This certificate of coverage shall become effective February 25, 2005.

We have a request from IP to change the stormwater permit at: the Bolton Equipment
Depot from IP to Cape Fear Paving. Apparently Cape Fear Paving is leasing the site,
and is also under separate contract to IP to service, maintain, and store woodlands
equipment at this site near Lake Waccamaw. It appears that IP (the current permit
holder and property owner) is seeking to place the responsibility for permit
compliance with the day-to-day operator of the facility. I don't think we have any
problem at this end, but in my very limited experience it is sort of an unusual
request, so I'm checking with you just in case there's something screwy in the
history of this site. Any input?

I'm remembering your comment a couple of weeks ago to the effect that there is a
legal reason for, or perhaps a legal convenience in, our seeking to issue our
permits to the site owner, in preference to a different site operator, not an owner.
I have a Name/Ownership Change form in hand from a permittee effectively seeking to
revise the permit to show the operator as the permitted party rather than the site
owner (and current permit holder). No other change is indicated.
International Paper Company owns a property in Bolton, NC and holds a stormwater
general permit, NCGO80028 (transportation type activities with vehicle maintenance).
According to a lease supplied with the Name/Ownership Change form, IP also owns or
controls lands adjacent to or abutting the permitted property. The lessee, Cape Fear
Paving LLC, is named as the new operator of the facility in the name change form. The
executed lease is "for the sole purposes of: Operating a woodlands equipment facility
where equipment is serviced, maintained and stored, where fuel is stored and
dispersed, where spare parts are purchased and stored, and where offices and meeting
spaces are available for the on -going administration of a forestry services
business."
Other provisions of the lease require, "Licensee shall maintain a valid Storm Water
Pollution Prevention Plan, a General Permit to Discharge Storm Water under the
National Pollutant Discharge Elimination System,
It sounds like they have the correct general permit for the activity. And it sounds
like there is a lease wherein the parties agree that Cape Fear Paving LLC is
responsible for the stormwater permit. Do we have a problem with revising the
Certificate of Coverage under this general permit to show the site operator, instead
of the site owner, as the permit holder?

between the state of North Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.

Your coverage under this general permit is not transferable except after notice to DWQ. The Division may require
modification or revocation and reissuance of the Certificate of Coverage. This permit does not affect the legal
requirements to obtain other permits which may be required by DENR or relieve the permittee from responsibility
for compliance with any other applicable federal, state, or local law, rule, standard, ordinance, order, judgment, or
decree.
