Skvarla, III, Secretary We are in receipt of the Stormwater Pollution Prevention Plan (SWPPP) that you prepared and dated August 18, 2013. Our office received it a month later, and I apologize for the time that it has taken to respond. The plan as submitted does not meet the requirements of an SWPPP. The band drawn sketch does not provide adequate detail and does not provide a scale. There is also nothing documented about Employee Training or records of Preventative Maintenance and Good Housekeeping, just to highlight a couple of other SWPPP components. In order to provide some guidance, the following is the outline in the NCG100000 General Permit: The Site Overview shall provide a description of the physical facility and the potential pollutant sources that may be expected to contribute to contamination of stormwater discharges. The Site Overview shall contain the following: (a) A general location map (USGS quadrangle map or appropriately drafted equivalent map), showing the facility's location in relation to transportation routes and surface waters; the name of the receiving waters to which the stormwater outfalls discharge, or if the discharge is to a municipal separate storm sewer system, the name of the municipality and the ultimate receiving waters; and accurate latitude and longitude of the points of stormwater discharge associated with industrial activity. The general location map (or alternatively the site map) shall identify whether any receiving waters are impaired (on the state's 303(d) list of impaired waters) or if the site is located in a watershed for which a TMDL has been established, and what the parameters of concern are. (b) A narrative description of storage practices, loading and unloading activities, outdoor process areas, dust or particulate generating or control processes, and waste disposal practices. A narrative description of the potential pollutants that could be expected to be present in the stormwater discharge from each outfall. (c) A site map drawn at a scale sufficient to clearly depict: the site property boundary; the stormwater discharge outfalls; all on -site and adjacent surface waters and wetlands; industrial activity areas (including storage of materials, disposal areas, process areas, loading and unloading areas, and haul roads); site topography and finished grade; all drainage features and structures; drainage area boundaries and total contributing area for each outfall; direction of flow in each drainage area; industrial activities occurring in each drainage area; buildings; stormwater Best Management Practices (BMPs); and impervious surfaces. The site map must indicate the percentage of each drainage area that is impervious, and the site map must include a graphic scale indication and north arrow. (e) Certification that the stormwater outfalls have been evaluated for the presence of nonstormwater discharges. The pernuttee shall recertify annually that the stormwater outfalls have been evaluated for the presence of nonstormwater discharges. The certification statement will be signed in accordance with the requirements found in Part ill, Standard Conditions, Section B, Paragraph 3. We advise you to consider hiring an environmental consultant to step you through the process. If that's not an alternative, you need to develop a more detailed plan, incorporate inspection records (or at least templates where you're going to record them), and create more appropriate maps. We use seperate containers for Waste oil and Solvents.. Antifreeze, gasoline, used oil and Solvents are held in Barrells and picked up by Noble oil Services. Greasy rags, and uniforms are picked up weekly by Cintas Corp. Invoices are given for picked up Waste Materials. Battery's are picked up bi-weekly by Interstate Batteries. Oil filters are drained and returned to cars for crushing, which is done offsite. Used fluids are held in container's until picked up. Maintenace area is inspected through out the day. Used parts remain on vehicle until sold. New parts are stored in parts Dept. Parts washing is conducted inside building, in Parts Washer. Vehicles loaded and unloaded in the drive way, beside the shop..Vehicle are brought inside shop for draining.. and fluids put into containers, nothing is spilled on the ground.. No spills in the last 3 years, or at anytime.. Feasibility = We are doing every thing we are suppose to do and more.. Secondary Containment Requirements, We use 250 Gallon drums, for Noble Oil co. The Division appreciates the assistance you provided during the inspection procedures. This site was issued an NPDES Stormwater General Permit (No. 100205) on June 11, 2010. The permit requires a written Stormwater Pollution Prevention Plan within 12 months of receiving coverage under the General Permit. The permit also requires quantitative monitoring of stormwater discharges from the site. Failure to follow your permit requirements is a violation of North Carolina General Statute 143- 215.1(a). This site is within the New River watershed and located in the White Oak River Basin. A letter was sent to you on January 25, 2010 requesting you apply for the NPDES General Permit within 30 business days of receipt of the notification. To date, no response or application has been made by East Coast Imports. As a result of the site visit and file review, the following violation is detailed below: (1) Operating this facility without a stormwater permit Item 1. Operating a facility without a stormwater permit It is illegal to operate certain industrial plants without a permit under North Carolina General Statute (NCGS) 143-215.1(a). Illegal operation is subject to civil penalties of up to $25,000 per day according to NCGS 143-215.6A(a)(2). NPDES general permit NCG100000 has been established pursuant to NCGS 143-215.1(b) for discharges of stormwater to surface waters. This general permit is applicable to owners or operators of stormwater point source discharges associated with activities classified as establishments primarily engaged in used motor vehicle parts. Division of Water Quality Representatives, Linda Willis and Jean Conway, with the Wilmington Regional Office, conducted the complaint investigation on January 12, 2010. According to my staff, no oil sheens were seen on any stormwater accumulation on site or in the peripheral ditches around the facility. Staff indicate that the facility appeared to maintain better housekeeping than the majority of the salvage yard facilities in our region. You are commended for your efforts in maintaining good housekeeping practices. This complaint will be documented in the Division's database as unsubstantiated. A review of the.
