Subject: House of Raeford , Wallace Chicken Processing Plant,
Wastewater Treatment Plant Capacity Calculations
The Wilmington Regional Office requested an evaluation of the stormwater runoff volumes that are
generated in the processing/truck staging areas of the facility. A "first flush" volume calculation was
requested. That should have involved some sampling in order to determine what the quality of the
stormwater is after, for instance, a 1", 2" and 3" rain event. Of course the quality of the stormwater
would vary given the time period between rain events.
The region received a map showing the drainage areas and flow of stormwater within the collection
system as well as calculations indicating the biological and hydraulic treatment capacities. The
information was received in this office on January 3, 2013. Several questions were sent to the
consultant, Jimmy Holland, on January 23, 2013 for clarification on questions concerning the calculations
and the map.
The wastewater treatment calculations indicate the plant is hydraulically limited at 1.013 MGD if a
detention time of 30 hours is required for biological treatment and 1.52 MGD if 20 hours of detention
time suffice. The biological treatment capacity was determined to be 1.05 MGD. The plant has two flow
limitations, one at 0.9 MGD and one at 1.5 MGD. The calculations for BOD loading were based upon an
influent BOD to the aeration basins of 343 mg/L and an allowable ROD loading of 3008 lbs/day of 800.
Production flows range anywhere from 0.026 MGD up to 1.143 MGD (based upon a review of DMRs
from January 2012 to October 2012). Regardless of the higher flows, there has only been one daily
excursion of the daily ROD limit (10 mg/L) and that occurred after a flow of 1.051 MGD the previous day.
It should be noted that monitoring was not conducted during the majority of the days where flow
exceeded 1.0 MGD. Based upon the average flows during the time period reviewed, there is flexibility
for increases in hydraulic loading to the plant for additional stormwater treatment. If hydraulic loading
remains a concern, House of Raeford could eliminate the cooling tower/boiler blowdown discharges to
the plant and discharge those directly to surface waters under an NCG500 permit.
The emergency stormwater pond is roughly 300' x 350' by approximately 2 feet deep. The depth is
questionable as the bottom of the pond has been full of solids which the House of Raeford has been
attempting to remove. Information concerning the dimensions of this pond was requested. One foot of
the depth available would need to be reserved for freeboard requirements. The pond is large enough
even at 1' depth, to provide a storage capacity of 78S,000 gallons. The consultant indicates a 1" rain will
result in 157,000 gallons of stormwater.
The area across the road from the facility generates a very poor quality stormwater due to the staging of
trucks hauling birds. A large portion of that site is not being captured for treatment. The area is gravel
which makes it impossible to implement good housekeeping practices such as sweeping, which might
suffice in reducing the bacteria content enough to bring bacteria levels down. The bacteria
concentrations have been in excess of 1 million (fecal coliform colonies{100 mL)_ DWQ requested
information on how much stormwater (in inches) would result in overflows from lift stations #1 and 2.
That information was not provided in the calculations. The consultant did not provide wet well
capacities, but did provide the time it takes to pump down the stormwater inputs to the lift stations
after a 1" rain. The House of Raeford needs to determine how much rain would result in an overflow
from the lift stations conveying stormwater and provide information on the quality of the stormwater
after a 1", 2" and 3" rain, for comparison.
Until further information is gathered, it is difficult to make any recommendations concerning how much
stormwater would need to be treated in order to bring bacteria levels down to an acceptable range.

THIS CAUSE came on.to be heard this day before the undersigned Judge of the Stipeiior
Court, sitting in session in Duplin County, located within Judicial District 4, which District'also
includes Duplin County, the County where this civil action originally was conunehc�d. .The
Plaintiff, State of North Carolina {"State"), by and through its Division of Water Quality
("DWQ") of the Department of Environment and Natural Resources ("DENR..'), was represented
by Anita LeVeaux, Assistant Attomey General. The Defendant, House of Raeford Farms, Inc.
(also "HORF"), was represented by Henry W. Jones, Esquire. The parties have informed the
Court that they have settled all matters in controversy between them and they desire to enter into
the following Consent Judgment. Based on the stipulations of the parties and the matters of
record, and it appearing to the Court that Defendant consents to the relief sought, as evidenced
by the signature of Defendant's counsel below, the Court makes the following Findings of Fact
and Conclusions of Law.

FINDINGS OF FACT AND CONCLUSIONS OF LAW
l . HORF holds North Carolina National Pollutant Discharge Elimination System (NPDES)
Permit No. NCO003344 ("Permit") for operation of an existing wastewater treatment system at
its chicken processing plant near the town of Wallace in Duplin County, North Carolina and for
making an outlet therefrom for the discharge of treated wastewater to Rock Fish Creek.
2. HORF is unable to comply with the final effluent limitations for Oil and Grease,
Mercury, Biochemical Oxygen Demand (BOD), and Nitrogen under the Permit. Compliance
with the effluent limitations Oil and Grease, Mercury, Biochemical Oxygen Demand (BOD), and
Nitrogen will require evaluation and/or re -design of existing wastewater treatment system, as
well as obtaining appropriate Authorization(s) to Construct ("AtoC"), construction, and
operation of modified or additional treatment facilities.
3. The absence of treatment facilities needed to comply with the effluent limitations for Oil
and Grease, Mercury, Biochemical Oxygen Demand (BOD), and Nitrogen control facilities
constitutes a violation of the State's water quality statutes and of the Permit.
4. Plaintiff is authorized to bring this action for injunctive relief for violations of the State's
water quality statutes, and of NPDES permits by reason of N.C. Gen. Stat. 143-215.6C.
5. HORF stipulates that it has been properly served with a copy of the Complaint, accepts
venue in Duplin County, accepts service of the Complaint, and admits to all factual averments
contained in the Complaint.
6. HORF is in the process of improving operations and planning for trial testing, technology
selection, design, obtaining appropriate Authorization(s) to Construct, and construction of the
additional treatment facilities needed to meet the Permit effluent limitations for Oil and Grease,
BOD, Nitrogen, and, Mercury.
7. The parties have agreed this Consent Judgment CIOC") may be signed out -of -court, out -
of -term, out -of -county, out -of -district, and/or out -of -session, as the case may be. HORF has
agreed to, and shall pay all court costs in this action.
8. HORF has agreed to, and shall undertake, the actions specified herein below in order to
ensure full compliance with all Permit effluent limitations, monitoring conditions and applicable
North Carolina law.

COMPLIANCE SCHEDULE AND INTERIM LIMITS
9. HORN' shall undertake trial testing, technology selection, design, obtaining appropriate
Authorization(s) to Construct, construction, and shall place into operation procedure and
facilities in order to ensure full compliance with Oil and Grease, Mercury, Biochemical Oxygen
Demand (BOD), and Nitrogen Permit limits and applicable North Carolina law. Pursuant to the
compliance schedule set forth below, HORF has agreed to and shall complete all items set forth
below on or before the compliance deadlines set forth below, during which time HORF is
authorized to discharge wastewater according to the following Interim Limits:

*The DWQ will not enforce mercury violation while the JOC is in effect, so long as HORF
develops and implements an acceptable mercury minimization plan.
a. . Within ninety (90) days, upon entry of this JOC, conducted by a NC registered
professional engineer, an evaluation of alternatives for wastewater disposal to included, but not
limited to, pretreated discharge to the Town of Wallace WWTP #2, NPDES Permit No.
NC0003450.
b. Within one hundred twenty (120) days upon entry of this JOC, and conducted by
a NC registered professional engineer, an evaluation of the actual hydraulic and biological
treatment capacity of the wastewater collection and treatment system to include, but not limited
to:
i. wastewater collection system;
ii. the 1000 gpm DAF unit;
iii: pretreatment flumes and. screening;
iv. equalization basin, including development of a plan and schedule for
removing grease, scum, and other solids;
V. aeration basins;
vi. clarifiers;
vii. secondary DAF unit;
viii. tertiary filters, including backwash disposal;
ix. emergency holding pond;
X. sludge digesters; and
xi. process control and compliance monitoring.
C. Within ninety (90) days upon entry of this 30C, and conducted by a NC registered
professional engineer, HORF shall complete an evaluation of the current stormwater collection
and disposal.
d. Within one hundred fifty (150) days upon entry of this 70C, submit a draft PE's
written -report to DWQ of the findings and recommendations for items under subparagraphs 9.a.,
9.b. and 9.c, to include, but not limited to:
i. design deficiencies at the facility;
ii. operational and maintenance deficiencies at the facility;
iii. identify the source of mercury;
iv, capacity calculations; '
V. flow schematics of the wastewater and stormwater collection systems;
vi. recommendations for corrective actions; and
vii. recommendations for disposal alternatives.
e. Within thirty (30) days upon receipt of DWQ comments of the evaluation, submit
the final PE's final written. -report to DWQ of findings and recommendations for items under
subparagraphs 9.a., 9.b. and 9.c, to include:
L design deficiencies at the facility;
ii. operational and maintenance deficiencies at the facility;
iii. identify the source of mercury;
iv. recommendations for corrective action;
V. capacity calculations;
vi. flow schematics of the wastewater and stormwater collection systems; and
vii. HORF's plan of action to implement the recommendations from the.
professional engineer.
f. Upon acceptance by DWQ of the plan of action, implement the plan of action,
having submitted all necessary complete AtoC applications with 90 days of acceptance of the
plan of action
g. Develop and implement a wastewater treatment process control, an optimization
plan and a mercury minimization plan.

h. Within twelve months of the issuance of AtoC permits, or within 12 months of
DWQ acceptance of the plan of action if an AtoC permit is not required, complete
implementation of the plan of action, construction activities, and return to full compliance with
Permit:
NOTICES
10. No later than fourteen (14) calendar days after any deadline identified in paragraphs
above, HORF shall submit to the Director of Water Quality, at the address below, three (3)
copies of the progress reports including written notice of compliance or non-compliance:

In the case of non-compliance, the notice shall include a statement of the reason(s) for non-
compliance, remedial action(s) taken, and a statement identifying the extent to which subsequent
deadlines may be affected. Notices shall include updates on HORF's progress with a mercury
minimization plan, notwithstanding other updates which may be requested by DWQ.
STIPULATED PENALTIES
l l.. Unless excused under paragraph 12 below, HORF will pay the Director of the Division of
Water Quality, by check, made payable to the "North Carolina Department of Environment and
Natural Resources", stipulated penalties according to the following schedule for failure to meet
the deadlines set forth above:
a. Failure to meet a schedule deadline:

$500/day for first 7 days;
$1500/day thereafter.

e. Failure to obtain compliance with Oil and Grease, .
Mercury, Biochemical Oxygen Demand (BOD),
and Nitrogen in the issued Permit within,60
days after upgrades are placed in operation: $10,000
12. Stipulated penalties shall not be due and payable if HORF demonstrates to the Division
of Water Quality that non-compliance was caused solely by:
a. An act of God;
b. An act of war;
c. An individual act or omission of a third party; however, this defense shall not be
available if the act or omission is that of an employee or agent of HORF or if the act
or omission occurs in connection with a contractual relationship with HORF;
,d. An extraordinary event beyond HORF's control. Contractor delays will not be
considered events beyond HORF's control; or
e. Any combination of the above causes.
13. Failure within thirty (30) days of written demand to pay the stipulated penalties or to
challenge them by a contested case petition pursuant to N.C. Gen. Stat`.§150B-23, will be
grounds for a collection action, which the Attorney General is hereby authorized to initiate. The
only issue in such action shall be whether the 30-day period has elapsed.
SETTLEMENT OF
LV-2009-0125, LV-2009-0455, AND PC-2009-0109 ("Agreement")
14. HORF upon entry of this TOC, shall pay the stun of thirty-four thousand five hundred
dollars ($34,500) in six consecutive monthly payments. The first payment shall be due thirty (30)
days after entry of this order.
15. Payment shall be made by check and made payable to the North Carolina Department of
Environment and Natural Resources (or "NC DENR"), and delivered to the following address:

16. HORF and DWQ agree that the consideration for this settlement is the promises
contained herein and that this Agreement contains the whole agreement between them and this
Agreement. shall be binding upon the parties, their successors and assigns, upon execution by the
undersigned; who represent and warrant that they are authorized to enter into this agreement on
behalf of the parties hereto.
OTHER PROVISIONS
17. The parties agree that, for purposes of any future bankruptcy proceeding, this JOC is not
intended as, nor shall it be deemed to constitute, a novation of any claims asserted by HORF
against DWQ. HORF further agrees that all sums payable to DWQ are nondischargeable in
bankruptcy under 11 U.S.0 §523. Nothing in this Agreement releases any nondis.hargeability
claims that may be asserted by DWQ in any bankruptcy proceeding, and nothing in this order
shall be deemed a waiver of DWQ's right to rely on the nature of any claim or debt released in
this order to show that the claim or debt is nondischargeable.
18'. Nothing in this JOC shall restrict the right of DWQ to amend deadlines in the event of
unavoidable delays outside of the control of HORF.
19. This JOC constitutes full settlement of all matters -referred to in the Complaint. Plaintiff
reserves all rights to otherwise assess appropriate civil penalties prospectively pursuant to N.C.
Gen. Stat. § 143-215.6A in connection with the operation of HORF's wastewater treatment
system; providcd, however, the parties expressly understand and agree that prior to the deadline
for compliance according to the Compliance Schedule set forth in Paragraph 9, above, HORF is
authorized to discharge wastewater according to the Interim Effluent Limits for Oil and Grease,
BOD, Nitrogen, and Mercury set forth in Paragraph 9.
20. DWQ shall request a dismissal upon notice by both parties that HORF has successfully
complied with all the terms of the compliance schedule, above and notwithstanding the other

provisions of this order, is in compliance with the effluent limitations for total nitrogen set forth
above, unless otherwise instructed by Order of this Court.
ORDER
IT IS THEREFORE, upon the consent of the parties and without the taking any evidence,
ORDERED, ADJUDGED and DECREED;
I . The above stipulated facts and terms, as agreed to by the parties, are hereby made
specific findings and orders of this Court. HORF is directed to undertake and complete all
actions in the compliance schedule according to and consistent with deadlines set out above and
to comply with the interim measure and interim limit set out above.
2. The Court shall retain necessary jurisdiction of this matter for purposes of enforcing the
terms of the Consent Judgment; -for purposes of determining -any matters in dispute; and for
purposes of determining any motions for further relief based on changes in circumstances. The
parties may jointly modify the provisions of the Consent Judgment only with affirmative
approval, in advance, by the Court.'
