On behalf of HFCS Transport Company (HFCS), Geoscience and Technology, P A (GeoSci) is
pleased to submit additional information pertaining to a request for "Representative, Outfall
Status" (ROS) for two stormwater drainage outfalls (SDOs) Fhe facility is covered under North
Carolina General Stormwater Permit #NCG080000, Certificate of Coverage #NCG080201
Based (in our conversation on November 7 2013 during a ieconnaissance of the l ll"CS site, we
are forwarding laboratory results for a stormwater sampling event oil Novembei 1 2013 These
data aie in support of HFCS's request for Representative Outfall Status (R.OS) for SDO's 002,
003 and 004 Please refer to the attached Figure 3 for SDO locutions Please note that the original
request for ROS submitted to Corey Basinger at DWQ asked for ROS for SDO's 003 and 004,
however, based on our conversation on 11/7/13, it is our understanding that if the laboratory
results foi all four SDO's foi the last sampling event were relatively similar, that you would
consider ROS status for SDO's 002, 003, and 004 Cho drainage area for SDO 001 is probably
the "worst case" scenario for stormwater contamination as it contains all the sites ASTs and the
fueling area The drainage areas for the other SDO's contain primal ily vehicle parking areas
the results for the 1 l/l/13 stormwater sampling event ate summarized below in Table 1 A copy
of the certified laboratory results for the 1 I/l/l3 event is attached

All result values are mg/L pH is not reported as HFCS measures pH at the time of
sampling and is reported on the DM foi in
Figure 3 indicates that the SDO located at the northwest corner of the site is designated as SDO
004 HFCS designated this SDO as `III NW' on the sampling Chain of Custody Similarly, the
SDO at the southern end of the site is designated as SDO 003 on Figure 3 and HFCS designated
it as `IV SE' The SDO designations on Figure 3 will be used in all future communication
MRCS understands that if ROS is granted for SDO's 002, 003, and 004, qualitative monitoring
will still be required for those outfalls

historically collects semi-annual stormwater samples at SDO 001 and SDO 002 SDO 003 was
created when the parking area was extended n1 the southeast corner of the lacrhty in 2012 SDO
004 is locmated at the northwest corner of the facility and has not been previously identified as an
outfall Activities occurring within the drainage areas for SDO's 003 and 004 are identical to
those for SDO 002, therefore HrCS requests ROS for SDO's 003 and 004 Please note that the
there is an asphalt berm that diverts stormwater drainage to the fueling rack area and from the
vicinity of AST-1 towards SDO 001 therefore, the only activities within the drainage aica for
SDO 004 are fleet and employee parking, which is identical to activates within drainage areas
for SDO's 002 and 003 HFCS understands that if ROS is granted for SDO's 003 and 004, that
qualitative monitoring will still be required for those outfalls

Dear Mr Basinger
On behalf of HFCS Transport Company (HFCS), Geoscience and Technology, P A (GeoSci) is
pleased to submit this letter in response to a Notice of Deficiency (NOD-2013-PC-0122) from
your office dated March 21, 2013 The facility is covered under North Carolina General
Stormwater Permit 4NCG080000, Certificate of Coverage #NCG080201 This response will
address the deficiencies noted as a result of a site inspection by Ron Boone of your office on
March 19, 2013 This response also includes an estimated timeline for compliance
1) General Location and Site Maps
These two maps will be updated to the permit standards before the end of April 2013 Please note
that the scale of the portion of the USGS map that we used for the General Site Local ion Map
does not allow for placement of the three SDO's In fact the USGS map does not even show the
facility and the approximate facility location is shown with an arrow The SDO's are ,Indicated
on the Site Map with drainage areas and latitude and longitude Furthermore, the topography of
the site is very flat and is not shown on the Site Map Flow directions are indicated on the site
map, which is a general indicator of the topography Overall topography of the area is shown on
the USGS map Please advise if this is not sufficient for the purposes of the SP3
2) Annual Reviews and Certiflcations
Certifications and reviews pursuant to Pat 11, Section A, Paragraphs 1(d) 1(e) and 7 will be
performed on an annual basis in the future A page will be inserted into the SP3 with spaces for
annual certification of the required reviews
3) Analytical Monitoring '
The facility will perform semt-annual qualitative and quantitative analytical monitoring of all
outfalls beginning in the current calendar year
4) Combining SDO's at the North End of the Facility
GeoSci and HFCS are investigating the logistics of combining SDO 001 and the previously
unidentified SDO at the north end of the facility The unidentified SDO is at the inlet end of an
RCP culvert that flows under Overdale Road The road embankment at this location is severely
eroded and must be stabilized prior to sampling at this location GeoSci is currently
communicating with the City of Winston-Salem (CoWS) Stormwater Engineering Department
regarding stabilization of the road embankment the road embankment is not part of the
facility's property and HFCS cannot be responsible foi stabilization of the erosion Furthermore,
some type of catch basin will have to be constructed to allow for collecting a stormwater sample
at thts point It is not feasible to collect a sample at the discharge end of the pipe as it is on
CoWS property and is secured with chain link fencing Any activity related to stabilization of the
road embankment and construction of a catch basin will require approval from the CoWS and
perhaps the NC Department of Transportation (D07) GeoSci will coordinate with these
agencies and provide an update as to the status of combining these outfalls

Subject Guidance on Reviewing Requests for Representative Outfall Status
At the East/West Consistency Meetings with the Regional Offices in May 2008, regional staff indicated
their willingness and preference to review and document approval of representative outfall status (ROS) requests
from stormwater permittees Before, these requests were processed by the Central Office (CO) However in the
past some requests were neglected or approval/disapproval was left undocumented Below is a checklist of
recommended review points and steps for tracking representative outfall status requests In BIMS If a request
comes to the regional office that you need assistance with or would prefer CO staff to handle we will be glad to
coordinate review with you
1 A word about a Representative Outfall Status request
Our permittees may be eligible for representative outfall status based on the physical facts at their site and on
some other qualifying criteria However granting of ROS is at DWQ discretion We owe the permittee an
evaluation but not a specific outcome The SPU has routinely denied ROS based on review of the submittal
documents or report from the regional office (RO)
2 Guidance on evaluating the initial request
a) Does the permittee's letter identify a physical basis for the request? Does it state that the character of the
stormwater pollution or the potential pollution or exposure is similar in the sub -drainage areas under
consideration?
b) Or, if not very similar, has the permittee indicated that the representative outfall includes the sub -drainage
area with the most stormwater pollution or the potentlalfor the most pollution or exposure (i a the
"worst" sub -drainage area?)
c) The permittee should provide a site map or drawing to show which outfalls he/she is propos ing to be
representative of which other outfalls and which ones will continue to be sampled as single olitfall5
d) While the objective of ROS is to reduce the monitoring burden on the permittee reducing the permittee's
costs is absolutely conditional on establishing the representativeness of the outfall We cannot grant
ROS simply because we think the permittee deserves a financial break

e) Consider the type of industrial activity For example landfills (NCG12) and mines (NCG02) have
changing footprints with higher potential for activities in a sub -drainage area to change, which might affect
our discretion Also, ready -mix concrete (NCG14) and mines may have wastewater discharges on site
with the potential for the two waters to commingle, which might affect the decision
f) If the request is for an individual permit, are the monitoring parameters the same across all the outfalls
being considered as representative/represented?
g) Typically Vehicle Maintenance Activity (VMA) outfal Is may not represent non-VMA outfalls, and vice -
versa
3 Review the file materials and BIMS
a) What is the receiving water classification? The region may choose to consider this aspect
b) Receiving water special circumstances? Impaired? For what? Is there a TMDL and if so, or what? Are
there threatened or endangered species? The region may choose to factor these into its discretion
c) Has permittee paid up? The region could consider withholding approval until past due amounts are paid
d) Past compliance history should affect our discretion Check file and/or BIMS for violations enforcement,
comments history etc and consider how this should weigh into an ROS approval For example if a
facility has failed to perform any analytical or qualitative monitoring whatsoever and has never
implemented a Stormwater Pollution Prevention Plan (SPPP) asking for ROS may be an attempt to get
out of permit obligations they never lived up to ROS approval may not be appropriate
e) Has past monitoring been complete) If not, has the permittee ignored past monitoring? Or did they
request ROS and never heard back from us so they assumed it was approved? If they ignored
monitoring requirements the regional office may consider denying ROS approval until either (1) there is
enough monitoring data to support representativeness, or (2) the permittee demonstrates diligence in
following permit conditions [How much is "enough' data? Ideally a minimum of eight (8) to 10 samples
but may consider less if other evidence supports ROS request] If the permittee sent us a request that
DWQ never responded to would you have approved it based on their case? Either way keep in mind the
site visit will likely be the most important factor in the final decision
4 Visit the sde
a) The site visit is a critical step in most cases Do the physical facts verify the characterization that one
outfall should be considered representative of another?
b) Look for the most consistently impacted outfall on the site especially if verifying where the "worst case"
runoff flows This is usually near a highly trafficked process or activity area on the site
c) How is general housekeeping? If poor consider whether the operator can confidently assert that one
outfall is representative of others
d) Check out the Stormwater Pollution Prevention Plan (SPPP) is the permittee using the SPPP as a
management tool and living record? Does the SPPP demonstrate that the permittee is actively aware of
and managing stormwater discharges from the site? If you think it is warranted the region may consider
requiring an updated/sufficient SPPP before continuing review of the ROS request

e) Try to pre empt misunderstanding about ROS it allows the analytical monitoring at one outfall to be
considered representative of other outfalls ROS does not change the monitoring frequency required nor
does it change the required monitoring parameters Remind the permittee that ROS also does not reduce
the qualitative monitoring (visual and odor Characterization of the discharge) required at all cutfalls
f) You may need to explain that the final determination is based on the physical facts and DWQ's discretion
DWQ is not obligated to approve a ROS request DWQ may also approve only part of the rE quest or
grant some kind of conditional approval
g) Remind the permittee that if the permit requires a tiered response to benchmark exceedencE s, then an
exceedence at the representative outfall may require attention to other sub -drainage areas represented
by the one outfall (when appropriate)
5 Tacking and documenting Representative Outfall Status
a) Copy the ROS request letter (and site plan if submitted) to the Central Office/SPU, if it did not already go
through us before getting to the region We will keep a copy in the permit file
b) Update BIMS under the Events Tab with the date for "Representative Outfall Status Requested
c) Log any site visit into RIMS as an inspection so you get credit for time spent on ROS review
d) An electronic template of an ROS approval letter is available from the Central Office Please feel free to
modify it as necessary The letter should be signed by the Regional Office Supervisor
e) Copy the final ROS approval or denial letter to (1) Central Office/SPU and (2) DWQ Central Files
f) If approved update BIMS under the Events Tab with date for "Representative Outfall Status
Approved Be sure to include information in the 'Comments' about which outfalls are representative
g) If you deny the ROS request list specifically the basis for denial in the response letter If the denial is
temporary note the conditions that need to be corrected before a re -visit and granting of ROS
h) If you deny the ROS request update SIMS under the Events Tab with date for "Representative Outfall
Status Denied or Revoked Be sure to include comments
i) If there is ever a need to revoke ROS (for example because of changes at the site or because ROS is
compromised in some other way) the regional office should (1) notify the permittee in writing and specify
the reason(s) why and (2) update BIMS under the Events Tab with date for "Representative Outfall
Status Denied or Revoked" that records the date of revocation Be sure to include comments

Ron Boone, of the Winston-Salem Regional Office (WSRO) of the NC Division of Water
Quality (DWQ or the Division), conducted a compliance evaluation inspection (C.EI) of HFCS's
Winston-Salem terminal on March 19, 2013 The assistance and cooperation during the inspection of
Mr Johnny Sheets was greatly appreciated An inspection checklist is attached for your records and
the inspection findings are summarized below
The facility is located at 4001 Overdale Road, in Winston-Salem, Forsyth County, North
Carolina, at approximate coordinates 36 0392190N, -80 226940°W According to the current
Stormwater Pollution Prevention Plan (SP3), stormwater related to industrial activity is discharged
from stormwater discharge outfalls (SDO) 001, 002, and 003, to an unnamed tributary to South Fork
Muddy Creek, which is currently classified as a Class C water and located in the Yadkin Pee -Dee
River Basin
Documentation & Monitoring Review
HFCS's SP3, documentation, and monitoring activities were reviewed during the inspection
The following deficiencies were noted
• The General Location Map (GLM) does not meet all the requirements specified in Part II,
Section A, Paragraph 1(a) of the NCG080000 general permit
• The Site Map (SM) does not meet all the requirements specified in Part II, Section A,
Paragraph 1(c) of the NCGO80000 general permit

No benchmark exceedences were noted in the available analytical records Mr Sheets did
state that HFCS was not able to collect one of the samples for 2012 due to the lack of, or the
timing of rain events during non -business hours A DMR indicating "No Flow" was submitted to
the Division for this 2012 sample
Site Review
In general, the site was very clean and well maintained However, Mr Boone noted the
following two significant issues
SDO 002, located on the southwest corner of the property, consists of a large stormwater drop
inlet on the southern edge of the parking lot, followed by a rip -rapped channel that is
approximately 70 feet in length During the inspection, Mr Boone noted that a large portion of
the riprap stone is coated with a black substance Mr Boone asked Mr Sheets what the
substance was Mr Sheets told Mr Boone he thought it was the parking lot coating material
used by contractor(s) that HFCS has hired in the past to coat the parking lot Please note that
discharge of this substance from the SDO is considered an illegal discharge and possibly a
spill that should have been reported and recorded as per the terms of the NCG080000 general
permit Mr Boone followed the rip -rapped channel to assess how far the material was carried
off site The rip -rapped channel ends within the forested area to the south of it and it appears
that flow then simply flows into the adjacent vegetated field to the south of the forested area It
does not appear and there is no evidence of surface water impacts as a result of this release
However, HFCS is strongly reminded that spills must be properly reported, recorded, and
cleaned up, and that the discharge of such materials from any SDO is considered an illegal
discharge
There is an additional SDO on the northwest corner of the facility that is not identified in the
SP3 and has not been monitored The SDO drains employeelvisitor parking areas, as well as a
portion of the fueling area on the north side of the facility This SDO should be added to the
SP3 and the stormwater management and monitoring program as a separate SDO

Alternatively, flow from this SDO and SDO 001, which is located on the northeast corner of the
property, both run through a drainage ditch that parallels the northern property line, along Old
Milwaukee Lane, but the flows are coming from opposing directions Monitoring could be
conducted at the point at which the two flows combine, and a new single SDO could be
identified which drams both drainage areas
The Division requires that HFCS corrects the viol ationsldeficiencies outlined above as soon as
practical Please reply in writing to this letter within 30 business days of receiving it Your written
reply should detail corrective action plans with implementation schedules for each of the
violations/deficiencies noted above HFCS is reminded that violations of the NCG080000 General
Stormwater Permit are subject to civil penalty assessments not to exceed $25,000 per day, per
violation HFCS's written reply, as well as the actual actions it takes to correct these
violations/deficiencies, will weigh heavily in our decision of whether to pursue further action in order to
compel full compliance with the NCG080000 general permit
