Yes, the correct moratorium we agree upon is Feb 15th-June 30th and Aug 15th-Oct 31st

The final project moratorium would be Feb 15th -June 30th and Aug 15th -Oct. 31st which
would match a previously agreed to moratorium on a similar project within this county and
watershed.

We appreciate you reaching out to discuss a change in the moratorium for sturgeon
during the construction of Bridge 54 in the Tam River basin. After further internal
discussion, we believe, with the anadromous fish moratorium in place from Feb
15th-Sept 30th, we can agree to the slightly less conservative dates of Aug 15th-Oct
31 st for sturgeon.
Unless you indicate otherwise we consider this resolved and I will save this email
exchange into the project file to document the change and your plan
going forward.

I am the project manager John is referring to in the email below. However for some
reason it slipped my mind that this section of river already had a moratorium on it for
anadromous fish. The anadromous fish moratorium we are currently under for this project
is from Feb. 15th -Sept. 30th. Combine that with the sturgeon moratorium from Aug.I to
Nov 30, constructing this bridge would be very difficult. After realizing this, I contacted
our NC Wildlife Resource Commission Biologist and he informed me that he had a
similar issue come up on another project in the Tar River basin and that after some
coordination with the NOAA rep they agreed to a anadromous fish mortarium from Feb
15th -June 30th and a sturgeon mortarium from Aug 15th -Oct 31st. I am attaching this
consultation for your reference. The consultation history on page 1 speaks to this
coordination and the first paragraph under the construction conditions on page 3 and 4 is
what was agreed to for that project. My hope that the these previously coordinated
moratorium dates can be agreed to for this project and that consultation for Bridge 54 can
quickly and easily be changed to reflect these dates. Please advise if this change is
acceptable or if additional coordination is needed. I will be glad to setup a conference call

First of all thank you for your prompt response to our request.
I have discussed with our Project Manager your concern and requested condition of "no
in -water work due to the occurrence of spawning runs/migration activities" associated
with NCDOT's proposed bridge replacement project on the Tar River "Atlantic Sturgeon
Critical Habitat". NCDOT can and will comply with the requested "No in -water work"
time periods. These time periods will be included as enforceable conditions in the contract
associated with this proposed project.

Hi John,
NMFS's concurrence letter for this project will soon be ready to submit for review.
However before I can continue, clarification is needed on the period of no in -water work
due to the occurrence of spawning runs/migration activities. Please confirm that the
following is agreed upon.
No in -water work will be done between August 1 and November 30 to prevent the
disruption of Atlantic sturgeon spawning runs/migration activities. No equipment
or construction materials of any type shall be allowed to be placed or fall into the
river during this time period. During the August 1 through November 30 period,
work may be done from or within cofferdams, socketed caissons, riprap pads,
temporary bulkheads, or temporary work bridges, as long as these features were
installed outside of the restricted season (i.e., installed between December 1 and
July 31).
When I receive your response via email, I will finalize and submit the letter for review. I
will be in contact with you if additional information or further clarification is needed, and
also through the review process. If you do not hear from me during the review process,
that is an indication it is moving through our process to signature. I am unable to provide
you a timeline for the review process, but I will continue to keep this project moving as
much as possible.
If no response to this request for additional information is received within 45 days, we
will assume the consultation is no longer active. We will then close out the consultation
request and change the status of the request to "withdrawn". Please note this 45-day
period has been established as a national policy.

Status update of current consultations: all consultations were held in abeyance for 38
days due to a lapse in appropriations and resulting partial government shutdown. All
consultation processes resumed on January 28, 2019.
Additionally, NMFS Public Consultation Tracking System (PCTS) has been replaced
by the NMFS Environmental Consultation Organizer (ECO). ECO does not yet have
external capabilities for the public or action agencies; therefore, if you need a project
