The inspection found the facility to be in violation of the state issued stormwater permit. Specifically, the Stonnwater Pollution Prevention Plan (SPPP) was outdated and the required qualitative and quantitative monitoring had not been performed. This inspection evaluated the five (5) areas designated on the attached inspection form. Observations from each area are addressed below: 1. Permit Sunset Feeds holds Certificate of Coverage 9 NCG060178 for the discharge of stormwater from the site. The pennit expires next on October 31, 2012. 2. Records/Reports Part II, Section A of the permit requires the development of a Storm«-ater Pollution Prevention Plan (SPPP). A coPy of the SPPP for Sunset Feeds was reviewed during the inspection. The plan has not been updated to describe current best management practices (BMP's) for stormxvater control. The plan is required to be revie,,ved and updated on an annual basis and should follow the format listed in Section A of the permit. 3. Facility Site Review The BMP for the roofed storage area (cotton seed, cotton hulls, dried distillers grain and minerals) consists of using a hand blower to blow any material back under roof that is tracked onto the asphalt by the loader. Additionally, each Saturdav the asphalt area is power washed. Wastev.,ater generated is routed to a sump and pumped to a storage tanker. The BMP for the tank area (corn gluten, soybean hulls, corn, soybean mill, cotton seed mill and spent brewers grain) consists of power washing each Saturday to collect spillage and dust. The wastewater generated is routed to a sump and pumped into the storage tanker. The liquid Nvhey tank has a dedicated sump that pumps to the tanker. Spilled feed at the truck scale area is cleaned up by hand. It is our understanding that the wastewater collected in the tanker during power washing is land applied onto fields off Union Cross Road. Stormwater from the roofed storage area drains to the west gate and flows along Barnes Road. Stormwater from the tank area flows to the east gate where piping from two storm drain grates connect and discharge on the other side of Barnes Road. Stormwater eventually reaches Soakas Creek, Class "C Waters in the Yadkin Pee -Dee River Basin. 5, Monitoring Program Part 11, Section B of the permit requires collection of semi-annual analytical samples during a representative storm event from both outfalls. A review of facility records revealed that these samples have not been collected since 2006. Samples must be collected per permit requirements. In addition, the permit establishes benchmark values that, if exceeded, require tiered responses that may involve increased best management practices, inspections, record keeping and/or sampling. You should familiarize yourself with the two tier levels and the responses required in the permit if benchmark values are exceeded. The semi-annual analytical monitoring results must be submitted to the Division on form SWU-249-102107 no later than 30 days from the date the facility receives the sampling data from the laboratory (see analytical reporting form attached). Part II, Section C of the permit requires that qualitative (visual) monitoring be performed and documented semi-annually at the same time that the analytical samples are collected. The file review also found that these observations are not being documented. This monitoring most be performed semi-annually per the permit requirements (see qualitative monitoring form attached). The qualitative records do not need to be submitted to the Division, however, the records must be kept on fife at the facility for a period of five years. Failure to comply with any permit conditions is a violation of the General Permit. Per the permit text in Part III, Section A (2)(a), "The permittee must comply with all conditions of this general permit. Any permit noncompliance constitutes a violation of the Clean Water Act and is grounds for enforcement action...". Additionally, per the permit text in Part III, Section A (2)(c), "Under state law, a daily civil penalty of not more than hventy-five thousand dollars ($25,000) per violation may be assessed against any - person who violates or fails to act in accordance with the terms, conditions, or requirements of a permit [Ref - NC General Statute 143-215.6AF. You are requested to respond, in writing, to this office on or before October 30, 2009,'advising what steps will be taken to ensure that the qualitative and quantitative monitoring will be performed as required and when the SPPP will be updated. According to Ms. Worsley the odor from the substance was horrific. I told her that I was unaware of any spill but that I would investigate the site and see what I could find. 9124/09 8:20AM I arrived on Barnes Road and found that there was a substance discharged onto the road which looked like it had been leaked out of a tanker truck along a section aproximately 1f2 mile in length. The discharge had an odor that was so pungent you could smell it in the oar with the windows rolled up. I immediately pulled into an entrance to a subdivision on Barnes Road and began trying to contact someonw with NCDENR DWQ and the City of WS Stormwater Department. I could not reach NCDENR DWQ but left a message for Rose Pruitt to contact me. I reached Andy Allen with WS Stormwater and he stated that someone would be dispached to the site right away. In about 20 minutes John Spainhour and Robert Riley with Stormwater arrived on site. They looked at the situation and said that they would contact WS Streets Division to dean up the residue. At this point the substance was drying on the road surface, John stated that they had just been out to Sunset Feeds which was located right below the spill area on Barnes Road the previous day and issued an NOV for an overflow of liquid from brewers grain that they store for cattle feed. We had had odor issues with Ronnie Charles the owner of Sunset Feed in the past because of Wort he was spraying on his fields on Union Cross Road_ The odor coming from the spill on Barnes Road was similar to the odor from the Wort. John asked me if 1 had seen the discharge of the liquid. I told him that I had not. He said that they would take over the investigation. I left the site. 9/241091 came back to the office and explained the situation to Bob Ragland I told him that I thought that Sunset Feeds was responsible for the spill but could not prove it. He asked if anyone had contacred Ronnie Charles and asked him if he had spilled the liquid. I told Bob that Stormwater had taken over the investigation and I did not know. He advised me to contact John Spainhour and ask him. I did and he stated that he had not contacted Mr. Charles_ I told him that I was going to call him and ask if he knew anything about the discharge. I contacted Mr. Charles and he stated that they had a tanker Wort going up Barnes Road at 7:30 or 8:00AM that morning and that there could have been a leak in the tanker causing the spill, He stated that he would go and inspect the tanker and contact me if he found any issues. I thanked him and told him that I would just come out to the site. I then contacted John Spainhour and told him what Mr. Charles had said. He said that Robert would meet me on site. 9/24109 2:00PM I met Robert on site and we found Mr. Charles inspecting the tanker. The three lids on the top of the tanker were found to be compromised. The one closest to the rear of the tanker was off and this is where the liquid was discharging from. Mr, Charles was going to repair the tanker by welding aluminum to the top thus sealing all three openings perminently_ - WS Stormwater issued an NOV for the spill and NCROT washed the residue from the road surface.
