(DEMLR)'conducted a compliance evaluation inspection at the subject facility on October 7, 2015. Your
cooperation and assistance was greatly appreciated. An inspection checklist is attached for your records and
the inspection findings are summarized below.
1. Permit
This facility holds General Storm water Permit No. NC100132 to discharge Storm water from activities
associated with Used Motor Vehicle Parts and Auto Wrecking for Scrap under the National Pollutant
Discharge Elimination System (NPDES), The permit became effective August 1, 2013 and expires July 31,
2018. Your permit renewal package must be received in the Central Office in Raleigh no later than 180 days
prior to the expiration date of the permit.

2. Records/Reports
Part II, Section A of the permit requires the development of a Stormwater Pollution Prevention Plan (SPPP).
The plan must include all nine (9) subsections of Part II, Section A of the permit. Qualitative monitoring is
required to'be completed and documented twice yearly as defined in Part II, Section C of the permit. The
SPPP plan must be updated annually and qualitative and analytical monitoring must be conducted and
properly documented semi-annually to retain compliance with the permit. Part of a SPPP had been
developed in the past but was not being maintained and was not current.

3. Facility Site Review
This facility pulls and sells parts from salvage vehicles and sells scrap metal from vehicles crushed. Ali fluids
are removed and stored under roof until they can be removed from the facility for recycling. Batteries are
stored inside and are also sold for recycling.
4. Effluent/Receiving Waters
Stormwater from this•site discharges into the Yadkin River (Class C, NSW) River Basin.
S. Self -Monitoring Program
Analytical Monitoring: This site is required to provide analytical monitoring under current operating
procedures. Monitoring has not been done in several years. Owner said that monitoring facility used in the
past went out of business. He has just found a new facility and is beginning testing now. Begin monitoring
as soon as the next rainfa#I even.
6. Qualitative Monitoring: All qualitative records do not need to be submitted to DEMLR, however, the
records must be kept on file at the facility for a period of five years. This site is required to complete
qualitative monitoring twice annually. Monitoring does not appear to have been done as required. Begin
monitoring as soon as the next rain and monitor every 6 months. This only requires that outfalls be observed
and documented. A copy of the monitoring form is attached for your reference.
Please update your SPPP (Stormwater Pollution Protection Plan) and begin monitoring as soon as the next
rain. Begin testing even if an updated SPPP is not yet available. The facility is currently non -compliant and
an opportunity to correct discrepancies is being provided. The site will be re -inspected in 2016 to review
progress and verify compliance with the permit.

In response to your renewal application for continued coverage under Stormwater General Permit NCGl00000
the Division of Water Quality (DWQ) is forwarding herewith the reissued General Permit. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October
15, 2007 (or as subsequently amended).
The following information is included with your permit package:
• A new Certificate of Coverage (COC)
• A copy of General Permit NCG100000
• A copy of the Technical Bulletin for the General Permit
• Two copies of the Discharge Monitoring Report (DMR) Form
• Two copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge
controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself
with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the
permit to update your current SPPP to reflect all new permit requirements.
The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable
storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable,
report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part II of your
permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this
permit and do not count prior exceedances.
The more significant changes in the General Permit since your last COC was issued are noted either in the
Draft Permit Fact Sheet that accompanied the public notice (http://Portal,ncdenr.org/web/wq/ws/su/current-
notices), or in the Response to Comments / Summary of Changes and Technical Bulletin documents that are
posted on the Stormwater Permitting Unit's website with the new General Permit. Please visit

for your specific General Permit carefully.

Some of the changes include:
• Part II:
* Section A: The Stormwater Pollution Prevention Plan (SPPP) section, if applicable, has been updated
to the most current language of our permits. Additional conditions for specific industry sectors have
been added to the SPPP requirements in some cases.
* Sections B, C: Failure to perform analytical stormwater monitoring may result in the Division requiring
that the permittee begin a monthly sampling scheme.
* Sections B, C: A lower TSS benchmark of SO mg/I for HOW, ORW, PNA and Tr Waters applies to these
more sensitive waters.
* Sections B, C: The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter
Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other
analytical monitoring requirements.
* Sections B, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in
separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined
in the "Definitions" section of the permit.
* Sections B, C. The -term "Representative Storm Event" has been replaced by "Measurable Storm
Event." A measurable storm event is defined in the permit.
* Section D: If the permittee fails to respond effectively to problems identified by qualitative
monitoring, DWQ may require the permittee to perform corrective action.
Please review Parts III and IV to understand the Standard Conditions of your new NPDES General Permit,
including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and
Maintenance obligations; and Definitions. Please note that all samples analyzed in accordance with the terms
of this permit must be submitted to the Division on Discharge Monitoring Report (DMR) forms available on
the Stormwater Permitting Unit's website above. DMR forms must be delivered to the Division no later than
34 days from the date the facility receives the sampling results from the laboratory. Also note that existing
permittees do not need to submit a renewal request prior to expiration unless directed by the Division.
Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit
does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it
relieve the permittee from responsibility for compliance with any other applicable federal, state, or local law,
rule, standard, ordinance, order, judgment, or decree. if you have any questions regarding this permit

This letter is being sent to you in response to our Notice of Deficiency dated, November 7, 2011 and
received in our office on November 9, 2011 about our SPPP. On October 19, 2011, Sue White visited our
facility and determined that we had not completed our QMR, or SDO reports properly. We have taken
immediate action to rectify this situation. Ms White discussed and explained what we need to do, because of
our lack of understanding and knowledge on the matter.
We are preparing a narrative description of practices required by the SPPP. We have prepared forms to
allow our inspection process evaluate areas of concern on our site and determine feasible alternatives to
manage pollution prevention. Based on Ms White's direction, we have begun qualitative monitoring
immediately and have begun researching labs that can analyze our collected samples as required by the
analytical monitoring process. We have identified two areas on our site to perform analytical monitoring as
shown on the site plan.
Our company is very careful to prevent any stormwater runoff contamination. We have consulted an
engineer on the matter and have hired a person to help oversee that all requirements are being implemented.
That implementation includes creating established times for inspections, preparing detailed forms to fill out
for site inspections, written instructions for spill prevention, and employee training for responsible practices
of pollution prevention. We are also creating forms to document our employee training activities that we will
be conducting periodically. Some of the practices we already have in place include: maintaining all liquids
under roofs and dismantling of vehicles indoors where fluids can be easily contained and disposed of quickly.
We have no real bulk storage, but do have secondary containment in the area as a precaution. After vehicles
have been dismantled, they are completely emptied of fluids before being placed in the inventory/storage area.
These practices will continue to be performed as pollution prevention activities.
We have never had any occurences of spillage or contamination, and will continue to monitor
the site.

On October 19, 2011, Sue White of this office performed a Stormwater Permit Inspection
at Rik's Auto Parts located at 10141 Hwy 67 in Yadkin County. You were present for the
inspection. This facility holds General Stormwater Permit No. NCG100132 to discharge
Stormwater from activities associated with Used Motor Vehicle Parts under the National
Pollutant Discharge Elimination System (NPDES).
1. Permit
The permit became effective November 1, 2007 and expires October 31, 2012.
2. Records/Reports
During the inspection, it was determined that your facility has not developed a Stormwater
Pollution Prevention Plan (SPPP) as required by the permit. There is a site map at the facility
that shows the overall property and has the outfalls marked. Please refer to permit text Part II
Section A, which describes the requirements for the SPPP.
3. Facility Site Review
The facility has two stormwater discharge outfalls (SDO), which collects Stormwater from the
majority of the site. These outfalls are where the qualitative and analytical monitoring needs to
take place.
All fluids at the facility are maintained indoors with secondary containment. When a car comes
onto the lot, it is pulled under cover and all fluids are removed and either stored in barrels under
cover or removed from the site by a licensed hauler. Batteries are kept under a storage shed
before taken to final disposal/sale.
4. Effluent/Receiving Waters
Stormwater from the property discharges to the Yadkin River (Class C, NSW) in the Yadkin
River Basin via the abovementioned stormwater discharge outfalls.

5, Self-Monitorinq Program
It was determined during the inspection that you have not been performing the self -monitoring
requirements of the General Permit. Monitoring requirements include one annual analytical
sampling event per year, which will require the use of a North Carolina Certified Wastewater
Lab and semi-annual qualitative monitoring at each stormwater discharge outfall on the property
that you can perform yourself.
The failure to comply with these requirements is a violation of the General Permit.
According to permit text Part III Section A, "the permittee must comply with all conditions of this
permit. Any permit noncompliance constitutes a violation of the Clean Water Act and is grounds
for enforcement action; for permit termination, revocation and reissuance, or modification; or
denial of a permit upon renewal application." Under state law, a daily civil penalty of not more
than twenty-five thousand dollars ($25,000) per violation may be assessed against any person
who violates or fails to act in accordance with the terms, conditions, or requirements of a permit.

You must respond in writing to this office within 15 days of receipt of this letter, advising
us of the actions taken to abate the violations. Please include in your response a detailed
description of why these violations occurred and how they will be prevented in the future. If you

On June 24, 2011, Division personnel received your request to revise your stormwater permit

In accordance with your application for discharge permit received on January 27. 2003, we are forwarding
herewith the subject certificate of coverage to discharge under the subject state - NPDES general permit. This permit is
issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the Memorandum of Agreement
between North Carolina and the US Environmental Protection agency dated December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you,
you have the right to request an individual permit by submitting an individual permit application. Unless such demand is
made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division of Water
Quality. The Division of Water Quality may require modification or revocation and reissuance of the certificate of
coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by the Division
of Water Quality or permits required by the Division of Land Resources, Coastal Area Management Act or any other
Federal or Local governmental pern'►it that may be required.
