I visited Odum's Garage, Permit NCG100057, located in Onslow County in response to a request to have outfall 1
represent outfall 2. 1 have determined that outfall 1 appears to have a larger drainage area than outfall 2, has a greater
potential for contaminates that outfall 2 and the monitoring data show that outfall 1 consistently show data that is
closer to being out of compliance than outfall 2. Based on this information I recommend that the request to have outfall
1 represent outfall 2 be approved. Please let me know if you would like any additional information.

If a facility is required to sample multiple discharge locations with very similar stormwater discharges, the
permittee may petition the Director for Representative Outfall Status (ROS). DWQ may grant Representative
Outfall Status if stormwater discharges from a single outfall are representative of discharges from multiple
outfalls. Approved ROS will reduce the number of outfalls where analytical sampling requirements apply.
If Representative Outfall Status is granted, ALL outfalls are still subject to the qualitative monitoring
requirements of the facility's permit —unless otherwise allowed by the permit (such as NCG020000) and DWQ
approval. The approval letter from DWQ must be kept on site with the facility's Stormwater Pollution
Prevention Plan. The facility must notify DWQ in writing if any changes affect representative status.

materials are similar.
Activities and materials exposed to stormwater are substantially_ identical and are expected to have
substantially identical effluent -Samples should be collected from Outfall 001, as it is the anticipated
"worst case" outfall as indicated by the area and level of industrial activity.
5) Certification:
North Carolina General Statute 143-215.6 B(i) provides that:
Any person who knowingly makes any false statement, representation, or certification in any application, record,
report, plan, or other document filed or required to be maintained under this Article or a rule implementing this
Article; or who knowingly makes a false statement of a material fact in a rulemaking proceeding or contested case
under this Article; or who falsifies, tampers with, or knowingly renders inaccurate any recording or monitoring device
or method required to be operated or maintained under this Article or rules of the [Environmental Management]
Commission implementing this Article shall be guilty of a Class 2 misdemeanor which may include a fine not to exceed
ten thousand dollars ($10,000).
I hereby request Representative Outfall Status for my NPDES Permit. I understand that ALL outfalls are still
subject to the qualitative monitoring requirements of the permit, unless otherwise allowed by the permit
and regional office approval. I must notify DWQ in writing if any changes to the facility or its operations
take place after ROS is granted that may affect this status. If ROS no longer applies, I understand I must
resume monitoring of all outfalls as specified in my NPDES permit.

Inspection Summary:
Permittee is now doing good job overall to meet the requirements of the permit. They are to be commended on the
improvements made in last couple of years and utilizing a third party to inspect their site.
However, a couple of items need to be addressed.
1) Obtain permit from http://portal.ncdenr.org/web/wq/ws/su/npdessw#tab-3
2) Add new outfall to SPPP and start sampling. See comments within report.
A few recommendations based on site observations.
1) Have sampled outfall pipe cleaned as needed - end at ditch observed to be 1/3 to 1/2 full of sediment, this would be a
source of TSS or other pollutants attached to it.
2) Try to sweep or keep area around entrance to facility and the pipe in #1 clean to minimize sediment/TSS loss to
Outfalls.
3) Recommend that all scrap vehicles be kept at least 10 feet off of property or wood line to allow for perimeter
observation and yearly maintenance by bushhogging.
Reminder: Will need to apply for permit/CoC renewal in late spring or. early summer of 2012 as permit expires at end of
10-2012.

Original plan completed in 2-2008 and updated annually as needed. 2011 inspection

Comment. Raleigh did not send copy of permit with CoC. Will provide e-mail link to
owner to obtain from website when report sent. Found 2nd outfall in isolated roadside
ditch between driveway entrances that is piped under road allowing any discharges to
enter Queens Creek from different location. Currently sampled outfall enters roadside
ditch that flows toward creek and bridge over it. Second outfall needs to be added to
Plan and sampling started immediately; if data supports it, then we would allow
sampling to cease by declaring representative outfall status to current outfall if
requested by Permittee -- at renewl would be good time to submit data & make request.

As a result of the site inspection and file review, the following violations,
detailed below, are noted:
(1) No written Stormwater Pollution Prevention Plan was found on site.
The absence of this document represents violation of the NPDES Permit
Conditions (see Part 11, Section A of NCG100057), requiring the Permittee to
develop a written Stormwater Pollution Prevention Plan.
As a result of the site inspection and file review, the following violations,

located at 491 Queen's Creek Road in Hubert (Onslow County) to determine compliance with the
requirements of the NPDES Permit NCG100057. The facility was found to be non compliant with
the NPDES Permit NC13100057 due to the absence of a written Storinwater Pollution Prevention
Plan. The site was last inspected on :March 2, 2005. During that inspection, Division
Representatives, (Pat Durrett and Linda Willis) determined your facility was not in compliance with
the requirement in the NPDES Permit NCGIO0057 to have a written Sturinw•ater Pollution
Prevention Plan and advised that a plan be developed immediately to avoid any further actions by
the Division.
As a result of the site inspection and file review, the following violations, detailed below, are noted:

LOCATION/ADDRESS: 491 Queens Creek Road, Swansboro, NC 28539

ADEQUACY OF SWPPP: No plan has been developed.
VEHICLE/EQUIPMENT MAINTENANCE AREA: This area was free of standing
liquid contaminants. The area where vehicle and equipment maintenance is being
performed is inside the building.
VEHICLE/EQUIPMENT WASH AREA: The wash area is directly behind the garage.
There is no method for containing the wash water. The washing operations are performed
on a pervious surface. Attempts should be made to prevent wash water from running off
the site a'nd into surface waters of the state. There were no surface waters in close
proximity to the washing area. The washing procedures and attempts to prevent wash
water from reaching surface waters should be specifically noted in the SWPPP.
TEMPORARY STORAGE OF WASTE MATERIALS: The temporary storage of waste
materials are being stored appropriately, however all waste drums must be clearly marked
showing any hazardous characteristics and contents should be identified on the labels.
Once the drums are full, they should be dated and moved to a satellite storage area that
provides secondary containment or is protected from the elements.
OUTDOOR STORAGE OF MATERIALS: A large waste oil drum is located behind the
garage which provides secondary containment. Be sure to inspect the containment basin to
be sure it can structurally contain any spills from the storage tank. The container should
be labeled.
SPILL RESPONSE AND CLEANUP PROGRAM: There are procedures that the
employees are to practice in responding to and cleaning up spills. No procedures are
formally written. This needs to be implemented in your SWPPP. Training should be
provided once per year to all employees.
EROSION CONTROL ON SITE: The area should be inspected for erosion problems and
remedies determined and implemented. One area of erosion was noticed at the back side of
the property boundaries. The contour of the land slopes to a low area. Sheet flow looked
apparent. To prevent another stormwater discharge point from developing in this area,
attempts should be made to minimize the channelizing of stormwater through this area into
one discharge point from the property. If a discharge point does occur, samples will need
to be taken to ensure no contaminants from the salvage yard area are leaving the property
via stormwater runoff.
A ILLICIT DISCHARGE ELEMINATION: No illicit discharge was observed.
WASTEWATER TREATMENT FACILITIES: Not Applicable
STREAM IMPACTS/RESULTS OF SAMPLING: No sampling was conducted as there
was no stormwater runoff at the time of the inspection. The receiving stream (ditch) at the
front of the property line did not appear to have any contamination in it that would result
from runoff from the property.
DISCHARGE OUTFALLS: There appears to be one discharge point at the front and
North side of the drive ways entering Odum's Garage. Please be sure to take your
stormwater samples from this discharge outfall.
SAMPLING REQUIREMENTS: To date, the facility has not taken any stormwater
samples for analysis. The owner was informed that during the next stormwater event,
samples should be taken and sent for analysis. Please contact me at 910-395-3900 Ext. 215
should you have any questions pertaining to the required analyses.
INSPECTION SCHEDULE: None have been developed.
SUMMARY: The SWPPP has not been developed. The plan must cover all areas of
concern listed in'General Permit NCG100000.

Your facility is currently covered for stormwater discharge under General Permit NCGl00000. This permit expires
on August 31, 2002. The Division staff is currently in the process of rewriting this permit and is scheduled to have
the permit reissued by late summer of 2002. Once the permit is reissued, your facility would be eligible for
continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in
advance that your permit will be expiring. Enclosed you will find a General Permit Coverage Renewal
Application Form. The application must be completed and returned by March 4, 2002 in order to assure continued
coverage under the general permit.
Failure to request renewal within this time period may result in a civil assessment -of at least $250.00. Larger
penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your facility

could result in assessments of civil penalties of up to $10,000 per day.
Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the 1 I categories of "storm water discharges associated with industrial activity," (except
construction activities). If you feel your facility can certify a condition of "no exposure", i.e. the facilty industrial

Inspection Summary:
Permittee is now doing good job overall to meet the requirements of the permit. They are to be commended on the
improvements made in last couple of years and utilizing a third party to inspect their site.
However, a couple of items need to be addressed. '
1) Obtain permit from http://portal.ncdenr.org/web/wq/ws/su/npdessw#tab-3
2) Add new outfall to SPPP and start sampling.. See comments within report.
A few recommendations based on site observations.
1) Have sampled outfall pipe cleaned as needed - end at ditch observed to be 1/3 to 1/2 full of sediment, this would be a
source of TSS or other pollutants attached to it.
2) Try to sweep or keep area around entrance to facility and the pipe in #1 clean to minimize sedimenVTSS loss to
Outfalls.
3) Recommend that all scrap vehicles be kept at least 10 feet off of property or wood line to allow for perimeter
observation and yearly maintenance by bushhogging.
Reminder: Will need to apply for permit/CoC renewal in late spring or early summer of 2012 as permit expires at end of
10-2012.

Comment: Raleigh did not send copy of permit with CoC. Will provide e-mail link to
owner to obtain from website when report sent. Found 2nd outfall in isolated roadside
ditch between driveway entrances that is piped under road allowing any discharges to
enter Queens Creek from different location. Currently sampled outfall enters roadside
ditch that flows toward creek and bridge over it. Second outfall needs to be added to
Plan and sampling started immediately; If data supports it, then we would allow
sampling to cease by declaring representative outfall status to current outfall if
requested by Permittee -- at renewl would be good time to submit data & make request.

Payment of the required annual administering and compliance monitoring fee of $80.00 for this year has not
been received for the subject permit. This fee is required by Title 15 North Carolina Administrative Code 2H.0105, under
the authority of North Carolina General Statutes 143-215.3(a)(1), (1 a) and (1 b). Because this fee was not fully paid within
30 days after being billed, this letter initiates action to revoke the subject permit, pursuant to 15 ncac 2H.0105(b) (2) (k)
(4), and G.S. 143-215.1 (b) (3).
Effective 60 days from receipt of this notice, subject permit is hereby revoked unless the required Annual
Administering and Compliance Monitoring Fee is received within that time. Discharges without a permit are subject to the
