You'll need to apply for coverage at the 804 Island Drive location to remain compliant. If the facilities at 209 East Murphy Street are no longer in use, you may rescind coverage at that site. But, please apply for coverage at the new location prior to rescission at the East Murphy Street site. Skvarla, III Secretary Aana Taylor -Smith of the Winston-Salem Regional Office of the NC Division of Water Quality (DWQ) conducted a compliance evaluation inspection at the subject facility on 23 May 2013. Your assistance and cooperation were greatly appreciated. An inspection checklist is attached for your records and the inspection findings are summarized below. This facility is located at 209 East Murphy Street in Madison, Rockingham County, North Carolina. Stormwater related to industrial activity is discharged from the site to an unnamed tributary to the Dan River, which is currently classified as Class WS (Water Supply) V waters in the Roanoke River Basin. Documentation & Monitoring Review A thorough and well -developed Stormwater Pollution Prevention Plan (SPPP) was available on site. However, the SPPP has not been updated since 2011 and does not meet all permit requirements. The following problems were noted with the SPPP: Recertification that Stormwater Discharge Outfalls (SDOs) have been evaluated for the presence of non- stormwater discharge should occur annually, as per Part II, Section A, Paragraph 1(e) of the permit. A re- certification statement must be signed and kept with the SPPP. A thorough facility inspection program was outlined in the SPPP, but facility inspections have not been recorded or documented. Part II, Section A, Paragraph 5 of the permit requires that facility inspections be conducted at least semi-annually. Although employee training is conducted regularly, it must be documented in the SPPP as required by Part II, Section A, Paragraph 6 of the permit. Stormwater training is required at least annually and training must be documented with the signature of each employee in attendance. The SPPP has not been updated or amended since 2b11. Part II, Section A, Paragraph 8 of the permit requires the SPPP to be reviewed and updated annually. In addition to the above problems, neither analytical monitoring nor qualitative monitoring has been conducted or documented as required. Part II, Section B of the permit requires semi-annual analytical monitoring during a measurable storm event, as defined in Part Vl of the permit. Part II, Section D describes the semi-annual qualitative monitoring requirements. A & Y Salvage, Inc. must immediately correct this violation by beginning monitoring as required. Site Review The facility is relatively orderly and well -maintained- Secondary containment requirements are not applicable for this site. There is one outfall for this facility, which was examined during the inspection. Maintenance will need, to be conducted in order to improve access and visibility at the outfall. Receiving waters at the outfall looked clear with no visible indicators of pollution. The incomplete and inaccurate SPPP, as well as the lack of analytical and qualitative monitoring are considered violations of the NCG100000 general permit. You are reminded that pursuant to NC General Statute 143-215.6A, the Division may assess civil penalties of up to $25,000 per day, per violation of NCG100000. Please reply in writing to this NOV within 30 days of receiving it. Your reply should detail corrective actions with implementation schedules for each of the violations identified above. The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable, report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part II of your permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this permit and do not count prior exceedances. Additional conditions for specific industry sectors have been added to the SPPP requirements in some cases. • Sections B, C: Failure to perform analytical stormwater monitoring may result in the Division requiring that the permittee begin a monthly sampling scheme. • Sections 8, C: A lower TSS benchmark of 50 mg/I for HOW, ORW, PNA and Tr Waters applies to these more sensitive waters. • Sections B, C: The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other analytical monitoring requirements. • Sections B, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined in the "Definitions" section of the permit. • Sections B, C• The term "Representative Storm Event" has been replaced by "Measurable Storm Event_" A measurable storm event is defined in the permit. • Section D. If the permittee fails to respond effectively to problems identified by qualitative monitoring, DWQ may require the permittee to perform corrective action. Please review Parts III and IV to understand the Standard Conditions of your new NPDES General Permit, including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and Maintenance obligations; and Definitions. Please note that all samples analyzed in accordance with the terms of this permit must be submitted to the Division on Discharge Monitoring Report (DMR) forms available on the Stormwater Permitting Unit's website above. Sullins Governor Director 2 March 2011 A & Y Salvage Attn: Mr. Dean Gentry 109 East Murphy St. Madison, NC 27025 Subject: Notice of Violation Operating Without a Permit A & Y Salvage (NCG100000) Rockingham County Dear Mr. Gentry: Dee Freeman Secretary On 1 March 2011 Mike Thomas of the Division of Water Quality met with you and Mr. Bill Gentry concerning the operation of A & Y Salvage, "The cooperation of both of you during his site visit was greatly appreciated. The purpose of his inspection was to investigate a complaint this off ce received regarding the facility. During the course of this investigation it was determined that A & Y Salvage has not obtained the required Stormwater General Permit (NCG10000) issued by this Division. Stormwater General Permits are issued based on an industrial facility's Standard Industrial Code (SIC) and are obtained by submitting a Notice of Intent to this Division. Observations: A & Y Salvage is a metal and automotive recycling company located at 209 E. Murphy Street, in Madison, North Carolina. The bulk of the automotive operation is directly across Water Street to the east. At the time of inspection, the facility appears to be overwhelmed with material resulting in significant housekeeping issues. In general, Mr. Thomas observed automotive batteries, piles of tires, 50 gallon drums, etc. all exposed to the elements. The greatest concern is the vehicles located across the street from the main office building, near the stream. Though no evidence of leaking oil and/or fuel were observed during the inspection, the potential 'risk of contamination is high. There is also a large drum of fuel located near that area that has no secondary spill containment and no secure lid. In addition, daily activities have denuded the ground resulting in a high potential for sedimentation of the adjacent stream. It is advisable to limit activities with heavy machinery in that area during wet conditions, until the site is stabilized. Required Actions: • Within thirty (30) business days of receipt of this letter, please submit the Notice of Intent (application) for NPDES permit #NCG 100000 (provided to Mr. Bill Gentry at the time of inspection). There are several areas in the town limits that flood and many within the planning and zoning district that flood. Within the town limits on the east side of town a metal scrap yard has been established. It has been there for awhile now. Recently they have expanded a holding lot across the road from their original location. I am certain all this property lies within the hundred year flood plain. The expansion lot has old cars and construction equipment within it for extended periods. So leaking from these are oil, grease, and probably fuel. This property is near the point where the Mayo River joins the Dan River. From that point the Dan flows on to Eden, NC, first and on to Danville, Va. The products in this storage area are certainly contaminating the flow downstream even if there are no vehicles in the lot because junk vehicles do leak.
