In my last report in 2016, 1 discussed with Rob Cottle to rescind the 323 permit. However, in 4/22/2009 Linda Willis has a comment in the Analytical monitoring section of her report noting confusion of the permit numbers and sites. In 2010, Willis noted that no application has been submitted for the Yellow Cut facility. All her reports were done under 276. In November of 2016, we issued ROS to 323 for outfalls on Yellow Cut Road. I think 276 should be rescinded and go forward with 323. — We will rescind NCG060276. — NCG060323 is scheduled to renew and we will let this one move forward. Just curious, for this one in the 2016 inspection summary in BIMS it says there is no processing and indicates that a permit may not be needed? NCGO80685 The Castle Street needs to be rescinded and a NOI submitted for their new facility. I spoke to the Megan Matheny, Deputy Director, to explain this. I will be writing a report and letters. — We can handle the rescission of NCG080685 and will let you work with them to get an NOI submitted for the new location. • . Box 756 Rose Hill, NC 28458 Subject: NOTICE OF VIOLATION NOV-201 O-D V-0351 Duplin Winery Making an Outlet Rose Hill Duplin County Dear Mr. Fussell: On September 15, 2010, Division of Water Quality (DWQ) representative, Linda Willis and 1, conducted a surprise inspection at the Duplin Winery, located at 310 Yellow Cut Road, Rose Hill, Duplin County. This inspection was in response to a citizen complaint that alleged that wastewater was being disposed illegally at the winery. During the inspection we observed that there was an uncapped pipe with an outfall into a ditch that is located several hundred feet east of the pretreatment basin. This ditch is part of an interconnected network of ditches that eventually discharge into an offsite wetland north of the winery. This wetland is considered waters of the State. During this same investigation, Ms. Willis discovered the presence of what appeared to be wastewater in the ditch north and west of the winery. Consequently, you and Mr. Cottle were asked to measure the physical parameters of what appeared to be wastewater at this location, and to collect samples for BOD-5 day, chemical oxygen demand, and nutrients. The next day, September 16, 2010, Ms. Willis returned to the site and collected samples for the same parameters at this location, and sent them to our Central Lab for analyses. Ms. Willis also measured the physical parameters of what appeared to be wastewater, and the dissolved oxygen measured 0.6 milligrams per liter, which confirmed that whatever was in the ditch was septic. Furthermore, Ms. Willis walked over the ditch network on the winery and Carolina Byproducts, and observed that all the ditches were dry, except at this location. The rainfall records sukgest that the last rainfall at the winery occurred on August 19, 2010. You were also asked to excavate the buried pipe. You hired a contractor to excavate it on September 20, 2010, and Ms. Willis and Mr. Chris Baker from DWQ were there to observe this excavation. After excavated, it was determined that this pipe had been cut about fifteen feet east of the pump house. N. C. The most significant finding, however, is that the samples that you collected on September 15, 2010 and the samples that Ms. Willis collected on September 16, 2010, confirm the presence of treated wastewater in the ditch in question. Attached are the laboratory results from the samples taken on September 16, 2010 by Ms. Willis. The results of the samples collected from the ditch by the Division on September 16, 2010, indicate the contents of the ditch are the same as the characteristics of the wastewater in the treatment lagoon. Making an outlet to surface waters of the State is in violation of the North Carolina General Statute 143- 215.1(a)(1): No person shall make an outlet to waters of the State unless that person has received a permit from the Commission and has complied with all conditions set forth in the permit. You are directed to respond to this letter in writing within 15 calendar days.of receipt of this Notice. Your response should include the following: 1. Give a detailed explanation of how wastewater was introduced to the ditch; 2. Give a detailed explanation ofany steps taken to mitigate the presence of wastewater in the ditch; 3. Give a detailed explanation for the underground piping from the ditch to the effluent pump house; 4. Explain why the freeboard is below the pump intake, as shown on the photograph taken on July 22, 2010; 5. Give a detailed explanation of how you will ensure no further discharges of wastewater will occur from your facility. Thank you for your attention to this matter. This Office is considering sending a recommendation for enforcement to the Director of the Division of Water Quality regarding these issues and any future/continued violations that may be encountered. Your above -mentioned response to this correspondence will be considered in this process. This office requires that the violations, as detailed above, be abated immediately. These violations and any future violations are subject to a civil penalty assessment of up to $25,000.00 per day for each violation. In order to study the characteristics of winery waste you have to understand two ingredients and factors are well involved in the two process a) grapes b) fermentations. a) Grapes: about 19.1% Carbohydrates (Sugar- fiber),<l% fat, <1% protein , 15%a minerals and some metals such as Zinc and Iron and 59% Vitamins The rest is Hzo and how knows such as Anthocyanins (red grape skin) and Phenolics specially with red grapes it is called the dietary anti oxidant and that is expected to be present in the waste post pretreatments done by the facility during the pressing process recommended analysis COD maybe total coliform for qualitative determinations, BOD5, TSS, pH and other Inorganic/metals determination for details and organic as well for carbohydrates, fat and protein if required or to run initial assessment to build removals or treatments models/procedures b) Fermentation: Simply converting Carbohydrates to sugar then alcohols finally to acids and it could be some Aldehydes present in between mostly unstable and will go either way alcohols or acids with yeast acting as a catalyst. It is 100% done under anaerobic condition. Chemicals to expect are lactic and acetic acids protein amino and fatty acids .Recommended analysis the same as grapes with the addition of Oil and Grease maybe and other organic related tests color analysis maybe needed for quick determination of actual wine waste and to determine the quality and efficiency of the product. How it work: 1) Grapes are pressed into juice and stored for later fermentation. 2) Processing is when the grape juice is fermented into wine and packed for shipment. In the following table based on an average flow of 1000 gallon of pressed grapes it will show you the difference between the two characteristics and parameters of interest, average data you may anticipate again location and the size of the facility will affect the data and if you apply California rules be sure adjust your data and treatment based on your state, county and area soil characteristics, data and climate. The allegations were that there were illicit discharges to the ditch from the winery. Linda Willis and Rick Shiver inspected the site (unannounced). The pipe in the ditch noticed during the July 22, 2010 investigation was still uncapped and there was water in the ditch beneath the pipe outlet and in the connecting ditch perpindicular to the receiving ditch which drains to a wetland located northwest of the winery. The water in the ditch had a septic appearance. DWQ requested that the Duplin Winery take samples at two locations behind their lagoon. Parameters for analyses requested were BOD-5 Day, COD, and nutrients. The Regional Supervisor requested the winery hire a consultant (engineer) to map out all the floor drains/piping in the facility to determine the location of their outlets. Pictures taken (on July 22, 2010, by staff) of the piping inside the pump house showed two stubs for connection to the filters. DWQ requested the underground pipe be excavated to determine where the piping had been connected. The piping was excavated on September 20th with Linda Willis and Chris Baker present to witness the excavation. The piping went directly to the pump house but was severed approximately 15 feet or so from the pump house and in a location where a recent (since July 22, 2010) excavation had occurred. Rob Cottle brought attention to the recent excavation to explain it was put in at the time when the plumbing and electrical was put in for the effluent pump house. There was no vegetation in the trench dug and when pictures taken during July 22, 2010 visit were reviewed, no stormwater trench in that location was seen. The extra stub in the pump house was plumbed to just outside the building where it lay parallel to the line that went to the effluent lift station The pipe in the ditch had been severed within a few feet of the dead end stub. A notice of violation was issued to Duplin Winery on October 15, 2010 concerning the issues found at the facility on September 15, 16 and 20th, 2010, requesting an explanation for the underground pipe and why the wastewater level was below the effluent pipe riser. The facility has yet to turn in an application for permit coverage under NCGO60 for the wine facility on Yellow Cut Road. Boxes are picked up by fork lifts and loaded to a piece of equipment that removes sticks and leaves. A big drum with an internal basket allows the grapes to fall through the holes to a squeezer that liquifies the grapes enough to be pumped by adding rice hulls. The pressers press for 1 hour. solids are removed and hauled to fields. No further information on the fields were provided. Cream of tartar comes off the bottom of the fermenters (approx .03 to .05 Ibs11000 gallon, floor drains inside where the fermenters are goes to septic tanks. Piles of cream of tartar were seen at the nw corner of the building. The lagoon out back is a 2 bay lagoon with the first bay very dark (septic looking) in color. The waste in this bay has lime added to control pH. The second bay discharges to the ditch via an overflow pipe. The facility generates approximately 7500 gallons of wastewater per day which gets pumped to the lagoon and to the septic system. The consultant (Geno Kelly) had some analyses on the wastewater in the lagoon. The analyses were primarily macro and micro nutrients. P, CA, N, K, Fe, Mn etc. no BOD or COD was analyzed. The inspector and supervisor walked to the ditch in line with the overflow structure and witnessed a discharge to the ditch. The ditch again, was full but no samples were taken. The consultant and Mr. Fussell were informed that the discharge must be discontinued and they need to resolve their wastewater discharge issues. The Wilmington Regional Staff requested the help of pollution prevention to help the winery sort out their problems. Neither the consultant nor Mr. Fussell knew how much wastewater discharges to the ditch during the course of the month. It is likely the discharge is not continuous throughout the year. The greatest volumes are generated during the grape season August -November. The results were as follows: SOD 5 day - 780 (1% solution).. sampling had to be diluted significantly due to toxicity problems (SEE AB43287 sample ID State Lab in Raleigh) fecal coliform - 890 (likely background given the nature of the ditch) COD - 4000 mg/L TSS - 1600 mg/L Grease and oil - 10 (below quant level) NH3-N - 1.7 mg/L TKN - 21 mg/l_ NO2 & NO3 - .02 mg/L TP - 8.9 mg/L Inspector advised Mr. Fussell to remove the wastewater from the ditch. They complied within approximately 3 days and sent pictures to Mr. Charles Stehman showing the ditch had been cleaned. APS worked with them to allow the application of the wastewater on fields. D D ■ Comment: This site was not covered properly under the NCGO60 permit. The facility with the permit is the retail store location. When DWQ representative asked why the retail store was covered and not the manufacturing facility, Patrick >=ussel, operations contact stated it was DWQ's issue for not catching the problem and correcting it. A stormwater pollution prevention plan had been written for the retail store (that has no exposure whatsoever). They had not been monitoring their stormwater discharges at the retail store.
