operators should be advised that the NPDES program does not apply. In that case, they should request to rescind the permit. NPDES stormwater requires [industrial activity in a category that's subject to NPDES] + [point source discharge]. We have authority to designate an activity outside the standard categories that poses a risk to surface waters in the regs, but we can't force a permit on someone who doesn't have a point source. Note that this company has another facility located at 852 New Leicester Hwy that was also visited on the same day. it appears that this facility may qualify for a "no exposure" based on observations during the site visit. The complainant was Mr. Roland Metcalf who worked at the site for about two years (no longer works there). Phone number 828/319- 5173. 1 do not see these on our permitted list for NCG1000000. i told him we would look into it and let him and Mr. Metcalf know what we find. Put on your list.
