On behalf of Crutchfield Mobile Crusher (Crutchfield), Mid -Atlantic Associates, Inc. is pleased to submit
this letter in response to the Notice of Violation (NOV) issued by the North Carolina Department of
Environmental Quality (NCDEQ), Department of Energy, Minerals and Land Resources on December
4, 2015. The NOV was issued based on the results of a recent site inspection conducted on December
3, 2015, which identified several issues regarding compliance with the facility's Industrial Stormwater
Permit. Mr. Edd Marsh, Manager, was present for the inspection and, upon completion, contracted with
Mid -Atlantic to provide assistance with the requested services. Specifically, these include:
Develop a Stormwater Pollution Prevention Plan (SPPP) in accordance with General Permit
NCG100170, Part II Section A; and
Coordinate the required semi-annual stormwater monitoring (qualitative and quantitative)
required by NCG100170. This includes arranging for delivery of sample coolers, providing
reminders about required activities, completing the required Discharge Monitoring Reports and
forwarding the reports to Crutchfield representatives for execution and submittal to the NCDEQ
Division of Water Resources. Crutchfield representatives will conduct the required monitoring
and sampling activities.
These activities will be initiated within 30 days following issuance of this response. We hope that this
information satisfies the items addressed in the NOV. If you have any questions or need additional

On December 03, 2015 Glen White of the North Carolina -Department of Environmental Quality;
Department of Energy, Minerals and Land Resources visited the subject facility located at 1941
US Hwy 70 located in Mebane to conduct an inspection for compliance with the facilities
Industrial Stormwater Permit. Mr. Edd Marsh, Manager, was present for the inspection and his
assistance was greatly appreciated. This facility was found to be in continued violation of
requirements of the permit. The prior Notice of Violation was issued on July 22, 2011 following
inspection by Jenny Graznak. At that time no enforcement was initiated.
General Industrial Stormwater Pen -nit NCGI O0170 was issued to Logan Crutchfield
(Responsible Party) on November 05, 2004 for industrial activity associated with Used Motor
Vehicle Parts according to G.S. 143-215.1 and Title 15A North Carolina Administrative Code
(hereby known as NCAC) 2H .0126. The permittee is required to develop a Stormwater
Pollution Prevention Plan and monitor per permit requirements.
Accordingly, the following observations and permit condition violations were noted during the Division
of Water Resources inspection and subsequent file review:
1. Stormwater Pollution Prevention Plan (SPPP): The General Permit NCG 100170, Part I1
Section A, No. I thru 9 requires the permittee to develop and implement a SPPP that
includes all of the information required. The DEMLR inspection revealed that this
facility has not developed or initiated a SPPP as required for permit compliance,

2. Qualitative Monitoring: General Permit NCG 100170, Part I1, Section C required that the
facility conduct qualitative monitoring twice per year following the established
guidelines. The facility has not been monitoring per the permit requirements.
Monitoring must be completed twice annually and records must be kept with the SPPP
for a minimum of (5) five years. Qualitative monitoring is required even if the permittee
is allowed to opt out of analytical monitoring.
Analytical Monitoring: General Permit NCG 100170, Part II, Section B required the
permittee to conduct analytical monitoring twice annually. The permittee may petition
DEQ Winston-Salem's Regional Office to be excused from required analytical
monitoring after a compliance report shows that the facility has been maintaining its
permit and is compliant with permit requirements. Failure to develop a SPPP and failure
to monitor per permit requirements does not grant permission to opt out of required
monitoring.
Required Response
Accordingly, you are directed to respond to this letter in writing within 30 calendar days of
receipt of this Notice. Your response should explain how each issue will be addressed and
should be sent to this office at the letterhead address and include the following:
1. Develop a Stormwater Pollution Prevention Plan to include all information required per
NCG 210016 Part II, Section A.
2. Begin Qualitative Monitoring and provide twice annually. Keep record in the SPPP
binder.
3. Begin Analytical Monitoring per permit requirements. NCDEQ cannot recommend a
testing facility. Locate a testing facility and get on a regular schedule with them so that
analytical monitoring can be conducted bi-annually. All records must remain with the
SPPP for a minimum of (5) five years.
Thank you for your attention to this matter. This Office is sending a recommendation for
enforcement to the Director of the Division regarding these issues and any future%ontinued
violations that may be encountered. This office requires that the violations, as detailed
above, be abated immediately and properly resolved. Environmental damage and/or failure
to secure proper authorizations have been documented on the subject tract as stated above. Your
efforts to undertake activities to bring the subject site back into compliance is not an admission,
rather it is an action that must be taken in order to begin to resolve ongoing environmental issues.
Pursuant to G.S. 143-215.6A, these violations and any future violations are subject to a civil
penalty assessment of up to a maximum of $25,000.00 per day for each violation. Your
above -mentioned response to this correspondence, the degree and extent of harm to the
environment and the duration and gravity of the violation(s) will be considered in any civil
penalty assessment process that may occur. Should you have any questions regarding these

In response to your renewal application for continued coverage under stormwater General Permit NCG100000
the Division of Water Quality (DWQ) is forwarding herewith the reissued General Permit. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October
15, 2007 (or as subsequently amended).
The following information is included with your permit package:
• A new Certificate of Coverage (COC)
• A copy of General Permit NCG100000
• A copy of the Technical Bulletin for the General Permit
• Two copies of the Discharge Monitoring Report (DMR) Form
• Two copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge
controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself
with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the
permit to update your current SPPP to reflect all new permit requirements.
The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable
storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable,
report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part II of your
permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this
permit and do not count prior exceedances.
The more significant changes in the General Permit since your last COC was issued are noted either in the
Draft Permit Fact Sheet that accompanied the public notice (http://portal.ncdenr.org/web/wq/ws/su/current-
notices), or in the Response to Comments / Summary of Changes and Technical Bulletin documents that are
posted on the Stormwater Permitting Unit's website with the new General Permit. Please visit

for your specific General Permit carefully.

Some of the changes include:
• Part II:
• Section A: The Stormwater Pollution Prevention Plan (SPPP) section, if applicable, has been updated
to the most current language of our permits. Additional conditions for specific industry sectors have
been added to the SPPP requirements in some cases.
• Sections B, C: Failure to perform analytical stormwater monitoring may result in the Division requiring
that the permittee begin a monthly sampling scheme.
• Sections B, C: A lower TSS benchmark of SO mg/I for HOW, ORW, PNA and Tr Waters applies to these
more sensitive waters.
• Sections B, C: The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter
Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other
analytical monitoring requirements.
• Sections B, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in
separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined
in the "Definitions" section of the permit.
• Sections B, C: The term "Representative Storm Event" has been replaced by "Measurable Storm
Event." A measurable storm event is defined in the permit.
• Section D: If the permittee fails to respond effectively to problems identified by qualitative
monitoring, DWQ may require the permittee to perform corrective action.
Please review Parts III and IV to understand the Standard Conditions of your new NPDES General Permit,
including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and
Maintenance obligations; and Definitions. Please note that all samples analyzed in accordance with the terms
of this permit must be submitted to the Division on Discharge Monitoring Report (DMR) forms available on
the Stormwater Permitting Unit's website above. DMR forms must be delivered to the Division no later than
30 days from the date the facility receives the sampling results from the laboratory. Also note that existing
permittees do not need to submit a renewal request prior to expiration unless directed by the Division.
Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit
does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it
relieve the permittee from responsibility for compliance with any other applicable federal, state, or local law,
rule, standard, ordinance, order, judgment, or decree. If you have any questions regarding this permit

On July 19, 2011, Jenny Graznak of this office performed a Stormwater Permit Inspection at
Crutchfield Mobile Crusher located at 1941 US Highway 70 in Haw River, Alamance County. You
were present for the inspection. This facility holds General Stormwater Permit No. NCG100170 to
discharge Stormwater from activities associated with Used Motor Vehicle Parts under the National
Pollutant Discharge Elimination System (NPDES). This type of inspection consists of two basic
parts: a review of facility files and self -monitoring data, and an on -site inspection of the facility and its
outfalls. You were present for the inspection. This particular inspection evaluated five (5) areas and
observations from each area are addressed below:
1. Permit
The permit became effective November 1, 2007 and expires October 31, 2012. A copy of the Permit
was available during the inspection.
2. Records/Reports
During the inspection, it was determined that your facility has not developed a Stormwater Pollution
Prevention Plan as required by the permit. The Stormwater Pollution Prevention Plan needs to
include, at a bare minimum, the following: a site map of your property, a description of your storage
practices for oil and other petroleum materials on site, a Spill Prevention and Response Plan, a
Good Housekeeping program, and a Facility inspection Program. All of these requirements are
thoroughly described in your permit in Part h Section A.
3. Facility Site Review
Crutchfield Mobile Crusher is divided into two sites that are down the street from each other. One
site is a "working site" and the other is used for storage. Storage practices and materials handling is
identical at each location. When a car arrives at the facility, the radiator is pulled out and the fluid is
stored in drums. Oil is pulled out before the car moves to the yard. When the crusher arrives on the
site, the gasoline tanks on the cars are drained into drums before crushing. Within a week, a
recycling company hauls off these drums. A lead recycler picks up old batteries as needed.
Transmissions and engines are placed in the yard with the cars. Some oil stains were noted on the
ground, but none were significant.

4. Effluent/Receiving Waters
Stormwater from the property discharges to Back Creek (Class C, NSW) in the Cape Fear River
Basin. Each location has its own Stormwater discharge outfall. Both outfalls are overgrown with
grass and weeds and showed signs of soil erosion.
5. Self -Monitoring Program
It was determined during the inspection that you have not been performing the self -monitoring
requirements of the General Permit. The permit requires you to take Stormwater samples from each
outfall twice a year. You will have to send the sample to a North Carolina Certified Wastewater Lab
(list of these laboratories is attached). You are also required to make observations of the outfalls and
keep reports from these inspections. All of these requirements are thoroughly described in your
permit in Part II Section B & C.
You are found to be in violation of your Stormwater Permit for the following reasons:
(1) Failure to develop a Stormwater Pollution Prevention Plan, and
(2) Failure to perform the monitoring requirements of the Permit.
This office is considering enforcement for the violations cited above. Your response to this
letter will be considered in this process. You must respond in writing to this office within 10
business days of receipt of this letter, advising us of the actions you will take to comply with
the requirements listed in this letter. Failure to do so will result in a recommendation by this office
for the pursuit of enforcement actions against you. Please include in your response a detailed
description of why these violations occurred and how they will be prevented in the future. If you
have any questions concerning this letter or the attached inspection report, please contact Ms.

In accordance with your application for discharge permit received on September 20, 2004, we
are forwarding herewith the subject certificate of coverage to discharge under the subject state - NPDES
general permit. This permit is issued pursuant to the requirements of North Carolina General Statute
143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental
Protection agency dated May 9, 1994 (or as subsequently amended).
' if any parts, measurement frequencies, or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual
permit application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the
Division of Water Quality. The Division of Water Quality may require modification or revocation and
reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required
by the Division of Water Quality or permits required by the Division of Land Resources, Coastal Area
Management Act, or any other Federal or Local governmental permit that may be required.
