Spill Prevention and Control
Interior of the building is handled by the shift supervisor and maintenance technician using the
spill control kits located throughout the facility Bulk tank farm is visually checked each morning
for leaks
Exterior of the building
Tanker unloading- The trained receiving coordinator monitors the adhesive raw material transfer
operations from all tank trucks to the storage area throughout the unloading period
Spill Containment and Clean up materials
Emergency spills kits contain sorbents, and sorbent materials to contain leaks if a spill occurs
Spill Containment and Clean up coordinator
The Spill containment and clean up coordinators for the facility are the maintenance manager
and the safety manager The Safety Manager is responsible for reporting spills
The maintenance department uses a preventative maintenance program for the equipment to
reduce the potential of oil leaks All internal drains have been capped and do not allow any
chemical to enter the storm water or the sewer Used chemical and wash water are placed into
totes and disposed of by our waste disposal contractor
Waste materials are picked up on a regular basis The receiving department handles the waste
pick up The areas of storage are checked daily and any discrepancies will be sent to
maintenance or safety for corrective action Spill kits are located in yellow drums labeled
emergency spill kit and placed throughout the facility They are checked and restocked when
items have been used
Training is conducted during orientation and also as a refresher class during a
weekly training session
Significant changes -
No significant changes have taken place other than change in personnel

(DEMLR) conducted a compliance evaluation ;nspection at the subject facility on October 23, 2015 Your

for your records and the inspection findings are summarized below
1 Permit
This facility holds General Storm water Permit No NCO50243 to discharge Storm water from activities
associated with Apparel, Printing, Converted Paper Products, Leather, Rubber Products or Miscellaneous
Products, under the National Pollutant Discharge Elimination System (NPDES) The permit became effective
June 1, 2013 and expires May 31, 2018 Your permit renewal package must be received in the Central Office
in Raleigh no later than 180 days prior to the expiration date of the permit
2 Records/Reports
Part II, Section A of the permit requires the development of a Stormwater Pollution Prevention Plan (SPPP)
The plan must include all nine (9) subsections of Part It, Section A of the permit Qualitative monitoring is
required to be completed and documented twice yearly as defined in Part II, Section C of the permit The
SPPP plan must be updated annually and qualitative and analytical monitoring must be conducted and
properly documented semi-annually to retain compliance with the permit The SP3 (Stormwater Pollution
Prevention Plan) and monitoring records were up to elate and maintained in two 3-ring binders at the facility

3 Facility Site Review
Tammy Isaacs, Safety Manage, assisted the inspectors with review of the SP3 documents, monitoring records
and a review of the site and outfalls The facility has a fenced outside storage yard for materials and pallets
and a bay door for bringing materials in and out These locattions are the areas where pollutants could
potentially get into the stormwater system In 2013, while an environmental firm hired to clean -out a tank
was performing the task, they created a spill NCDEQ was notified and environmental clean-up began
immediately Facility now stores a sand pile in the vicinity to aid with emergency clean-up
4 Effluent/Receiving Waters
Stormwater outfalls the property and into an unnamed tributary of the Haw River (Class C, NSW) of the Cape
Fear River Basin
5 Seif-Monitoring Program
Analytical Monitoring This site is required to provide analytical monitoring under current operating
procedures Monitoring records for 2015 were available for review Results were within parameters
6 Qualitative Monitoring All qualitative records do not need to be submitted to DEMLR, however, the
records must be kept on file at the facility for a period of five years This site is required to complete
qualitative monitoring twice annually Records were current and available for review

Dear Mr Lawson
On May 11, 2010, Jenny Graznak of this office performed a Stormwater Permit Inspection
at Acucote, Inc located at 910 East Elm Street in Graham, North Carolina This facility holds
General Stormwater Permit No NCG050243 under the National Pollutant Discharge Elimination
System (NPDES) to discharge Stormwater from activities classified as Apparel, Printing,
Leather, Rubber, etc Specifically Acucote, Inc manufactures adhesive coated products, 1 e
peel and stick materials As Safety and Training Manager for the facility, you were present for
the inspection This type of inspection consists of two basic parts an in -office review of facility
files and self -monitoring data and an on -site inspection of the facility's discharge This particular
inspection evaluated five (5) areas, and observations from each area are addressed below
1 Permit
The permit became effective .tune 1 2008 and expires May 31, 2013 A copy of the most
recent permit was available during the inspection
2 Records/Re orts
As required by the permit, the facility has a Stormwater Pollution Prevention Plan (SPPP) that
was available for review during the inspection The SPPP is dated December 1996 and is in
need of updating However, the location map of the outfalls and the site plan are current
Employee Training documents were also reviewed during the inspection Training occurs on an
annual basis and is documented in the SPPP
The SPPP also included a report from a spill that occurred on the property in November 2008
A truck owned by R&L Carriers leaked 75 gallons of water -based adhesive onto the gravel lot
Acucote immediately responded to the spill by placing a berm around the leaking truck R&L
Carriers sent HMHTTC Response Team (from High Potnt, NC) to clean up the 75-gallon spill,
remove the contaminated soil and replace with fill dirt The spill was handled appropriately
3 Facility Site Review

portion of the property that mainly drains from the parking lot No discharge was observed at

SDO #1 during the inspection SDO #2 is a large ditch on the western portion of the property
that forms via the convergence of two smaller ditches that drain the bulk of the site SDO #2
had severe erosion during the inspection in 2005 However, it should be noted that Acucote has
taken great measures to maintain this outfall The entire ditch on the western side of the
property is now lined with riprap Vegetation can also act as a filter and dissipater for storm
water leaving the property
During Ms Graznak's site inspection of the property, she observed a black corrugated pipe
behind the building No discharge was noted during the inspection However, you explained
that this pipe discharges any overflow from potable water that is used to coat the paper during
your manufacturing process This water is considered process wastewater and should
only be removed from the building via municipal sewer Please be aware that even though
this is potable water, it still constitutes an illegal discharge of wastewater No such wastewater
should be discharged directly outside of the building You stated during the inspection that the
pipe would be re -plumbed to drain to the sewer Ms Graznak will remain in contact with you
until this issue is resolved
4 Effluent/Receiving Waters
Stormwater from the property discharges to an unnamed tributary to Haw River (Class C. NSW)
in the Cape Fear River Basin via the two-abovementioned stormwater discharge outfalls
5 Self -Monitoring Program
The stormwater permit requires semi-annual qualitative monitoring at both stormwater outfalls
An on -site review of the monitoring data during the inspection showed that all parameters are
evaluated per the specifications of the permit You are exempt from the annual analytical
monitoring requirements since no vehicle maintenance activities occur on -site

This letter is to inform you that, as of the date of this letter the Division of Water Quality has not received a
renewal request for the subject permit certificate of (.overage This is a violation of NCGS § 143 215 1 (L)(1) which
states All applications shall be filed with the commission at least 180 days in advance of the date on which it is
desired to commence the discharge of wastes or the date on which an existing permit expires m the case may be
Any permittee that has not requested renewal at least 180 d ays prior to expiration or permittee that does not have a
permit after the expiration and has not requested renewal at least 180 days prior to expiration will be subjected to
enforcement procedures as provided in NCGS § 143-215 6 and 33 USC 1251 et seq
In order to prevent continued, escalated action including the assessment of civil penalties you must submit a
completed permit coverage renewal application to the .attention of the Stormwater and General Permits Unit at
the letterhead address within ten (10) days of your receipt of this letter (renewal application enclosed) If the
subject discharge has been terminated please Lomplete the enclosed rescission request form A valid reason for
requesting rescission is required incomplete forms will be returned and you will still be subject to possible
esLalated action Mailing instructions for submitting rescission request are listed on the bottom of the form You
will be notified when the rescission process has been completed

In response to your renewal application for continued coverage under the subject pernut, the Division
of Water Quality (DWQ) is forwarding herewith the reissued stormwater general permit Thus permit
is reissued pursuant to the requirements of North Carolina General Statute 143-215 1 and the
Memorandum of Agreement between North Carolina and the US Environmental Protection agency
dated December 6, 1983
The following information is included with your permit package
■ A copy of the stormwater general permit
■ A Stormwater Pollution Prevention Plan Certification Form This form certifies that you have
developed and implemented the Stormwater Pollution Prevention Plan (SPPP) requited in your
permit This form must be completed and returned to the Division within 30 days of receipt of
this letter DO NOT send the SPPP with the signed form
■ Five copies of Analytical Monitoring forms
■ Five copies of Qualitative Monitoring forms
■ A copy of a Technical Bulletin on the stormwater program which outlines program components
and addresses frequently asked questions
■ A corrected Certificate of Coverage if you indicated a name or address change on the Renewal
Form returned to the Division
Your certificate of coverage is not transferable except after notice to DWQ The Division of Water
Quality may require modification or revocation and reissuance of the certificate of coverage
This permit does not affect the legal requirements to obtain other permits which may be required by
DWQ or permits required by the Division of Land Resources, Division of Air Quality, Coastal Area
Management Act or any other Federal or Local governmental pernuts that may be required
