On June 12, 2018 this facility was inspected for compliance. I met with Jim Queen on site. SWPPP was maintained and no
compliance issues were observed during the inspection.
However, be advised that the current North Carolina General Permit for Used Motor vehicles requires monitoring for the
following parameters: PH, Total Suspended Solids, Non -Polar Oil & Grease, Ethylene Glycol, Total recoverable Lead, and
Total Toxic Organics (TTO). If the facility is exempt from TTO monitoring based on NCG100000 requirements. Please submit

concerning the representative outfall status for this permit.
This is the second inquiry concerning this permit.
Follow-up.
Wednesday, May 30, 2018. Called Ms. Albert and left a voice message that I returned her call.
Thursday, May 31, 2018. Ms. Albert returned my call of the 30'th. She said the request for
representative outfall status was delivered at the Asheville Regional Office on April 17'th to DWQ.
I gave her Isaiah's phone number as a new contact for this site.

4) Detailed explanation about why the outfalls above should be granted Representative Status:
(Or, attach a letter or narrative to discuss this information.) For example, describe how activities and/or
materials are similar.
Activities and materials exposed to_stormwater are substantially identical and are expected to have
substantially identical effluent. Samples should be collected from Outfall 004 as it is the anticipated
"worst case scenario" outfall as indicated by the drainage area and level of industrial activity.
5) Certification:
North Carolina General Statute 143-215.6 B(i) provides that:
Any person who knowingly makes any false statement, representation, or certification in any application, record,
report, plan, or other document filed or required to be maintained under this Article or a rule implementing this
Article; or who knowingly makes a false statement of a material fact in a ruiemaking proceeding or contested case
under this Article; or who falsifies, tampers with, or knowingly renders inaccurate any recording or monitoring device
or method required to be operated or maintained under this Article or rules of the [Environmental Management]
Commission implementing this Article shall be guilty of a Class 2 misdemeanor which may include a fine not to exceed
ten thousand dollars ($10,000).
I hereby request Representative Outfall Status for my NPDES Permit. I understand that ALL outfalls are still
subject to the qualitative monitoring requirements of the permit, unless otherwise allowed by the permit
and regional office approval. I must notify DWQ in writing if any changes to the facility or its operations
take place after ROS is granted that may affect this status. If ROS no longer applies, I understand I must
resume monitoring of all outfalls as specified in my NPDES permit.

Activities and materials exposed to stormwater are substantially identical and are expected to have
substantially_ identical effluents. Samples should be collected from Outfall 001 as it represents the
"worst case scenario". This is due to the higher level of industrial activity being conducted in the
drainage area of the Outfall 001.
5) Certification:
North Carolina General Statute 143-215.6 B(i) provides that:
Any person who knowingly makes any false statement, representation, or certification in any application, record,
report, plan, or other document filed or required to be maintained under this Article or a rule implementing this
Article; or who knowingly makes a false statement of a material fact in a rulemaking proceeding or contested case
under this Article; or who falsifies, tampers with, or knowingly renders inaccurate any recording or monitoring device
or method required to be operated or maintained under this Article or rules of the [Environmental Management)
Commission implementing this Article shall be guilty of a Class 2 misdemeanor which may include a fine not to exceed
ten thousand dollars ($10,000).
I hereby request Representative Outfall Status for my NPDES Permit. I understand that ALL outfalls are still
subject to the qualitative monitoring requirements of the permit, unless otherwise allowed by the permit
and regional office approval. I must notify DWQ in writing if any changes to the facility or its operations take
place after ROS is granted that may affect this status. If R05 no longer applies, I understand I must resume
monitoring of all outfalls as specified in my NPDES permit.

The Division of Energy, Mineral, and Land Resources (DEMLR) has reviewed the Representative Outfall
Status (ROS) Request Form submitted for Speedy's Used Parts on September 20, 2013.
On October 2r° and 2151, 2013, DEMLR staff conducted a site inspection and records review at Speedy's
Used Parts in Candler, North Carolina. At the time of the inspection you stated that your consultant,
James Environmental Management, Inc., has advised you that outfalls 002, 003 and 004 do not need to be
sampled. There were no analytical data for outfalls 002, 003 and 004. A review of sample data from outfall
001 demonstrates a history of benchmark exceedances. Additionally, you stated that outfall 001 has varied
in location over the history of your permit coverage. Upon review of your paperwork and site plan, it
appears that there may be some confusion about the location of outfall 001 and 004. Finally, it was
discovered that the direction of flow depicted on your site plan may not be accurate for all drainage areas.
Based on our findings during the inspection and pursuant to 40 CFR §122.21(g)(7), representative outfall
status was denied at that time as documented in our October 29, 2013 letter to you. There is not enough
monitoring data to support representativeness and it is not clear that benchmark exceedances at outfall 001
have been mitigated.
A letter from James Environmental Management, Inc. (JEM) was received by our office on November 12,
2013. This provided an explanation as to why Speedy's Used Parts failed to sample all subject outfalls as
required by the referenced Certificate of Coverage (COC) and general permit. We appreciate this timely
response to our request. This letter also requested clarification on the number of sampling events
necessary to provide adequate information for resubmittal of the ROS Request Form. We have reviewed
this request with our Raleigh Central Office, and have determined that a minimum of eight sampling
events will be required to provide adequate information for review of a ROS request.

in accordance with the procedures outlined in your permit and to evaluate your permit requirements for

on the plan. Finally, you should re-evaluate the direction of flow for each sub -drainage area at your facility

Given their past history of non-compliance with sampling, I wouldn't consider a re -application for ROS with any fewer
than 5 samples for all the outfalls. Your site visit may have shown you that 5 or 6 will tell you what you need to know
about the drainage areas. [In general, remember not to get terribly caught up in the numbers -- it's just a guidance
because 8-10 yields a decent pool for making decisions about numeric averages. Stormwater events are highly variable
and influenced by so many factors, and 8-10 samples arguably will still not give you the most statistically significant
average ... but we feel it gives some kind of guide for an acceptable amount of data to base ROS determinations on.] Site
conditions and where materials are stored are going to play a role. And, as the memo emphasizes, so does past
compliance.
I'll discuss with Ken tomorrow, but you all are more than justified to insist on a minimum of 8. We do need to be careful
here that all the regions are in the loop, because these guys are going to go across the state asking for ROS now. In
fact, RRO has already been dealing with them very recently. Maybe it's most straightforward in this situation (and in all
other regions) to advise we will not accept fewer than 8 because of the past non-compliance.
I'm copying Dave Parnell because he's been dealing with several sites using James Environmental and instructed their
clients to reapply for ROS. I'll look back over his email to us last week for details. IT confer with Ken and Dave and get
back to you later this week; I'm tied up in meetings most of tomorrow.

ROS. We had a phone conversation with Mr. Cockrum (James Environmental) and explained that each facility is unique
and that we didn't have a set number for samples to collect before applying for ROS. We also told him that the guidance
suggests 8-10 samples. Mr. Cockrum thought this number was unreasonable and suggested 1 sample. I would like your
thoughts and suggestions, Keep in mind that this facility has never sampled all of their outfalls because Jaynes
Environmental Management, Inc. advised them that they did not have to. They are and have been in violation of their

Denial Letter. Please note NCDENR QUESTIONS below in bold and our subsequent

Why has Speedy's failed to sample all subject outfalls as required by the referenced
Certificate of Coverage (COC) and general permit?
Response: Speedy s has implemented a sampling program where analytical samples
are collected from Outfall 001 and serve as a representative discharge for Outfalls 002,
003, and 004. This determination of representative discharge was established by
comparing the industrial activities at each outfall and selecting the most likely worst -case
outfall from which to collect samples for analytical monitoring. Upon further review of
facility operations, JEM determined that samples should be collected from Ou falls 001
and 004 as Outfall 001 should only be considered to be representative of Outfalls 002
and 003 (and not Outfall 004).

Inspection Summary:
This inspection was conducted in response to a representative outfall status (ROS) approval request. Analytict data were
reviewed, the facility was toured and all outfall locations were observed.
Based on our findings during the inspection, there is not enough monitoring data to support representativeness. In
addition, benchmarks have been exceeded at outfall 001. Therefore, ROS is denied at this time.
Speedy's has been conducting stormwater related sampling and analysis per the advice of their consultant, ,lames
Environmental Management, Inc. Speedy's has not been sampling outfalls 002, 003 and 004. Speedy's has been
advised to implement analyticaI-monitoring at all outfalls in accordance with the permit and COC.
Speedy's should re -valuate the direction of flow for each sub -drainage area and make corrections to the site plan where it
is found to be inaccurate. In addition all outfall locations should be re-evaluated to determine their most appropiate
location. There is some confusion about the location of outfall 001. Speedy's may be sampling outfall 004 and labeling
the samples as outfall 001.
Speedy's plans to to discuss their permit and non-compliance with James Environmental Management, Inc. to correct and
improve their SPPP.

If a facility is required to sample multiple discharge locations with very similar storm water discharges, the
permittee may petition the Director for Representative Outfall Status (ROS). DWQ may grant Representative
Outfoll Status if stormwater discharges from a single outfall are representative of discharges from multiple
outfalls. Approved ROS will reduce the number of outfalls where analytical sampling requirements apply.
If Representative Outfoll Status is granted, ALL outfalls are still subject to the qualitative monitoring
requirements of the facility's permit —unless otherwise allowed by the permit (such as NCG020000) and DWQ
approval. The approval letter from DWQ must be kept on site with the facility's Stormwater Pollution
Prevention Plan. The facility must notify DWQ in writing if any changes affect representative status.

In response to your renewal application for continued coverage under stormwater General Permit NCG100000
the Division of Water Quality (DWQ) is forwarding herewith the reissued General Permit. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October
15, 2007 (or as subsequently amended).
The following information is included with your permit package:
• A new Certificate of Coverage (COC)
• A copy of General Permit NCG100000
• A copy of the Technical Bulletin for the General Permit
• Two copies of the Discharge Monitoring Report (DMR) Form
• Two copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge
controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself
with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the
permit to update your current SPPP to reflect all new permit requirements.
The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable
storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable,
report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part II of your
permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this
permit and do not count prior exceedances.
The more significant changes in the General Permit since your last COC was issued are noted either in the
Draft Permit Fact Sheet that accompanied the public notice (http://portal.ncdenr.org/web/wq/ws/su/current-
notices), or in the Response to Comments / Summary of Changes and Technical Bulletin documents that are
posted on the Stormwater Permitting Unit's website with the new General Permit. Please visit

Some of the changes include:
Part II:
• Section A: The Stormwater Pollution Prevention Plan (SPPP) section, if applicable, has been updated
to the most current language of our permits. Additional conditions for specific industry sectors have
been added to the SPPP requirements in some cases.
• Sections B, C: Failure to perform analytical stormwater monitoring may result in the Division requiring
that the permittee begin a monthly sampling scheme.
• Sections B, C: A lower TSS benchmark of 50 mg/I for HQW, ORW, PNA and Tr Waters applies to these
more sensitive waters..
• Sections B, C: The monitoring parameter- Oil &Grease-(O&G) has been replaced by the parameter
Total Petroleum Hy-drocarbons (TPH) for vehicle maintenance areas, and in some cases, other
analytical monitoring requirements.
• Sections B, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in
separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined
in the "Definitions" section of the permit.
• Sections B, C: The term "Representative Storm Event" has been replaced by "Measurable Storm
Event." A measurable storm event is defined in the permit.
• Section D: If the permittee fails to respond effectively to problems identified by qualitative
monitoring, DWQ may require the permittee to perform corrective action.
Please review Parts III and IV to understand the Standard Conditions of your new NPDES General Permit,
including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and
Maintenance obligations; and Definitions. Please note that all samples analyzed in accordance with the terms
of this permit must be submitted to the Division on Discharge Monitoring Report (DMR) forms available on
the Stormwater Permitting Unit's website above. DMR forms must be delivered to the Division no later than
30 days from the date the facility receives the sampling results from the laboratory. Also note that existing
permittees do not need to submit a renewal request prior to expiration unless directed by the Division.
Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit
does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it
relieve the permittee from responsibility for compliance with any other applicable federal, state, or local law,
rule, standard, ordinance, order, judgment, or decree. If you have any questions regarding this permit

Your facility was found to be in excellent shape, with all records in order, outfalls clearly defined,
and operating as to cause no harm to adjacent water resources. The issues along your property
border where the creek has rerouted itself into your storage facility should be addressed through
channelization of the stream such that it will continue to drain along the property boundry, and not
enter the storage facility.

Enclosed please find a copy of the Compliance Evaluation Inspection report from
the inspection conducted on June 19, 2006. The facility was found to be in compliance
with your general stormwater permit NCG100097. Your recent acquisition of a
stormwater pollution prevention plan has been a good investment. Your consultant has
prepared a site -specific best management practice checklist with good recommendations
for improving your current activities and for minimizing stormwater impacts from your
facility. I recommend that you and your brother both become familiar with the permit and
with the new stormwater pollution prevention plan so that you implement the plan
commitments. Note that during this month when it rains, you will need to record your
visual observations of the runoff as well as collect samples for laboratory analyses (the
referenced quantitative monitoring).
Please refer to the enclosed inspection report for additional observations and -
comments. If you should have any questions regarding the permit requirements, please

Site is covered with ballast -size gravel. Secondary containment is provided for antifreze and used oil.
Facility has a new stormwater pollution prevention plan recently prepared by consultant and annual training
conducted in April 2006. Plan contains site -specific and detailed description of best management practices
to be implemented and to be inspected on a semi-annual basis. Permittee has analytical sampling kit ready
and waiting for spring storm event, Permittee appears familiar with permit requirements as consultant has
recently worked with him.
Recommend that Permittee and -all owners become familiar with permit requirements as well as with
stormwater pollution prevention plan contents so that plan will be implemented properly'and thoroudhly.
Recommend that general housekeeping be improved around vehicle breakdown buildings and as described
in the stormwater pollution prevention plan.
This facility is on the right track towards improving stormwater awareness and best management practices.

on August 31. 2002- The Division staff is currently in the process of rewriting this permit and is scheduled to have
the Ivniiii reissued by laic summer of 2002. Once the permit is reissued, your facility would be eligible for
continued coverage under the reissued permit.
In order to assure your continued coveragge tattler the general permit, you must apply to the Division of W tier
Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier. we are inforining you in
advance thal your permil will be expirin`,. Enclosed you will find aGeneral Permit Coverage Renewal
Application form. 'I'hc application nutst be completed and returned by March 4, 2002 in order to assure conlimred
coverage under the general permit.

Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the 1 1 categories of "storm water discharges associated with industrial activity." (except
construction activities). If you feel your facility can certify a condition of "no cxposuFC", i.e. the faeilty industrial
material; and operations are not exposed to storrnvvaler. you can apply for the no exposure exclusion. For additional

In accordance with your application for discharge permit received on September 28, 1994, we are
forwarding herewith the subject certificate of coverage to discharge under the subject state - NPDES general
permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and
the Memorandum of Agreement between North Carolina and the US Environmental Protection agency, dated
December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual permit
application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division
of Environmental Management. The Division of Environmental Management may require modification or
revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Environmental Management or permits required by the Division of Land Resources, Coastal
Area Management Act or any other Federal or Local governmental permit that may be required.
