On April 2, 2014, staff from the Wilmington Regional Office of the Division of Energy, Mineral
and Land Resources- (DEMLR), conducted a site inspection for the tract/project known as Town
Creek Marina located in Carteret County, North Carolina.
A review of the file by DEMLR staff revealed that the subject project is covered by NPDES
Stormwater General Permit — NCG080687.
Thank you for your assistance and cooperation during this inspection. As noted in the attached
inspection report, you need to implement and maintain your stormwater pollution prevention
plan and conduct semi-annual monitoring of the stormwater outfalls. Please implement best
management practices to contain contaminants onsite.

ADDENDUM
The National Pollutant Discharge Elimination System (NPDES) program was established under
the federal Clean Water Act and then delegated the program to the NC Department of
Environment and Natural Resources (NCDENR). As of August 1, 2013, the Division of Energy,
Mineral and Land Resources (DEMLR) manages the implementation of this program for
NCDENR. The NPDES permitting program for stormwater discharges was established in 1990.
Phase I focuses on site and operations planning to reduce pollutant sources.
Through the NPDES permitting program, industrial facilities that fall into one of the subject ten
categories are required to obtain permit coverage under a general permit or an individual permit,
depending upon the facilities SIC code and the industrial activity occurring at the facility. There
are currently 19 active general stormwater permits in North Carolina. One condition that is
applicable to both the general permits and individual stormwater permits is the requirement to
develop and implement site -specific comprehensive stormwater pollution prevention plans
(SPPP). These plans are required to include a comprehensive evaluation of the site and
operations to reduce pollutant sources and prevent pollutant discharge.

under a NPDES General Stormwater Permit] can be found at this web site.
The following items are a subset of permit requirements and are listed to assist you and help
bring your attention to certain permitting issues, process and condition requirements of your
permit. Please see the above mentioned web site in order to obtain a copy of the permit such that
you may fully comply with all the conditions therein. Failure to properly comply with
conditions of the permit, like those bulleted below, constitutes violations and are subject
civil penalty assessment of up to $25,000.00 per day.
• Industrial facilities that fall into one of the subject ten categories are required to obtain
permit coverage under a general NPDES stormwater permit or an individual NPDES
stormwater permit
• All persons desiring to have facilities covered by a General Permit must register with the
Division of Energy, Mineral and Land Resources (DEMLR) by the filing of a Notice of
Intent (NOI) and Applicable Fees.
• This Notice of Intent (NOI) must be submitted and a Certificate of Coverage issued prior
to any discharge of stormwater associated with the industrial activity, process
wastewater, andlor mine dewatering.
• Once the Notice of Intent is received, DEMLR will review and determine whether a
Certificate of Coverage (COC) may be issued. If this Certificate of Coverage is issued the
facility is covered by the General Permit. That is, the permiee is authorized to discharge
stormwater, process wastewater, and/or mine dewatering pursuant to the type of General
Permit until the permit expires or is modified or revoked.
• Any other point source discharge to surface water of the state is prohibited unless it is an
allowable non-stormwater discharge or is covered by another permit, authorization or
approval.

There are currently 19 active general permits. Permit conditions vary accordingly;
however, most of the permits have following condition requirements (you must read your
entire permit to ensure full compliance):
o Development and compliance with the Stormwater Pollution Prevention Plan
c Collection, reporting, and recording of Analytical Monitoring
o Collection, reporting and recording of Qualitative Monitoring
o Collection, reporting and recording of Vehicle Maintenance Monitoring
o Records — Visual monitoring shall be documented and records maintained at the
facility along with the Stormwater Pollution Prevention Plan. Copies of the
analytical monitoring results shall also be maintained on -site. The Permittee
shall retain records of all monitoring information, including all calibration and
maintenance records and all original strip chart recordings for continuous
monitoring 'instrumentation, and copies of all reports required by this general
permit for a period of least 5 years for the date of the sample measurement.- report
or application.
o Expiration — The permittee is not authorized to discharge after the expiration date
of the general permit. In order to receive automatic authorization to discharge
beyond the expiration date, the permittee shall submit forms and fees as are
required by the agency authorized to issue permits no later than 180-days prior to
expiration date. Any permittee that has not requested renewal at least 180 days
prior to expiration, or any permittee that does not have a permit after the
expiration and has not requested renewal at least 180 days prior to expiration, will
be subject to enforcement. Failure to renew your permit is a violation.
o Transfer — The Certificate of Coverage (COC) issued pursuant to this general
permit is not transferable to any person expect after notice to and approval by the
Director. The Director may require modification or revocation and reissuance of
the Certificate of Coverage to change the name and incorporate such other
requirements as may be necessary under the Clean Water Act. The Permit is
NOT transferable.
o Name Change, Closure or Facility Ownership change — Permittee is required to
notify the Division in writing in the event the permitted facility is sold or closed.
The Division of Energy, Mineral and Land Resources views changes of name or
ownership as a modification that requires the Director's approval and reissuance
of the permit. Name and ownership changes required you to complete a
Name/ownership Change Form from the Division and mail it back to the along
with all appropriate information to the Division of Energy, Mineral and Land
Resources.
o Proper Operation and Maintenance is a requirement of the permit.

The purpose of this Prevention Plan is to control, limit, and monitor storm -water
discharges form the Town of Beaufort's Public Works Facility located at 412 Hedrick
Street in Beaufort, NC in accordance with NPDES Permit No. NCG80687.

DRAINAGE STRUCTURE FOR FACLITY
There is only one constructed drainage structure on the permitted facility. It is located
approximately in the center of the property. The structure consists of a 10' x 10' concrete
pad sloped to a catch basin in the center. A 12" pipe leads from the catch basin to a ditch
that eventually drains to an unnamed tributary of Town Creek.
There is a permanently installed and maintained silt fence around the concrete pad.
Potential pollutants expected at the outfall from this drainage structure would be
primarily cloudy water caused by runoff from the marled surface of the lot. There is also
the possibility of road grease/oil contaminants caused by rainwater runoff from vehicles
and equipment parked on the lot.
PERCENTAGE OF IMPERVIOUS SURFACE
Approximately 75 % of the permitted property is impervious. There is a grassy buffer of
varying widths separating the impervious surface from a ditch that borders the property
on three sides.
STORAGE PRACTICES
There are several storage operations going on at this facility. Items are stored both inside
and outside. Inside items include:
a. New tires
b. Town records
c. Christmas decorations
d. Parts for vehicles and equipment
e. Lawn equipment
f Lubricants
g. Welding supplies
Outside items include:
a. Mulch
b. PVC piping
c. Trench shields
d. Enclosed portable generators
e. Vehicles
f. Heavy equipment
g. concrete products (new manholes)
h. Impounded vehicles including bicycles
i. Items to be auctioned
LIST OF LEAKS AND/OR SPILLS
There have been no spills or leaks at this facility in the past three years.
PRESENCE OF OTHER STORM WATER OUTFALLS
There are no other storm water outfalls at this facility. See enclosed certification.
STORM WATER MANAGEMENT PLAN
Feasibility Study:
It would not be economically feasible and would be in violation of a portion of the Town
of Beaufort's Storm Water Policy pertaining to impervious surfaces to cover all the work
areas at this site.
Public Works' staff work diligently to ensure that items stored outside are elevated off
the ground. No manufacturing, fueling operation, or hazardous material handling and/or
storage occurs outside.
There are no potential contamination areas that can be affected by storm water runoff.
Roll off containers for yard debris and re -cycle materials are removed on a regular basis.
Secondary Containment Schedule:
There is no bulk storage of liquids at this facility.
BMP Summary:
Debris at this site is deposed of on a regular basis. There is no bulk storage of items of
concern on the outside at this site. There is a vegetative buffer (grass) separating the
impervious surfaces from the conveyance means. This buffer is maintained by Town
staff.
There are small sediment basins at various intervals in the conveyance system
immediately followed by a varying size rock filtration system to slow the flow of water in
the system. These areas are maintained by staff.
Vehicle and Equipment Cleaning Areas:
There is a concrete pad with a drain that is attached to the Town sewer system located on
this site. All equipment and vehicles are washed on this pad. The basin is cleaned on a
regular basis to prevent clogs. Please refer to site plan for location.
Remote fueling Operations:
There is a small amount of remote fueling at this site. The Town of Beaufort has a truck
with an enclosed body that contains a sixty (60) gallon diesel fuel tank. This is used to
fuel a track loader. The equipment operator is the person responsible for fueling the
equipment. The type nozzle used requires constant physical contact to operate. All
rubber tired equipment are driven to a local service station for fuel purchases.
SPILL PREVENTION AND RESPONSE PLAN
Public Works personnel are aware of the problems that may arise if there is a spill on the
permitted site. Likely materials involved would be some type of petroleum product.
Spills would be most likely to occur when some type of equipment hose should fail. The
spill would be a small amount and easily contained.
Town mechanics and equipment operators would be on site if this should happen.
Material is available on site to dike around such a spill.
Measures will be taken to prevent spilled material from entering the storm water
conveyance system.
These measures may include one or more of the following:
a, dike construction
b. containment pool
c. vegetative material ( wheat straw)
d, non -porous material
Cause of the spill will repaired or removed by Town personnel or by a private contractor.
Contaminated material will be removed by a licensed contractor and taken to an approved
disposal site.

The Responsible Person in Charge or the Chief Mechanic is responsible for initiating the
response. This shall include notification of the appropriate Federal, State, and local
officials in the event of a reportable spill.
PREVENTATIVE MAINTENANCE AND GOOD HOUSEKEEPING PROGRAM
The Responsible Person in Charge shall maintain a schedule of site inspections and
maintenance activities of the storm water control systems. This includes the proper
storage of materials; maintenance of the wash down area; maintenance of vehicles and
equipment; general site maintenance and maintenance of the storm water control
system(s).
EMPLOYEE TRAINING
The Responsible Person in Charge shall ensure that Public Works employees are properly
trained to meet the requirements of this policy.
Training shall be provided at a minimum on an annual basis. New employees shall be
trained when they are hired.
Training shall include but not limited to:
a. site maintenance
b. good housekeeping
c. material storage
d. spill management
e. wash down procedures
f. equipment maintenance
g. fueling operation if required
h. notification
Training may be conducted by the RPC, the Chief Mechanic or other qualified personnel
The RPC shall be responsible for maintaining the training records.
Documentation shall include the following information;
a. date of training
b. training topic(s)
c. name of person(s) doing the training
d. list of personnel being trained
RESPONSIBLE PARTY (RPC)
The Town of Beaufort's Street and Sanitation Department Supervisor or his designee
shall be considered the RPC in charge of carrying out the requirements of this policy.
The duties of the position shall include but are not limited to:
a. overall coordination of the Plan
b. development of additional items for the Plan when needed.
c. policy implementation.
d. policy revisions when needed.
e. accurate record keeping.
f. proper training of employees
g, overseeing required testing
h. communication with Town Officials and Local, State and Federal Agencies as required
PLAN AMENDMENT
The Town of Beaufort shall amend the Plan whenever there is a change in design,
construction, operation or maintenance when said change will have a significant effect on
the potential for discharge of pollutants to surface waters.
The Storm Water Pollution Prevention Plan shall be reviewed and updated on an annual
basis.
If the permitted site does not meet the requirements of the issued permit, within 30 days
of notice from the Director, the permittee shall submit a time schedule to the Director for
modifications to the Plan to meet minimum requirements. The permittec shall provide
written certification to the Director that said changes have been made.
FACILITY INSPECTION PROGRAM
The RPC shall cause the facility storm water system(s) to be inspected on at least a semi-
annual schedule, once in the fall and once during the spring. Additional inspections may
be required if a change in conditions warrant them.
The inspection and any subsequent maintenance activities performed shall be
documented, recording date and time of inspection, individual(s) conducting the
inspection and a narrative description of the conditions found. Records of these
inspections shall be incorporated into the Plan.
Storm water discharge characteristic monitoring as required by the permit shall be
performed in addition to facility inspections,
PLAN IMPLEMETATION
The Town of Beaufort's RPC shall ensure all monitoring, measurements, inspections,
maintenance activities, and training of employees are documented. This documentation
shall include sampling data logs, implementation pf BMPs associated with the site
activities and vehicle maintenance activities. Documentation shall be kept for a period of
five (5) years and made available to the Director or his authorized representative
immediately upon request.

An inspection of the "Town of Beaufort garage facility was conducted on January 5, 2010. This inspection was conducted to verify
that the facility is operating in compliance with the conditions and limitations specified in NPDES Permit No. NCGO80687.
A review of the Stormwater Pollution Prevention Plan (SPPP) was not conducted. Please ensure that somebody on site is
knowledgeable of the requirements of the SPPP and its whereabouts. Also ensure somebody is knowledgeable of the whereabouts of
the qualitative/quantitative monitoring reports, employee training records, certifications for illicit discharges; and semi annual site
inspection documentation.
The general housekeeping practices at this facility are good. The compost pile with turkey litter is located too close to the ditch and
should be kept covered. You may have this material on site, but it should be off the ground and covered. The large pile of sand on the
adjacent property needs silt fencing around it.
Please forward to this office a copy of the analytical and qualitative monitoring reports for the years 2008-2009 and a copy of
the Stormwater Pollution Prevention Plan with employee training records, facility site inspection reports and certifications of
no illicit discharges from the facility. Should you have any questions concerning the inspection report or the requested information,

You had requested some guidance concerning the State's position on a sidewalk to be built from the assisted living development to the

Comment: Please forward a copy of the Certificate of Coverage to the Wilmington
Regional Office. The outfalls were inspected. There is compost piles on site that has
turkey litter mixed in. This pile should be covered to protect it from the rain and it should
not be located close to any ditches surrounding the perimeter of the site. There is also
a large pile of fill dirt located on the adjacent site which belongs to the Town. This pile
of sand should have silt fence around it to prevent runoff of sediment to the nearby
ditches during storm events.

On January 5, 2010, Linda Willis from the Wilmington Regional Office of the Division of
Water Quality, conducted a site inspection for the Town of Beaufort Garage located at 412
Hedrick Street in Beaufort. This site was issued an NPDES Stormwater General Permit
(NCG080687) on June 6, 2003. The permit requires a written Stormwater Pollution Prevention
Plan within 12 months of receiving coverage under the General Permit. The permit also requires
qualitative and quantitative monitoring of stormwater discharges from the site. Failure to follow
your permit requirements is a violation of North Carolina General Statute 143-215.1(a). The
following permit condition violations were noted during the Division of Water Quality inspection:
1) Stormwater Pollution Prevention Plan (SPPP)
A Stormwater Pollution Prevention Plan (SPPP) has not been developed, recorded, and properly
implemented.
2) Qualitative Monitoring
Qualitative monitoring has not been conducted and recorded in accordance with permit
requirements.
Other Observations:
An area on site had turkey litter stored near a ditch with no containment to prevent stormwater
exposure and runoff to the adjacent ditch.

This office requests your immediate attention to the development of a Stormwater Pollution
Prevention Plan (SWP3) for this facility. The SWP3 should be developed in no less than 60 days
from receipt of this notice.
Thank you for your attention to this matter. Your above -mentioned response to this
correspondence will be considered in this process. This office requires that the violations, as
detailed above, be properly resolved. These violations and any future violations are
subject to a civil penalty assessment of up to $25,000.00 per day for each violation. Should

Dear Ms. Willis,
The above listed NOV was caused by a failure to pass information from one office to
another. The permit information was received by the Beaufort Town Hall
on November 9th, 2007 (see attached).
For whatever reason, the information did not reach the permitted facility. Actions have
been taken to ensure there will be no such happenings in the future. Permit compliance
information will be kept in the Office of the Street and Sanitation Supervisor and will
readily available.
Said compliance information will be upgraded as necessary with accurate information in
regards to sampling, on -site inspections, site Plan amendments, employees training and
any other pertinent information.
Also the pile of compost that was observed during your inspection on January 51h, 2010
has been removed from the facility.

In response to your renewal application for continued coverage under stormwater General Permit NCG080000 the Division of
Water Quality (DWQ) is forwarding herewith the reissued stormwater General Permit. This permit is reissued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North
Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.
The following information is included with your permit package:
• A new Certificate of Coverage
A copy of stormwater General Permit NCG080000
• A copy of a Technical Bulletin for the General Permit
• Five copies of the Discharge Monitoring Report (DMR) Form
• Five copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater only, and it specifies your obligations with respect to stormwater
discharge controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself with all
the changes in the reissued permit -
The more significant changes in the General Permit since your last Certificate of Coverage include the following:
• Part 1 Section A — A new notation that the No Exposure Exclusion from permitting option may be available to the
permittee.
• Part I Section A — A new provision that facilities draining to 303(d) listed waters, or in watersheds with an approved TMDL,
may not be eligible for renewed coverage under the General Permit.
• Part II Section B Table 1 -- An increased sampling frequency from once per year to twice per year.
• Part II Section B Table 3 -- Benchmark concentrations now replace cutoff concentrations; the elimination of the option to
avoid sampling based on cutoff concentrations.
• Part II Section B — New provisions requiring the permittee to execute Tier One and Tier Two response actions, based on
the first benchmark exceedence (Tier One) and the second consecutive benchmark exceedence (Tier Two). Tier Two
requires that the permittee institute monthly monitoring instead of twice -per -year monitoring, until three consecutive
monitoring events show no benchmark exceedences.
• Part II Section B — A new provision that four exceedences of any particular benchmark will trigger increased DWO
involvement in the permittee's stormwater management and control actions. DWQ may direct the permittee to apply for
an individual permit, or may direct the implementation or installation of specific stormwater control measures.
DWQ received a number of comments on a series -of general permits similar to this one. A full response to comments can be
found at http://ncwaterquality.org/su/industrialgpinfo,htm. Some comments resulted in permit modifications, others are
addressed in the response document or Fact Sheet. A few specific requests for clarification are addrested below.
1. What is the deadline for having a revised SPPP that reflects the provisions of the New Genera! ,Permit? DWQ will require
that the permittee have a revised, complete SPPP no later than six months after the date of issue of that permittee's new
Certificate of Coverage.
2. Must analytical results be by a certified tab? What about pH measurements? All -analytical results obtairied to satisfy
NPDES permit requirements must be certified, as directed in North Carolina regulations at 15A NCAC 2H .0800, and as
administered by DWQ's LaboratorySection Certification Branch. This includes field pH measurements.
