Dear Mr. Gregson:
Foss Recycling, Inc. (Foss) appreciates the opportunity to respond to your NPDES Compliance
Inspection Report, dated July 30, 2013. The report was based on observations noted during an
NPDES compliance inspection conducted at the above -referenced facility on July 17, 2013. As
indicated in the report, the facility was found to be in minimal compliance with the permit
requirements. The issues or findings noted during the compliance inspection are listed below in
italics, with the responses and/or actions taken provided directly beneath them.
Item 9: The location and numbers of the outfalls need to be addressed and corrected, if
necessary, on the site plan. Both outfalls need to be sampled for the analytical and
qualitative monitoring requirements from this time forward.
Stormwater at the site either infiltrates into the sandy site soils, leaves the site as sheet flow or
enters the on -site network of drainage ditches. The ditches are interconnected and ultimately
discharge off -site at Outfall No. 1, located on the southeast portion of the site. During heavy
rain events, stormwater entering the ditches may also overflow and leave the site as sheetflow
on the northern portion of the site. Outfall No. 1 is located at the intersection of two drainage
ditches, which run along the southern and eastern perimeters of the site. An updated site map
showing the direction of flow associated with the on -site ditch network, as well as the location
of Outfall No. 1, is provided as an attachment. In addition, a path/walkway will also be cleared
along the southeast portion of the site in order to provide better access for outfall monitoring.
Qualitative and quantitative monitoring will continue to be conducted on a semi-annual basis
at Outfall No. 1.
Prior to the July 17, 2013 site inspection, the facility also included a potential stormwater
discharge outfall location along the western property boundary of the site (identified on the
previous site map as Potential Outfall No. 2). During the site inspection, the portion of the
drainage ditch associated with this potential outfali had recently been cleared and over -
excavated. Given the overall topographic gradient and general direction of stormwater flow
within the ditch, the over -excavation activities ultimately resulted in the formation of a point -
source discharge on this portion of the site. In order to eliminate the presence of a second
point -source discharge, the portion of the ditch associated with Potential Outfall No. 2 was
then backfilled. Stormwater runoff from this area will now be directed into the remaining on -
site ditch network, which flows east/west across the site prior to either discharging off -site
at Outfall No. 1 or leaving the site as sheetflow on the northern portion of the site.
Item 2: Good housekeeping practices need to be increased in dealing with (a) daily
inspections of fuel and transmission spills on -site and their immediate clean up (b) daily
cleaning of the fuel spills around the fluid drainage area to prevent the fuel from leaving the
concrete pad; (c) cleaning up of the debris in the ditches on -site to allow the water to now to
the outlets; and (d) areas around the lot need to be bermed to prevent illicit stormwater
discharges.
Better housekeeping practices will be implemented at the site and incorporated into the
day-to-day operations to ensure that spills/releases are cleaned up upon initial discovery.
Particular emphasis will be applied to the covered drain racks, bulk fluid aboveground
storage tanks (ASTs) and surrounding concrete pad along the western exterior of the scrap
metal storage building.
Following the July 17, 2013 site inspection, Foss personnel took measures to clean out and
remove debris from the on -site ditch network, as discussed with you during the site
inspection. In the future, routine measures will be implemented at the site to ensure the
ditches remain unimpeded and continue to flow as designed. In addition, Foss personnel
also constructed earthen berms along the northern portion of the property (where
stormwater runoff would leave the site as sheet flow) to prevent illicit discharges and
eliminate the potential for a point -source discharge on this portion of the site. However, the
areas along the southern and eastern portions of the site discharge directly into one of two
adjacent drainage ditches, which run along the southern and eastern perimeters of the site
prior to merging and discharging off -site at Outfall No, 1.
Foss appreciates this opportunity to respond to the NPDES Compliance Inspection Report. The
inspection has helped to clarify the necessary procedures required to remain in full compliance
with NPDES General Permit NCG100000. It is hoped that these actions and responses will be
to your satisfaction. If you have any questions or need additional information, please do not
hesitate to contact me at 252-560-7821 or deubanks fossrec clip .cam.

Inspection summary:
The site is mainly in compliance but needs to do a more good housekeeping duties. The following issues need to be
addressed:
1) The ditches on -site have alot of debris in them and should be cleaned out to keep the water moving off the site.
2) A couple of areas around the perimeter of the lot need to be bermed to prevent illicit drainage areas.
3) The facility needs to be more diligent about checking for hydrocarbon spills in the yard daily and cleaning them up
ASAP (within 24 hrs)and disposing of the material properly.
4) The confusion of the outfall numbering needs to be addressed. Please send pictures of where you have determined
where outfall #1 is (since the location on the site map and the physical location itself did not look to be an outfall) or if you
change the location. Please address which outfall has been previously sampled and how you want to address this in the
future. Be sure to update the Stormwater Pollution Prevention Plan with this information.
5) Whatever the•facility can do to maintain a vegetated buffer around the perimeter of the lot would benefit the facility
itself.

Comment.
The site has tanks that the car fluids are drained into the bottom of the rack where the
cars are placed has a secondary catch basin that fluids are captured that do not make it
it to the tanks. This catch basin is then drained and the fluids are drained into tanks.
The DWQ observed some areas where fluids had drained across the concrete pad
where the draining station is located and suggests that additional inspections and
general good housekeeping maintanence be stepped up for this area. Although the
station is located under a roof, it could cause potential problems if not consistently
cleaned and maintained.

Has the facility conducted its Analytical monitoring? ■ ❑ Q 0
# Has the facility conducted its Analytical monitoring from Vehicle Maintenance areas?
Comment: The facility has collect sample from Outfall #1 consistently. It is not clear if
outfall #2 does not discharge, or if samples had not been collected four it or if the
sample was mis numbered. The site plan shows two outfalls and the site inspection
would lead one to think that outfall #2 would discharge before outfall #1. The answer to
this will be determined by Mr. Eubanks and he will respond to this issue.
Permit and Outfalls
# Is a copy of the Permit and the Certificate of Coverage available at the site?
# Were all outfalls observed during the inspection?
# If the facility has representative outfall status, is it properly documented by the Division?
# Has the facility evaluated all illicit (non stormwater) discharges?
Comment: The facility has recently changed management of the environmental
portion of the facility. Mr. Eubanks was shown what to look for in the site inspections in
determining the areas of illicit stormwater discharge. He has agreed to fix (berm up) the
areas where the discharges are occurring.

Dear Permittee:
In response to your renewal application for continued coverage under stormwater General Permit NCG100000
the Division of Water Quality (DWQ) is forwarding herewith the reissued General Permit. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October
15, 2007 (or as subsequently amended).
The following information is included with your permit package:
• A new Certificate of Coverage (COC)
• A copy of General Permit NCG100000
• A copy of the Technical Bulletin for the General Permit
• Two copies of the Discharge Monitoring Report (DMR) Form

The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge
controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself
with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the
permit to update your current SPPP to reflect all new permit requirements.
The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable
storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable,
report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part II of your
permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this
permit and do not count prior exceedances.
The more significant changes in the General Permit since your last COC was issued are noted either in the
Draft Permit Fact Sheet that accompanied the public notice(http://portal.ncdenr.org/web/w&wsZsu/current-

Some of the changes include:
Part II:
• Section A: The Stormwater Pollution Prevention Plan (SPPP) section, if applicable, has been updated
to the most current language of our permits. Additional conditions for specific industry sectors have
been added to the SPPP requirements in some cases.
• Sections B, C: Failure to perform analytical stormwater monitoring may result in the Division requiring
that the permittee begin a monthly sampling scheme.
• Sections B, C: A lower TSS benchmark of 50 mg/I for HOW, ORW, PNA and Tr Waters applies to these
more sensitive waters.
• Sections B, C: The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter
Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other
analytical monitoring requirements,
• Sections B, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in
separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined
in the "Definitions" section of the permit.
• Sections B, C. The term "Representative Storm Event" has been replaced by "Measurable Storm
Event." A measurable storm event is defined in the permit.
• Section D: If the permittee fails to respond effectively to problems identified by qualitative
monitoring, DWQ may require the permittee to perform corrective action.
Please review Parts III and IV to understand the Standard Conditions of your new NPDES General Permit,
including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and
Maintenance obligations; and Definitions. Please note that all samples analyzed in accordance with the terms
of this permit must be submitted to the Division on Discharge Monitoring Report (DMR) forms available on
the Stormwater Permitting Unit's website above. DMR forms must be delivered to the Division no later than
30 days from the date the facility receives the sampling results from the laboratory. Also note that existing
permittees do not need to submit a renewal reguest prior to expiration unless directed by the Division.
Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit
does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it
relieve the permittee from responsibility for compliance with any other applicable federal, state, or local law,
rule, standard, ordinance, order, judgment, or decree. If you have any questions regarding this permit
package, please contact the Division's Stormwater Permitting Unit at (919) 807-6300.

outline our plansimeasures to address the issues noted in your letter:
• Mid -Atlantic Associates, Inc. (Mid -Atlantic) has prepared a new site map for the
facility showing the drainage ditches within the site boundaries.
• We will continue to monitor potential discharges from Outfall No. 2 and sample
this outfall when and if it discharges, as outlined in the current SPPP. We will
also update the map to show the connectivity of these two outfalls when it is
determined.
• Foss will take measures to make sure that sampling is conducted within 30-
minutes of the start of the discharge. This may include training on -site personnel
to perform the sampling.
• Foss will continue to evaluate sampling results to determine if other site
improvements (vegetative buffers, filter strips, etc.) are necessary to maintain
compliance with our general permit.
We appreciate the opportunity to respond to your request. Please do not hesitate to
contact me at 919-252-9252 or delmore@fossrecycling.com if you have any questions.

Permit, NiCG100119 Owner - Facility: Foss Recycling Inc
Inspection Date: 03/15/2011 Inspection Type: Compliance Ervaivation Reason for Visit: Routine
Inspection Summary:
This was an unannounced visit.
Management of the site has changed in the recent past and both he & the company are trying to make operational and
physical changes at the site. Overall site is in fairly good shape, but some issues do exist. Facility is considered to be
marginally compliant since plan is in place and at least some sampling & inspections are occurring, but missing any
sampling events from Outfall #2 is an issue unless "representative outfall status" is granted by DWQ to Outfall #1, if
deemed appropriate to do so.
Site could really use stabilization of most drainage ditches with establishment of vegetative buffers or filter strips along
them that are maintained and protected from on -site activities plus include periodic trash or debris removal. On -site staff
or manager should be trained and put in charge of sampling to make it easier for facility/company to obtain representative
sample(s) from applicable outfalls and within sampling constraints or windows; sample kits are kept at the site.
Site contains a 1000-gal AST for old fuel, 250-gal AST for used oil, 500-g6l AST for old antifreeze, and one 1000 &
1500-gal AST for diesel fuel. Site utilizes a mobile car crusher (tractor trailer mounted) that visits site as needed_

Comment: Sampling being done for Outfall #1, but not for Outfall #2. Sample results
for last half of 2010 are not present. Attempts have to be made to perform sampling for
all outfalls and may not be capable to sample all outfalls for the same rainfall event if a
discharge is not produced at all locations. Company staff from headquarters in
LaGrange (1,5 hours away) has been doing the sampling and it seems improbable that
they can catch discharge within the first 30 minutes, Records reviewed show the
sample collection events have usually occurred in the last month of the sampling
window and the company/facility runs the risk of not being able to obtain a sample for
all required outfalls within the remaining time. The above observations pose concern
about sampling events & data. collected, thus recommend that on -site manager/staff are
trained to perform sampling.

Your facility is currently covered for stormwater discharge under General Permit NCG100000. This permit expires
on August 31, 2002. The Division staff is currently in the process of rewriting this permit and is scheduled to have
the permit reissued by late summer of 2002. Once the permit is reissued, your facility would be eligible for
continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in
advance that your permit will be expiring. Enclosed you will find a General Permit Coverage Renewal
Application Form. The application must be completed and returned by March 4, 2002 in order to assure continued
coverage under the general permit.
Failure to request renewal within this time period may result in a civil assessment of at least $250.00. Larger
penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your facility
without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and
could result in assessments of civil penalties of up to $10,000 per day.
Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the 11 categories of "storm water discharges associated with industrial activity," (except
construction activities). if you feel your facility can certify a condition of "no exposure", i.e. the facilty industrial
materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion. For additional
information contact the Central Office Stormwater Staff member listed below or check the Stormwater & General
Permits Unit Web Site at http://h2o.enr.state.nc.us/stt/stormwater.htmI
If the subject stormwater discharge to waters of the state has been terminated, please complete the enclosed
Rescission Request Form. Mailing instructions are listed on the bottom of the form. You will be notified when the
rescission process has been completed.
If you have any questions regarding the permit renewal procedures please contact Ed Beck of the Wilmington
Regional Office at 910-395-3900 or Aisha Lau of the Central Office Stormwater Unit at (919) 733-5083, ext. 578
