SUBJECT: Compliance Evaluation Inspection Norfolk Southern Corporation
NPDES Permit No. NCGO80625, Guilford County
Dear Mr. Turner:
Sue White of the Winston-Salem Regional Office performed a Compliance Evaluation
Inspection on the Norfolk Southern Corporation stormwater facility on June 7, 2011. You, Barry
Harmon and Brandon Lambert were in attendance. The inspection consisted of two parts: an
on -site inspection of the stormwater facilities and an in -office file review. The following are the
findings from the subject inspection.
I. Permit
The NPDES permit for Norfolk Southern Corporation became effective on November 1, 2007
and expires on October 31, 2012. Application for permit renewal must be received no later than
180 days prior to expiration date.
II. Records/Reports
Part II Section A of permit NCGO80625 requires that a Stormwater Pollution Prevention Plan
(SPPP) be implemented and maintained on site. This is typically reviewed during the inspection.
The Stormwater Pollution Prevention Plan was reviewed and contained the necessary data.
III. Facility Site Review
All stormwater conveyances and outfalis noted in the Stormwater Pollution Prevention Plan were
inspected and found to be satisfactory. All containers of fluids must be stored undercover or in a
secondary containment unit large enough to hold the entire content of the container placed in it.
Old railroad ties and batteries that are not serviceable need to be removed from the site or placed
undercover and not stored in the open.

IV. Effluent & Receiving Waters
Norfolk Southern Corporation, Pomona Yard, discharges stormwater to Buffalo Creek, a class C
NSW stream in the Cape Fear River Basin.
V. Self-Monitorin__Program
Part II, Section D requires qualitative monitoring on a semi-annual basis, once in the spring and
once in the fall.
A rain gauge must be on site in a permanent location to record rainfall amounts during the
sampling significant rain fall event.

decree.

Your facility is currently covered for stormwater discharge under General Permit NCG080000. This, perrnit expires
on August 31. 2002. The Division staf f is currently in the process of' rewriting this permit and is scheduled to have
the permit reissued by late surnmcr cif 2002. Once the permit is reissued, your facility would he eligible for
continued coverage under the reissued permit.
In order to assure your Continued coverage under the -eneral perrnit. you must apply to the DIVISiun of W;Lier
Quality (DWQ) lirr renewal of your permit coverage. To make this renewal process easier, we are informing you in.
advance that your perrnil will he expiring. Enclosed you will find a General Permit Coverage Renewal
Application Form. The application must be completed and returned by March 4. 2002 in order to assure continued
coverage under the ,cneral permit.
Failure to rcqucst renewal within this time period may result in a civil assessment of at least $250,00, Larger
penalties may he assessed depending on the delinquency of the request. Discharge of stormwater from your Facility
without coverage under a valid storntwater NPDES permit would constitute a violation of NCGS 143-215.1 and
could result in assessments of civil penalties of up to $10.000 per day.
Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any ol,thc 1 1 categories of "storm water discharges associated with industrial activity." (except
construction activities). If you feel your facility can certify a condition of "no exposure". i.e. the facilty industrial
materials and operations are not exposed to stormwater. vnu can apply for the no exposure exclusion. For additional
