Dear Mr. McIntyre,
The Division of Water Resources (DWR) received a draft Buffer Mitigation & Nutrient Offset Plan
(Plan) for the Scarborough Mitigation Site (Site) in 2019, for review and approval under the terms and
conditions of the Water & Land Solutions, LLC (WLS) Scarborough Mitigation Banking Instrument
for Riparian Buffer Mitigation and Nutrient Offset (MBI) received on July 16, 2019. The MBI is made
and entered into by WLS acting as the Bank Sponsor, and the DWR. Katie Merritt, with DWR,
reviewed the Plan and MBI documents and provided comments and recommendations. DWR received
a revised Plan and MBI that addressed all comments and recommendations. The table below
summarizes the timeline of the Plan and MBI:

The closing date for the public notice was November 14, 2019. DWR received no comments
regarding the subject Plan or MBI documents, but some edits were made to the MBI by DWR and
accepted by WLS on November 18, 2019. These documents are now approved.
The approved Buffer Mitigation & Nutrient Offset Plan should be included as an appendix to
the final 404/401 Mitigation Plan for this Site with hardcopies provided to DWR in accordance
with the Mitigation Bank Document Submittal guidance by the US Army Corps of Engineers.
