Let me also note, that previous outfall samples tested last April (below) that had very poor results for COD and TSS were investigated and cause detennined the following week after that sampling. Our site topography is'pitched, and on the high side adjacent to the property is Ivry Ave., which for the month prior and during the April sampling date had undergone significant road resurfacing anti new blacktop paving by the city of Winston Salern. All that runoff flowed downhill into and through our lot and into the two Outfall locations below it. Additionally, the road project contaminated our 2151 Street Warehouse outfall on the other side of Ivy Ave where our tractor trailer traffic continually crossed that road throughout each day. The water samples were abnonnally blackish in color. These findings were reviewed and validated on -site by City of Winston Salem stonnwater inspector, LaDonta Clark, that following week. Pasted clata from last April, 2016 caused by road resurfacing and blacktop adjacent to site. Here's what I see in the OMB 1987 SIC Manual, and in federal rule at 40 CFR 122.26(b)(14): • OMB: SIC 0254 Hatcheries, poultry; • OMB: SIC 0921 Hatcheries, fish; • OMB: Major Groups 01 through 09 (01xx - 09xx) , including these two SIC codes, could be characterized as agriculture and forestry businesses. It's a general rule of thumb to think of first -line ag and forestry businesses as exempt from the NPDES program. Federal rules at 40 CFR 122.26(b)(14) start naming captured SIC codes at Major Group 10. • If we were to run across a hatchery that was using animal mortalities to produce feed, or extract oil, or recover some other byproduct as a secondary activity to the hatchery, I think we would look at the business as primarily a hatchery, and so, not subject to the NPDES program. Somewhat parallel: We actually have run across a tiny composting operation (normally captured) at a trout farm (not captured.) In that case we concluded that the primary commercial activity was the trout farm, and that the composting activity did not require an NPDES permit, since the predominant site activity was not a captured activity. Also, note that our brothers and sisters in NPDES wastewater have a General Permit for discharges from fish farms and packing plants, so the facility was already subject to some level of surface water protection regulation. We also had a question about milk production that coincidentally serves to show the boundary that I called'first-line' ag businesses above, although that specific term doesn't come from the rules. • OMB: SIC 0241 Dairy Farms are not captured by the NPDES rules, and so we don't permit these folks. Intuitively it's clear that they are an agricultural business. • OMB: SIC 2021— 2026 Various subsectors of the general description, "milk plants." These facilities receive raw milk from farmers or co-ops and make various kinds of milk, ice cream, Wendy's Frosty, etc. These folks are captured by the NPDES program, and would be one of the other types of businesses (not meat, feed mills, or rendering) that would typically fall under General Permit NCG06, the permit we discussed today.
