The Notice referenced certain inadequacies discovered and required a response within 30 days of receipt. Below is our response to these issues. 1. Provide annual stormwater training as required Keep training record, pen/ink signatures of attendees in the SPPP. Training for storm water cleanliness has begun and within the next 30 days all of our applicable employees will have taken the required training. We will properly record each employee's signature upon completion. 2. Provide Spills Record as required. Keep record of the spill and response procedure initiated as well as measures implemented to.prevent or decrease likeliness of future spills. Part it Section A Subpart 1(d) of the permit states that "A list of significant spills or leaks of pollutants during the previous three (3) years and any corrective actions taken to mitigate spill impacts" must be included in the facility's SPCC. Part IV section 27 of the permit defines a significant spill as one that "Includes, but is not limited to: releases of oil or hazardous substances in excess of reportable quantities under section 311 of the Clean Water Act (Ref. • 40 CFR 110.3and 40 CFR 117.3) or section 102 of CERCLA (Ref: 40 CFR 302.4)." Part II Section A Subpart 8(a) states that annual updates of the SPPP shall include "an updated list of significant spills or leaks of pollutants for the previous three (3) years, or the notation that no spills have occurred..." Furthermore, the permit states in Part III Section E Subpart 7 that "The permittee shall report to the local DWQ Regional Office, within 24 hours, all significant spills as defined in Part IV of this general permit. Additionally, the permittee shall report spills including: any oil spill of 25 gallons or more, any spill regardless of amount that causes a sheen on surface waters, any oil spill regardless of amount occurring within 100 feet of surface waters, and any oil spill of less than 25 gallons that cannot be cleaned up within 24 hours." In the last five (5) years no spill to the ground of any material meeting the available definitions of a significant quantity has occurred at the facility. No spill of any quantity has occurred to a water way or storm water sewer system. A notation of this fact has been added to the SPPP. The annual storm water training that will be completed in the next 30 days will include examples of how to clean and prevent spills. 3. Remove contaminated soils and dispose of it in an approved landfill facility. Install clean soils and gravel in these locations. Soil testing will be required if future contaminated soil is not cleaned up after spills are verified. Contaminated spots are being dug up and a licensed hauler will be used to dispose of the waste properly at an approved landfill. The removed soil is being replaced with soil and gravel obtained from a clean source. Proper documentation, such as manifests and receipts, will be maintained on site to confirm proper disposal. As vehicles are removed from the facility for crushing and recycling, the soil underneath will be inspected for contamination that was not discovered during routine inspections. Any contaminated soil discovered at this time will be removed and properly disposed of. The Compliance Inspection Report, attached to the {notice of Deficiency, noted that a review of the SPPP revealed the potential for missing records related to the Self -Monitoring program. The facility is noted as having collected storm water samples at the required frequency and having provided the testing results to the department. All available records have been retrieved and, going forward, the facility will ensure at least five (5) years of data is always maintained in the SPPP, as required by Part III Section D a Subpart 6 of the permit. The facility will ensure compliance is maintained by continuing to have two (2) analytical samples done per year. VAN DER VAART Secretury TRACY DAVIS Director On August 11, 2016 Glen White of the North Carolina Departmentof Environmental Quality; Department of Energy, Minerals, and Land Resources, met with you at the facility located at 100 Ward Road in Greensboro, to conduct a compliance inspection per the Industrial Stormwater Permit requirements. This inspection consists of review of the Stormwater Pollution Prevention Plan, training, monitoring and spills records as well as observation of the general condition 'of the site, the outfalls and any possible exposures to downstream stormwater. Your assistance and cooperation with the inspection was greatly appreciated. Permit: This facility holds General Stormwater Permit NCG 100040 to discharge stormwater from industrial activity associated with Used Motor Vehicle Parts [SIC 50151 & Automobile Wrecking for Scrap [5093] under the National Pollutant Discharge Elimination System (NPDES). The permit became effective November 01, 2012 and expires on October 31, 2017. A copy of the current permit is required to be maintained with the Stormwater Pollution Prevention Plan (SPPP) documents. The current permit was available for review and was included in the SPPP. State of North Carolina I Environmenta[ Quality 1 Energy, Mineral and Land Resources Winston-Sa[em Regional Office, 1 450 Hanes Mill Road, Suite 300 1 Winston-Salem, NC Z7103 336 776 9800 Records/Reports: This facility was required to develop and maintain d Stormwater Pollution Prevention Plan (SPPP) in accordance with Part II, Section A of the permit. All qualitative and analytical monitoring records are required to be maintained with the SPPP for a minimum of five (5) years. James Environmental prepared the current SPPP performed an audit of the facility in October of 2013. They made recommendations to achieve and maintain compliance. The SPPP was well prepared and appears to have been maintained for many of the required components. Deficiencies were found. Stormwater training is not being conducted since the James Environmental created the SPPP and spills and corrective action records are not being maintained. Facility Site review: This facility is a used vehicle salvage facility that offers "self-service pull it yourself' auto parts to the general public and supply parts to body shops for collision repairs. It employs approximately 15 employees on one (1) shift. The yard is covered with gravel and it is maintained under each vehicle. The car crusher is maintained under cover and on a concrete floor. The fluid removal station is located under cover on a concrete pad. Motor oil. Gasoline, diesel, antifreeze, batteries and mercury switches are picked up for recycling. Tanks and totes are stored under cover and on a' concrete pad. Site inspection revealed that the cars still have engines and transmissions in them and many are leaking significantly and oil and fluids are Ieaching into the soils under the cars. It appears that some have not been drained of fluids or that additional measures need to be implemented to prevent fluid leaks_ Effluent Receiving Waters: Effluent from this facilities drain to an unnamed tributary of South Buffalo Creek, class "C" waters of the Cape fear River Basin. Self -Monitoring Program: Part 11, Section B & D of the permit requires semi-annual qualitative and analytical monitoring. Monitoring appears to have been.conducted as required although some records may be missing. All records are required to be maintained with the SPPP for a minimum of five (5) }rears. The following observations and violations were noted during the DEMLR (Division of Energy, Minerals, & Land Resources) inspection and subsequent file review: 1. Stormwater Pollution Prevention Plan - Training: General Permit NCG 100000, Part II Section A, No. I thru 9 requires the permittee to develop and implement an SPPP. Inspection revealed that annual Stormwater Training has not been conducted since 2013. Stormwater training must be conducted annually and all employees with any exposure to sormwater are required to attend. They should sign of with date and pen/ink signature when attended. The record needs to be maintained in the SPPP. Update all components of the SPPP each year by going through it and marking tip any additions or changes, resigning certifications, etc. State of North Carolina I Environmental Quality I Energy. Stormwater Pollution Prevention Plan — Spill Prevention: General Permit NCG 100000, Part II Section A, No. 1 thru 9 requires the permittee to develop and implement an SPPP. Inspection revealed that Spills records are incomplete and not maintained Small and large spills occur regularly at like facilities. Please keep a record offluid spills, leaks and method used to clean them up as well as a note on how to prevent the same event from occurring is possible. 3. Stormwater Pollution Prevention Plan — Soil Contamination: General Permit NCG 100000, Part II Section A, No. 1 thru 9 requires the permittee to develop and implement an SPPP. Site inspection revealed that many vehicles stored on the site are leaking oil/fluids into the soils. This is a violation of not only the Stormwater but also Soils Conservation and Water Quality. _Required Response Accordingly, you are directed to respond to this letter in writing within 30 calendar days of receipt of this Notice. Your response should outline how the violations will be addressed and should be sent to this office at the letterhead address and include the following: 1. Provide annual stormwater training as required. Keep training record, pen/ink signatures of attendees in the SPPP. 2. Provide mills Record as required. Keep record of the spill and response procedure initiated as well as measures implemented to prevent or decrease likeliness of future spills. 3. Remove contaminated soils and dispose of it in an approved landfill facility. Install clean soils and gravel in these locations. Soil testing will_ be required if future contaminated soil is not cleaned up after spills are verified. Thank you for your attention to this matter. This Office is considering sending a recommendation for enforcement to the Director of the DEMLR (Division of Energy, Minerals, & Land Resources) regarding these issues and any future/continued violations that may be encountered. This office requires that the violations, as detailed above, be abated immediately and properly resolved. Environmental damage and/or failure to secure proper authorizations have been documented on the subject tract as stated above. Your efforts to undertake activities to bring the subject site back into compliance is not an admission, rather it is an action that must be taken in order to begin to resolve ongoing environmental issues.
