DEFINITIONS no Pei nia No NCG050000 PART I - IN'l-RODUCTION SECTION A GENERAL PERMIT COVERAGE All persons desiring to have facilities covered by this General Pet nut must t egtster with the Division of Watez Quality (DWQ) by the filing of a Notice of intent (N0I) and applicable fees The NOI shall he submitted and a certificate of covet age issued pi ioi to any point soul ce discharge of stormwater associated with industrial activity to the surface waters of the state Any owner or operator not wishing to be covered or limited by this General Pei mtt may make application for an individual NPDES permit in accordance with NPDES procedures to 15A NCAC 2H 0100 stating the t easons stnppot Ling the t equest Any application for an individual pet tart should be made at least 180 days pi tot to commencement of discharge This General Permit does not cover activities of discharges covet ed by an individual NPDES permit until the individual pet mit has expo ed of has been i Exposm a Exclusion annually Any facility may apply for new of continued coverage under this pet mtt until a Total Maximum Daily Load (TMDL) for pollutants for stormwatet is established A TMDL sets a pollutant loading limit that affects a water shed of portion of a watershed, di anning to a specific rmpai ed water For discharges to watersheds affected by a TMDL, coverage under this permit may depend on the facility demonstrating it does not have reasonable potential to violate applicable water quality standards for those pollutants as a result of discharges if DWQ determines that disch-irges have i easonable potential to cause water quality standat d violations, the facility shall apply for an individual pet unt 180 days pr]ot to the expit ation date of this Genel al Pet mtt this Genes al Permit Any other point soul ce discharge to surface waters of the state is prohibited unless it is an allowable non stormw itei discharge or is covered by another permit, authorization, FOR PERMITTED DISCHARGES SECTION A STORMWATER POLLUTION PREVENTION PLAN The per mittee shall develop and implement a Stormwitei Pollution Prevention Plan (SPPP) The SPPP shall be inaintained on site unless exempted from this reguit ement by the Division The SPPP is public infoi mation in accoi dance with Part III Standard Conditions, Section E, paragraph 3 of this permit The SPPP shall include, at a minimum, the following items I Site Overview The Site Overview shall provide a description of the physical facility and the potential pollutant sources that may be expected to contribute to contamination of storiwater dischai ges The Site Overview shall contain the following (a) A general location map (USGS quads angle map or appropi lately di afted equivalent map) showing the facility s loc ition in rel-ition to transportation i outes and surface waters, the natne of the receiving waters to which the stoi niwater outfalls discharge, or if the discharge is to a municipal separate stoi m sewer system, the narne of the municipality and the ultimate receiving water s and actin ate latitude and longitude of the points of stormwater dischai ge associated with industt ial activity The general location neap (or altet natively the site ni ip) shall identify whether any receiving waters are impaired (on the state s 303(d) list of impair ed waters) or if the site is located in a watershed for which a TMDL has been established and what the parameter s of concei n ai e (b) A narrative description of storage pt ictices loading and unloading activities outdoor pt ocess ai eas, dust or par titillate gener ating of control pi ocesses, arid waste disposal practices A narrative description of the potential pollutants that could be expected to be pi esent in the stormwatei discharge ft om each outfall (c) A site rnap di awn at a scale sufficient to cle-irly depict the site pi opei ty boundary the storrnwatei discharge outfalls, all on site and adjacent sur face water s and wetlands, industi ial activity areas (including stoi age of niatei ials, disposal areas pt ocess ar eas, loading and unloading areas, and haul i oads) site topography and finished gi ade all drainage features and structures, dt ainage at ea boundai tes and total contributing area fol each outfall, du ection of flow in each drainage area, industrial activities occurring in each dt ainage area, buildings, storrnwater Best Management Pi actices (BMPs), and impervious surfaces The site map must indicate the percentage of each drainage area that is impel vious and the site neap must include a gi aphic scale indication and north at i ow (d) A list of significant spills or leaks of pollutants during the previous three (3) yeas s and any corrective actions taken to inittgate spill impacts (e) Cei tifrcation that the stoi mwater outfalls have been evaluated for the pt esence of non- stormwatet discharges The permittee shall re -certify annually that the stormwater outfalls have been evaluated for the presence of non-stormwater discharges The cei tification statement will be signed in accot dance with the requirements found in Par t I11, Standard Conditions Section 13, Paragi aph 5 Part 11 Page 1 of 9 Permit No NCG050000 Stormwater Management Strategy The Stormwatei Management Strategy shall contain a nai i ative description of the materials management practices employed which Conti of or minimize the stormwatei exposure of significant materials including structural and nonsh uctui al measures The Storm water Management Strategy at a minimum, shall incoi poi ate the following (a) Feasibility Study A review of the technical and economic feasibility of changing the methods of operations rind/or storage pi actices to eliminate of r educe exposure of materials and processes to i amfall and run on flows Wherever pi actical the permittee shall prevent exposui a of all stot age ai eas, nmatei ial handling open ations and manufacturing of fueling operations In areas where elimination of exposure is not practical this review shall document the feasibility of diverting the stormwater run on away fi oin areas of potential contamination (b) Secondary Containment Requirements and Records Secondary containment is required for bulk storage of liquid material§including petroleum pi oducts storage in aau amount of Section 313 of Title III of the Superfund Amendments and Reauthorization Act (SARA) water priority chemicals, and storage in any amount of hazardous u tan s in of dei to prevent leaks and spills fi om contaminating stoi mwater i unoff A table of summary of all such tanks and stoi ed materials and their associated secondary containment areas shall be maintained If the secondary containment devices ai a connected to stormwater conveyance systems, the connection sliall be coati oiled by manually activated valves of other similar devices (which shall be secured closed with a locking mechanism) Any stoi mwater that accumulates in the containment ai ea shall be at a minimum visually observed for color foam outfall staining visible sheens and di y weather flow pi for to i ehease of the accumulated stormwater Accumul ited stormwater shall be i ele ised if found to be tmcontaininated by army niatei ial Records documenting the individual making the observation the description of the accumulated stormwater, and the date and time of the release shall be kept for a period of five (5) years Foi facilities subject to a federal oil Spill Prevention Control and Countei measui a Plan (SPCC) any portion of the SPCC plan fully compliant with the i ecitin ements of this permit m iy be used to demonsti ate compliance with this permit (c) HMP Summary A listing of site sti uctur al and non-sti uctui al Best Management Pi actices (BMPs) shall be provided The installation and implementation of BMPs shall be based on the assessment of the potential for lout ces to contribute significant quantities of pollut-ints to stormwater discharges and on data collected thi ough nionitorrng of stormw inter discharges The BM Summary shall include a wi rtten i ecoi d of the specific rationale for installation and implementation of the selected site BMPs The BMP Summai y shall be reviewed and updated annually 3 Spill Prevention and Response Procedures The Spill Prevention and Response Procedures (SPRP) shall incorporate an assessment of potential pollutant soul ces based on a mates ials inventory of the facility Facility personnel i esponsible for implementing the SPRP shall be identified in a written list mncoi poi ated into the SPRP and signed and dated by each individual acknowledging their responsibilities for the plan A responsible person shill be on -site at all times dui ing facility operations that have the potential to contaminate stoi mwater t unoff thin ough spills of exposmn a of materials associated with the facility opera ations The SPRP must be site stot mwater specific Therefoi a an oil Spill Prevention Control and Counteimeasure plan (SPCC) may be a component of the SPRP but may not be sufficient to completely address the stormwatei -aspects of the SPRP The common elements of the SPCC with the SPRP may be incorporated by reference into the SPRP Part 11 Page 2 of 9 Pet snit No NCG050000 4 Preventative Maintenance and Good Housekeeping Program A pt eventative and adjacent sur face water s and wetlands industrial activity areas (including material stoz age at eas mates sal handling areas disposal at eas process areas loading and unloading areas and h nil toads), all drainage features and sti uctui es, and existing sit uctut al BMPs The pi ograrn shall establish schedules of inspections, maintenance, and housekeeping activities of stormwatei contr of systems, as well as facility equipment facility ai eas and facility systems that pi esent a potential foi stoi mwater exposun e or stormwatei pollution where not air early addressed under another elemetit of the SPPP Inspection of mates ial handling ai eas and i egular cleaning schedules of these areas shall be incoi poi ated into the program Timely compliance with the established schedules for inspections, maintenance, and housekeeping shall be recorded and maintained in the SPPP Facility Inspections Inspections of the facility and all stot rnwater systems shall occur as part of the Pi eventative Maintenance and Good Housekeeping Program at a nimimum on a senu- annual schedule once dui ing the first half of the yeas (January to June), and once during the second half (July to December) with at least 64 days separating inspection dates (unless Pei for med mot a ft equently than semi-annually) These facility inspections are different from ~ind in addition to the stoi mwater discharge ch-iractei istic monitoi ing at the outfalls requm ed in Part II B and C of this permit 6 Employee Training Ti aunng prograrns shall be developed and training pi ovided at a minimum on an annual basis for facility pea sonnel with responsibilities for spill response and cleanup preventative maintenance activities -ind for any of the facility's opei ations that hive the potential to contaminate stormwatei i unoff The facility personnel responsible for implementing the training shall be identified, and their annual ti ammg shall be documented by the signatut e of each employee tt armed Responsible Party The SPPP shall identify a specific position of positions responsible for the overall coordination development implementation and revision of the SPPP Responsibilities for all components of the SPPP shall be documented and position assignments provided 8 SPPP Amendment and Annual Update The pet mittee shall amend the SPPP whenever there is a change in design construction, operation site drainage ni iintenance or configuration of the physical featut es which may have a significant effect on the potential foi the dischat ge of pollutants to surface waters All aspects of the SPPP shall be reviewed and updated on an annual basis The annual update shall include (a) an updated list of significant spills or leaks of pollutants for the previous three (3) year s, of the notation that no spills have occui i ed (element of the Site Overview) (b) a written re certification that the stormwater outfalls have been evaluated for the pr esence of non stormwater discharges (element of the Site Overview) (c) 1 documented re-evaluation of the effectiveness of the on -site stormwater BMPs (BMP Summary element of the Stormwater Management Strategy) (d) a review and comparison ofsample analytical data to benchrnai k values (if applicable) over the past year including a discussion about Tier ed Response status The permittee shall use the Division s Annual Summary Data Monitoi ing Report (DMR) form, available fi orri the Stormwatei Permitting Unit s website (See Monitoi ing Forms here httI2 1/coital ncdeni oigfweb/wgfws/su/npdessw) Part 11 Page 3 of 9 Petinit No NCG050000 The Director may notify the permittee when the SPPP does not meet one of mot a of the minimum requirements of the pet snit Within 30 days of such notice the pet mittee shall submit a time schedule to the Dn ector for modifying the SPPP to meet minunum requirements The pet nuttee sliall pi ovide cet tification in writing (in accoi dance with Pat t Ill, Standat d Conditions, Section B Paragi aph 5) to the Directot that the changes have been made 9 SPPP Implementation The permittee shill implement the Stormwatei Pollution Pi evention Plan and all appi opt Late BM Ps to pi event contaminants from enter Ing sur face waters via stormwatet Implementation of the SPPP shall include documentation of all monitor mg measutements inspections, maintenance activities, and training provided to employees, including the log of the sampling data and of actions taken to implement BMPs associated with the industrial activities including vehicle maintenance activities Such documentation shall be kept on site for a peiiod of five (5) years and made available to the Director or the l311 ectoi's authorized i epresentative immediately upon i equest Part I I P-ige 4 of 9 Per mit No NCG050000 SECTION B ANALYTICAL MONITORING REQUIREMENTS FOR STORMWATER DISCHARGES FROM ON -SITE VEHICLE AND EQUIPMENT MAINTENANCE Facilities that have any vehicle maintenance activity occurring on site which uses more than 55 gallons of new motor oil and/or hydraulic oil per month when averaged over the calendar year shall pei foi ni analytical monitoring as specified below in Table 1 All analytical monitor ing shall be pet formed dui trig a measureable storm event at all stormwatei discharge outfalls (SDOs) that discharge storinwatet runoff from vehicle maintenance areas and in accot dance with the schedule presented in Table 2 Sampling is not i egtiired outside of the facility s not oral operating hour s A measurable storm event is a stoi ni event that i esults in an actual discharge from the pei nutted site outfall The previous nieasui able stoi in event must have been at least 72 hours pi ioi The 72-houi stoi in interval does not apply if the periittee is able to document that a shortei intei vat is i epi esentative foi local stoi m events dui ing the sampling period and the permittee obtains appi oval from the local DWQ Regional Office See Defjmtions Table 1 inspection of each stop nnwatei outfall associated with industrial activity (not 1 ust vehicle maintenance activities) regardless of i epi esentative outfall status Qualitative monitoring shall be pei Regulation 40 CFR 136 To meet the intent of the monttot ing required by this general permit, all test procedures must produce minimum detection and reporting levels and all data generated must be repot ted down to the minimum detection or lower reporting level of the procedure If no approved methods are detet mined capable of achieving nunitnum detection and i eporting levels below general permit discharge requirements then the most sensitive (method with the lowest possible detection and reporting level) approved method must be used Representative Outfall If a facility has multiple discharge locations with substantially identical storaiwater discharges that are required to be sampled the permittee may petition the Director for representative outfall status If it is established that the stormwatei discharges -ire substannally identical and the permittee is granted repi eseritative outfall status, then sampling i equiretnents may be performed at a reduced number of outfalls RecGrds Retention Qualitative monitoring shall be documented and records maintained at tine facility along with the Stoi mwater Pollution Pi evention Plan (SPPP) Copies of analytical monitoring i
