Dear Ms. Leonard:
On February 17, 2016 Glen White of the North Carolina Department of Environmental
Quality visited the auto salvage facility located at 622 Grimes Blvd in Lexington, NC. You were
present at the time. You and your staff were busy with continuing clean-up efforts. The intent of
the visit was to check compliance with permit coverage from the former owner. "Davidson Auto
Salvage". At the last inspections in 2012, the facility was issued a "Notice of Continuing
Violation with Recommendation for Enforcement."
As the new owner of the facility you are required to update and maintain the permit. I am
sending you a copy of the NCG 100000 which this facility is covered under. Its Certificate of
Coverage is NCG 100190. You'll need to complete a "Change of Name/Ownership Form", and
develop a (Stormwater Pollution Prevention Plan) SPPP as well as provide bi-annual monitoring.
I have a template that you may use to help create your SPPP if you do not wish to hire an
engineer. I'm sending the template by email. Enclosures are listed below.
Please submit the Change of Name as soon as possible to begin coverage under your business
name as you continue to improve conditions of the facility. If you need additional information,
please contact Glen White at 336-776-9660.

Dear Mr. Leonard. -
On June 29, 2011, Jenifer Carter, from the Winston-Salem Regional Office of the Division of Water Quality, performed a
stormwater inspection at Davidson Auto Salvage on Grimes Boulevard in Lexington, North Carolina. The site drains to
Swearing Creek, Class C waters located in the Yadkin -Pee Dee River Basin.
The following observations and/or permit conditions violations were noted during the inspection:
• Conditions at the site were acceptable. There was no evidence of excessive fluids on the ground, batteries and
engines were stored properly, and fluids disposed of properly.
• A Stormwater Pollution Prevention Plan (SPPP) could not be located during the inspection. Since the files had been
thrown about during a recent burglary, a week -was given to locate and provide a copy the plan. This was not done.
• Qualitative monitoring records are apparently stored with the SPPP and also not provided.
• Quantitative monitoring was attempted a few times since January 2010, but the lab rejected the samples each time for
different reasons. The facility thinks they now understand how to properly collect, preserve and transfer samples, and
had a cooler with sample bottles from the lab on hand to attempt it again.
Requested Response, due within 15 business days of receipt of this letter.
• Please describe your failure to create a site -specific SPPP, as well as your failure to perform qualitative monitoring. If
created and located, please provide a copy to this office within the time allotted.

Begin qualitative monitoring immediately, and continue semi-annually as required by the permit.
Thank you for your attention to this matter. This Office is considering sending a recommendation for enforcement
regarding these issues. Your above -mentioned response to this correspondence will be considered in this process. This
office requires that the violations, as detailed above, be abated immediately. These violations and any future violations
are subject to a civil penalty assessment of up to $25,000.00 per day for each violation. Should you have any questions

Comment: The facility had just been robbed, as noted by the security cameras torn off
of the walls and papers everywhere. Given a week to locate SPPP and related records,
but nothing was submitted.

TTO Certification Statement
For those facilities electing to employ the TTO sampling waiver, the discharger shall include the
following signed certification statement on each discharge monitoring report:
"Based upon my inquiry of the person or persons directly responsible for managing compliance with the
permit monitoring requirement for total toxic organics (TTO), I certify that to the best of my knowledge
and belief, no leak, spill, or dumping of concentrated toxic organics into the stormwater or onto areas
which are exposed to rainfall or stormwater runoff has occurred since fling the last discharge
monitoring report. I further certify that this facility is implementing all the provisions of the Solvent
Management Plan included in the Stormwater Pollution Prevention Plan."

In accordance with your application for a discharge permit received on August 3, 2006
we are forwarding herewith the subject certificate of coverage (COC) to discharge under the
subject state —NPDES general permit. This permit is issued pursuant to the requirements of
North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the US Environmental Protection Agency dated May 9, 1994 (or as subsequently
amended).
If any parts, measurement frequencies, or sampling requirements contained in this permit
are unacceptable to you, you have the right to request an individual permit by submitting an
individual permit application. Unless such demand is made, this certificate of coverage shall be
final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to
the Division of Water Quality. The Division of Water Quality may require modification or
revocation and reissuance of the certificate of coverage. This permit does not affect the legal
requirements to obtain other permits which may be required by the Division of Water Quality or
permits required by the Division of Land Resources, Coastal Area Management Act or any other
federal or local governmental permit that may be required.
