We considered the comments and their application to the NPDES Industrial Stormwater General permitting procedures. However our established approach to the issues you identified is different than the ARO described options. So, after reviewing your comments closely, we are going to issue coverage to the CSX Spruce Pine facility as per their general permit application. Please contact us if -there is some aspect of site conditions that we don't understand, or which we may not have assigned the appropriate significant weight. The following clarifies our perspective on the aspects raised from the site inspection: • Concerning the oil/water separator: o If the o/w separator is receiving wash down from a hose, that flow is a wastewater. NCG08 does not authorize wastewater discharges. We are not authorized to permit that discharge to surface waters, and we won't permit it. Consistent with your recommendation, the facility must find another way to dispose of any wastewater flow. o However, if the o/w separator is receiving stormwater only, the general permit authorizes the discharge to surface waters. We routinely permit o/w separator discharges of stormwater-only flows. ■ The general permit text provides that we can permit o/w separator discharges subject to the stormwater benchmarks listed in Part II Section B Table 3; or ■ For cause, and upon specific designation, we can permit the o/w separator discharges subject to the stormwater effluent limitations in Part If Section C Table 4. ■ In both cases the numerical threshold is 50 mg/L TSS for Tr waters, as either a benchmark or an effluent limit. Concerning hooking up the o/w separator to the Spruce Pine sanitary sewer: o Ifstormwater: Such a hook-up could only be accomplished by permission of Spruce Fine. Typically towns do not approve the introduction of stormwater into the sanitary sewer system, although it has happened rarely. So back to bullet items above, if the o/w separator heavy phase (water) is just stormwater, it is unlikely Spruce Pine will accept it. • Further, it is not our practice to direct our permittees as to how they must. configure the site, or treat stormwater, or where they must discharge their stormwater. We require a SPPP, and also monitoring, reporting, and inspections within the NCG08. That is the essential content of the stormwater permit requirements. o Ifwastewater_: On the other hand, if the o/w separator heavy phase is wastewater (for example wash down flows or other wastewaters), then it may be that Spruce Pine will see that it specifically is their job in life to accept and treat such a flow from businesses in their service area. DEMLR actions. If the o/w separator is discharging wastewater then we can encourage (i.e. suggest in a technical assistance mode) the facility to either hook up to the Spruce Pine system (with their permission), or approach the DWR folks for a wastewater discharge permit. (Probably the first option as far as our wastewater folks are concerned. They generally like to devote their manpower to more substantial permitting projects.) • Concerning whether the facility has 1 MG storage and an Oil SPCC Plan. It's not clear on the aerial photo or in their NOI application that 1 MG storage is located on site. Again, with ARO in a technical assistance mode, we can advise the site that federal rules may require an oil SPCC Plan if they meet the criteria. As I understand it, the federal SPCC rules are not ours to enforce. The Stormwater Permitting Program has never exercised authority to enforce this set of federal rules. Considering the Nortli Toe River and stormwater discharges. o The River is classified C, Tr; and is impaired for turbidity. o The site has a gravel parking lot (potential source of TSS) and is in relatively close proximity to the River. o We rely on the permit requirements for visual observations of solids/clarity/turbidity and on the analytical analyses for TSS with a benchmark of 50 mg/L to control polluted stormwater discharges. The 50 mg/L is a lower benchmark reserved for sensitive waters like ORW, HQW, PNA, and Tr waters. o Again, in a technical advisory role, the ARO might suggest that the permittee berm the site, or encourage infiltration, or make use of the vegetated margin of the site to reduce sediment transport into the North Toe. But absent a permit violation or repeated benchmark exceedances, we don't have authority to direct or require such actions either in the permit or in other communications at this point. o if coverage under NCG08 proves demonstrably inadequate to protect the North Toe, we always have the option of kicking them out of NCG08 coverage, and requiring coverage under an individual permit that we would construct to specifically address the failures at the site. ARO finds the best option to be collection of stormwater and discharge to the sanitary sewer. Please see my comments from the 7/31 email to you. Based on discussions with LQ and DWR staff, the following comments were generated: 1. Spruce Pine has a sanitary sewer line in this area. Serious consideration should be given to connecting the oil/water separator to this line. Historically, discharges from p/m-separators have not been allowed under N! C� 2. With 1M gallon stora a of pe- - leum, does facility have approved SPCC plan and/or a Facility Response Plan. 3. Currently, North Toe is impaired for turbidity. Also, North Toe is classified C;Tr. Since you do not have any objection to allowing coverage for CSX Spruce Pine permit under NCGO80940, we will continue with their application. ARO can send a follow up letter to your inspection to CSX with non -binding recommendations concerning I their storm water management. Once under the permit, CSX will have to follow their SPPP and monitor their site twice per year. Did you get a chance to visit the Bostic Rail yard in Rutherford Co?
