Glen White of the Winston-Salem Regional Office of the INC Division of Energy, Mineral, and Land Resources (DEMLR) met with you and conducted a compliance evaluation inspection at the subject facility on September 09, 2015. It was a pleasure to meet you and your assistance and cooperation were greatly appreciated. An inspection checklist is attached for your records and the inspection findings are summarized below. 1. Permit This facility holds General Stormwater Permit No. NCG100066 to discharge Stormwater from activities associated with Clearing, grading or excavation activities under the National Pollutant Discharge Elimination System (NPDES). The permit became effective August 03, 2011 and expires July 31, 2016. Your permit renewal package must be received in the Central Office in Raleigh no later than 180 days prior to the expiration date of the permit. 2. Records/Reports Part il, Section A of the permit requires the development of a Stormwater Pollution Prevention Plan (SPPP). The plan must include all 9 sections of Part ll, Section A requirements of the permit. This site is not required to complete analytical monitoring but qualitative monitoring is required to be completed and documented twice yearly as defined in Part ll, Section C of the permit. The plan must be updated annually and qualitative monitoring must be conducted semi-annually to maintain compliance with the permit. A current SPPP plan and current qualitative records were available for review at the time of inspection. Mr. Louia's SPPP was updated by a consultant on August of 2015 and contains all sections required by the permit. Plan is well prepared. Facility Site Review This site is permitted for automotive maintenance, automotive body repair and salvaged vehicles. The facility was in operation during the time of inspection. In the past, old batteries were being stored outside and onsite, which is a violation of the permit. Mr. Louia's battery supplier now picks up all old batteries when new ones are delivered. There are no other materials stored outside and not under cover except for salvage vehicles which are in an area near the outfah location and are in an area that is heavily grassed. 4. Effluent/Receiving Waters Stormwater from the site is discharged into Pounder Fork Creek, Class "C" waters of the Yadkin Pee Dee River Basin. 5. Self -Monitoring Program Analytical Monitoring: This site is not required to provide analytical monitoring under current conditions of the permit. Less than 55 Gallons are used per month. 6. Qualitative Monitoring: All qualitative monitoring records were available for review at the time of inspection. The latest monitoring event was completed in August 2015 and records go back several years with monitoring completed twice annually. Records do not need to be submitted to DEMLR, however, the records must be kept on file at the facility for a period of five years. This permit is reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as subsequently amended). The following information is included with your permit package: • A new Certificate of Coverage (COC) • A copy of General Permit NCG100000 • A copy of the Technical Bulletin for the General Permit • Two copies of the Discharge Monitoring Report it Form • Two copies of the Qualitative Monitoring Report Form The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the permit to update your current SPPP to reflect all new permit requirements. The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable, report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part 11 of your permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this permit and do not count prior exceedances. Page 2 of 2 Some of the changes include: • Part II: • Section A: The Stormwater Pollution Prevention Plan (SPPP) section, if applicable, has been updated to the most current language of our permits. Additional conditions for specific industry sectors have been added to the SPPP requirements in some cases. • Sections B, C: Failure to perform analytical stormwater monitoring may result in the Division requiring that the permittee begin a monthly sampling scheme. • Sections B, C: A lower TSS benchmark of 50 mg/I for HQW, ORW, PNA and Tr Waters applies to these more sensitive waters. • Sections B, C: The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other analytical monitoring requirements. • Sections B, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined in the "Definitions" section of the permit. • Sections B, C. The term "Representative Storm Event" has been replaced by "Measurable Storm Event." A measurable storm event is defined in the permit. • Section D: If the permittee fails to respond effectively to problems identified by qualitative monitoring, DWQ may require the permittee to perform corrective action. Please review Parts III and IV to understand the Standard Conditions of your new NPDES General Permit, including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and Maintenance obligations; and Definitions. Please note that all samples analyzed in accordance with the terms of this permit must be submitted to the Division on Discharge Monitoring Report (DMR) forms available on the Stormwater Permitting Unit's website above. DMR forms must be delivered to the Division no later than 30 days from the date the facility receives the sampling results from the laboratory. Also note that existing permittees do not need to submit a renewal request prior to expiration unless directed by the Division. Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it relieve the permittee from responsibility for compliance with any other applicable federal, state, or local law, rule, standard, ordinance, order, judgment, or decree. This inspection falls under the provisions of North Carolina General Statute 1.43-215.1. The aforementioned inspection was performed by Marc Stokes of this office. PERMIT Louia Motors received a Certificate of Coverage (COC), NCG100066, under the NPDES General Permit NCG100000 in 1997. This permit was renewed in 2002 and again in November 2007 and will expire in October 2012. The permit is associated with Standard Industrial Classifications 5015 and 5093. All stormwater discharge from this facility is to Bounder Creek. FACILITY Louia Motors consists of a 3-acre site divided by a public thoroughfare. The site is basically divided into 3 major areas. Area 1 consists of the main building and office.. One shop area is contained in this building and is also used for part storage. Rainfall from this area is majority sheet flow to a drop inlet southeast of the main building. Rainfall from adjacent industrial and commercial establishments enters onto Louia property. The facility currently employs 4 personnel. Area 2 is east of the thoroughfare and consists of 1 main building used for car stripping and storage. Several other small buildings are utilized for storage of various car parts. The runoff from this area is sheet flow and exists the property on the southeast corner. This area is used for storage of received scrap vehicles. Sheet flow from part of this area collects in a low-lying area at the east side of the property. The remaining sheet flow is funneled to a conveyance at the northeast corner of the property. STOR.hIWATER POLLUTION PREVENTION PLAN (SPPP) A SPPP plan was developed for the facility in 1997. A site map that contains and indicates those items as listed within the COC was unavailable for review.(This is a violation of the COC) The SPPP plan requirement to certify and on a annual basis recertify evaluation of outfalls for the presence of non-stormwater discharges was unavailable. (This is a violation of -the COC) A feasibility study,was unavailable for review.(This is a violation of thc'COC)' ANALYTICAL MONITORING Analytical monitoring was performed once in 1997 for 2 outfalls. Monitoring was performed once at 1 outfall in 2008. No other analytical monitoring records were available. (This is a violation of the COC) The data for the 2008 monitoring showed values above the Benchmark Values, for the parameters of pH, Oil & Grease, . Lead and Total Suspended Solids. QUALITATIVE MONITORING Qualitative monitoring was performed once in 1997 and on 1 outfall in 2008. No other monitoring records were available.(This is a violation of the COC) This office requests a response, within 30 days, addressing each of the aforementioned violations. The response must include recognition and documentation indicating corrective actions for each violation. This office is appreciative of the cooperative attitude shown by the facility.
