(DEMLR) conducted a compliance evaluation inspection at the subject facility on September 24, 2015. Your
cooperation and assistance was greatly appreciated. An inspection checklist is attached for your records and
the inspection findings are summarized below.
1. Permit
This facility holds General Storm water Permit No. NC100179 to discharge Storm water from activities
associated with Used Motor Vehicle Parts and Auto Wrecking for Scrap under the National Pollutant
Discharge Elimination System (NPDES). The permit became effective August 1, 2013 and expires July 31,
2018. Your permit renewal package must be received in the Central Office in Raleigh no later than 180 days
prior to the expiration date of the permit.
2. Records/Reports
Part II, Section A of the permit requires the development of a Stormwater Pollution Prevention Plan (SPPP).
The plan must include all nine (9) subsections of Part II, Section A of the permit. Qualitative monitoring is
required to be completed and documented twice yearly as defined in Part 11, Section C of the permit. The
SPPP plan must be updated annually -and qualitative and analytical monitoring must be conducted and
properly documented semi-annually to retain compliance with the permit. No SPPP (Stormwater
Pollution Prevention Plan) or monitoring records were available for review.

3. Facility Site Review_
This facility is a salvage vehicle yard and performs maintenance and auto repair as well. Car crushing is no
longer done at this site because of a hydraulic leak in the past. Crushing equipment has been removed. The
overall appearance of the site is fair. The business was in operation during the inspection with one vehicie
being serviced in one of the bays. Mr. Miller said that most of the salvage yard has been cleaned up and
vehicles removed. It was evident that this was the case. Many old tires and metal salvage still remain and
need to be hauled off as soon as feasible.
4. Effluent/ eiving Waters
Stormwater from this site exits the property into Bob Branch, a part of the Randleman Lake River and a part
of the Cape Fear River Basin.
S. Self -Monitoring Program
Analytical Monitoring: This site is required to provide analytical monitoring under current operating
procedures. Monitoring has not been -done in several years. Begin analytical monitoring as soon as the next
rain. Find an approved testing facility to test samples. Collect samples in jars provided by the testing facility
and ship sample to them overnight for testing. Begi.n sampling per the permit requirements.
6. Qualitative Monitoring: All qualitative records do not need to be submitted to DEMLR, however, the
records must be kept on file at the facility for a period of five years. This site is required to complete
qualitative monitoring twice annually. Monitoring does not appear to be done as required. Begin
monitoring as soon as the next rain and monitor every 6 months. This only requires that outfAs be observed
and documented. A copy of the monitoring form is attached for your reference.
7. Outfalls:
This site outfalls into Bob Branch along the northern side property line.
Please update your SPPP (Stormwater Pollution Protection Plan) and begin monitoring as soon as the next
rain.

In response to your renewal application for continued coverage under Stormwater General Permit NCG100000
the Division of Water Quality (DWQ) is forwarding herewith the reissued General Permit. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October
15, 2007 (or as subsequently amended).
The following information is included with your permit package:
• A new Certificate of Coverage (CDC)
• A copy of General Permit NCG100000
• A copy of the Technical Bulletin for the General Permit
• Two copies of the Discharge Monitoring Report (DMR) Form
• Two copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge
controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself
with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the
permit to update your current SPPP to reflect all new permit requirements.
The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable
storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable,
report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part II of your
permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this
permit and do not count prior exceedances.
The more significant changes in the General Permit since your last CDC was issued are noted either in the
Draft Permit Fact Sheet that accompanied the public notice (http://portal.ncdenr.org/web/wq/ws/su/current-
notices), or in the Response to Comments / Summary of Changes and Technical Bulletin documents that are
posted on the Stormwater Permitting Unit's website with the new General Permit. Please visit
http://Portal.ncdenr,org/web/wq/ws/su/npdessw (click on 'General Permits' tab) to review that information
for your specific General Permit carefully.

Some of the changes include:
Part II:
• Section A: The Stormwater Pollution Prevention Plan (SPPP) section, if applicable, has been updated
to the most current language of our permits. Additional conditions for specific industry sectors have
been added to the SPPP requirements in some cases.
• Sections B, C: Failure to perform analytical stormwater monitoring may result in the Division requiring
that the permittee begin a monthly sampling scheme.
• Sections B, C: A lower TSS benchmark of 50 mg/I for HQW, ORW, PNA and Tr Waters applies to these
more sensitive waters.
• Sections B, C: The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter
Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other
analytical monitoring requirements.
• Sections B, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in
separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined
in the "Definitions" section of the permit.
• Sections B, C. The term "Representative Storm Event" has been replaced by "Measurable Storm
Event." A measurable storm event is defined in the permit.
• Section D: If the permittee fails to respond effectively to problems identified by qualitative
monitoring, DWQ may require the permittee to perform corrective action.
Please review Parts III and IV to understand the Standard Conditions of your new NPDES General Permit,
including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and
Maintenance obligations; and Definitions. Please note that all samples analyzed in accordance with the terms
of this permit must be submitted to the Division on Discharge Monitoring Report (DMR) forms available on
the Stormwater Permitting Unit's website above. DMR forms must be delivered to the Division no later than
30 days from the date the facility receives the sampling results from the laboratory. Also note that existing
permittees do not need to submit a renewal request prior to expiration unless directed by the Division.
Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit
does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it
relieve the permittee from responsibility for compliance with any other applicable federal, state, or local law,
rule, standard, ordinance, order, judgment, or decree. If you have any questions regarding this permit

On November 6, 2013, Sue White of this office performed a Stormwater Permit Inspection at 311
Auto Parts located at 6622 US Hwy 311, Sophia, NC in Randolph County. You were present for the .
inspection. This facility holds General Stormwater Permit No. NCG100179 to discharge Stormwater from
activities associated with Used Motor Vehicle Parts under the National Pollutant Discharge Elimination
System (NPDES).
1. Permit
The permit became effective November 1, 2012 and expires October 31, 2017.
2, Records/Reports
During the inspection, it was determined that your facility has not developed a Stormwater Pollution
Prevention Plan (SPPP). In Bart II Page 1 of your permit, all the information needed to create a complete
SPPP is listed. Please refer to your permit and develop your plan.
3. Facility Site Review
This facility is an auto salvage parts yard. When vehicles are brought on site, they are pulled into an
enclosed garage and drained of fluids prior to being put on the yard to be parted out. All batteries are
stored in an enclosed area. This site has never been evaluated for the number of outfalls. This must be
done before this site can be considered compliant. Sampling and qualitative monitoring is required at all
outfalls.
4. Effluent/Receiving Waters
Stormwater from the property discharges to an un-named tributary to Bob Branch (Class WS-IV waters) in
the Cape Fear River Basin via the abovementioned Stormwater Discharge Outfalls,
5. Self -Monitoring -Program
It was determined during the inspection that the self -monitoring requirements of the General Permit have
not been performed. Monitoring requirements include semi-annual analytical sampling and qualitative
monitoring at each Stormwater Discharge Outfall (SDO) on the property. The analysis of the samples
must be performed at a NC Certified Lab.
Please keep in mind that failure to comply with all requirements is a violation of the General
Permit. According to permit text Part I II Section A, "the permittee must comply with all conditions of this
permit. Any permit noncompliance constitutes a violation of the Clean Water Act and is grounds for
enforcement action; for permit termination, revocation and reissuance, or modification; or denial of a
permit upon renewal application." Under state law, a daily civil penalty of not more than twenty-five
thousand dollars ($25,000) per violation may be assessed against any person who violates or fails to act

• Part I Section B Table 3 — Benchmark concentrations now replace cutoff concentrations; the elimination of
the option to avoid sampling based on cutoff concentrations.

Part 1l Section B —New provisions requiring the permittee to execute Tier One and Tier Two response
actions, based on the first benchmark exceedence (Tier One) and the second consecutive benchmark
exceedence (Tier Two). Tier Two requires that the permittee institute monthly monitoring instead of twice -
per -year monitoring, until three consecutive monitoring events show no benchmark exceedences.
Part II Section B —A new provision that four exceedences of any particular benchmark will trigger increased
DWQ involvement in the permittee's stormwater management and control actions. DWQ may direct the
permittee to apply for an individual permit, or may direct the implementation or installation of specific
stormwater control measures.
DWQ received a number of comments on a series of general permits similar to this one. A full response to
comments can be found at http://ncwatergtiality.ofg/su/generalpermitinfo.htm. Some comments resulted in permit

The General Permit authorizes discharges of stormwater only, and it specifies your obligations with respect to

familiarize yourself with all the changes in the reissued permit.
The more significant changes in the General Permit since your last Certificate of Coverage include the following:
• Part I Section A — A new notation that the No Exposure EXCIUsIOn from permitting option may be available to
the permittne.
• Part I Section A — A new provision that facilities draining to 303(d) listed waters, or in watersheds with an
approved TMDL, may not be eligible for renewed coverage under the General Permit.
• Part If Section B Table l — An increased sampling frequency from once per year to twice per year.
• Part If Section B Table 3 — Benchmark concentrations now replace cutoff concentrations; the elimination of
the option to avoid sampling based on cutoff concentrations.

Part II Section B —New provisions requiring the permittee to execute Tier One arid Tier Two response
actions, based on the first benchmark exceedence (Tier One) and the second consecutive benchmark
exceedence (Tier Two). Tier Two requires that the permittee institute monthly monitoring instead of twice -
per -year monitoring, until three consecutive monitoring events show no benchmark exceedences.
Part 11 Section B — A new provision that four exceedences of any particular benchmark will trigger increased
DWQ involvement in the permittee's stormwater management and control actions. DWQ may direct the
permittee to apply for an individual permit, or may direct the implementation or installation of specific
stormwater control measures.
DWQ received a number of comments on a series of general permits similar to this one. A full response to

modifications, others are addressed in the response document or Fact Sheet. A few specific requests for

On'March 24, 2009, Mike Mickey of this office met with you to perform a General Stormwater
Permit Inspection at the 311 Auto Parts facility located in Sophia, NC. The inspection found that 311
Auto Parts was in violation of the state issued stormwater permit. The specific violations are as
follows: (1) failure to request renewal of the. permit, (2) failure to the pay the $100 annual fee for
calendar years 2007 and 2008, (3) failure to have a Stormwater Pollution Prevention Plan, and (4)
failure to perform the required qualitative and quantitative monitoring. This inspection evaluated the
five areas designated on the attached inspection form. Observations from each area are .addressed
below:
1. Permit
Certificate of Coverage # NCGIO0179 for 311 Auto farts expired on 8/31/07. Information for
renewal of the permit was mailed to you in a letter dated January 28, 2007 (See letter attached). To
date, a renewal request has not been received for the used motor vehicle parts operation. This in a
violation of Part Ill, Section B(1) of the permit. Additionally, you failed to pay the required $100
administering and compliance monitoring fees for calendar years 2007 and 2008.within 30 days after
being billed by the Division (See attached invoices dated 9/18/07 and 9/17/08). This is a violation of
Part V of the permit. A copy of the stormwater pennit attached for your files.
2. Records/Reports
Part 11, Section A of the permit requires the development of a Stormwater Pollution Prevention Plan
(SPPP). To date, 311 Auto Parts has not developed the SPPP. It is strongly recommended that you
obtain the services of a consultant to assist you with preparing a SPPP specific for your facility.
3. FacilitySite Review
The facility's handling of batteries, motors, radiators, used motor oil and antifreeze was riot reviewed
during the inspection.

4. Effluent/Receiving Waters
The majority of the stormwater from the 311 Auto Parts site flows to the back of the property where it
reaches an unnamed tributary to Bob Branch, Class "WS-IV" waters in the Cape Fear River Basin.
5. Monitoring Program
Part II, Section B of the permit requires collection of semi-annual analytical samples from each .
stormwater discharge outfall during a representative storm event. No samples have ever been
collected by 311 Auto Parts. The semi-annual sampling should commence in 2009. Again, it is
strongly recommended that you obtain the services of a consultant to assist you with the collection of
these samples. The results must be submitted to the Division on form SWU-251-031308 no later than
30 days from the date the facility receives the sampling data from the laboratory (See analytical
reporting form attached).
Part II, Sectioii C of the permit requires that semi-annual qualitative (visual) monitoring be performed
and documented at each stormwater outfall at the same time that the analytical samples are collected.
No visual monitoring has been documented by 311 Auto Parts. This monitoring should be performed
semi-annually per the permit requirements (See qualitative monitoring form attached). The
qualitative records do not need to be submitted to the Division, however, the records must be kept on
file at the facility for a period of five years.
Failure to comply with any permit conditions is a violation of the General Permit. Per the
permit text in Part -III, Section A (2), "The permittee must comply with all conditions of this general
permit. Any permit noncompliance constitutes a violation of the Clean Water Act and is grounds for
enforcement action...". Additionally, per the permit text in Part III, Section A (2)(c), "Under state law,
a daily civil penalty of not more than twenty-five thousand dollars (S25,000) per violation may be
assessed against any person who violates or fails to act in accordance with the terms, conditions, or
requirements of a permit [Ref: NC General Statute 143-2 t5.6A]".
You are requested to respond, in writing, to this office on or before April 24, 2009 advising that
(1) the permit renewal application has been submitted to the Stormwater Permitting Unit in Raleigh,
(2) the overdue annual permit fee invoices have been paid, and (3) what steps 311 Auto Parts has
taken to prepare the SPPP and to ensure that the qualitative and quantitative monitoring will be
performed as required.
Please note that this office is considering sending a recommendation for enforcement to the
Director of the Division of Water Quality. Your response to this correspondence will be considered in

Your facility is currently covered for stormwater discharge under General Permit NGG_100000. This permit expires on
August 31, 2007. The Division staff is currently in the process of renewing this permit. When a draft version is
available for notice and public comment, it will be posted on our website at http!//h2o.enr.state.nc.us/su/. Once
the permit is reissued, your facility would be eligible for continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your permit. Enclosed you will find a Permit Coverage Renewal Application Form. The
application must be completed and returned by March 2, 2007 in order to assure continued coverage under the
general permit. Letters confirming our receipt of the completed application will not be sent.
Failure to request renewal within the time period specified may result in a civil assessment of at least $250,00.
Larger penalties may be assessed depending on the delinquency of the request. Discharge of Stormwater from your
facility without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and
could result in assessments of civil penalties of up to $25,000 per day.
Please note that "no exposure exclusion" is now available to all operators of industrial facilities in any of the
categories of "storm water discharges associated with industrial activity," (except construction activities). If you feel
your facility can certify a condition of "no exposure", i.e. the facility industrial materials and operations are not
exposed to Stormwater, you can apply for the no exposure exclusion. For additional information contact the Central

are forwarding herewith the subject certificate of coverage to discharge under the subject state —
NPDES general permit. This permit is issued pursuant to the requirements of North Carolina
General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the
US Environmental Protection Agency dated May 9, 1994 (or as subsequently amended).
Please take notice that this certificate of coverage is not transferable except after notice to
the Division of Water Quality, The Division of Water Quality may require modification or
revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be
required by the Division of Water Quality or permits required by the Division of Land
Resources, Coastal Area Management Act or any other federal or local governmental permit that

Motor Vehicles). This facility sells used auto parts. The stormwater discharge drains to a UT to Bob
Branch, both Class WS-IV in the Cape Fear River Basin. This facility is located in Randolph
County, handled by the Winston-Salem Regional Office.
Application review
a) The permit application has been signed and sufficiently completed. Yes.
b) The SIC code accurately describes this facility's activities and is covered by this general
permit. Yes. SIC: 5015 (Used Motor Vehicle Parts)
c) Does this facility have other permits? No.
d) Hazardous Waste Activities? Yes
Applicant indicated facility is a small quantity generator (< 1000 kg per month).
Material is stored in a large standing tank inside the building...?
Per company contact (Roger Miller, 336.431.8988) on 8/2/05:
Facility stores used motor oil in a 300 gallon tank on a stand inside the building (oil
pumped into it). Any spills would be onto the concrete and should not drain out
anywhere. Spills would be cleaned promptly from the floor. Have not had any major
spills; applicant also mentioned that facility is in the midst of a major clean-up and
has about three more weeks of "heavy-duty clean-up" ahead of them.

I just spoke with the applicant Roger Miller. He says the used motor oil is stored in a 300 gallon
tank that is on a stand and inside the building. Any spills would be onto the concrete inside but
should not drain anywhere, and would be cleaned up promptly. He also mentioned they've been in

clean-up"...not sure what that means, but hopefully they're improving things.

I phoned the contact (Roger Miller, 336.431.8988) today to follow-up on haz waste storage, but
haven't been able to get in touch yet.
Does the Winston-Salem Regional Office have any concerns with issuing a COC for this
facility? Maybe you are already familiar with the site.
